take over a regulation, where the justice department could have a conflict of interest. they operate under the same rules, but they are an independent body, and while they do answer to the attorney general, they like to remind us that under the regulations any prosecutorial deference is if overruled by the attorney general, it has to be informed by congress. and that is to insulate the attorney general for partisanship, and if trump was not indicted and that is not likely garland's decision, and it came from smith, but it is unlikely that even garland's remarks are going to stop the relentless attacks from trump and the allies. >> yes, but to try to use that

decision day at the supreme court. we have a couple of decisions that we have been watching closely. and jes isica schneider has the details. >> well, john, the justices have issued a couple of decisions. there is a 1978 law that prioritized the placement of native american children in the adoption system, and placed them with native american families, and this is the case of a couple out of texas saying that this law should have been tossed out on equal protection grounds. they said they were trying to adopt two native american children, but they were blocked from the adoption because it prioritizes the adoption of the children with native american tribes or families, that is the

utmost priority of the law. so the supreme court law is not ruling with the family trying to get custody of the two children, and upholding law in existence from 1978. when the law was passed, it was looking preserve tribal sovereignty. it was discovered around the time that the law was passed that too often native american children when they were placed into the adoption or the foster care system, they were placed with white family, and nonnative american family, and the law was an effort to protect the sovereignty of tribes and the supreme court today, preserving law, and rejecting challenge to it. john. >> and jessica, the separate case delved into the criminal charges and venue. explain this. >> yeah. it was an interesting case for the facts. this is the case of an alabama fisherman who had hacked into

computer systems and had gotten a hold of fishing coordinates and private reefs that fishermen pay a lot of money to set up for prime fishing locations. this company had a look at the coordinates for those reefs, and selling them. alabama fisherman was upset about it, and so he hacked into the system, and he told the company, i will start to tell the people that you selling coordinates for the reefs that you paid a lot of money for. he was brought to trial and convicted, however, his argument was that the government had brought his case in the wrong venue. the lower courts said no, even if the venue was wrong, your case still is wrong. so if you bring a criminal case in wrong venue, and the wrong jurisdiction, can the venue be tossed out or retried.

the fisherman in this case wanted the case completely thrown out, and the supreme court stepped in to say, no, even if the criminal case is brought in the wrong venue, it could be retried and maybe this is on the mind of the prosecutors of the trump indictment when they decided to bring the case in southern florida for fear they would bring it to the wrong venue, prosecutors, you didn't have to throw the case out, but try it in the right venue. >> and fishing locations and this new federal case against the former president of the united states. jessica schneider, thank you for explaining it all. and now, a military veteran put a chokehold on a man and killing him and now he is

charged with second degree manslaughter charges. the prosecutors plan to make the official announcement later today. and we are told to cnn that they believe he is going to be fully exonerated. he is accused of holding the man down and holding him in the chokehold unhe loses confidence. >> the charges of second degree standard and what it requires. >> it does not have to be intent to kill, but a recklessness standard, and penny saw the risk and the risk of death and he continued in the conduct that continued to be a threat to neely. so reckless standard does not

have to be proved that it was intentional, but that he ignored a very open and obvious risk. >> how do you prove that penny feared for his life? >> right now, we know that is where the defense is going, as he said as much in but the other rider on the train that day. the standard that the prosecution has to be satisfied that the force was justified. they have the burden. but what they are to be looking at is from the eyes of penny on that day, and the total ti of the circumstances, and the best way to do that is what are the other witnesses going to be saying a about the words used or any being a part of fave injury
