russian soldier on the battlefield in the eastern city of bakhmut, and then using his hands to surrender. the ukrainian forces spared his life after the commander says he threw his machine gun aside and raised his hands and he said this he would not continue the fight. cnn is getting an exclusive look at the ukrainian special fortss and -- forces and how they are using night vision. sam, what is the latest from ukraine? >> well, boris, striking isn't it how terrifying it is to be on the front line. well, imagine what it might be, and this is deliberate from the ukrainian perspective to be an officer on the front line, because they are picked out and picked off. >> as special forces night operation, the objective to bring a special kind of misery

tough going. >> brianna? >> today, the trump campaign announced a major haul, and a huge $7 million alone since the indictment last week, and this is news coming since aileen cannon issued one of the first orders in the case. we have paula reid on this case, and what have you learned here? >> well, is it the first time that we are hearing from the judge since former president donald trump has entered nonguilty plea. and so she is setting a deadline for them to get in order. here this is a national security clearance case, and so this is something that the justice department can expedite, but first president trump has to finalize the legal team, and judge cannon is under enormous scrutiny, and appointed by former president trump, and in the one matter related to the case was heavily criticized and

eventually overturned, and what is interested about this, and scheduled two days after arraignment to give her a update, and that is a swift pace and pacing, and scheduling, and why it is so in the weeds, it is one of the ways she can influence the case, because one of the key tensions here is timing and the speed with which this is going to proceed. and jack smith said he wants a speedy trial, and we know that former president trump wants to dragt out. the speed with which she schedules hearings and files for orders, and that is trump has tricks, too, if he takes too long to select the lawyers, that can be dragged out, and normally, i would say this is in the weeds and highly technical, but these little decisions can affect the timing of the case, and these little implications of the timing of the case can impact this nation and the

election. >> and some of the legal experts are split. they say that the trial is going to happen before the election and some say it is going to stretch out after, but the judge is the one who is going to decide that. >> yes, she gets a lot of leeway, and not a lot of oversight. if she makes a motion on a piece of evidence, that is going to be going quickly, and no one is going to overturn. but trump can drag it out to get a lawyer or two. >> we will see how long it takes. boris? >> yes, the manhattan d.a. has confirmed that this man in this image has been indict bade grand jury. daniel penny seen here executing a chokehold has been seen executing a manslaughter charge against george neely. they say that neely got on the subway yelling at passengers that he was hungry, thirsty and he did not care if he died.

penny said that he feared for himself and others and their safety and put a chokehold on him. we will get some perspective from attorney areeva martin. thank you for sharing some of your afternoon with us. and the second degree manslaughter charges, and what is the significance there? >> we knew that the charge were coming, and after jordan neely was put in that chokehold on that subway, and there were massive protests in manhattan around the district attorney's office initial unwillingness to arrest daniel perry, and the indictment has been issued and second-te gree manslaughter is the reckless causing of another person on that subway, but he was not aggressive against any one individual or threat epp any one individual. so it is going to be interesting how the defendant in the case

tries to build a case in that anticipated testimony. >> so would you say that much of the case lies on the degree of threat that the passengers on the train felt? >> i think it is a combination of things, boris. obviously the eyewitness testimony of the passengers, but also, a video. there was a journalist on the train, and recorded the incident and the altercation that happened and the conduct of george neely at some point before he was put in that chokehold and in some of the time that he was apparently in the chokehold. so the investigators have to get through it in terms of getting the indictment, and so i would think that both of those items will be key in the trial. >> another question, reeva, the amount of time that penny keeps

him in the chokehold even after he is unconscious, and stops moving, and penny denies he kept him in that chokehold too long. this is statement from his attorneys, and here a portion. >> some people say that i was trying to choke him to death. that is not true. i was trying to restrain him. there is a clear rise and fall of the chest, and i am trying to restrain him. i am trying to restrain him from carrying out the threats. and you can see the clear rise and fall of the chest, and i am calibrating the grip based on the force that he is exerting. >> your reaction to that statement, areeva? >> yeah, boris, that is a remarkable action on the part of daniel penny. and his lawyers know that this criminal indictment is to be handed down, and for him to

issue that video statement of a detailed statement of what happened, and the fact that anything that is said by the defendant can be used against him in a courtroom, and i would not allow sim to make such a statement, but that statement does not absolg about the threat that jordan neely posed. why didn't he just get up and walk to another compartment on the train. or go to the authorities and so many things that he could have done other than placing him in the chokehold. other passengers did not feel the same threat that he allegedly said that he felt. so a number of alleged questions, and that videotape does not suggest that he is going to be found not guilty in this case. >> we hope that you will come back to give us the analysis.
