mccarthy reacting to this on capitol hill a short time ago. >> what is your reaction? >> my first reaction is that it is continuing to show the two-tier system in america. if you are the president's leading political opponent, the doj is going to try to put you in jail and give you prison time, but if you are the president's son, you will not. and so, the doj should not be able to withhold any information because of the pending investigation, and they should provide chairman comer with any information. >> but this is a trump appointee that was held over, and why would you not accept that this is a thorough investigation accepted on the merits given the person who investigated it. >> it was thorough investigation -- >> i am asking you. >> you believe it is a thorough investigation? >> i am asking you. >> you believe it is a fair that

trump-appointed prosecutor. >> and that is what you have heard from the house speaker kevin mccarthy, and more reaction coming in, and there is more to be hearing from the plea agreement and what went in it. and we are going over the evan perez, and you are hearing more on these filings, and what are you picking up, evan? >> we are seeing that the documents have been filed in court related to the plea for these two tax charges. i will read you just what it says here. two counts. both of them were for income of $1.5 million in 2017 and 2018 in both cases, hunter biden is saying that he owed in excess of $100,000 to the federal government, and he did not pay that money when it was due. again, this is for the tax years 2017 and 2018. so that is what he is pleading guilty to, and admitting that he did not pay his taxes on time. now what we know from the

reporting from kara scannell and paula reid is that the hunter biden's lawyers have said that he has paid the money. he has sense paid the back taxes, and paid the penalties, and so what this resolves now is the fact that this obviously, fact that he did not pay on time is still a crime. that is what hunter biden is pleading guilty to. and what you have heard from kevin mccarthy there is giving you a preview of what the justice department is going to be able to withhold a lot of the information of what they have been doing in this ongoing investigation, and that is going to end once the judge gavels and accepts whatever the deal is here between hunter biden's lawyers and the justice department, and one other thing to note here is 2017, and 2018 is a period in which hunter biden is getting money from a company from china, energy company, and serving in a bord

in burisma, and keep those two names in your head, because you will be hearing a lot more from republicans who want to know more about where that money went, and is it possible that it went to other places for that they need to investigate. guys. >> and also, 2017, and 2018, evan, to be clear, joe biden was not in office, correct? >> that is correct. he was not in office at that time. and again, hupter biden was having the financial dealings and his work that he was doing in china and ukraine. >> okay. evan perez for us in washington. let's go to the courthouse -- no, not to the courthouse, but outside of the courthouse as kara scannell is there, and what are you seeing and hearing? >> well, john, we just saw evan explain that new information hit the docket explaining what these tax-related charges are. one thing that we're looking for next is to see when the judge, which judge is going to be

getting this case and when the judge sets date for the arraignment, and when hunter biden comes to the courthouse to enter the date for the crimes he will a elucute to the crimes he has plead guilty to. and we will see if from the biden team they will have any more statements that it is in addition to the addiction that he had as well as the gun charges there that he is avoiding to plead guilty or be sentenced on the felony, the gun possession charge, because he is getting into this diversion program which is going to require him to undergo certain conditions for a set period of time which i am told by one

source it is 24 months and if he does that, then the charge will go away. certainly this reaction coming from the republicans, including the former president trump who has been critical of this deal, because as we have been reporting the tax-related misdemeanor charges will have result in a recommendation from the u.s. attorney's office here to a judge of probation with no jail time. this misdemeanor itself carries no more of a maximum of one year in prison anyway under the statute, but the u.s. attorney's office as part of the plea deal has agreed to recommend probation, and it is up to the judge to decide if that is suitable, and that is going to be coming further down the line in the process, but with recontinuing to watch the docket for additional information and we will be sure to bring it back to you, john. >> okay. karen kara scannell, bring us any additional information there. and we have been looking for

reaction from the president or first lady, and arlette is back with us from the white house. what are you hearing? >> kate and john, the president and first lady are offering support for their son via a statement from the white house. the president is out traveling to california and san francisco, and a spokesman ian sands did issue a statement on their behalf saying that the first l lady love their son, and they will continue to support their son as he rebuilds his life. and now, this is tracking to the strategy and approach that we have seen from the bidens as they continually lend support to their son as he has been facing this doj investigation, and repeated investigations from the republicans up on capitol hill, and the president has not shyed away from hunter biden as the legal issues have been playing out. he has been a soundingboard for

the president, and he has been a fixture over the years, traveling recently with his father as they went to ireland back in april, and he has been seen at state dinners here as well as the events like the white house easter egg roll, and it is speaking to the biden's belief that they can stick by their son based on the familiar ties. over the years, democrats have privately expressed concerns about having him around, and how it might serve as a distraction for the president politically, but ult imately the bidens say they are standing by their son's side. just previously, the president has said that he didn't believe that his son had done anything wrong. they are really weighing into the investigation of hunter biden over last two year of biden's presidency trying to maintain some independence and distance from it, but the officials from the white house, and the president's personal attorney have kept tabs on this case as it has been ongoing, and

one thing that the biden family has had to navigate over the past few years is the repeated republican attacks from including former president donald trump, and this was a focal point for them in the 2016 presidential campaign, but for now, the bidens are sticking by the line of support for their son as the legal matters have been playing out. >> arlette, thank you for bringing us this. >> as we said, it has been a five-year investigation by a trump-appointed attorney, a holdover from the last presidential administration. and so, going back and fort, what are you learning about this investigation? >> we are learning that negotiations have intensified, and as you noted, this is a year's long investigation, but in recent months this whole issue has heated up once again as cnn reported last summer that the prosecutors had narrowed down potential charges to a few

possible tax charges and the prosecution of this gun charge. then seven months passed with nothing. as we reported, biden's lawyers asked for a meeting with the justice department officials and they were granted that meeting with the trump-appoint ed judge and attorneys, and why biden should not be charged, and they said, look, he has paid these taxes back, and on the gun charge, a recent supreme court case would make it more difficult to prove a case beyond a reasonable doubt after the supreme court sort of expanded the second amendment right, but over the last few week, calls back and forth multiple exchanges and possible deals put on the table between hunter biden's team and the justice department which resulted finally after years in this agreement. now i will note that this is just the proposal that has been agreement upon by the defense attorneys and prosecutors, and

it is up to the judge whether they want to approve this or make some modifications, but right now, we are just waiting to find out when hunter biden might have the first appearance for that arraignment in court. it is interesting that over the past few weeks, it has really ramped up, and finally, finally resulted in this plea deal. >> a lot of activity and a lot of discussion that no doubt begins now, and in fact, it has begun. paula reid, thank you very much. joining us now for all of this and adding to the breaking news is jennifer rodgers, and i was look back at the statement coming from hunter biden's attorney saying that with this, the legal matter and investigation into hunter biden, the criminal probe is resolved is the statement coming from the attorney. is that the case? i mean, we hear it from the attorney, but is that necessarily the case in your view? >> well, we don't know. we know they are certainly hoping for that, and obviously, the republicans are wanting to push further on the corruption

charges and we have not seen more on the doj and possible that something else is going on, but we have to wait and see, but certainly, these investigations around the tax fraud and the gun charge are resolved with this. >> obviously, you are hearing the shouting, oh, sweetheart deal, and oh, this or that, but none of us knows details of the possible charges here, and exactly what was agreed to as part of the plea, jennifer, but how does one assess whether this is the type of deal that a normal person, not a president's child would get in this circumstance? >> so, you would look to other similar cases. so on the gun form charge, it is very, very standard for someone in this situation who lies on the form because they are an addict. the gun is long gone, an apparently only had it for a couple of week, and very standard for this diversion to occur and wipe out the charges assuming he successfully completes it. and the tax fraud is similar as

well. he paid back the taxes for a long time ago, and that is something that the doj takes very, very seriously. and also, hunter biden was an addict at the time, and this is something that he goes, and whether you can prove the mens r rea, and if he can prove that he paid the taxes. and so given the tax fraud, it is not a sweetheart deal, but he is going to be able to stay out of jail but it is going to be on his record, and it is not a sweetheart deal. >> and with kevin mccarthy, in his view, that this investigation, this criminal probe is now done, it should now, there should be nothing standing in the way of the justice department handing over any information that congressional republicans are

handing over their investigation which they promise will continue and are ongoing. what is, and how does the justice department approach that. e eli elie honig was on earlier, and said it was going to be something they would not hand over to doj. >> i agree with him. it is something that would be unfair to the investigation and the way that the republicans have been politicizing their investigations, i would say it is fair that doj will do their best to protect the confidential information that is part of their investigations. >> all right. thank you, jennifer rodgers for coming in to help us understand what is part of this.

board meant to explore the wreck of the "titanic." the submersible went missing when it launched sunday all part of the eight-day journey conducted by oceangate explorations. now, human divers can reach depths of about 1,000 feet. at 3,200 feet, life can no longer be seen. at 5,200 feet, animals can no longer survive. sperm whales as big as you can imagine can only get 10,000 feet down. 10,000 feet is very, very deep. the "titanic" is even lower than that, and more than 12,000 feet below resting on the ground 12,000 feet which is 2.4 miles down at the bottom of the sea. cnn's jason carroll is in boston following the search efforts for us. jason, what is the very latest?

>> well, we are waiting a press briefing from the u.s. coast guard which is expected to happen about 1:00, john. still a lot of questions, as you can imagine that we have for the coast guard and namely, any sort of emergency beacon on board this vessel. what was the nature of the last communication they had with the titan before they lost communication with it sunday and it disappeared. we can tell you that the u.s. coast guard has released more additional information about the search. they say now that a canadian p-3 aurora is in the area conducting sonar searches, and in addition to that, the sonar prince and the deep sonar ship is conducting searches. they have searched about 10,000 square miles which is a remote area of the atlantic ocean, and a massive area, and we are told

that there are 54 to 80 hours of oxygen left. when we hear this briefing of the coast guard, we are hoping to get an update on that figure adds well. it is a massive effort under way, and you have the u.s. coast guard and the u.s. navy and the can canadian coast guard and the canadian armed forces, and the coast guard has also said that a vessel is deployed into the area to help with the searching below the surface at this point. the only thing that those who were on board, the family and friends and the colleagues of those on board, and five people on board. all they can do at this point, john, is to pray for their safe return. john. >> it is such a complicated search to be sure. jason carroll, keep us posted. thank you. kate? >> and as john and jason were just talking about, the search capabilities, and all of the agencies, and all of the

authorities and the experts now involved in assisting with the search. over to cnn's oren liebermann who has much more on this. the coast guard and so many others helping out and assisting with the search operation, and walk us through what the search capabilities are that have now been deployed. >> kate, several different assets coming from the coast guard and canadian coast guard and both have brought the c-130s which are capable of long endurance missions to search large missions on the surface of the water and flying back and forth and using different capabilities to see if there is debris on the surface or if the submersible surfaced without comecom coms, and in the potential of searching below the water, and there with p-8 poseidons

searching, and we have heard from jason, p-3s, and they are an anti-submersible aircraft to search the submarine using different methods, but this submersible is much smaller than an enemy submarine, and the advantage is that the submersible wants to be found. and one of the way that the p-8 searches is sonar buoys to drop them in the water at different location, and because the sounds can travel so easily underwater, they can pick town acoustic stounds and try to triangulate and figure out where the sounds are coming from to allow them to zero in. and other variables to find search capability, and with these assets, kate, it is an incredibly difficult search. >> it is great to layout the search capabilities and what they can provide from the u.s.

back to the breaking news this hour, president biden's son, hunter biden is going to plead guilty to two federal tax crimes and he has struck a deal with federal prosecutors on a felony gun charge, and all of this is coming out, and the reaction has been swift. >> yes. and keeping up is manu raja and abby phillips, and you have just tracked down house speaker kevin mccarthy, and what did he tell you? >> he said it is quote going to enhance the investigation into hunter biden, and he is not satisfied with this plea deal. and he said that people in similar situations would have gotten much stiffer jail time, and that hunter biden may not serve any time with these offenses, and you can factor other things into the sentencing decision, and the speaker is not happy about this, and i asked him about the trump-appointed attorney held over from the

comer issuing a statement saying it is not going to stop his investigation, and mccarthy expects the u.s. attorney from delaware and the u.s. department of justice to provide the committee in the house with the relevant information they are seeking, and the question is why they didn't pursue other charges and questions related to hunter biden's overseas business dealings and the like, and something that the republicans are pushing on, and perhaps not evidence to bring the charges there, but nevertheless, the republicans are going to plan to press ahead, and the speaker is saying that they plan to enhance how they plan to probe this ahead. >> abby, let me bring you in on this, because we can hear and see clearly as manu is reporting out that the republicans are going to continue to push ahead with the investigations on capitol hill, but it is raising question of your perspective on do you see that this is remaining the issue of hunter biden and the long time ongoing investigations, and if it was as

potent and activating issue as the republicans clearly think it is? >> yeah, i think it raises some questions about whether it will be in the future, because now, you know, the biden white house and campaign will be able to point to the absence of federal charges on the allegations that are being made by house republicans to say that the justice department didn't charge those things. at least not as far as we know at this moment, they did not charge these things, and if there is enough evidence, perhaps they would have. i do think that this is going to bring this whole saga right back where it was probably always going to end up being which is in the political realm. these capitol hill investigations don't have to prove beyond a reasonable doubt in a court of law. they don't have to have enough evidence that would lead to an actual conviction by a jury of hunter biden's peers. they can simply ask questions. they can raise topics.

they can put out information is embarrassing to both president biden and to hunter biden, and that is going to be what they intend to do over the next several months, but for folks who are watching at home, it should be very clear at this point that there are a lot of allegations being thrown around on capitol hill, and really no concrete evidence to actually support them, and until there is evidence to support them, that is all they are is allegations, and many republicans on capitol hill and around the country believe them, but it does not necessarily mean that there is anything concrete there that would have either led the doj to bring charges or that we can sit here and say that as a matter of fact occurred and says something about whether or not president biden did anything wrong or hunter biden did anything wrong as it relates to the business deals. >> abby, you are saying it is in the political realm or the familial realm now, because

president joe biden or joe r robinette biden says that he didn't believe that his son did anything wrong. so how is joe biden the father going to say about the son as we will hear from him today or in the copping days? >> well, when you are looking at it, the charges that he plead guilty to is not paying the taxes by the deadline, but paying them later, and really, this is an individual who was addicted to drugs and engaged in all kinds of behavior that would be embarrassing to a lot of people, and whether they are a politician or not, and that has been a part of joe biden's political life since the last presidential election when he ran. that part of the story is not actually new. what you seen biden doing is

basically saying, look, my son has made mistakes, but he is my son, and when you are putting it in the context of joe biden's life, this is a president who lost his wife, and lost a child, and then lost another child, and hunter biden's brother to cancer. and joe biden has made it clear that all of this swirling around hunter biden does not change the way he is feeling about his son, and so he is willing to take the political hits that comes from that, and the question is now for the american public after two presidential cycles, will this still matter and weigh on how they view president biden, and so we don't know the answer to that question. at least the last time around, it appears they didn't, because biden did win the last election despite all of the allegations around hunter biden. >> manu, we have been hearing from the top republicans on capitol hill, and there is a statement coming in from the delaware senator chris coons reacting to this saying that he is encouraged that hunter is

taking responsibility for his actions, end quote. and what else are you hearing from the democrats are on this? >> yeah, not a whole lot. chris coons statements was one of the first, and he is a delaware senator, and he has known the bidens for a long time, and he is occupying a seat that joe biden had in congress, and he knows the hunter bidens, and sits on the judiciary committee and from chuck schumer and hakeem jeffries yet to weigh in. and chuck schumer similar to the trump case, they have weighed in, but only saying that they let the process play out, and not try to cast judgment one way or another, and expect that as well from the democrats trying to say, look, let the process play itself out, and let's have faith in the system here, but that, those comments have been far and, few and far between here in the moment, kate. >> absolutely. great to see you, guys.

today? >> kate, it is really important to remember that john durham was appointed when trump was in office four years ago, and only last month did he put out the report. it was critical of the fbi, and it raised same issues that we are seeing raised in the inspector general report today, but it is the first time that the democrats and the republicans are going to be sitting in the same room as durham to hash out the same issues in the report and ask questions of the former special counsel about his investigation. now the democrats and the republicans have voiced different priorities as to what they want to talk to him about. the republicans who view that his report really as a referendum and really damning reflection on the fbi and the justice department, they want to get some of that and more emphasis on that point from durham, but the democrats are seeing the report as a rehash of problems that the fbi has had today and point out today that they have already addressed, and so two competing priority lists for the democrats and the

of the of the north atlantic ocean, stockton rush, leading this, was one of the people aboard the deep sea vessel when it went missing according to a source with knowledge of the mission. now in a little over -- little over an hour, more than an hour we're expecting an update from the u.s. kest guard, update on the search for the vessel and five people on board. cnn will bring that to you live at 1:00 p.m. eastern when we are expecting that to happen. time here is really everything in this moment. the submersible lost contact with its crew sunday about an hour and 45 minutes into the dive going down to explore the wreckage of the "titanic" located 2.4 miles down of the bottom of the north atlantic. the rescue mission at almost 13,000 feet below the surface seems nearly impossible, and it really does. the biggest concern the vessel is running out of oxygen.
