miles deep. the hunt for a missing submersible in the north atlantic is entering a critical phase. the coast guard just telling us 40, 41 hours of oxygen remain for the five people onboard. we are learning alarming new details about exactly how that vessel was built. plus hunter biden set to plead guilty. the president's son reaching a plea deal with the feds led by a trump appointee. he's now facing the consequences of tax and gun charges, while the political consequences play out in the nation's capitol. >> and he is still leading the republican field, but a new poll shows post-indictment support for former president trump is softening. we're following these major developing stories and many more all coming in right here to cnn news central. new updates from the coast guard have just come in as the

search for that tourist dive vessel becomes more dire, revealing just how complex, delicate, and huge this mission and search has become. they said the vessel had enough oxygen to last a total of about 96 hours, four days when it lost contact with its port ship on sunday. now we're looking at doing the math anywhere from 39 to 40 hours until they run out. >> today the vessel deep energy, 194-meter pipe laying vessel arrived on scene with underwater rov capability. they have rendezvoused with the prints and will commence at the proximate position of the titanic wreck. that operation is currently ongoing. >> the vessel not that big, about the size of a minivan. it's the property of an expedition company called ocean gate. it is carrying a pilot and four

passengers, the aim to visit and view the wreckage of the titanic which is at the bottom of the north atlantic. the u.s. coast guard says their search area is about the size of the state of connecticut, but one of the biggest challenges is the depth of that search area. 3,200 feet. line can no longer be seen, and while canadian search equipment is equipped with sonar, the titanic wreckage lies nearly 13,000 feet below the surface, about 2 1/2 miles. cnn's paula newton, she's been following this from outtawa. tell us what we know about those assets and what that means for the search going forward. >> yeah, so that was quite a sobering update we just had from the u.s. coast guard. and here's the reason. while many people offered their assets they are saying there's about 40 hours left of survival

for those five passengers there. what was most interesting they talked about that vessel, right, deep energy, and that's the best shot they have in the next few hours of finding the titan, this submersible and then trying to figure out how to bring it to the surface. they're going to launch rov, short form for remote operated vehicle. what this commercial vessel, normally this vessel is normally laying pipe at the bottom of the sea. it's already sensed now we believe that remote vehicle to the ocean bottom there in order to see if the submersible is there. that is only the beginning, though, jim, because if they find it, they then have to figure out how to get it back to the surface and it's especially dependent obviously on how far is it. is it 2 miles down or did it happen to make it further up? still an immense task ahead of them. >> i have to ask you, paula, it's a difficult question. when you speak to officials about this in canada, do they

manage expectations for the likelihood of a successful rescue? >> they are not managing expectations right now. they are fixated, jim, i have to tell yowl on the clock. we just heard in that press conference 40 hours. what does that mean? they have a question even coming in from all over the world to try and help. the issue, though, jim, who can get to the scene as soon as possible. and they are convinced if they can get more assets to the bottom near that titanic wreck and actually, you know, keep an eye on this submersible they do have a shot at bringing it back up to the surface and hopefully bringing the five passengers up safely. >> el, that's encouraging to hear. paula newton, thanks for covering this from canada. this of course a joint operation of u.s. and canadian assets. >> let's a take a closer look now at the structure of this missing submersible. joining us now cnn's tom foreman. the space inside has been compared to the interior of a minivan, very small and

mcgyver at all because that's where we work with boeing, everything else can fail, your lights can go, your thrusters can go, you're still going to be safe. >> that video raised a lot of concerns for a lot of people because you're saying what about the back up. they use this xbox sort of controller but they also can go past that and operate the controls manually. he said, yes, there are separate power supplies outside and inside, and they might get into trouble and they may not work, none of which he says should not keep them from getting back to the surface. >> talk about that. without power how are they going to get back to the surface? >> there were weights and they were taught you rock the vehicle to make the weights fall off. if that doesn't work you use a numatic pressure jock to knock the weights off and it should naturally float to the surface. but, still a challenge if that happened. remember this is sealed entirely from the outside, bolted down

weiss said the probe is still ongoing. let's get to senior justice correspondent evan perez. evan, we now have the charging documents. what do they reveal? >> they tell us, boris, on the two counts of failing to pay taxes, that is part of the plea agreement that has been struck between david weiss' office and hunter biden's attorneys. according to prosecutors for the years 2017 and 2018 he had income of more than $1.5 million and failed to pay on time. and so that is the reason for that part of the charge. by the way, his attorneys say hunter biden has now paid the sums owed, and he's paid the penalties. now, as far as the gun charge, this has to do with a gun that hunter biden purchased during the time he was addicted to drugs. he has, you know, talked about this in a book that he published as well as in television interviews, talked about how he was struggling with substance

abuse and clearly should not have been able to buy a gun but did. and so that is now going to be a charge that the prosecutors are going to deal with through a diversion program, which means, you know, if he satisfies the terms of what a judge orders he will have that charge completely dismissed. we got a statement from hunter biden's attorney, chris clark, and he says i know hunter believes it is important to take responsibility for these mistakes that he made during a period of turmoil and addiction in his life. he looks forward to continuing his recovery and moving forward. now, as you pointed out pretty standard in these public statements from prosecutors to say that an investigation is ongoing while all this is pending before a judge. we do not know whether there's anything more certainly from the justice department that could be beyond that. hoover, we know republicans on capitol hill are far from done with this. we know this investigation began

looking at money laundering, looking at hunter biden's business in ukraine and china. that is something not part of this case anymore. but you can bet republicans are going to keep looking at that part of this. >> yeah, they've often attacked president biden and his son for foreign business dealings, but that is not included at all in any of this. >> right. none of that ended up being part of what became part of this plea agreement. >> evan perez, thank you so much. briana. >> we're joined by michael moore. this probe is headed by a prosecutor that was appointed by former president trump who stayed on during the biden administration, kept on by joe biden to obviously avoid the appearance of political interference here. but when you listen to republicans on the hill broadly they are saying this is a sweetheart deal. when you look at this, is this a sweetheart deal? >> well, it's a pleasure to be with both of you.

no, it really is not a sweetheart deal at all. it's just a sort of matter of course run of the mill. this is how some of these cases are resolved. there's nothing here to indicate there's any special treatment. this is -- when people try to poke fun or make distinctions who the prosecutor is, they usually find out those people who shout the loudest are the ones whose ox is getting gored. and in this case there's nothing to indicate there's anything improper or out of ordinary with the deal. and it's common, frankly, to keep a prosecutor in place from the prior administration if they're investigating somebody currently in a different administration. that's normal. that's been done throughout. you saw it in the edwards case, and you can go back from that. so nothing here that causes any red flags to go up. >> it seems clear why hunter biden would take the deal here. these are difficult charges to fight, why he would try to avoid a trial and potential prison time here. why from the doj's perspective

is this something to move forward with a plea deal on? >> well, unfortunately, the doj is just like anybody else.d. you don't go too hard on them because it looks like they're getting negative treatments. you don't go too light because it looks like they're getting special treatments. so you try to maintain consistencies with cases you handled in the past, and so my guess is that the prosecutor in this case simply looked at from a historical perspective those cases they were handled and this is a decision in line with those type of cases. and frankly, it is. it's a nonviolent offense and especially on the tax charges those tax cases come up every day and what's important is obviously the u.s. treasury gets

paid back its money and that by all appearances he be done. and those needs for the united states to satisfy the fact the government was the victim in the case if they met. >> michael moore, great to have you for your analysis. thank you so much. jim? >> let's speak now to white house correspondent jeremy diamond, chief congressional correspondent manu raju, and cnn political analyst ron br brownstein. what has been the reaction to this deal and has there been any indication they were encouraging hunter biden to seek a deal with prosecutors? >> well, we haven't heard very much from the white house other than one comment from white house spokesman ian sams. and in that statement sams says, quote, the president and first ladylove their son and support him as he continues to rebuild his life. he says we will have no further comment. and look, that is just a continuation of the strategy and frankly just the posture we have

seen from president biden and his administration as this hunter biden investigation has unfolded over the last several years. the president has really made little effort to distance himself publicly from his son. instead he has really embraced him. we have seen hunter biden with the president in public multiple times. you know, most recently perhaps most prominently when the president went to ireland hunter biden was at his side, a near constant presence, and president biden is someone extremely close with his family, so the notion of distancing himself from runter was simply never going to happen despite the fact some democrats privately have und wondered whether he should have taken more distance from his son at least publicly for the possibility for the very outcome we are seeing today. but instead the president and first lady have both embraced their son saying they're proud of him, proud of his recovery from his drug addiction and most recently the president said in an interview he doesn't believe his son has done anything wrong.

we know white house officials and the president's personal attorney they have kept close tabs on this legal case throughout, keeping in touch with hunter biden's attorneys. now, the question is will the president himself comment on this plea deal? we are expecting to see him on camera later today as he meet with a.i. experts in san francisco. we'll see whether or not he responds to any shouted questions on this, jim? >> manu, there are a cup of hard facts here. this is a u.s. aattorney appointed by trump. and while the sitting president is running for president. what has been -- and has any of those facts influenced the rchr republicans' response to this on the hill? >> reporter: i tried to ask speaker mccarthy about the fact whether this was initiated david weiss and a hold over in the administration, but mccarthy has down-played that fact and point today the fact that the former

president donald trump has been prosecuted after being indicted by a federal grand jury in a classified documents case, trying to compare the two issues. and i pressed him about that, the fact these are completely different cases involving a different set of facts, but mccarthy still claims there's political bias of the justice department. >> congress has to have a right -- we have the constitutional right to investigate and oversee. and for any investigation that we have or any information we need, we can't now stand behind that theshz an investigation going on. >> well, there's two separate cases. the trump case involving alleged obstruction of an investigation, alleged misstatements. this is a tax case and a gun case. these are two separate cases. why conflate them? >> i'm not conflating them. >> they're alleging you lied to investigators, that's the issue. >> did hunter biden lie about the tax situation, did lunter

biden lie about the gun? >> he pleaded guilty. they're different cases, they're different facts. >> it's about equal justice. >> reporter: so mccarthy's indicating that he expects the justice department now to provide documents and records to the house oversight committee, which has begun this hunter biden investigation really since the beginning of the this congress. and now that this investigation at least this part of the investigation appears to be have concluded, once those records -- and that's going to be the pressure point going forward whether they get those and whether they subpoena for those and whether the justice department complies, as you can hear from the speaker if they're not satisfied with the results of this plea deal and comparing to the situation involving donald trump, which of course is much different. >> and presumably carry that congressional investigation into the election cycle. ron brownstein, there's another fact here. the president's son has pleaded guilty to federal crimes while the president is running for office. what are the political implications for joe biden's

re-election campaign? >> you know, jim, i think the odds are very high that this is going to have more impact on the republican primary than it's going to have on the general election. joe biden certainly has his problems with the electorate, in particular this very durable and stubborn majority that has concerns about whether he is simply too old to handle the job, but i think the prospect that there are significant number of voters who would genuinely be open to voting for him and will not because they think his son, you know, is corrupt or got an unfair deal is pretty small. on the other hand, the charges of dual justice or bias against republicans that you're hearing from so many republicans like speaker mccarthy in manu's report there, that has a real impact on the republican primary. it basically forces the entire republican race into the narrative that donald trump has setup, that essentially, you know, it is him standing up against the deep state, and that

makes it tougher for the other candidates. even the cnn poll like other polls out today shows in the broader electorate outside the coalition voters are responding to indictment of trump pretty much the way you'd expect, they're deeply concerned about it. but in the republican race the primary focus is justice is being weaponized and it helps trump. >> that's a great point. that is one while you have had some republican candidates for instance running for office deny the former president's claim about the election, on this issue they've been pretty uniform, and that is to your point under at least one of trump's arguments that this is a weaponized justice department almost despite the facts because in the same week you had a report in "the washington post" that it delayed investigating him for his role in january, so what is your response to that?

>> look, there are very mixed feelings among democrats. certainly the biden administration's view has been to avoid almost any political commentary on this for fear of fueling this republican narrative that he's the victim of a weaponized deep state. i think there are definitely democrats concerned other figures in the party are not out there making the kind of arguments we are hearing from members of trump's own senior, you know, officials, his attorney general bill barr, his defense secretary mark esper, his national security advisor john bolton. all have made the case this is very serious set of facts and it raises fundamental questions about whether he's fit to be president again. you really aren't hearing that from democrats and i think there is ambivalence whether they're letting the republican arguments

let's get back now to our top story this hour. the coast guard has said they still have found no trace of the missing tourist vessel. they estimate the five people trapped onboard have less than 40 hours of the oxygen left. the crew was on a mission, a tourist mission to visit the wreckage of the titanic tens of thousands of feet below the surface, 2 1/2 miles, in fact. cnn's jason carroll following live from boston. i guess one of the challenges here is that some of the assets involved in this search are not even on site yet and yet you have a dwindling oxygen supply. what is getting all these pieces into place. >> reporter: the coast guard put their best foot forward and said there is a vessel at the site where the submersible went down.

this vessel is equipped with an rov, remotely operated vehicle machinery with a camera located on it as well. so as it's heading beneath the surface, it can try to search for this, for the missing submersible. again, with just 40 hours of breathable air that's left within the past hour, when the coast guard was giving its briefing i asked captain jamie frederick, look, let's say you had located the submersible below the surface, and let's say you had all the resources you needed at surface level to go down there and get it, would 40 hours be enough even if you had all that. here's what he said. >> obviously getting salvage equipment on scene is a top priority. unified command is working through that to prioritize what equipment we can get there. there are ongoing operations right now via the u.s. navy and

transcomm to get equipment on scene. what i can tell you there's a full-court press effort to get equipment on scene as soon as we can. >> so what does as quickly as we can mean for some of this type of equipment needed for this deep sea rescue, that equipment still 24 to 48 hours still away from the site where that submersible went down. jim? >> 48 hours window of course is outside what they say is the oxygen supply inside. jason carroll in boston covering the search. boris? >> joining our conversation now a friend of one of the missing passengers. he spent a lot of tame with amish harding and spent a lot of time with him. we're so sorry that your friend is in the middle of this ordeal. first, i'm curious what your reaction is to hearing that the

vessel went missing. >> well, when i first heard they lost comm, i wasn't too concerned because you lose comm often in missions like this. but pretty quickly it became obvious it was a serious problem and something more than just a simple lost comm. >> i understand you were texting with hamish before he went down in the vessel. what was that conversation like? what did he share with you? >> it was very brief. he was talking with our one more orbit team. we did a mission where we flew around the earth and he said, hey, i'm going down to see the titanic as long as the weather permits, and that was right before he went down. he was very excited about it, and there was no concern in his voice. >> had he talked to you before about wanting to see the titanic in person? was this a long time geloal of

his? >> well, we've talked about a lot of things. h hamish has done all kind of different adventures, been to the south pole and the trench. this is the kind of thing we were talking about when we were hanging out. i'm kind of chuckling while he's down at the bottom of the ocean waiting for rescue, he's probably planning out his next exploration adventure. >> i was going to ask you about that because he's been to outer space, done really several cool things with you. i'm wondering how you think those experiences may have served him in a situation like this. >> well, i know when we were on one more orbit we were flying over antarctica in the wintertime. the whole continent was not available to land. it was dark and freezing and we had several thousand more miles. and we had to descend into warmer air, and that meant our

gas mileage got worse, and our fuel ability to get to the airport in south america was right on the limit. like we were just barely able to make it, and he stayed perfectly calm. he was one of our pilots flying the airplane, so he's had enough experience in these different flying missions and other missions that he's done. he'll be able to stay calm, and they know i'm sure this rescue effort is an incredible armada. by the way, thank you to the u.s. coast guard and navy and canadians and commercial vessels involved. i really think if they can be rescued, they will. the rescue effort is just so strong. so he's going to be able to stay strong and hope those five folks down there can. the calmer they are, the longer their oxygen supply will last and they certainly realize that. >> the temperament to stay calm in that situation is really impressive, and obviously these rescuers do some incredible work. i wonder if, you colonel, do

contact with his loved ones and whether they're holding up. >> i have spoken to his family, and thankfully they're all together right now. they're hoping to stay out of the public eye right now. obviously this is stressful time, and hopeful they'll be rescued. and hearing some doom and gloom. the really good news is we haven't had bad news. we haven't seen wreckage floating or haven't had that explosion under water in the sonar. so that means we don't know anything bad has happened, and it's very possible they are awaiting rescue. so that's the hope. and again, u.s. navy u.s. coast guard, the canadians, there's a significant effort. so i'm hopeful they can get going, but there's not a lot of time. as you noted, you know, two days from now it may be too late. so everybody is very much aware they're on the clock and they need to get this rescue operation. it's two parts. it's a search. they haven't found them, and once they search they have to figure out if they're stuck on the bottom, if they're tangled in the titanic and how to actually get them up.

his federal indictment. he is, though, still the clear leader in the gop primary field, but since he has become the first former president to face federal charges he's now seen his lead shrink slightly. we have cnn political director david chalian to break down these now noobs. let's start with trump standing among republicans in the wake of these charges. >> if you just look at in the course race where he stands among republican and republican leading candidates in the field we tested you'll see he's currently at 47%, ron desantis at 26%, mike pence at 9%, everyone else is single digits. he was at 53% in may. he's down 6 points in that support to 47%. that difference that you see there, that 53 on the right side to that 47 is something to watch. for eight years we've been asking when might something that happens to donald trump in the news actually affect his numbers. this is something to watch. i'm not suggesting we're there. i'm suggesting we're seeing this little bit of softening.

he's still got a 21-point lead. his favor numbers, another opponent in this poll, you just saw he's at 60% favorable among republicans and republican leaning independents. but in may he was at 77%. his favorables are down 10 points. his unfavorables as you can see there are up 9 points. that's not welcome news for donald trump, and we've seen an uptick in the number of republicans who tell us they won't even consider him for the nomination. that's up to roughly a quarter of republican and republican leaning independents. >> that's really interesting. more broadly what are the views of americans in this indictment? >> it's such an important question you just asked, because what i was just discussing with you was in the context of the republican primary, and that's up first. obviously what we are learning is this news is terrible news for donald trump what is happening with him broadly speaking for a 2024 re-election candidate. 61% of americans in this poll approve of the indictment, and obviously you see overwhelmingly democrats do.

but 67% of independents, two-thirds of independents approve of the indictment. that is not a place donald trump wants to be. >> it seems like those who are squaring off against donald trump, i mean in normal times this would give them a giant opportunity, but actually it presents them with a conundrum. >> it does because he's still so popular within the republican party, so all the other people running have to figure out how to navigate this. can they join in the bashing of the quote-unquote weaponization of the justice department that's a big republican talking point but still try to make ground on donald trump who's still under federal indictment. a majority of republicans not supporting donald trump, so take the trump supporters away, they don't want to hear the candidates talk about this, rather they stay silent. and briana, the fundamental thing is can republicans beat joe biden in 2024? they want to find a candidate who can actually defeat the incumbent president. the republican party is split on this. 51% say they're better off with

trump as the nominee. 49% of republicans in this poll say they're better off with someone else as a nominee. >> some of these folks want an alternative but don't bash him. it's an interesting look there. jim? now to some of the other headlines we are following this hour. a restaurant chain in california being forced to pay $140,000 in back wages after federal investigators say the owner hired a fake priest to spy on employees. the sacramento area chain used the priest to elicit confessions of wrongdoing. the owners also told employees to lie about how much overtime they worked and threatened employees with immigration consequences. investigators were unable to identify the alleged priest, but local church authorities are confident he was not actually part of the diocese. also we have an update on tropical storm brett now churning in the atlantic. it's not expected to reach

♪ u.s. secretary of state antony blinken may have another problem with diplomatic relations with china. china is close to expanding its footprint with a new joint training facility in cuba. a facility that could potentially place hundreds of chinese troops just miles away from the u.s. coast of florida. blinken today, though, said he's made it very clear that the u.s. would have deep concerns about chinese military activities just 90 miles away from u.s. shores. cnn national reporter natasha bertrand is here with the development.

natasha, is this a done deal? is there anything the united states can do to deter china from opening this training facility? >> well, boris, we're told this is not finalized yesterday that cuba and china are in discussions. something that would concern u.s. officials because it would involve potentially hundreds of peoples liberation army troops being stationed on the island at any given time, conducting train with the cubans there. it's unclear what the u.s. can do at this point to deter any activity because the chinese/cuban partnership in terms of partnerships has been growing over the last five or six years. there's two paths that can take to minimize the impact on the u.s. the first, of course is basic diplomacy. talking to cuban officials, talking to chinese officials to figure out any type of way for the relationship to be tamped down. and the second is counterintelligence issues, something that the white house spoke to with john kirby, the

national security council, saying, look, we have our ways of protecting our facilities or infrastructure from any spying. we're not getting into that, sufficed to say it's very effective, the counterintelligence. >> it echoes the cold war, right? we also know there are negotiations underway right now to secure the release of some americans detained in china. the u.s. said they wrongfully detained, china says nobody is wrongfully detained? >> secretary blinken said this is a top priority meeting with chinese officials. he spoke to them about wrongfully detained americans in china. that was something that the chinese obviously have pushed back against pretty hard. blinken told reporters that he does believe this is a major irritant in the relationship well, the chinese foreign ministry spokesperson said we don't believe in the phrase "wrongly detained."
