the clock is ticking, and time is running out for five people trapped in a missing submersible. experts say they have about 40 hours of oxygen left. and making matters more complicated, the equipment they need to salvage the sub has not yet arrived. this is as we're learning alarming new details about how this submersible is built and operated. plus, the president's son hunter biden pleading guilty to tax charges making a deal as well on a felony gun charge. we're following all of those charges and the political fallout both at the white house and on capitol hill. and trump's busy defense, the former president's new explanation for why he had classified documents at mar-a-lago. we're following these major developing stories and many more, all coming in right here to "cnn news central." ♪

right now, both american and canadian coast guard officials are combing the seas for any evidence of that missing tourist dive vessel. four people and a pilot were onboard as it submerged off the coast of newfoundland to visit the ship wreck site of the "titanic." it was about 1 hour and 45 minutes into their voyage, that is lost contact with the support ship. that was on sunday. and now officials estimate there are only about 38 to 39 hours left in they run out of oxygen. the vessel is about the size of a minivan. and it's a property of an expedition company called oceangate. the u.s. coast guard case the search area is about the size of connecticut. but one of the biggest challenges is the depth the vessel may have already reached. at some 3200 feet you can no longer see light. and while much of the search equipment is equipped with sonar, keep in mind, the "titanic" wreckage sits at more than 12,000 below the surface.

we want to take you live to cnn's paula newton tracking all of the details for us. so, paula, what you can tell us about the latest of this ongoing mission? >> reporter: yeah, boris, we just had a very sobering update from the u.s. coast guard, which as you say is leading certainly the search and rescue but that's in a unified command with both canadian and american officials. i have to say, boris, with all of the resources they can must every literally from anywhere in the world. what has happened now, though, just to start with the good news here, a vessel called "deep energy" has arrived at the site and is already doing what they knew had to be done immediately. and that was actually try and go to the depths of the seabed there. they have already searched well over 7,000 square miles in the air. i've been saying, having been in the waters if the submersible comes to the surface, that it would take some time in the

water, as you said, the size, no bigger than a family van. having said that, now that they've told us how much they've searched in the air and on the surface, it is important for them to get to do what they call a sub surface search and that requires deep diving. i want you to listen to captain jamie frederick. >> today, the capsule deep energy, 190-foot vessel arrived on the scene with underwater rov capability. they have rendezvoused with polar prince, and the last known position of the titan and the approximate of the "titanic" wreck. that operation is currently ongoing. >> reporter: ongoing, boris, but no matter what here, even if they see it, depending on where it's located, the true task is going to be how do you bring it to the surface. and to that point, both the u.s. and canadian officials are looking for any expertise they can as well as obviously,

leaning on the resources of those two governments to preposition as much equipment as they can, whether onshore in st. john's, on in the north atlantic, to find a way, assuming, they're assuming the best, boris, that they will see it somewhere. and then will try to bring it to the surface. two hours ago they said there were 40 hours of oxygen left. i can tell you right now, i know from the canadian side, officials are focused on the clock. they know they have a limited time to try for this rescue. and they are bringing all of the resources to bear, not just military or government but also commercial assets like that vessel that's out there now. and have sent a remote-controlled unit to the seabed. boris. >> and at that depth, a rescue of this scale would be unprecedented. paula newton live for us in ottawa. thank you so much. jim. the u.s. navy said it's working to bring more assets for the search of the submersible. currently, the canadian coast

guard and now france have joined in international efforts. cnn's oren liebermann joins us from the pentagon. the u.s. assets, what kind of when and where, the p.a. on the sea, with enormous ability to search for subs. are there more like that coming? and how quickly can they get them there, given that time is of the essence? >> of course, we learned a bid from the u.s. navy. let me pick up where paula left off, the key question is once you're able to find the submess a but how do you you lift it and the fly-way deep ocean salvage system. it's a fancy name for something that can lift heavy things such as fallen aircraft or vessels off the bottom of the ocean floor and bring it up, fly a ways, you're able to transport tfr and bring it to a ship and then able to use it. it would certainly lift

something of this size which is to say not all that large, the submersible, as long as you can find it. that remains the key question to this point. and back when we started this, what are the search assets. first c-130s, used in the surface of the water. long-range abilities to keep searching an area the size of connecticut. >> by later today, air national guard c 1-30 will conduct a search over the area. we would have committed consider-130s to flights. in addition to that the navy has been in touch with the coast guard and is working to provide personnel, such as subject matter experts and assets as quickly as possible. >> the canadian coast guard has also dedicated. p-8s and p-3s.

those are capable of detecting air mass under water in different ways. it's just another way, jim, to try to figure out exact with where the submersible is. >> the pentagon press secretary said as soon as possible. what does that mean, if we're talking less than 40 hours of oxygen still inside the submersible? did they specify the arrival times? >> so, we don't know exact arrival times and we do know, we've seen this on flight trackers, more assets to st. john's where they'll be moved to the area. that process is ongoing. one of the question, why is this just discussions now between the coast guard and navy. the deputy press secretary said those conversations have been ongoing it's a question of when the coast guard knows they need the assets and knows when to bring them in. >> urgency of the essence, too. oren liebermann, thank you, at the pentagon. brianna. >> let's take a closer look at

what the submersible looks like. you can see it's not a lot of space for five people. it's about the size of a minivan, it's cramped. and uncomfortable. and a cbs crew took a trip on the titan last year and they were surprised by some of the hardware inside, let's look. >> inside, the sub has about as much room as a mini van. >> this is not your grandfather's submersible. we only have one button, that's it. it should be like an early vart. >> we can use the off-the-shelf components. >> i got these from camper world. we run the whole thing with this game controller. >> come on. >> cnn's gabe cohen has also been inside this very submersible, it was actually five years ago when it was about to launch. you were a reporter in seattle, when you got a chance to look inside. what was it like? >> yeah, i did this story back in 2018, actually, taking a inside of titan before it went out for the first expedition for the "titanic."

the first thing that's striking is the size of it. it's extremely cramped. very small space for five people to be on board. of course that technology aspect of it, pieces of components that felt simple, even rudimentary. it is operated as you saw by a gaming controller, or playstation controller. and yet, the company insisted while some of those components may be off the shelf that really the structure of it, they did not cut any costs, cut any corners, when it came to safety. with its carbon fiber structure it would have no issues making that dive to the "titanic." 13,000 feet down in the ocean with pressure 400 times the pressure at the surface around it. actually at the ocean floor. now, of course, we have learned since then that titan has had some communication issues. we know last year, the crew of the vessel, did lose communication with their support crew on the surface of the water for about two hours, it was lost. but then again, we don't know

what the issue was here. >> you actually interviewed as well the ceo of the company who we have now confirmed is on board at this very moment. >> yeah, stockton rush who is the founder of oceangate founded back in 2009. he's onboard this vessel. i've interviewed him several times. he always spoke very passionately behind the science of these expeditions. not just going on a journey, but trying to map these vessels, the wreckage down below. but we also push him during the interviews of the safety aspects just how safe theye. i want to read you a quote before the another expedition. i asked him, how safe the vessels are, quote, everyone is getting back safe. we can take risks with equipment, but not with people. >> let's hope that everyone gets back safe. gabe, thank you so much. it's rare to have someone who has a look inside of this, it's certainly very helpful. jim. coming up on "cnn news

us from wilmington. kara, what penalties will hunter biden now face? >> reporter: well, brianna, on the tax charges you mentioned two misdemeanors failing to pay taxes for 2018 and 2019, prosecutors saying hunter biden didn't pay taxes on $1.5 million in income for each of those years. the trump-apointed u.s. attorney david weiss here has agreed to recommend to the jump that hunter biden get probation under those charges. under the statutory statute, the maximum punishment for those charges is up to a year in prison each. now, there's also that gun possession charge that you mentioned and that is a felony. but in this instance, hunter biden won't plead guilty to that charge, instead, it's going to be diverted. which means if he lives up to certain elements of conditions that are set by this agreement then that chargeological go away. that's a common charge that's used in instances where someone has been under the influence.

an addict, it's one way to resolve that kind of case. so, you know, clearly a negotiated deal that has been in the works for some time. this investigation has spanned more than five years. at one point, it was looking at a potential crime violations, money laundering violations with the resolution being announced today. hunter biden's attorney said to their knowledge, this investigation is closed. that attorney chris clark also said, i know hunter believes it is important to take responsibility for these mistakes during a period of turmoil and addiction in his life. he looks forward to continuing his recovery and moving forward. now, how much of that will take place, given there's going to be a lot of attention from republicans who are focusing on this investigation, not only saying that they're going to continue to look into the biden family finances, but also exploring, or hoping to get some more information about the department of justice investigation, that led to the guilty plea.

finally, that we saw today. and then the next thing here, a judge will be assigned to the case. hunter biden will come into the court behind me and allocate the charges saying he's pleading guilty to them and saying to judge what crimes he's committed. brianna. >> we'll be looking for that kara scannell, thank you. let's talk to cnn analyst and epic czar norm eisen. norm, you've been hearing this, we've heard a lot of republicans today, different kinds of republicans, sometimes, they don't agree on certain things but they seem to agree on this including house speaker kevin mccarthy saying this plea deal is evidence of a two-tier justice system. that this is a sweetheart deal. is it? >> it doesn't appear to be, brianna. the firearms charges of this kind, false statements in getting a firearm, the tax misdemeanors, these are typically charges where you do

get no jail guilty pleas. and you can't really compare that to the very serious offenses that donald trump is accused, innocent in proven guilty in the mar-a-lago classified documents mishandling case. you know it would be wrong if prosecutors treated hunter biden better than anybody else. but it's also wrong for them to treat him worse than anybody else. here it appears that he's being treated the same way. >> yeah, that's right. it should be equal, right. so, here we are talking about, these are tax charges. this is a gun charge. just because the doj hasn't found anything legal in terms of hunter biden's business dealings with foreign -- with entities in foreign countries like ukraine, like china, at least so far, they haven't found anything, we should be clear about that. that doesn't mean that his business dealings were ethical,

right? there could be a distinction between the law and ethics. you were the ethics czar as i mentioned when biden was vice president. are there still more questions that need to be answers when it comes to that? >> well, brianna, it was foolish for hunter biden to do business with burisma in ukraine. with that energy company in ukraine. given his father's role. but when i was counsel in the first impeachment, we did a very deep dive into these issues. and there just appeared, certainly, as to joe biden that there's no there there. we're not actually aware of any allegations of an ethical behavior by hunter biden. he's had a pattern of unwise decisions and this was another

one. we'll have to see if anything emerges. and having looked at a time, we looked hard, we did not find any violations of law there. >> david weiss who is the u.s. attorney in delaware, trump-appointed remained on under the biden administration, said the investigation is ongoing. hunter biden's legal team put out a statement saying the deal resolved the doj's investigation. obviously, kind of different stories we're getting here. what do you understand the situation to be? could there be other charges still on the table, even if there's a deal like this? >> well, if thmr. weiss says th investigation is ongoing, we need to take him at face value. this certainly resolves the gun charge, the tax charges. he may not have concluded his look at burisma or other matters. but it does have the feeling, brianna that we're coming to a close in the hunter biden investigation. part of that is i know his lead

counsel abby lull well. i don't think they'll be resolving the case unless a clean bill of health from mr. biden. but the greater role, we're see the terminus of the hunter biden review. >> norm, thank you so much for being with us this afternoon. >> thanks very much. >> jim. >> for white house reaction, let's go to cnn's jeremy diamond. jeremy, i wonder do we know if the white house had any involvement with hunter biden's legal team in terms of encouraging a deal, or any involvement from that end? and, two, has the white house said anything about this plea deal? >> well, jim, biden advisers have repeatedly told me that look, they do keep tabs on this. they have maintained contact with hunter biden's legal team, one thing a senior adviser told

me they do not direct or advise on what they should do. but they certainly have kept apprised of this. the president himself, he, remarkably, has made little to no effort to distance himself publicly from his son throughout the investigation. instead, he's really embraced had im. we've seen hunter biden at his side in a foreign trip a couple months ago. it's no surprise, the first reaction we're getting from the white house is a statement of support from the president and first lady, saying, quote, the president and first lady love their son and support him as he continues to rebuild his life. we will have no further comment. that's a comment from the white house spokesman ian sands. and the president as recently as several weeks ago said that he's proud of his son, he doesn't believe he's done anything wrong. of course, in this case, hunter biden has admitted to wrongdoing with suspected guilty pleas. white house officials and the

president's personal attorney, as i have said, they've kept tabs on this situation. so this did not come as a surprise to the president the way we've seen when charges are announced against a former president. the president has been aware of that. that's because of communication with hunter biden's legal team. not because of any involvement with the justice department. this is a justice department that's tried to maintain that independence and that right red line between the two. >> and the statement expressing love for their son. the reaction. this, jeremy, at the white house, boris. still to come after an interview on fox news, chris christie said donald trump's attorneys probably want to throw themselves out of a window. why he believes the former president just admitted to obstruction. and former special counsel john durham is on capitol hill right now, testifying behind closed doors on the scathing report on the trump investigation. what he's expected to reveal, when we come back.

♪ special counsel who investigated the investigators behind the trump russia probe arrived on capitol hill. he's meeting with the house intelligence committee behind closed doors, ahead of a public judiciary committee meeting tomorrow. last month, durham concluded

that the fbi never should have launched a full probe into alleged connections between donald trump's 2016 campaign and russia. cnn's zack cohen is live on capitol hill for us, so, zack, what do we know about the meeting? >> reporter: yeah, boris, it's important to remember that john durham was appointed when former president donald trump was still in office over four years ago. d that invtigation led to the report that he released last month. and now today for the first time, democrats and republicans will have a chance to sit in person and ask questions of john durham about his investigation. now, john durham's report was pretty polarizing based on the interpretations and the responses that we've seen from republicans and democrats. republicans, you know, view it as a compelling and damning account of the fbi's shortcomings when it comes to their decision to launch an investigation into donald trump and his connections with russia. where democrats see it more of a, you know, reiteration of the

same criticism of the fbi that we've seen from the inspector general previously. durham has a chance to answer questions from both parties ahead of the public hearing in front of the judiciary committee. the house intelligence committee is notoriously -- preaching a message of bipartisanship but the house committee a little more politicized since its formation with its chairman jim jordan running the show tomorrow. there could be political fireworks because of that. both sides gearing up to job that john durham in person since the report was released last month. >> we look forward to seeing exchanges between lawmakers and special counsel. zachary cohen, thank you so much. brianna. a trial date is now initially set for former president trump's classified documents ace. judge aileen cannon has proposed beginning the federal court trial in august. but as court proceedings get move so too are trump's explanations for why he held on to classified documents. just last night he said this in

an interview with bret baier on fox. >> why not just hand it over to them? >> because i had the boxes i wanted to get through the boxes and get my personal things i didn't want to hand that over to mara yet. i was very busy. >> that is just the latest of many different documents that trump has said failing to turn over the documents to the federal government. last month, at his mar-a-lago, he suggested the fbi made him plant the materials on his property. around that time, he said he declassified everything he took from the white house when he left and he could do that just by thinking it. >> >> you're the president of the united states, you can declassify, saying it's declassified. even by thinking about it. >> trump's legal team tried to expand that argument saying he declassified documents so he could work from home. this is the statement that trump's office gave in the wake of the fbi search. >> as we can all relate to

everyone, as we can all relate to, everyone ends up having to bring home their work from time to time. american presidents are no different. president trump, in order to prepare the work the next day, often took documents including classified documents, to the residence. he had a standing order. there's the word i've been looking for. that documents removed from the oval office and taken to the residence were deemed to be declassified the moment he removed them. >> we now know that special counsel has a recording of trump post-presidency, admitting he had in his possession, a secret document that he could have declassified when he was in office. but that he can no longer declassify because he was no longer president. among the other explanations that trump gave about holding on to classifies documents, everybody does. .former president falsely claimed his predecessors left office with copious quantities of classified materials. like when he baselessly accused former president obama taking more than 30 million records.

that prompted the national archives to issue a statement debunking the claim. then in january, trump claimed that he nearly kept empty folders that were labeled classified as a keepsake. cnn's katelyn polantz is here. kat katelyn, quite the change in stories, and prosecutors are likely keeping track. >> there's no doubt they're keeping track. what trump was saying about previously classified documents, quite frankly in the indictment. and we also know they have much witness testimony, evidence, these audiotapes. and now potentially what donald trump is saying out there publicly that coco become part of a criminal trial, if and when he goes to trial. now, there's been a lot of reaction to what trump said, especially the part where he's acknowledging in this interview last night on fox news that he had these documents. and wanted to go through them, even after receiving a subpoena from the grand jury. and not turning over all of the

documents back to the justice department. here's what one person, a very particular of political person, who also has some experience with law enforcement chris christie said on cbs this morning. >> it appears to me last night, as a former prosecutor, that he admitted obstruction of justice on the air last night. i can tell you this, his lawyers this morning are jumping out of whatever window they're near. >> now, chris christie, obviously, has been very vocally critical of donald trump especially in recent days. but he is a person that has experience in this area. and he is mentioning about this lawyer issue, donald trump had two lawyers representing him in court that they are looking to add to this legal team. once they get that team together, it's going to be a big question, what is his defense actually going to be? and that is what will come in the court papers in the coming weeks. >> you have judge aileen cannon setting this initially.

we say initially because we want to see if this is actually going to be the date for all of this to get going. but tell us about the trial deadline as it stands right now. >> right. she did put a order in the court record for this case saying donald trump is now set for trial in the back half of august. so, not that long away. this is how cases begin, though. this is how you kick off a case, especially one that the justice department has indicated they want it to go to trial fast. nobody has come into court to argue, actually we need more time to take care of classified records issues or take care of other issues that might arise because it's a pretty complex date. that date could hold, it's extremely unlikely that it would. because this is a case with a lot of possibilities in it. there's clearly a timing issue. but there is a date on the calendar, and they're going to have to work backwards from that. we'll have to see what happens in the coming weeks whether that gets offtrack. >> mid-august, happening quickly, katelyn polantz, thank
