"cnn newsroom" with max foster and bianca nobilo. >> it is wednesday, june 21, 9:00 a.m. this london, 5:30 a.m. in st. john's, canada where the crews say that they have heard banging sounds. according too an internal memo, banging was heard for 30 minutes every half hour and then againa were put out. >> and searches will continue. the sub owned by the underwater company oceangate disappeared sunday almost 400 nautical miles southeast of newfoundland,

canada. more from jason carroll. >> reporter: with each passing hour it is becoming increasingly clear if the five people on board the missing submersible are to be rescued, it will have to be soon. search and rescue teams from the united states and canada have been working around the clock in the north atlantic and have scanned an area about the size of connecticut remotely operated vehicles equipped with canada are now searching the area where the vessel was last seen son. sonar buoys deployed to try to detect any sound, and deep sea rescue equipment is on its way. >> it is a challenging operation, but right now we're focused on putting everything we can at it and searching as hard as we can and getting assets out there as quickly as we can. >> reporter: the titan lost communication with its mothership the polar prince less than two hours into its descent

sunday morning as it headed toward the wreckage of the titanic nearly 13,000 feet below the surface. the company that operate the vessel says our entire focus is on the well-being of the crew and every step possible is being taken to bring the five crew members back safely. on board is the oceansgagate ce founder, a pakistani businessman and his son. the vessel's pilot is a french national. and also a british billionaire also on board. he was recently a passenger on board blue origin space flight in 2022. on saturday, he posted on his facebook page i am proud to finally announce that i joined oc oceansgat oceangate expeditions as a mission specialist on the sub.

and harding texted his friend, a retired nasa astronaut. >> he was all excited, hey, i'm going down to see titanic. as long as the weather permits. that was right before he went down. he was very excited about it and there was no concern in his voice. >> reporter: jason carroll, cnn, boston. >> earl your rier rosemary chure with a veteran of the navy about the challenges. >> i think the noises that they describe could possibly come from the submersible and it is classic rescue signaling to send a location. but it has been detected by maritime uses sonar buoys. so there needs to be some degree of not skepticism but no certainty attached to this. we need to be realistic about the situation that the adventurers find themselves in.

if you think about it, we talked that they are in a submersible, they have gone down to look at the titanic, you've already pointed out that it is 4 kilometers deep, the water temperature down there is 0 degrees celsius, so very cold. the air that they have remaining, still 24 to 36 hours of air, but they are also breathing out carbon dioxide. and when i looked around at the youtube footage of the submersible itself, the carbon dioxide, to be able to deal with five people didn't seem to exist in that particular hull. so the bigger challenge here is the cold and also carbon dioxide. u.s. supreme court again at the center of an ethics controversy after a bombshell report about one of the justices. samuel alito is alleged in 2008 went on a luxury fishing trip to

will plead guilty to federal tax charges. >> but sources tell cnn that he probably won't serve anytime in prison. jasmine wright asked the requested about the deal during a meeting in san francisco. >> have you spoken to your son today, mr. president? >> i'm very proud of my son. >> more now from legal affairs correspondent paula reid. >> reporter: president biden's son hunter reaches an agreement with the justice department to resolve a long running criminal investigation. according to a letter filed tuesday by federal prosecutors, hunter will plead guilty to two miss demeanor tax charges and struck a deal to resolve a separate felony gun charge if he complies with his end of the plea agreement. biden owed at least $100,000 in federal taxes for 2017 and at least $100,000 for 2018. but did not pay the irs by the

deadline. his lawyers say that he eventually paid the tax bill along with fees and penalties. as part of the deal, the justice department has agreed to recommend a sentence of probation for the tax charges. according to sources. but the final punishment will be up to the judge. on the gun charge, prosecutors allege that he possessed a gun despite his addiction in violation of federal law. biden's lawyers met with the justice department in april and sources tell cnn that negotiations to resolve the case have ramped up in recent weeks. the deal comes after a broad years long investigation that also looked at hunter biden's foreign deals and possible money laundering. on capitol hill, republicans have been focused on the president's son and his foreign business dealings. but prosecutors han't charged him on those claims. tuesday house speaker kevin

mccarthy criticize hunter's deal. >> it continues to show the two tier system in america. if you are the president's leading political opponent, doj tries to literally put you in jail and give you prison time. if you are the president's son, you get a sweetheart deal. >> reporter: the hunter biden investigation has been overseen by trump appointed u.s. attorney david weiss. biden's lawyer chris clark called the investigation dogged but fair. >> this was a five year very diligent investigation pursued by incredibly professional prosecutors, some of whom have been career prosecutors. one of whom at least was appointed by president trump. no one ever said they were not competent, good or diligent. >> reporter: we're still waiting for a date to be set for hunter to head into court for his arraignment and plead guilty. we expect that will happen in the coming weeks. but i want to emphasize that

this deal including that recommendation for probation is still subject to approval by a judge. paula reid, cnn, washington. donald trump is speaking out against the justice department saying hunter biden is getting off with a mere traffic ticket and the former vice president mike pence joined the criticism. >> i like tens of millions of americans is concerned about a two tiered system of justice, like one set of rules for republicans and one set of rules for democrats. i have a sense that while i welcome these charges and the guilty plea, i have a sense that this will do very little to allay the concerns of millions of americans that we just simply don't ha equal treatment under the law. >> house testimon democrats are back. >> let's remember this was a five year investigation that was conducted by a trump appointed

u.s. attorney who was operating completely independently from the biden department of justice as he wrote to republican jim jordan a couple weeks ago. so given the length of the investigation and the exhaustive nature that mr. weiss no doubt put into it, that this is what they could prove beyond a reasonable doubt to a jury. and notwithstanding what everyone else wants to say, nobody else has seen the evidence to -- as part of this investigation. and so it is always bewildering that you -- a little bewildering how the republicans talk about this is a sweetheart deal when they of course have not seen the evidence that mr. weiss had. a new cnn poll shows donald trump's favorite ability rating

classified. now he's insisting all he ever had were newspaper clippings. >> these boxes were interspersed with all sorts things, golf shirt, clothing, shoes. >> iran war plans? >> not that i know of. there was no document. that was a massive amount of papers and everything else talking about iran and other things. and it may have been held up or may not, but that was not a document, i didn't have a document per se. there was nothing to declassify. these were newspaper stories, magazine stories and articles. >> reporter: all of these estimates from trump post indictment could be admissible during his upcoming trial, but trump continues to brush off the broad implications of his criminal charges. >> so you are not worried about this case? >> based on the law, zero. zero. >> reporter: and trump is taking fire from many of his former allies including bill barr who just wrote in an op-ed that if the facts laid out in the indictment are true, trump's actions amount to, quote, brazen

him and has all these unfounded claims. tell us about the charges, and they are not the only ones. >> so he is indicted on rape and human trafficking charges. he is also being investigated for money laundering and trafficking of minors that could potentially come down the pipeline later on. what is important to know about today's preliminary hearing is that all that is really taking place is, a, a determination as to whether or not he stays under house arrest or what preventive detection wo-- detention would look like going forward and set a date for the trial. this will take years. and one could argue that andrew tate remains an influential figure. his twitter account has been reinstated, his number of followers has skyrocketed. i was on his account and he has tweeted dozens of times since just this headline broke yesterday. including one video that was seen by 4 million people.

along the floor, we've seen medical gloves, bullet casings and even blood stains. and we've seen people coming up to the scene. we just saw a woman on her knees praying. there were two teens killed as a result of this attack, a man in his 60s and a man in his 20s. and right over here, you can see the very heavy police presence that is here as a result of the attack. again, deadliest attack targeting israelis since january. and we are just outside an israeli settlement in the occupied west bank. israeli officials say it was actually two hamas gunman who came up to this location, started firing at the restaurant and then fired at somebody who was filling up his car. one armed civilian shot and killed one gunman, the other gunman stole a car and got away. after several hours, israeli forces shot and killed that man. in the aftermath of that attack, several israeli settlers started

essentially on another rampage toward palestinian villages nearby. and we drove by and you could see carcasses evees of burned o cars. at least 37 were injured, mostly from stone throwing, most are in light to moderate condition and there is a lot of damage to things like homes and vehicles. hamas in their statement taking credit for this attack here saying this was in response to that major gunbattle that happened on monday when the israeli military went into arrest what they say were two wanted terror suspects. but it ended up being an 11 hour fierce gunbattle including the use of ieds by the militants, israeli military using an apache helicopter. eight israeli soldiers were injured. and you can feel the tension right now in the occupied west bank and now there is the

underwater noises in the search area from the missing submersible in the north atlantic. but so far they haven't been able to identify the source. an internal u.s. government memo says banging sounds were heard every 30 minutes on tuesday, though it is unclear for how long. and sonar devices picked up more sounds hours later. >> the sub called titan lost contact with its mothership sunday less than two hours into its descent. it is still unclear what caused the sub to lose contact. it is believed that the crew has less than 30 hours of sox oxyge left. tom foreman spoke with a previous passenger to get a sense of what the journey inside the submersible is like. >> oceangate competitions offers you the once in a lifetime opportunity to be a specially trained crew member safely diving to the titanic wreckage site. >> reporter: it may look like a

extreme heat advisory. more than 38 million americans are under active alerts and warnings while hundreds of thousands are without power. the scorching temperatures are in texas, oklahoma and louisiana. in texas several cities have been dealing with intense heat and the city of san angelo set a new record for its hottest temperature ever on tuesday. the national weather service is warning that daily records could be broken throughout the week with peak heat occurring tuesday and wednesday. and meanwhile in india, officials are investigating the deaths of dozens of people in the northern state that have been linked to a heatwave. at least 68 people died last week as temperatures soared and many others were hospitalized. >> and in another state, at least 44 people lost their lives in recent days. temperatures in some parts have reached 46 degrees celsius, that is more than 114 degrees farenheit. ukraine says that its top priority right now is to k3 haus russian forces before the main

impossible for some. so i said what are you going to and she said just wait, wait for the date. >> reporter: maria jose and her husband entered from venezuela, and they arrived two weeks ago in mexico with their 4-year-old daughter living here the past several days. they feel like after title 42 expired, that it is now much more difficult to try to cross title 42 allowed u.s. officials to immediately expel migrants who crossed illegally without processing their claims. those same migrants would try and try again until they got in. now title 48 back in full effect. and those who fail to qualify risk being banned from entering the u.s. for at least five years. the result? migrants flooding in to mexico

where they wait to figure out how they can get into the u.s. and you can see encampments have already taken up most of this little square here. you can see along this street you've got an art gallery, a nice restaurant. but then just turn the corner here and look down the sidewalk, you can see tents, families set up for days and weeks with nowhere else to go at this point. >> reporter: we drive an hour outside mexico city where a government run shelter is set up to handle the overflow. officials tell us most here from haiti. makeshift medical stations. this little girl complaining of a sore throat. her dad says she's not wanted to eat in five days. they pass the time doing chores and playing sports. their cellphones sit in a web of chargers, battery power fuels their chances of getting online cpb appointment.

eventually they move on. you can see these folks will be boarding the bus, they will go meet with mexican authorities and get paperwork that allows them asylum in mexico, basically trying to buy more time so that they can continue on their journey to get closer to the u.s. southern border, eventually get that appointment and they hope enter the u.s. legally. since title 42 expired, migrant crossings are down for now at least. we visited eagle pass, texas, main street, quiet. but texas congressman gonzalez warns what we saw building up in mexico will push north. >> it is almost a calm, i say calm, there is 800 apprehensions a day just in the del rio sector, but on the other side, it is just building up, building up, the cartel will adapt and then that will be the next thing that they send over. >> reporter: u.s. border officials warn as more either fail to qualify for asylum or grow frustrated waiting, they

are turning to cartel-controlled smugglers to getting across. the congressman proposing a bipartisan approach to counter that. >> send them another route, work visas make sense, remove the politics in it, remove you have access to vote or access to social services and say do you want to have a job, we have a job for you, link up the two. >> reporter: back in mexico city, we find maria jose and their daughter walking a busy commercial street. carrying a sign and candies. >> we're a venezuelan migrant family and we're asking for your support. >> reporter: they tell me they are out here three hours twice a day. she was a nurse in venezuela and so doing this, resorting to having to sell things, it is different as she points out, but she'd rather do this than ask

for money. now, given the buildup of migrants that we're seeing in mexico, one group in particular seeing this as an opportunity. that is mexican cartel-backed smugglers. and we've seen in the past of course they have trafficked folks using the back of cars, trunks in particular, containers from trucks. now according to u.s. officials they are seeing recent cases of migrants following smugglers into the u.s. by swimming through the pacific ocean at night. shows you just how increasingly desperate and dangerous some of these journeys are. david culver, cnn. men suspect sued smuggling hundreds face several charges including setting up a criminal organization, manslaughter and illegal trafficking of foreigners. all the suspects have maintained their innocence. meanwhile pakistani officials say 88 people have
