what, in that region, would stop the seven from bringing it up? if it hasn't already, it is a huge area. >> that is a good question and that is something i'm trying to grapple with, if the sub didn't make it to the bottom in an hour and 45 minutes, i'm not sure that they could, it means they probably went by anything like a jagged edge or a cable. so would have been mid water and if something went wrong mid water, why did they drop a ballast, so to speak, of batteries, and --. it is a tough one and that is why the suace search from air is important, and the underwater search is important. >> can we talk about the ongoing search? out searching the area. a great they heard the sound that helps give them data points, trying to triangulate this. how hopeful are you this morning with 24 hours left of oxygen, that they've got enough time, with my dad about where this could be?

about five years, looking at everything from possible when lobby violations to money laundering. in the end, the only charges broughas a result of this deal are two relatively minor tax charges and one charge is being diverted, related to the purchase of a firearm. so in no way does this particular case from the justice departme affirm the many accusations the gop has made about president biden, or his son. >> reporter: the doj's years on investigation into hunter biden , nearing a potential end. accordg to a letter filed by federal prosecutors, hunter will plead guilty to two misdemeanor tax charges and strike a deal to resolve a separate felony gun charge. accoing to crt documents, hunter biden owed at least $100,000 in federal taxes for 2017 and at least anothe $100,000 in 2018. but did not pay the irs by the deadlines. his lawyers say he eventually paid the bill along with fees and penalties.

on the tax charges, according to cnn sources, the justice department has agreed to recommend a sentenf probation, as part of the deal. on the gun charge, prosecutors allege a 2018 incident in which hunter biden possessed a gun to -- despite hisrug addiction and in violation of federal law. struggling with drug and 18 years of age. rly as the deal allows him to enter a diversion program. hunter has been in and out of rehab numerous times before. house republicans, seizing on the news. >> it continues to show the two tier system. if you are the president's leading clinical opponent, t doj tries to put you in jail and give you present time. if you are the president's son, you a sweetheart deal. >> reporter: presidential hopeful and former vice president mike pence also weighed in. >> while i welcome these charges and the guilty plea, i

have a sense that this will do little to allay the concerns of millions of americans, that we simply don't give equal treatment under the law. >> reporter: ian interview on tuesday, biden's lawyer, chris clark, called the investigation dogged but they are. >> this was a five-year, very diligent investigation pursued by incredibly professional osecutors. some of whom have been career prosecutors. one of them at least was appointed by president trump and no one has said they're not confident, good or diligent. >> reporte the hunter biden investigation has been overseen by trump appointed u.s. attorney david weiss. in the letter, he made it clear that he has ultimate authority over the criminal investigation. asked about the doj deal on tuesday, the president expressed support for his son. >> i'm very proud of my son.

>> reporter: and we are waiting for a date to be set for hunter to go to crt for his arraignment and to plead guilty. i want to emphasize everything about this deal is still subject to approval by a judge. poppy, you and i were talking during the commercial break about this deal and whether this is something that would happen to anyone else. but based upon previous cases, while no one is exactly like hunter biden, for someone who failed to pay taxes on time for the first time, and for someone who failed to disclose their addiction on a form when purchasing a firearm, especially in the wake of last year's supreme court decision expanding second amendment rights, asl as a similar case working its way to the appeals court, this seems like a pretty average resolution. diversion, which is what is getting for the gun charge, that is a common alternative to incarceration, especially when drugs or alcohol are involved. >> thank you smuch. standby. >> let's bring in legal analyst -- former assistant attorney for the southern district of new york and formefederal new

jersey state prosecutor. do you agree with that? there's nothing sweet about the steel? >> i do. if you bring it down this wa on the tax charges, nothing unusual. failed to pay his taxes r two years and later repaid them. you can't geyourself out of a charge by paying but giving a misdemeanor plea is completely within the norm. the gun crime is unusual in th virtually nobody gets charged with that partular crime to begin with, which is possessing a firearm while an addict. i was a prosecutor for 14 years and charged dozens and dozens of federal firearms cases in new york and never heard of that law. it is a lot but it is way down the list. the very fact that hunter biden got charged withs on its own, is unusual. on the other hand it is unusual to get charged with firearms crime and get pretrial diversion. but it is rare to see someone charged to begin with. >> something i thought was interesting is hunter biden's lawyer said, i'm paraphrasing, we consider this pretty much done.

assuming the judge signs off. the actualustice dartment, the memo or whatever you call it, says this is quote, ongoing and jim jordan is an example of a republican in congress who wants to know what ongoing actually means. what you think it means? >> i'm right there with representati j jordan. we need to do reporting to understand what that means because u.s. attorney david weiss put in his statement about this case, the investigation is ongoing. now too many of us, that read like boilerplate language. this entire deal is subject to approval by a judge and that file stays on, while he is on probation, while he completes his requirements for diversion and if anying goes wrong, right, the case can can go on. there could be additional steps because it would be highly e unusual. if they are still looking at some sort of subti matter, potentially to bring charges to resolve a case with a plea deal and bring those

additional charges, you want to make sure that you have all your chips on the table when you're trying to negotiate a deal and pressure someone. so that they are up against the potential charges. at this point based on talking to sources and experts, it appears it is the plate. but we are interested as representative jim jordan is in getting answers and clarification from the u.s. attorney. >> if i can add to what paula said, doj prosecutors are trained from day one. you call everything ongoing until a case is signed, sealed and delivered. that is the habit of doj, something th do to protect themselves. when we see the paperwork between the parties, i assure it will say everything that we as doj no, as of this moment, and there are no future charges. you would not ter a deal otherwise. >> one investigation we know that is ongoing th out any ambiguity is the house chippy investigation into all of this. they wanted more documents from doj. e they likely, more likely at the doj, to handover documents now that this deal has been reached?

light. if they've lost the ability to genete light within the vessel, it would be very dark. if they lost the ability to generate light, that's possible because they have had power issues and the inability to communicate, would also mean that they ve an inability to geraecessary he'd. it is going to be cold at those abs as well. there's not a lot of ambient heat coming from the surrounding environment. the air, circulating inside the cabin, would be probably, still, there wouldn't be cabin air circulation, which could also pose a lot of potential hazards, with just breathing the air. the oxygen is important, but also co2 generation by five people in this small, confined vessel, is going to be very challenging and potentially creating poisonous environment for the crewmembers. >> youentioned temperature and this is something i've been

because she ruled in favor of the former president last year dung the document investigation. cnn's kaitlyn polich joins us from washington, d.c. she says she expects there could be some movement here. how quickly do expect the date to but that depends on the work to do before trial and when it takes place. so there is a state on the calendar now, set by judge eileen cannon in florida, for essentially the back half of august when the trial is set, now. and now, there will be some discussions about that, that is very likely, it is expected and it typically happens in this part of the federal court in the southern district of florida. both sides get to go to her an potentially ask to delay things. if they need to. and she said that in her order yesterday. if there are complicated issues that arrive in this case or issues that are around the classified material being used in the case, there's 31 documents, many of them have some sort of classification

markings that are charged as part of this case. so there may be very complicated discussions that have to be hadefore trial, about how much classified information can be used at that trial, and how that will be handled. that could derail things andt is very likely that trial date will change. but of course, the justice department wants it to move fast. the special counsel said that. the day of the indictment, that they wanted to speedy trial. edited -- and is the defendant's rights to have a trial that happens faster they can clear their name without beg under a cloud of scrutiny for too long. so we will have to wait and see how this plays out. victor, there is no predicting court, especially when it comes to timelines. >> understood, we know that you will watch that quickly. this, new overnight, propublica publishing the latest in a series of investigations into the supreme court ethics. reporting in 2008, justice samuel alito went on a luxury fishing trip to alaska with

connection to some of these big cases. one of them is a 2014 case, one of singefunds, versus argentina, it had to do with sovereign wealth and sovereign debt. it ultimately grand singer over $2 billion. is it believable he really didn't know alito and his clerks didn't know the connection to these cases? >> it is hard to sayha in the justice' head, but i can tell you that paul singer's connection, to this case, was widely reported in mainstream media. you might remember, his hedge fund actually at one point to try to seize an argentine navy ship. this was an incident in 2012, covered in the "new york times", wall street journal. it was not a secret that this was paul singer's fund, being sued by argentina in the supreme court. >> justin, reading this op-ed, published by the wall street journal, justice samuel alito,

writes that propublica misleads readers. and talked about why there was no application to recuse but some of the things he points out, he writes that what you describe lavish evenings, he says while they were family- style meals, they were rustic accommodations. can you paint a picture here of what the justice was enjoying in alaska? >> yeah, i acknowledge luxury is in the eye of the beholder but what is not contested is that justice alito flew to alaska from the east coast, on a private jet, provided by the hedge fund billionaire, paul singer. in alaska, they stated a king salmon lodge, which at the time you know, they serve king crab, they are flown around the area on bush planes, to go fishing. we have pictures, you can see the fish and they flew back in

a private plane. drink, is in dispute but pretty much everything else, justice alito acknowledge. i think the important fact here is that when paul singer later had cases at court, justice alito did not recuse hself. >> so alito writes in his op- ed, his interactions with paul singer over the decades have been extremely limited. he describes them as more than a handful of occasions, all of which consisted of brief and casual cnts at events attended by large groups. on the location, have we discussed activities of his business and we have never talked about any cases or issues before the court. does that square with your reporting? >> you know, we talked to a series of ethics experts about when justices should recuse themselves and what it came down to ins case is the fact justice alito accepted private jeflights from paul

singer and this is not cheap. a one-way private jet flight on the jet we are talking about to alaska, could cost over $100,000 to charter the plane, justice alito did not pay for it. he did not reimburse paul singer, that is not in dispute. so the experts we spoke to say it is an expensive gift and if you are going up against somebody in court and you found out that the person on the other side had been flying around, a judge on a private jet, the basic question is, can the judgbe fair. that is the situation. >> you write in this piece, it is potentially a violation of federal law. that alito did not make these disclosures. i know the disclosure rule changed recently, justin, and this is part of the defense justice thomas gave as well. were those rules in place that

would require alito to disclose all of this, when it happened in 2008, for that have since been updated? >> he gets into the weeds but the law issued here, was passed after watergate. kind of the area of good government reform. the law has not changed. all the ethics lawyers we spoke to say getting a gift of a private jet flight should have been disclosed. justice alito maintains the filing instructns did not require him to disclose it. but, i will note as we say in the peace, we found examples of multiple other federal judges, disclosing guests of private jet flights at the time. >> really important reporting, everyone should read it. justin elliott, thank you very much. a development in the search for the missing submersible, underwater banging has been detected. what it means for the passengers on board and will rescuers be able to reach them, before they run out of air. .
