coming into cnn news central. just in, a new top level assessment on russia's war in ukraine, the military commander in chief of ukraine's armed forces says the counteroffensive against russia is going according to plan. but ukraine is reeling from an attack far from the front lines. five people were killed and several dozens were wounded in luvive, a city in the west with poland's border. they are calling it the deadliest attack in the lviv reemgen since the beginning of the war. before we talk about the attack there, bring us up to speed on the state of the counteroffensive. >> reporter: yes, we heard an assessment from the commander of you cranian armed forces who

from president lukashenko was that he could be used to defend belarus or train the troops in belarus. i'm not sure that the group you want training your troops is one with the brutality and absence of any of respect of the rules of war that we saw with the wagner group. and then the big question which knows beyond prigozhin himself is will he deploy the russian weapons as putin said? when is that going to happen? there has been some suggestion that it could hap p quickly, remembering that president biden will be in lithuania next week at the nato moting. it is -- i'm sure that putin is trying to think about what he can do around that time. then there is the worrisome expansion of some of the civilian casualties in the war. you saw the attack on lviv.

walt nauta for a moment steps out of donald trump's shadow and into a blistering legal spotlight. trump's legal-ade and now codefendant pleaded not guilty to helping his boss, the former president hide classified documents. but here's a twist. the arraignment comes after a judge unsealed more of the mar-a-lago search warrant affidavit which reveals prosecutors have surveillance video showing someone moved dozens of boxes before that fbi search. we want to bring in our legal analyst and former counsel to the house democrats during trump's first impeachment. kaitlin, first to you, tell us what we learned in the courtroom today. >> not a lot. it was really a short hearing but it is an important hearing. it is a hearing where walt nauta, finally after a month from the indictment of him and

12:20 pm
trial, the video of nauta moving the boxes which prosecutors say was done at the direction of donald trump. we get a document, redacted doegs or more redactions lifted from the document of the warrant in last august. the surveillance footage was extensive. there were four imnls around the storage room. you could see people moving behind a refrigerator which indicated they were going in and out of the storage room. they say this witness, now we know walt nauta, moving 50 or so boxes out on one day and then taking more out and not all of the boxes come back in. that's the reason they say that they need to search the property. >> from a legal perspective and i don't want to minimize the difficulties in this case and you have to prove it and so on to a jury. but if you have video of them moving documents. you knew they had been informed they needed to hand it back.
12:21 pm
this is taking place before the search. it sounds like they have a lot of pieces of the case together here. >> this may be the single strongest of all of the cases that have been brought or that are potentially on the horizon. you just have such damming evidence that is laid out in the indictment. now we have even more because of the lifting of the additional redactions out of the materials supporting the search warrant. you know, to the nauta question, it makes you wonder. deals never get better over time. why wouldn't he want to leave the trump train earlier to cut a better deal. perhaps he is gambling. perhaps donald trump is gambling on a return to the white house where the pardon power or simply trump ordering the department of justice stand down on this

prosecution is available. it is puzzling, the loyalty that nauta has shown particularly since it seems overwhelmingly likely, they have video evidence. >> well, it is also possible the justice department isn't interested in offering him a plea deal or walt nauta thinks he could take it to trial and win. >> i have never known in 30 years where they would not want to make an offer of some kind. it is not always a sweetheart deal. maybe nauta has to serve some jail time but even a moderate amount of jail time is better than the high risk of decades in jail. he can testify to having an insider say yes, if the government proves its case, donald trump ordered me to do that. that would be devastating. >> that would be remarkable. decades in prison is a quite a penalty to face.

there has been frustration bubbling up in the freedom caucus over the last few months. it boils down to the fact that she has become one of the biggest allies of republican leadership. she publicly criticized some of her freedom caucus colleagues for not supporting kevin mccarthy for speaker. she criticized her colleagues for the backlash they gave kevin mccarthy for handing out a debt ceiling deal and blocking the house floor. the real straw that broke the camel's back corg to andy harris, a member of the freedom caucus, was that the last week before the recess, there was a confrontation between green and another member of the freedom caucus where green admitted that she called lauren bobert, a little b-word. she did confirm that she said that on the floor. and i want to say what a colleague said earlier, i think
12:33 pm
the way she referred to a fellow member is not the way we expect. a lot of this boils down to some personal and internal issues between members but there is a broader identity crisis happening inside the freedom caucus on whether they want to be a group that just stands up to kevin mccarthy at every turn or if they want to play the inside game. >> really interesting development, thank you for the report from capitol hill. a new report has found that the strict texas abortion law may have led to nearly 10,000 more births than expected there. coming up, we will speak to a doctor in texas on what they are seeing. police still investigating after a block party ended in deadly gunfire. more than 130 rounds fired. new details on another shooting ahead.
