♪ welcome back. we have some breaking news just in to cnn. a jury in the uk has reached a verdict in actor kevin spacey's sexual assault trial. he has been found not guilty on all counts of sexual assault. i want to bring in salma abdelaziz. this verdict coming out a short time ago. what else are you learning? >> just moments ago, rahel, and this has been a riveting case that has taken the jury nearly four weeks to hear what has been astounding evidence with kevin spacey defending himself against 12 charges that were brought forward by four men. those were later dropped down to nine offenses. i'm speaking about very serious charges here. three cowunts of indecent assault, one count of sexual assault and one count of
7:01 am
engaging in sexual activity without consent and one count of engaging in penetrative activity without consent. he has now been found not guilty of all of those charges, rahel. this will, of course, be welcomed by kevin spacey and his lawyers. he has said throughout this trial that he welcomes his day in court. he welcomes the -- in 2000 and 2010, a period in which kevin spacey was the artistic director of the old vick theater here in london. the prosecutor, of course, bringing forward these accusations of the young men who at the time were in their 20s and 30s described spacey as a sexual bully saying he delighted in making others feel powerless. of course, kevin spacey hit back in court, yes, i was a big flirt and a promiscuous person and
7:02 am
went on to describe the encounters as fun, flirtatious and denying that, and found innocent of all 12 of those charges and this is huge for kevin spacey and said he hopes to be found innocent and hopes to get his career back. >> salma, this was a four-week process, and a four-week trial and remind us who testified of the alleged victims and what we learned about the relationship between the alleged victims. spacey now being found not guilty, but the relationship between these people and spacey? >> now, the rules will not allow me to name those victims, rahel, and that's very, very important. we are not going to identify them in any way. these are alleged victims of sexual assault so they absolutely cannot be identified by us, but these are four people who knew kevin spacey well. one of them was a driver who alleged that kevin spacey at one point while sitting in his vehicle grabbed his penis with
7:03 am
such force that he screamed out in pain. this was an allegation dating back nearly 20 years ago. another was a young actor who also was aspiring to learn to have kevin spacey as a mentor. he described being drugged by kevin spacey. that was his allegation against this award-winning actor and said that oral sex was performed on him without his consent. again, these are just absolutely horrifying and riveting tales. the prosecutor in this case, brought these cases to life, brought them to a juror of 12. what the issue is when you're looking at these cases is that this jury needed to find kevin spacey guilty beyond a reasonable doubt, and that seems to be the conclusion, of course, with them now finding him not guilty of any of these charges that that was not the case, dating back to these charges. some of them again, nearly 20 years old and very little
7:04 am
physical evidence there. it really became a matter of he said-he said in court with the prosecutor trying to paint the picture of a powerful actor in a great position of influence. of course, kevin spacey, as the artistic director of the old victor -- of the old vick, rather, who tried to take advantage of that position, and kevin spacey and his lawyers hit back and said that was absolutely not the case. yes, he was a flirtatious person and yes, he was a person engaged in the youth scene in london, but he never, as he says, never engaged in anything untoward with these men. >> that conclusion coming down and that verdict coming down moments ago. salma abdelaziz, we so appreciate you bringing it out to us. john? >> at this moment hunter biden is inside a federal courthouse where he is expected to plead guilty to two federal tax misdemeanors. he arrived a short time ago. biden will plead guilty for not paying taxes on time and a

felony gun charge. this probe began in 2018 and examined allegations of money laundering, foreign lobby and other potential charges throughout its course. with us now is evan perez and sara murray, what are we expecting to see over the next several minutes if has not already begun? >> we expect that the hearing is getting under way right now there at the federal courthouse in wilmington. this is a five-year investigation and in the end what prosecutors are agreeing to as part of this deal with hunter biden is that he's pleading guilty to two misdemeanor counts related to his taxes, not paying them on time in 2017 and 2018. as part of this investigations, investigators also found that he had purchased a gun during a time that hunter biden says he was addicted to drugs and therefore making him -- making that purchase an illegal purchase. as part of that he is going to agree to abide by certain
7:06 am
conditions and at the end of which if he satisfies them and if the court is satisfied he will -- the federal government will get rid of this felony gun charge, something that obviously, this is a case -- obviously, that has now become highly politicized and it's just a matter of where you think the politicization comes from. if you talk to republicans, they believe that this investigation was politicized by people inside the justice department. now, of course, they are making this the center their effort to go after the current, sitting president. what we expect, though, at the end of this, john, is that the prosecution is going to suggest that hunter biden serve no prison time as a result of this. now there's a very bizarre little sideshow that happened just in the last 24 hours where the federal judge yofr seeing the trump appointee, by the way.

republicans that even if this signals the end of hunter biden's legal problems, it will not signal the end of the political headaches for hunter biden or joe biden or the rest of the biden family. one thing republicans want is they want to get testimony from david weiss, the u.s. attorney overseeing this probe. he said he would agree to testify in september or october. they want to know essentially what the avenues of the investigation he covered included. they wanted him to answer more directly than he has in the letters with the allegations of political interference and it's clear that this fodder over the biden family business dealings is building a potential campaign for joe biden impeachment and we heard the most important words from kevin mccarthy so far. take a listen to what he said. >> the more of this continues to unravel it rises to the level of inquiry. what that simply provides is that the american public has a
7:09 am
right to know and this allows congress to get the information to be able to know the truth. >> now republicans haven't been able to prove that joe biden benefited off of his son's business dealings, that he was involved in all in his son's business dealings and they believe impeachment may be another mechanism for him to do so, john. >> sara murray, thank you so much. evan and sara, keep us posted because this is all in the federal courthouse right now. elie holding and from southern district of new york. counselor, the expectation is that the judge will sign off on this probation for two tax charges. do judges always sign off, federal judges on plea agreements? >> almost always, but not always, always. it is up to the judge whether he or she, in this case, she wants to accept the plea agreement, but 99.something percent of the time when you go before the court saying we, the
7:10 am
prosecution, has agreed with the defense and the judge will accept the plea and move forward with sentencing at some point later. why could the judge reject the deal to anticipate your next question? >> you're asking my follow. >> first of all, the judge could not be convinced that the person is guilty. the judge will listen to what hunter biden says and if the person hasn't fully admitted to the crime she cannot accept the guilty plea. another possibility is if the plea is simply inadequate. i had one very close call in my career where he thought we as prosecutors are being too lenient with the defendant and he put us through the ringer and made noises that he was not going to accept it. the point is the judge has the final say as to when she accepts it. >> how much does the letter from the house ways and means committee to the judge have? >> little to no influence, i think. it's not really the judge's concern here whether politicians
7:11 am
think that there's some other universe of fact. the judge needs to constrain herself to the charges as they're laid out in the judging instrument, in this case it's called the information and not an indictment because the parties agreed to it and bigger picture to whether this is a reasonable and appropriate outcome within very broad parameters. sara outlined what is happening inside congress. hunter biden, if this is all agreed to will be under probation for some time, the prosecutor here has also said things that make one wonder about whether or not there are still any other criminal investigations still going on. what's possible to continue on there? >> yeah. so this is sort of a standard thing that prosecutors will say and any investigations is ongoing until the moment when the sentence is done and when the appeal is done and this is the question that the whistle blowers have been raising and the claim made by the irs agents who worked on the cases is that there were certain investigative avenues that were unduly, prematurely headed off and they
7:12 am
were told you cannot look down that avenue. the u.s. attorney trump appointed who has been in charge of this case has now agreed that he will testify in the fall and that is the key question. >> what else would david weiss be asked about and how much would he be willing to say? will he open all of his books in the investigation? >> he has to be careful and i think he will be careful, and i do not think he'll get into the nuances of the investigation. what investigative tactics did you use? did you seek a search warrant and that kind of thing. i think he can answer the following questions. one, how did this take five years? i've not heard a reasonable answer from anybody and for the record, there's no way this case should have taken close to five years. did you, david weiss have complete control over this case. he has said in a letter i had complete control and that was a distinct question from, in your capacity as the person who had complete control, did you shut down any lines of inquiry, and

7:15 am
this lawsuit today is going to factor into that and also, rahel, he is trying to still find a way to eke out some sort of win or at least something that doesn't hurt him too badly in this lawsuit. one of the things that he wants to say is he shouldn't be held liable for the damages that these women suffered or that they say they suffered meaning he won't have to necessarily pay them if he is able to convince the judge of that. he wants to try and claim that what he's saying after the election is protected speech. so opinion, largely, more so than fact, but here is what those women had to say according to their house deposition when congress investigated. >> i've lost my name, and i've lost my reputation. i've lost my sense of security all because a group of people starting with number 45 and his

investigators are wrapping up with their search after coming up with boxes and boxes of items from the home of suspect serial killer rex heuermann. they found a lot of evidence inside of his long island home and that includes 279 weapons found inside of a vault. heuermann is accused of killing two women in 2010 and authorities believe he may be linked to more murders. i want to bring in trial attorney misty maris. always good to see you.

this is an investigation that seems to grow and grow and grow. when you heard the detail about all of these weapons inside of a vault, what was your reaction to that? immediately, i thought now law enforcement and investigators are going to be looking at whether or not these weapons have been involved in any other crimes. remember, this was the first time that they searched heuermann's home. we heard that this home was cluttered. we heard that this home had a large backyard that appeared to have some disturbances and now we're hearing that there was a vault with a cache of weapons. the purpose now searching the home, there are several different buckets. first, we have anything that connects heuermann to the three victims that he is being charged with a crime. we know there's a fourth. he's a prime suspect in the fourth. those are the gilgo four. now we learned there are property in other states so are there other crimes he could be connected to or missing persons
7:33 am
cases? now the second part of that is we now hear about all of these weapons? are there other crimes that these weapons could have been involved in? law enforcement went into the home under the presumption and thinking that some of the murders could have occurred there. so what evidence remains after all these years? did he keep trophies? is there dna? there's a whole slew of things that can come out of the search of his home. >> misty, as you know, heuermann has said that he has not done this. you are a defense attorney. what could a possible defense here be? >> i would expect the dna analysis to be attacked. we don't know what comes out of this search now. we only know what was in the probable cause affidavit and one of the things that linked rex heuermann is mitochondrial dna, there are hairs on the bodies that belong to his wife and one that belongs to him and as a defense attorney you are always going to look to undermine those

findings with respect to dna with expert, but keep in mind, he had been observed and followed for over a year before he was arrested, but during that time law enforcement did not want him to be keen to the fact that this was happening. so now with this search of his home, it's going to be interesting to see what else comes out of that that links him to these crimes and of course, as defense attorneys are going to try and develop those defenses after reviewing all of that evidence. >> misty, stand by because i want you to listen to an interview my colleague anderson cooper had with a woman who went out on a date with the suspect in the summer of 2015. this is what she said. >> he seemed almost like too excited to talk about it, and then once he did start talking about it, it didn't seem like a true crime fan who has seen information who watched tv or read and it seemed like someone who was re-living it.
