we hope you get that excited about this show. let's begin with a dramatic day in court for hunter biden. when the judge refused to accept a plea deal for the president's son. >> reporter: hunter biden walked into the federal courthouse expecting to put a five year investigation behind him, instead he left with his plea deal hanging in the balance and pleading not guilty to the charges. the judge scrutinized what was covered under the terms. that revealed a disagreement
12:03 am
between prosecutors the immunity but hunter's lawyer said they thought it was more expensive. they came back and agreed to the narrow immunity deal but that agreement did not work either after the judge questioned if it was constitutional. the judge said it was not straightforward and she questioned whether it was constitutional. after more than three hours the judge told biden that she was sorry but she could not let him plead guilty to a deal he did not understand so she is giving both sides 30 days to break the case. >> let's talk all of this through with are great guest, elliot williams, john avalon, and political commentator scott
12:04 am
jennings. did the judges objection have to do with the terms of the deal or does she have a problem with it under the law? >> all of the above. we talked about this yesterday, judges can not approve plea agreements if they think something does not smell right. the whole point is to ensure that the defendant's rights are protected and he knows what he is pleading guilty to. the whole point is that she felt perhaps the gun diversion thing set him up for future prosecution that would violate his rights as a defendant. i have never seen it happen before. often they will send you to a back room and say you do not seem like you are fully in
12:05 am
agreement and you can usually go to a conference room and work it out. i never had a plea agreement get blown up like this but it can happen. >> i want to ask you scott, hunter biden has been under investigation for five years, what else can they find? do you think there is more there? >> part of what was going on today i think is this concept that he may still be under investigation for his foreign business dealings. i think he walked in thinking he would be protected from all of that and that is not the case. from a republican perspective there is more hunter biden to know. that is why republicans are talking impeachment inquiry because they feel like they
12:06 am
need extra tolls to get to the bottom of the pedaling. from a republican perspective there is a lot more. >> the presidential candidate chris christie tweeted tonight about hunter biden, saying i have seen enough, we need special counsel that has jurisdiction over any and all biden family investigations. appoint a special counsel that will investigate with confidence and independence. >> chris christie is trying to shore up his right flank with this. we need to remind folks that weiss is a trump appointee that oversaw the investigation into hunter biden and he has disagreed with the reports of whistleblowers. what happened today is a blowup of something that had been long planned and it is unusual. these charges are about taxes, it had nothing to do with
12:07 am
foreign influence peddling, that is a separate topic but apparently they are all conflated. >> the question was, is there more to learn and i think republicans think there is more to learn and he is still under investigation. that is the connection between him and the president. did you enrich your family or follow registrations? that is a separate matter. >> totally separate yet they thought that it was somehow intertwined. >> the judge made this decision, i assume they are working this out? >> they will take up to 30 days to brief the issues and write some memos to the judge. we will see. >> i am tired of talking about this until we see something new.
12:08 am
you know i am right. the grand jury in the trump case is expected to meet tomorrow. >> what is the story? >> it is happening tomorrow supposedly but we were expecting the grand jury together yesterday and they did not, where are we now? if they meet it does not mean there will be a indictment tomorrow. >> not necessarily but in order for there to be a indictment prosecutors need to get to a grand jury and present evidence. i think what we will be watching to see is if they meet, our prosecutors there and is there a indictment but it could be imminent after they get together. let's talk about rudy giuliani. i want to go to you. he has conceded that he made defamatory statements about these two election workers in georgia. ruby freeman and moss, watching
12:09 am
them testify was hard to watch, their lives were put in jeopardy, they were being citizens and doing the right thing with their job. he has now said this. >> ruby freeman and shea moss and one other jenna meant quite obviously passing around usb ports as if they are vials of heroin or cocaine. it is obvious to anybody that is a prosecutor that they are engaged in criminal activity. >> i wanted to remind people that it is not true in these two women suffered because of it, he is saying he is protected by free speech, is he? >> this is about defamation. this is demonization and public
12:10 am
scapegoating. what giuliani alleged today is baseless. i worked with him many years ago. there is very little to no resemblance to the person i worked for, he was one of the most respected prosecutors. he said this is about stopping discovery which would be a mess in the case of rudy giuliani but it is a concession in effect that all of those accusations made publicly were lies. >> what can they do about it? will he face some sort of punishment? >> i think he might. he is trying to minimize how much trouble he can get in by owning it. the problem is, that is potentially evidence and other lawsuits and he admitted to a
12:11 am
central part of what would be a defamation claim that you admitted you were lying. it is a bizarre strategy to be candid. >> it is about containment, he is trying to contain the damage for possibly financial and other reasons. >> by the way they are not public figures. humble servants of our electoral system, it depends on people like these women to show up and volunteer and make little money to execute the elections and be treated the way they were was a abomination. whatever can happen to him, he deserves every bit of it. they are not public figures. >> they are now unfortunately. >> it is his fault and it is unfair and there needs to be consequences. >> we will see what happens there. next, warnings from three built military veterans from

12:23 am
he literally walked on a gun charge and i think they are realizing what is going on in these committees and i think they are paying attention to it and the judge realizes there is more to this and this is a bad deal. >> would you vote for impeachment when it comes to joe biden? >> from the evidence i have seen i would. you are talking 10 million, money from china -- >> there is no evidence -- even though there is no evidence that we have all seen that was put forward from the congress and gop, that there are very clear ties between hunter biden's business dealings and joe biden. >> let me correct you on the fbi's informant, not the

looking at the electrical patterns in the heart. at least the snapshot ekg from a couple of months ago we are told is also normal. if you add to that, that he was in the icu but let out quickly, that is another good sign. that means he was stable and he did not find anything unnerving. these are all good signs, they still have to figure out what happened which probably means putting a longer-lasting ekg monitor to look at the electric pattern of his heart over a long period of time to see if there are abnormalities. the picture is increasingly looking better for him.
