for the first time. he's in the same city as vladimir putin. this is cnn "news central." all right. we have breaking news. a grand jury spotting. this is at the federal courthouse in washington d.c. cnn has seen jurors and prosecutors who have been working on the case the investigation into donald trump surrounding the 2020 election. this is the first time we have seen them there this week. cnn's katelyn polantz joins us. with what could this mean? >> reporter: any time the federal grand jury looking into january 6th, any time they gather in the courthouse, at this time they could be asked to approve an indictment

specifically one against the former president, donald trump. that's because 11 days ago, donald trump got the target letter from the justice department indicating to him that he was likely to be charged. you're right, the grand jury was not in earlier this week they met a couple on times last week and saw a couple different witnesses that they had spoken to throughout the day who gave them testimony. but now we are waiting to see what happened. our own casey gannon is over there watching the courthouse. she has seen not only the grand juries coming in to that secret proceeding convening this morning but also seen a person working with the special counsel's office over there at the courthouse. so now we watch to see what else might come today. will there be other witnesses? who else could the special counsel's office want to talk to still for this grand jury. there have been so many witnesses who have gone in, including mike pence, the former vice presint under trump, many top people from his white house

such as mark meadows, cassidy hutchinson, pat cipollone, his white house counsel. and that doesn't include the fake electors who have testified, the state officials who have spoken to the special counsel's office. so a lot the grand jury could be looking at and we are waiting to see exactly what they do next. >> what we know is they are there and for there to be an indictment they would have to be there to vote so we are on indictment watch. it may not happen. we don't know. katelyn polantz please keep us posted. you'll be, working today, no doubt. rahel. new numbers coming in this morning on the state of the u.s. economy and they show the u.s. economy grew at an annualized rate of 2.4% for the second quarter, better than expected and shows no signs of a recession. i want to bring in christine romans to break it down. better than expected. becoming a bit of a theme here. what does it tell us?

>> picking up from last quarter. the economy picking up speed, so many people are saying our word to watch is recession but the r word is resilience. you have exports and consumer spending accounting for this. consumers are still driving the economy and american factories are churning out goods we're sending overseas. this is two things to help. this is despite inflation too high and punishing interest rate hikes. we had another one yesterday, another 25 basis points. what that means for everybody watching is that the money you borrow is more expensive but also the money in your bank account is getting a higher interest rate too. so that's how we feel the higher interest rates but it's quite surprising. the u.s. economy still doing so well despite the higher rates and inflation that is cooling but still too high. >> we heard powell talk about the resilience of the consumer. talk to me how it fuels the economy, we have a strong labor

market, that could be feeding a lot of what we see. >> that's right. when people have a job they feel confident in spending their money. we know there are all these open jobs in america and a tight labor market still. that's an important under pinning. we know american consumers have more money in their bank account today than they did before the pandemic. they're spending down the savings but they're in better shape than before the pandemic. with the excess savings, child tax credits, those things boosted the bottom line for people and one of the reasons you've been seeing such strong consumer spending. another thing there's this warp effect from covid. people may be pulling back in some areas but spending on things they want to. the "barbie" movie, beyonce con concerts. you saw united say their profits tripled because people are still

going on trips. >> and remarkable. adding another r word to it remarkable. >> my favorite r word is romans. >> what about rahel! >> it's a tie. ruh-ro clearly as the case may be. cnn has leadrned that mitch mcconnell has fallen multiple times this year. it comes after mcconnell froze during a sentence in his weekly news conference. manu raju is on the hill this morning with the new reporting. what are you hearing? >> reporter: i'm told by multiple sources this has happened on multiple occasions this year. mitch mcconnell is 81 years old, walks with a slight slip, is a survivor of polio from his time as a child. has had issues walking much of his life and is more pronounced this the year. it's been at least three instances we know of this year

through our reporting and the one public one that occurred in march en he fell and hit his head, suffered a concussion, broke some ribs was out for six wes. but two other incidents happened asell. one in february when he was traveling overseas with a u.s. delegation to meet with the president of finland. as he was getting out of his car walking, it waa snowy day, he slipped and felled. he was not injured. he where brushed himself off, didn't seek medical attention and continued his meeting. then another one that occurred this month when he was getting off the plane at reagan national airport. he was walking off the plane and he did fall as well, i am told. after that incident he returned to the capitol and continued his work day. this all game before the incident we saw yesterday in which senator mcconnell was at his press conference, made some remarks and suddenly froze for

some time. and then came back and later answered questions, including one from myself asking what happened there. he said he is fine. he later told reporters again he's fine but he did not explain what happened. what was the root cause of the reason he froze and whether it had anything to do with that fall from earlier this year, any other lingering health issues. his office had said that he felt light headed, which is the reason why he stepped aside at yesterday's press conference. but no doubt questions continue to persist about the 81-year-old republican leader. he said he's fine but how long will he stay as republican leader and in his seat as his term expires at the end of 2026 and leader until the end of this congress, what about the next congress? >> i know there's concern about senator mitch mcconnell outside of politics as well. people want to motorcycle sure he's doing okay. omar? a lot of scary factors there. joining us now is dr. sanjay

gupta. sa sanjay, obviously you're not there in person, this is not someone you're treating you're not able to see everything you could if you were treating him in person. but from your point what are concerning factors you see? >> that video is important to look at. i imagine his doctors would look at that to see if they could see any clues as to what happened there. it's concerning, omar. no question. anyone can see that. if you look at the timeline, to give context, it happened just before 2:00 yesterday. he was essentially speechless in that state he wasn't doing anything for 23 seconds before someone asked him if he was okay, and then it was 32 seconds before he was lead away from the podium. at that point he was moving on his own, which is a good sign. it was a long episode with a

quick recovery. that's important. it could be a lot of different things. it could be common things, just dehydration, medication interaction, feeling under the weather. but the thing is, with something like this you have to rule out potentially more problematic things. was this a mini stroke, something known as a tia, or a mini seizure, which is something that can look that way as well. so that's why it's concerning. and it needs to be checked out. he's probably been seeing his doctors all along, you know, especially since march. but that was an episode that was quite obvious yesterday, omar. >> and as manu raju reported, sort of documenting previous instances maybe not to this degree is obviously something else their doctors will likely be keeping an eye on. dr. sanjay gupta thank you so much. rahel? coming up for us, plea deal on pause. the future of hunter biden's plea agreement up in the air as

a many mess. where does that leave things this morning? >> reporter: the end of the day ended with hunter biden pleading not guilty to those charges with his plea agreement up in the air. the judge telling both sides, the prosecution and biden's team, they need to do work they have 30 days to file legal briefs on this. there were two agreements one for the tax misdemeanor charge that was the agreement he would plead guilty to two charges. she had questions about the scope of immunity and poked holes in it, revealing a disagreement between the prosecution and biden's team. she wanted them to solidify what in that. she told hunter biden she knew he was eager to wrap it up but she wanted to make sure he understood the terms of the deal. so that was something they're hammering out, limiting it to the tax charges, gun charges and drug use charges not a blanket

immunity for everything that the government has been looking for the five years. but also she had questions about the gun diversion, the deal where hunter biden would essentially avoid prosecution for possessing a gun while he feels addicted to a controlled substance. he's been very public about his struggles with cocaine and other drug abuse. so she wants legal briefings on the issue of whether she should play a role in this. she said most of the time the diversion agreements are between the parties but both sides wanted to give her a role in case there was a dispute if he breached it. she was saying she's not sure as someone in the judicial branch she should have a role in the executive branch function. in some ways this could be good news for hunter biden to make sure this deal is solidified and couldn't be challenged if there is a change in administration

but it's not where they expected to be. so 30 days to file the briefs and we'll see if the judge brings everyone back here or if she rules on the papers. john? >> it has to be an uncomfortable time for everyone involved. this is not what they were expecting at all. thank you so much for being there. rahel? >> this morning several republican members of congress are aiming to capitalize on the confusion surrounding hunter biden's plea agreement. this is after being critical of the deal. i want to bring in lauren fox up on capitol hill. good morning. so what are you hearing? >> reporter: yeah, yesterday we talked to a number of conservatives, close allies of former president trump who said the reason it fell apart was because it was a sweetheart deal to begin with. there was a nuance to what the judge's concerns were with this deal. here's what one republican, matt ga gaetz said to me yesterday.

>> i guess when analyzing the hunter biden plea arrangement, one would ask the question would you take an inoculation if it didn't deter the virus. in this case the virus for hunter biden is more severe than a few tax filings. indicting hunter biden over tax issues would be like charging jeffrey dahmer with littering. >> reporter: there's questions what republicans are going to do from here. obviously republican leaders are talking about opening up an impeachment inquiry into president joe biden. obviously there's no direct tie they've been able to show between president biden and his son hunter biden. but the house judiciary committee wants to hear from david weiss about the investigation and weiss has said he doesn't want to talk about an ongoing investigation, which he made clear yesterday in court was still ongoing but he wants

to clear up some of the misconceptions brought to the forefront by some irs whistle-blowers he's saying. so there's a huge question mark of where house republicans go after this. but what you saw from this yesterday is they were saying this fell apart because it was a sweetheart deal. >> as you point out a huge question about who the justice department could make available if, in fact, this process is still ongoing. lauren fox live on capitol hill, thank you. bottom line, the u.s. district judge is the one who controls the fate of hunter biden's plea deal. she was appointed to bench by donald trump in 2017 with democratic support is. this isn't her first case, earlier this year she tossed out part of a defamation lawsuit about hunter biden's laptop. as for her political spending it's been bipartisan. she's donated more than $15,000

to candidates dating back to 1999, in 2008 she gave $1,000 to hillary clinton's question to become the presidential come knee but later donated 2,300 to john mccain. and she stuck with the republicans in 120z 2012, giving to mitt romney's bit. tom cotton is on her list. as well as the democratic campaign in 2009. >> a mix. with us is jessica roth. i want to start tecat the end, counsel, if i can. you have the lawyers who need to fix things. how hard will it be to uncomplicate this situation and get it back before the judge? >> the judge sent them to home to hammer out a deal to be explicit for a deal for hunter

biden. i thought it was really important that the judge identified there has not been a true meeting of the minds about what immunity he was being given. and that's really important because if there hasn't been a meeting of the minds then hunter biden could back and say his plea was not knowing and voluntary and seek to withdraw it. or if the government sought to prosecute him for crimes he thought he was protected from, there could be an argument such were barred by the plea agreement. so i thought it was important the judge identified that issue. it looked like by the end of the hearing they had a meeting of the minds. on the other issue whether or not she could play a role with respect to whether or not he satisfied the conditions of the preferred prosecution agreement, that's something they have to brief for her to her satisfaction if they want to stick with that term. she raised a constitutional question based on separation of powers. they'll have to gok back and look at the law.

this is an important point she raised. if they can't satisfy her they may to take out that part of the agreement. >> or make it prosecutors who oversee the program. >> that's usually what happens, it's a prosecutorial decision. but i thought hunter biden's attorneys made it clear to have this neutral party in the event the department of justice is under a different administration. >> i know people are looking for possible political motivations one way or the other here. when you look at what happened do you see politics at play or administration? >> i don't see politics. i see the judge doing her job as a neutral, involved judge. making sure the plea agreement was clear, it was going to be a knowing and voluntary plea if it went forward and making sure there were no legal flaws in the agreement she was asked to sign off on.

i thought she was diligent, reflected she took the job seriously and i didn't see any issues with politics. >> i know both prosecutors and hunter biden's team wanted to walk out with this thing signed and finished yesterday but did, in some respects, she do people a favor? maybe both sides? >> i think she was right to flag the issues she did. if it had gone forward without her having identified the fact there was not a meeting of the minds but the scope of the immunity, there was going to be a question down the road about hunter biden seeking to withdraw the plea or raising issues if there's future prosecution. it's good she ironed these out. >> was there a ball dropped? i was going to say who dropped the ball but that assumes there was a ball dropped? >> it was surprising there was an issue not hammered out -- >> you say an issue this is the issue. the scope of the immunity when you're forging an immunity deal is then thing. >> it's not clear what happened.

same summit putin addressed this morning. nic robertson is following it for us this morning. how significant is it given what prigozhin led not too long ago at this point? >> reporter: where putin said there were going to be severe punishments and the punishments seemed to be that prigozhin was going to be sent to exile in bel belarus, where he was seen giving his group who's there a pep talk a week ago. but here he is back in russia. we know that bill burns has said that he's aware that prigozhin is in belarus and moves in and out of russia. but here he is in a high profile position. i think one of the things we can take away from this is that prigozhin, boss of wagner, that has kremlin-backed interests in some african countries, central african republic, sudan, mali,

just to name a few, is putting out a clear public statement he's still in business with these countries. this backs up what he said to an african broadcaster earlier this week saying wagner is going to do business in africa. the only thing we can't do is cut across russia's national interest which appears to be the slap on the wrist from putin for the mutiny. but the fact he can be in public mixing with the dignitaries pushing wagner's interest perhaps speaks to the fact that wagner and the kremlin and prigozhin himself are so tied together in these business interests, gold, diamond, other things in these nations that putin cannot untangle him that fast. we don't know the limits of the constrains that have been put on wagner. other than he's running out of some cash according to the

about from ukraine? >> reporter: we don't know how many they have actually committed from their reserve forces but this is something the u.s. and western officials have been waiting for because the ukrainians could not commit all of these reserve forces until they managed to make more progress in getting through those mind areas and, of course, punching through the russian defensive lines. the mine fields here have been a challenge for the ukrainians and prevented them from funneling the troops in that they wanted to. so at this point the u.s. sees it as a sign that the ukrainians have found a moment of opportunity here. and they are taking advantage of that. taking advantage of the fact that the to have made some progress against these really dug in russian defensive lines and are funneling in additional reserve forces many of whom have been trained by nato and the west in had these sophisticated combined maneuvers

cohen. there's an emergency in d.c. explain to us what it means, what can you tell us? >> reporter: there is that hot weather emergency. that's why if if you look around me the national mall is empty this morning. we would expect it to be more crowded but the extreme weather is coming through. if you look it already feels more than 90 degrees out here on the national mall but that number is going to go up dramatically in the coming hours. d.c. could hit 100 degrees for the first time in seven years and with the humidity the real feel the heat index is going to be closer to 110 degrees. today, tomorrow, into saturday, no relief until sunday. so the mayor has declared the hot weather emergency. they've launched their cooling centers, activated them and putting five public buses they rented out around the city to be mobile cooling centers for some of the most vulnerable people

here in the district. people living unsheltered, seniors, low income families that might not have access to air conditioning. as you look around me, many of the people we're seeing out here today are workers. these are workers who right now you are seeing on breaks. people who are landscapers, construction workers and that goes to a decision, an announcement made today by the biden administration which has asked the department of labor to issue the first ever hazard alert for heat. what does that mean? that means they are asking the department of labor to essentially take a more pro active approach to go out and do enforcement, make sure that workers are getting enough breaks, water breaks, time in the shade, they are not put in danger when they were out here in the elements because work doesn't stop for them as part of that biden administration announcement they have announced funding for better forecasting and better clean water supply. >> it's an interesting point because you often hear try to limit your time outdoors, stay
