revolt is seen smiling entering a building. what is going on here? i'm john berman with rahel solomon and omar jimenez. this is cnn "news central." at the hour, the grand jury hearing evidence in the special counsel's efforts against donald trump and his allies to overturn the federal election loss has been seen with the special prosecutor entering the courthouse moments ago. and we go to katelyn polantz, and when we spoke tuesday, the grand jury was not in, and what does it mean that perhaps they are meeting today? >> well, rahel, any time this grand jury convenes, they could be asked to look at and approve the indictment of the former

president, and is something that we largely expect to be coming, because the justice department has told donald trump that is going to be coming. they sent him a target letter 11 days ago that in the election around the 2020 election, they are charging him with the obstruction of the congressional proceeding or obstruction in some way, and they are also looking at the conspiracy charge, conspiracy of defrauding the united states as well as a charge related to depriving the people of rights, and very likely the right to vote in some way, and so we don't know what the charges will be here at this grand jury who has been at work relentlessly and at work every tuesday and wednesday with witnesses and last time they were in last thursday, they had two witnesses before them, and one of whom had their interview and the testimony ending in a way that was very abrupt and

unpredictable and dramatic and not sure what we were left at. the grand jury proceedings are secret and the testimony is secret and that indictment is secret until it is approved and handed up in the court system, so we are waiting to see what happens next since this is the first time that the grand jury is in this week. they skipped the regular date tuesday and now that they are here, the prosecutors or at least some of the people associated with the special counsel's office are here as well with the courthouse and we just wait to see what materializes following that target letter and this year's long investigation into january 6th and the aftermath of the 2020 election. >> we wait to see who comes and goes at the courthouse. katelyn polantz, great to have you there. john? >> to be clear, we will be watching that closely, and await any updates and could be very busy on that front.

meanwhile, lawyers for hunter biden are going to try to clarify the plea agreement put on pause for a federal judge, and she called it unusual and even at one point asked if it was constitutional. we are joined by cnn's sara murray where we are on this dramatic front. >> yeah, john. it was not the day in court that anyone was expecting to get yesterday. i mean, hunter biden walked into the federal court in delaware expecting to plead guilty to two misdemeanor charges and he would sign a deal to plead guilty to federal gun charges, but then it went awry. and politico obtained a copy of the plea agreement, and this is a look at the problem. it agreed not to prosecute biden outside of the terms of the agreement for any federal crimes

outside of the attached and any future conduct by biden or any of his affiliated businesses, so the judge asked the prosecutor, is this ongoing prosecution, and the prosecutor said yes, and he said, could you bring something like a foreign lobbying charge, and the prosecutors said yes, we believe we could, and this is when hunter biden's attorney said, then the deal is off. so they reached a new understanding, and came back to the court and told the judge that they would proceed, and the judge had more questions about the gun deal that he could avoid this felony charge, and ultimately the judge said she did not feel comfortable ak sepgt or-- accepting or rejecti this, and she wanted to make sure that what hunter biden

would be getting according to the plea agreement, and so there is a 30-day delay. and so we will see what the judge decides in 30 days, and what happens. he decided to plead not guilty while this is in pro forma limbo. >> okay. get back to us with anything new in regards to that, sara. and now, going to the deputy assistant general attorney at the doj, and elliott, great to see you in person, and start here with hunter biden and the rejection of this plea deal, and how significant is this? a run of the mill deal on the big stage? >> it is not run of the mill, omar, because it is not common for a judge to toss out a plea agreement. it is common for the judges to ask parties to come back to work

something out. and now, to be clear on the plea of guilty, it is common for the defendant to know what rights he is giving up, and this is to not be charged with the same crime, but it is not clear that he was aware of that or the justice department had made him aware of this, and do not violate this defendant's rights down the road. >> can this be fixed? >> they can, and i'm surprised it was not worked out yesterday. but in 30 days on laptops and on zoom, they can work out the parameters of the plea deal, and most of the cases end up in pleas. >> and now the oversight committee has heard from two whistle-blowers saying that the justice department has criminalized the plea deal, and this is what one of the whistle-blowers told cnn this

morning. >> as far as this investigation goes and the part of the testimony, we did not follow the normal process, and we did not follow normal investigative leads that we want to follow as part of the tax investigation. tax investigations are quite complex, and we interview a lot of the witnesses, and you have to follow the money. example in my testimony is the sister of joe biden is his sister, and we were not allowed to interview that sister. >> from who specifically. >> and that came from the assigned is prosecutor -- >> and the justice department have denied any claims like that, but could that testimony play any role in this plea deal case? >> not plea deal case, but it is fair game for congress to ask questions about this, and this is what i did for many years at the justice department working the legislative affairs and congress can look into the questions of have the justice

department politicized or looked into any plea deal, and they want to testify in a few months and ask those questions burk as a former prosecutor, often there can be disagreements as to what agents want to do and the prosecutors want to do, but again, it is the kind of thing they can hammer out in a c congressional hearing and if it is a fair one and not a political one. >> and then over on the donald trump side of things with the actions trying to overturn the election, and there is a grand jury meeting and possible third indictment, and what does the grand jury say to someone like you or someone like me, and how close to approaching this process? >> we have been close 11 days ago when donald trump received a letter that he could be charged with a crime. so the mere fact that they are meeting for the first time this week is significant that an

indictment could come, and we have been on notice that an indictment could coming soon. >> and so we will keep an eye on this, and many people across the country. elliot williams, thank you so much. john? perfect time to talk to the cnn political director david chalian, and great to see you. i wanted to ask you about the hunter biden plea agreement, and this is before we saw the grand jurors walking into the courthouse about a possible indictment against donald trump, and the fact that both of these things are happening before our eyes, and how does this scramble the presidential race? >> yeah, i think that the two things are quite different politically most likely here, john. the hunter biden investigation obviously it was not welcomed news that it is going to drag on and he remains under active federal investigation for the

white house or the president. certainly not welcomed news personally and not politically even though, and we have to say two things can be true. this is going to be an ongoing political headache for him, and there has been no absolutely reporting or evidence to connect any of this to president joe biden the man who is going to be on the ballot and those two things can be true together. the point about donald trump and the grand jury meeting ten days about and the letter, and the team seems to be poise and expecting yet another indictment coming their way, and we have seen that, and we have a couple of incidents of case history here from manhattan and the first federal indictment in the documents case that he has a playbook here, john. he is able to rally the troops, juice the grass roots donations and keep the competitors at bay despite he may be indicted on federal crimes related to the very fundamental principles of

our democracy trying to overturn the election. >> and people may say whether it helps or hurts him to blocking out the sun when it comes to the attempt to reset the campaign of ron desantis and laying off one-third of the set and trying to remessage the staff, and yet he says things that are raising controversy in the republican race in his own primary like yesterday when he was asked about robert kennedy jr. whether he might be a possible running mate, and instead of a running mate, he offered another possibility. listen. >> yes, the medical stuff, i'm very good on that, and that does appeal to me, but there is a whole host of other things that he would be out of step with, and if you are president sick him on the fda or the cdc, but in terms of being the veep, 70%

of issues that he is adverse to the base on, that creates an issue. >> and again, robert kennedy who has been a vaccine skeptic though he claims he is not anti-vax, and he claims that he is not saying that he would put him in charge of the cdc, that is raising concerns among some people, but on the republican side, mike pence and others said that you would employ robert kennedy jr. who is pro choice, pro abortion rights, and that is a problem, too, and it seems that desantis tries to appeal to other voters and creates problems for himself. >> yes, you are talking about the reboot, and that is to me, the perfect example that desantis loves to throw the chum in the water and then ginning up the controversy, and he knows that saying something like this about robert kennedy jr. is going to get the tongues wagging, but it opened up a right for him with competitors like mike pence to make hay, and

even if you may agree with the outland ish pish positions on t vaccines is, he is not somebody that a republican president should have in the administration kind of thing. so i think that we still have to see to your point about the desantis reboot how real it is, because ron desantis doesn't seem to be changing his ways all that much. >> you are a young man, but we have covered the campaigns for a long time, and this morning news about the economy that was plain positive news. there is still solid economic growth, the recession that was long predicted does not seem to be materializing, and i'm old enough to remember when economic news like this would be a real boost for the incumbent, and how much of a factor does it play in this campaign? >> i mean, it is likely going to be a factor, and we know that the economy is this backdrop to political decision making for voters, but i would note, john, white house, and the biden

re-election campaign is frustrated that he doesn't, he, the president, he does not seem to be getting the political credit the way from americans that clearly just really good economic news that you pointed out, and this is why they have reframed everything in the bidenomics messaging, and have him out there on the trail of what he has accomplished as president, but what is happening in the economy that we are seeing as a recession is not front and center and inflation is easing, and they will claim that it is due to the policies. you will hear it time and again, because they are not giving up on leaning up with it even if they are not giving the political credit they wish they were, but in the long run, it is something to potentially benefit him. >> thank you, david challenge i -- david chalian, thank you.

into donald trump. we already told you that the grand jury is meeting today in washington for the first time we believe this week. it is necessary they meet if they are going to vote on an indictment, and so we are watching to see if that potentially happens today. we know that trump received a target letter 11 days ago, and in the meantime, and this is new, the sources tell cnn that donald trump's legal team is requesting a meeting with special counsel jack smith. let's go right to katelyn polantz, and obviously, katelyn, there is stuff going on, and what is the latest? >> there is a lot going on, and what evan perez and jamie gangel and i have learned is that the attorneys of donald trump have

learned after receiving that letter is that he is likely to be indicted, and they have done one of these before after he received that target letter with documents, and they went in and made their argument to smith and others in the justice department, and it was not successful. donald trump was indicted there, and this is the sort of meeting that often that a defense team is given the opportunity to do whenever they have a client that is told that they are likely to be indicted. in this situation, this january 6th investigation, there is a lot of unsettled law here, and the attack on january 6th, the events after the election were so unusual, and also, donald trump as the target of this investigation, he would not be a normal defendant if charged, because he was president at the time, and a lot that they may be want to argue to jack smith to

persuade the justice department to move forward on a criminal case, however, donald trump, himself, he did not want this meeting, because he thought that after he got this target letter it was a done deal and he would be indicted. now we have the wait and see, john, how this comes together today, and the grand jury here is meeting at the courthouse, and any time they are together, they could be asked to look and approve an indictment against donald trump. >> is it a noble thing of whether there is a meeting today, if that would impact the timing of a possible indictment? >> john, it could. i mean, the last time that donald trump got this target letter, there was a 20-day window between donald trump being told that he would be indicted and then him actually getting indicted and the meeting that they had was at the

beginning of the week, and the same week they went to the grand jury to ask them to approve that indictment in florida, and so it is a question of whether the justice department is going to request these lawyers to dissuade them from bringing the case and time to think it over or some sort of conclusion that merges out of the meeting if it does happen, and if the justice department does allow the trump lawyers to come in to meet with them, and tell them at the meeting that we have considered all of the arguments and ready to move forward and we just don't know, and of course, we won't have a full window into that meeting unless it happens potentially that we may hear from the sources after it happens, but the justice department is closed lipped on this, and we have asked them for comment, but they have not said anything. >> okay. katelyn polantz outside of the courthouse, and as i el yoquent said, there is stuff happening there. and so, whatever it is, we will

here, and perhaps the people are heeding the warning from officials who said that if you can stay inside, and the temperatures is in the mid-90s in termsf h of how it feels, ant may hit 100 here for the first time in 70 years, and it is going to be feeling close to 110 degrees today and tomorrow, and the mayor has declared that the state of emergency for washington, and that means that they are extending the hours right now for their spray parks and the swimming pools and also activating ing centers. part of that, they are renting five public bus, and much like this one behind me, and st stationing them around me as mobile cooling centers for people around the district for

the homeless, families and seniors and around the national mall, the people here are workers who are out and have to work in the elements even though we are approaching 100 degrees and it may feel like 110 later today, and the next hour president biden is expected to make an announcement on several measures related to extreme heat including the department of labor to issue a heat hazard alert to make sure that the workers like these are safe and get water breaks and breaks in the shade so we don't have tragedies like the ones that you mentioned before. >> and gabe, this is serious, but did i actually see someone running in this heat? are you seeing people out and about exercising? >> no, only a handful and i will say that we saw a bike tour going by, and that is amazing as the weather is warming up, and people say they want to go out to exercise, and they want to do

going over every single nominee held up and talking a lot about their qualifications and why they should be promoted. we should reiterate that tommy tuberville's holds don't block the senators from going forward with the process, but it is making it extremely difficult to move quickly, and the democrats have chosen not to bring up the nominations one by one and burn the floor's valuable time, and saying it is affecting the military, but so far, tommy tuberville is not backing down, and they believe it is going far past the august recess. they do not believe it is going to be worked out in the next several hours or days that the senate is working through the national defense authorization bill, and it is going to be prolong and protracted problem, and tommy tuberville is dug in, and despite the fact that a number of bipartisan groups have come to him with off ramps there

is no resolution in sight, john. >> no resolution in sight. lauren fox, thank you. rahel. >> john, thank you. i wanted to continue the conversation with kate who is a military spouse and the president of a nonprofit who created a petition who urged tuberville to stop playing politics. when you hear "no resolution in sight" how does that make you feel? >> hi, thank you so much for having me. it makes me feel incredibly frustrated. we are already in this time of limbo, and the military families are waiting to go to the next duty station, and to hear it is not moving on is incredibly frustrating. >> help us to understand how this impacts the military

families. >> absolutely. first, the senator has said something like it only impacts these 270 nominees directly. i will speak to why i don't believe it is true in a moment, but i wanted to point out how callous and cavalier how that is and if it only impacted these folks, but this is the best and the brightest military accomplished leaders and the ones that the younger in the forces look up to, so they are playing with the folks who have literal ly dedicated years to or country, and it impacts entire community, because we are seeing the military lives put on hold and so it is not happening in a vacuum and it is very discouraging. >> the military office received the petition, and he said that he is pro military and that why he is doing it, and he doing it for all of the right reasons,

and you have seen his response. so if you were sitting across from him at the negotiating table, what would you say? >> i would ask the senator the please listen to military leaders and yes, to military families and we are telling him about the impact on the community, and it is really politicizing folks who are super apolitical and just want to serve the country and defend the constitution, and serve a cause greater than themselves. he is politicizing folks who just want to do their jobs. >> with no resolution in sight, what are you hearing from the military familiessh a -- families, how are the families preparing? >> our position has been very, very positive, but hearing that no resolution in sight is going to be very discouraging, and for the folks especially in limbo. when they get an assignment, we spend months preparing and

researching and the possible outcomes of where we could be moving and people have moved out of their homes and living in hotels to wait to know whether they are going to a new duty station or if they are staying where they are, and so much out of their control. they have done everything right, and it is time for the senator to end his protest. >> what is happening with the august recess happening. >> the marine commandant is unconfirmed for the first time in over 100 years and we expect the joint chiefs of staff to be vacant and it is going to be a whole sense of uncertainty for the entire community to see these very, very important positions left vacant. so, you know, i hope that there is some sort of resolution soon, and i would ask again the

states that prigozhin is interwoven with wagner mercenary group interwoven with the kremlin have been backing with the african country such as mozambique, and libya and a few, and the quid pro quo was access to minerals including gold, including diamonds. so this is kind of a in a way what we are looking at is part of prigozhin's get out of jail free card, because putin said there is going to be severe consequences of your mutiny and now here he is seen doing business with the very countries that he was doing business with in africa at the behest of the kremlin in the past. is he being rehabilitated or some leverage that he has with putin? it is all clear. he is not dead, and if he went
