the stock market is expected to break a record that has lasted more than 100 years. sara and kate are off, and i'm john berman with rahel solomon and omar jimenez. this is cnn "news central." and we begin with the breaking news. lawyers for former president donald trump meeting with jack smith right now as a potential third indictment looms, and the grand jury is hearing evidence on evidence to overturn the 2020 election, and also lawyers meeting inside of the federal courthouse. katelyn polantz is there outside of the courthouse, and this is a big development. what more are we learning about this meeting? >> right. so this meeting is occurring as the grand jury has convened here at the federal courthouse in d.c., and this is a grand jury

investigating donald trump for the 2020 election and january 6th, and this meeting is always a possibility out there, but it was very unclear if something like this would happen. looking back at the time line, and 11 days ago, donald trump was told that he is very likely a target in this investigation, and he is very likely going to be charged with the crimes around his behavior after the 2020 election as he was trying to undermine the vote, and then there is often an opportunity given to the defense lawyers to come in and make their appeals essentially to prosecutors as to why their clients shouldn't be indicted, and our team of reporters, we have been able to confirm this morning that the meeting is currently happening. the trump lawyers are meeting with special counsel jack smith and his team to talk about this looming set of charges against the former president that have not been approved yet.

how that meeting resolves is going to be something to watch rahel, and on top of that, we are going to be watching this grand jury who have been work for months and heard for many, many witnesses and they were in since last thursday to be wrapping up, and now the question if there is more evidence to be hearing and if the justice department with that meeting to be happening with the trump lawyers, will they want to present the possible indictment about the former president at this time. >> it is interest, katelyn, that they have the opportunity, but not the obligation to meet, and so it is interesting that they are taking opportunity. katelyn polantz, thank you outside of that courthouse. i want to bring in paula reid, because what do we know about what the trump attorneys plan to hear? >> they are going to hear that he going to be indicted.

he had the opportunity to go before the grand jury, and these are all of the steps that precede an indictment, and highly unlikely given all of the time and resources that has gone into the investigation that his lawyers are going to be changing the hearts and minds of these prose prosecutors. if the former president is charged either today or next week when the grand jury is back, these defense attorneys are going to be coming up with a strategy to defend their client while he continues to campaign for the presidency. what we have seen in the other criminal case brought by the special counsel down in florida, the mar-a-lago case, the trump team is in the mind to delay, delay, delay until after the 2024 election and it is unclear if it is successful, and clearly a trial on the calendar for next year and unlikely for the date to hold, but at this point, we have to wait for the charges and not expected to deal with the complicated matters like

classified materials to be reviewed, but we have to wait to see what, if any charges, will be assessed and push any trial until after the election. >> and until late may we have to wait and see what is going to happen there. john? >> and joining us is democratic congressman eric swalwell of california. he was also an impeachment manager for the second impeachment trial of donald trump, and now we know that donald trump's lawyers are meeting with the federal prosecutors right now, and what do you think is going on behind closed doors and any chance of talking him out of an indictment? >> john, i was actually a local prosecutor to work with local grand jurors, and what to do is to give them the last best chance to make your case of why an indictment should not occur,

and also, in many ways to offer the target of the investigation an opportunity if they have any evidence and if they want to sit before the grand jury to do so, and so if there is any questions if an indictment comes down as to the fairness here. >> what do you think that the most likely charge is to find success here against former president trump if in fact an indictment is handed down. >> being responsible for aiming the mob at the capitol, and being in the capitol that day and counting votes of the people, we were stopped from doing that, and it was a terrorizing experience to leave the capitol in a gas mask, because donald trump sent a mob to descend on the capitol. and so he could be indicted for inciting a crowd, and also, the way he publicly talks about things, i would not be surprised

if there is an obstruction of justice charge, but taking a step back, like every defendant in america, he is to be entitled to due process and not treated any differently than anybody else. >> and so, we didn't know whether or not there would be a criminal investigation or are you surprised that it would take so long to get to this point? >> i credit the january 6th committee, because only once they started to animate, and you know, we didn't have much evidence impeaching him other than what he had said at the rally, and we went immediately into the trial, and so i think that we laid the groundwork for the january 6th committee spent over a year and a half bringing in donald trump's colleagues, and to bring in the motivator for the doj to say, we may need

to take a closer look at this. >> so if donald trump is charged, he should be treated no worse or better than any other defendant, which is what people have said about hunter biden, and you and everyone else watched as the plea deal was put on hold by a federal judge who called the terms of the plea deal and some of the words were called unusual and atypical. do you think that a plea deal like that would have existed had it been for, you know, hunter brown instead of hunter biden? >> well, it sure looks like it. i will tell you about a guy named roger stone who owed allegedly $1 million in back taxes, and the doj went after him civilly and not criminally, and i don't want hunter to be treated worst. he is a private citizen by the way to resolve this case, and he has paid the back taxes, but the judge wants to make sure that both parties are understanding what they agree to, and come back to in two to four weeks to

resolve this, but hunter biden has tried to accept responsibility, and no democrat said that we should burn down the rule of law and that the prosecution is rigged, and we accept the outcome, because that is how the rule of law works, and that is not what you are seeing from donald trump. >> you were a state prosecutor, and worked in the d.a. office, and worked in the federal -- >> yeah, i did the real work. >> and that is the job that i know that you held as a one-time presidential candidate, and what was the platform when you launched your campaign, because once again, it has come into focus with the age of president biden and the age of mitch mcconnell, and you and everyone else share the concern of the health of mitch mcconnell, but this is what you said when you were running for president four years ago. >> i was 6 years old when a presidential candidate came to the california presidential

the hottest month on record ever. it is this one. july 2023, and the scientists are sure that these temperatures are the warmest that the planet has seen in 120,000 year. an emergency alert has been issued by the nation's largest power grid from michigan to north carolina, and nationwide, 150 million people under heat alerts. and maricopa county, temperatures hit 115 degrees and 18 people have died from the heat so far. we go to the steamy washington, d.c., and gabe cohen is there, and gabe, give us a sense of how awesome it is there. feeling awesome this morning? >> well, john, i have to tell you that the good news is that we have a lit cloud coverage this hour, and the breeze is coming through according to the not so scientific measurement, and it is feeling about 90 degrees, and if you are looking quiet here on the national mall,

but we are seeing some folks coming around, and people wandering through, and the bike tours and thing like that, and the temperatures are expected to spike, and spike dramatically and quickly this afternoon, and it could be 100 degrees here in washington for the first time in seven years, and with the humidity feeling closer to 110 degrees, today, tomorrow and even into saturday. the mayor here is activating emergency center, including renting five public buses, and the public buses including the one that just passed us is going to be stationing across the district for the most vuler inable -- vulnerable people who might not have access to emergency management. >> we are very concerned, and those are the health risks and mitigating them are paramount, and we want people to stay hydrated and have people to make

>> well, rahel, in about an hour, the president is going to lay out how he is trying to help the communities to deal with the extreme heat which is rolling out new actions to help the communities to protect themselves from the extreme heat. as gabe just mentioned, one of the items is asking the department of labor the issue a health hazard related to heat, and specifically trying to ramp up the enforcement to protect workers who are working in conditions where there is extreme heat. extreme heat is the number one cause of the weather related deaths in the country, and many of the jobs affected are farm workers and construction workers and delivery workers, and additionally, the president is rolling out $11 million funding through noaa to improve weather forecasting, and another 152 million to expand water storage, and enhance climate resilience which is aimed for states like

california and colorado, but the president has been pointing to these weather events where they are exacerbated by climate change, and that is what he is likely to discuss, and meeting with the mayors of san antonio and phoenix who has been hitting the record levels in the temperatures yesterday. >> and san antonio and phoenix so hard hit in the last three weeks, and arlette saenz in the white house for us. and republican leader mitch mcconnell is back on the hill today after he froze mid sentence. and today, no signs of any aftereffects, and we have learned that he has fallen multiple times this year. chief correspondent manu raju is on the hill right now. and manu, this is your reporting as well, but of course, mitch mcconnell is speaking today. >> yeah, he is, but he is not

answering any questions about what exactly happened yesterday. i asked him about that at the press conference yesterday, and he did freeze for some time, and came back to answer questions about a fall that was highly publicized where he did hit his head and broke some rib, and he was out for some week, and he did not explain the root cause of that fall. but i have heard that there are two more falls, one of which occurred in february in hel sin ski wh t senate president fell and got back up, and continued with the meeting. there was another one in regan airport where he fell and got back up, and came back to the capitol and came back to work. only the fall in the washington hotel caused serious injury, but nevertheless, a number of questions from republican

senators. and also, how long will he continue the lead the conference that he has been the longest serving senator as leader. and i put the question if he should continue as leader of the conference in 2025? >> well, you heard him respond to questions yesterday. he was crisp in the answers. >> reporter: but is there enough support for him to stay as leader in the next congress? >> he has a tremendous amount of support. >> reporter: even in the next congress if he ran for leader, he would get the job? >> well, i think that is speculation that is not necessary right now. >> reporter: but it is very -- >> it was very icy at the time, and it could happen to any of us. >> and do you think that -- >> well, any of us could take a fall, and i'm older than 50, and

so it is a concern. >> reporter: that last comment from senator ted budd who was on that trip, and he witnessed him falling, and he got back up, and continued the meeting. but john thune's comments there at the beginning of the meeting and i asked him again after he left that meeting if mcconnell should run for leader again in the next congress, and thune said that he is not worried about the next congress, but what was happening on the senate floor, and thune could be one of mcconnell's potential successors, and so a bit of speculation there, and mitch mcconnell says that he is fine, and he will continue on, but there is a question as to how long he will continue on. >> at some point they won't be able to avoid it. thank you so much, manu. rahel. >> we are following developments

vote on an indictment. in order to have an indictment, they are going to meet, and they are meeting. we are watching that closely. while that is going on, we have learned in the last several minutes that donald trump's lawyers sought a meeting with jack smith's office. they got to meeting, and they have been meeting behind closed doors. so there is a lot at stake here. and there could be some moves that are imminent. let's get right to cnn's evan perez, and you have new information on what the trump team was hoping to get out of the meetings that we think that are happening at this minute. >> that is right, john. look, we are watching closely every single black suv that comes out of the offices, and that is where we are at, at this point, and it is that the meeting has wrapped. we are just trying to verify whether this meeting has conc concluded, but the reason that the trump team was looking for this meeting is to kind of make

a hail mary pass here to try to persuade the special counsel that now is not the time to do an indictment, and at least a few more weeks, and if they don't get the indictment today, they are hoping that a few more weeks, they can get between now, and when an indictment comes. now, the former president has a political and legal strategy, and they are kind of one in the same -- delay, delay, delay. they want to push it off as long as they can, because it is going to bring it closer to the time of the primary voters, and the republican primary voters are going to begin to have their say. we have a first debate coming within the next month, and so they know that the justice department is up against the clock here, and it is putting the justice department in a position whereby prosecuting president biden's chief rival at a time when the voters are going to begin to have their say, and

the strategy here was to ask the special counsel to consider a few more things before making a decision on the indictment, and it is possible, however, today, that this grand jury will vote. they are there, and they took the early lunch according to casey gannon who is sitting there at the courthouse, and watches every move. again, watching and trying to determine what might happen today in the next few hour, and certainly the big item today was that meeting that happened with the special counsel team, that trump team asking for it, and receiving it, and really trying to make the case that there should not be an indictment at least not today. >> and the meetings like today happened with the mar-a-lago case, and the investigations, and prosecutions -- >> they just don't get this kind of scrutiny. >> well, they don't get this kind of scrutiny, and maybe trying to slow it up, and gum it up is a strategy, but a possibility here, evan, thinking, that well, if the

so far today. and i want to bring in elliot williams, former prosecutor. and today, two things are happening today, and the grand jury is happening right now, and they may be in an early lunch break, and donald trump's lawyers are meeting with the jack smith team, and is it possible that if they went to vote on the indictment, they would say, wait, you have to wait, because we are meeting with trump's lawyers also. >> i don't think they would wait because they are meeting with donald trump's lawyers. it is not like a wedding where you can't see the bride before the wedding. it is not uncommon to meet in advance of the grand jury proceedings, and the defendant's lawyers have every incentive to try to talk to prosecutors to say, look, this is why i should not be the invest day or the's meetings. i bet that trump's lawyers are saying, you had this whole

fracas with hunter biden and now, why would you want to do this today? they would try to have this last-ditch effort here, and it would be remiss not to go talk, but not much is probably going to come of it. >> and if you are on the prosecution's side, and saying is, hey, i want to pack my briefcase with this indictment that i want the grand jury to vote on, and anything that defense team could say to keep you from having that happen? >> not at this point. they have been building the case for a long time, and the defense has had the prosecutor's phone numbers for the last several month, and they could have had the meetings at any time along the way, and nothing other than, hey, prosecutors, here is a stack of thousands of pages of documents that exonerate my client, and it exonerates my client, and someone else did it,

and that would be something like in a drug case or something. >> and say they wanted to gum it up, and find out the logistics of the indictment, and maybe the shape of the indictment, and they can ask, but tell us the nature of charges. what would happen here? >> well, you got a target letter of the three crimes, and they would reiterate that he could be charged with any of the three or all three. and so, the deal is the classified documents and involved months of litigation, but this is a case that could go to trial in a few month, because it is a civil rights case, and the conspiracy to construct the government case, and all of them are relatively straight forward and proving that it did or did not happen. the documents case in florida, they have to litigate all of the sensitive case of what you are going to do, and sod trump's

lawyers would say, put this in the back of your minds, because they believe this could go sooner. >> and with the mar-a-lago case, there was an indictment handed up, and then there were details that started to leak largely from the trump side, and characterizing the nature of the indictment, and then ultimately jack smith's team released details there, and do you, and partially, because they wanted to clarify what was in there and they didn't want a narrative out there from one side, and given what they have learned how quickly if there is an indictment do you think that they will make clear to the american people, all of us, what is in it? >> it is important to release it soon enough, because the risk of the justice department to state to the lawyers today early what the charges are going to b and then the trump's lawyers have every incentive to say, this is what our client is going to be

reacceleration in some measures and resilience in others, and we are seeing the consumers continue to spend, and the businesses start to invest again, and all of that is contributing to what is a pretty strong pattern. >> and for people at home trying to understand, well, make it make sense how a few months ago, we are expecting a recession, and now suddenly, we are not, and is the labor market powering consumer spending, and what are we seeing that didn't happen? >> yeah, i think it is the labor market is the most important key here. you know, we have very low unemployment, and 3.6% which is the lowest in half a century, and that is really contributing to a backdrop where the consumers are taking home pay checks, and wage gains, and inflation is slowing down, and families are feeling more confident and going out spending, and that is adding up to the situation where this economy has retained more oomph than anybody thought it would at this stage. >> and stronger than jay powell

thought that it would be at this stage. they raised rates again yesterday, and what is the forecast looking like going forward and how much did they say about that? >> yes, so interest rates at 5.5% at this stage which is the highest that we have seen them since 2001 and very high relative to what we have had over the last couple of decades, but it is seeming that the fed is nearing the end of that road. they think that the rates are high enough to weigh in on the economy, and they may inch them up, but at this point, we are not expecting anymore massive increase, and that means that loans are not going to be more expensive and near to the point where this process is over, and the adjustment is getting to the end. >> and jeanna, to the folks sitting it out hoping that the mortgage rates come back down, and the fed does not influence the mortgage rates, but it is
