to delete security camera footage to keep it away from a grand jury. prose prosecutors say that maintenance worker lied to the fbi when he said that he didn't help move boxes around the florida resort. prosecutors also added a charge against trump for willfully retaining a top secret document detailing plans for a military attack on iran. they say he showed it to bying on griefers at his golf club in 2021. >> this was the defense department and him. we looked at something. this was him, this wasn't done by me, this was him. and all sorts of stuff. pages long. isn't that amazing? this totally wins my case, you know, except it is highly confidential.

>> more now from paula reid in washington. >> reporter: new charges and a new co-defendant for former president trump in the criminal case alleging that he mishandled classified documents down at his mar-a-lago estate. now, prosecutors have charged him with an additional count of willful retention of national defense information as well as two additional counts of obstruction alleging that the former president and two of his employees attempted to destroy surveillance footage from mar-a-lago from the summer of 2022. that surveillance footage is at the heart of this investigation. it is key evidence for prosecutors as they try to put together where exactly classified materials were moved on the mar-a-lago property after the former president left office, but we also know that witnesses have been asked if anyone tried to prevent them from getting all of the surveillance footage or if anyone tried to tamper with it
1:04 am
or sdestroy it. according to the indictment, two trump employees wanted to sdoi this surveillance footage because, quote, the boss wanted it gone. now, the new charges were filed not only against former president trump and his co-defendant walt nauta, but they added a new co-defendant carlos dio live aura, and he has been seen on footage moving boxes including an incident where they moved boxes out of a storage closet right before trump lawyers went to certainly it for classified documents. carlos is represented by a lawyer who is paid for by a trump linked political action committee. his lawyer tonight had no comment. they will appear in court next week. and trump denies all the

charges against him. and calling it nothing more than a continued desperate and flailing attempt by the biden crime family and their department of justice to harass president trump and those around him. new charges against the mar-a-lago maintenance worker came as a surprise to many people elie honig explains how they likely came about. >> this individual would only be added to the indictment if jack smith and his team believed that they could prove that he acted knowingly and intentionally, mean thaeg wasn't simply following orders with no concept that what he was doing was against the law. presumably jack smith believes that he has prove beyond a reasonable doubt that he intended to break the law. whether obstruction of justice or some other charge. the other thing to keep in mind, the more defendants in this case, and this would be a third defendant along with donald trump and walt nauta, that is now one more person with an even

more powerful incentive potential throw cooperate. but behfore this, there was nothing to threaten him with. and now if and when the charge comes through, this person will have to make a decision do i fight this charge and risk potential jail time or do i help my own bottom line by cooperating. so this gives jack smith and his team potentially more leverage and donald trump one more thing to worry about. benjamin netanyahu is making no apologies for pushing a right wing agenda that has infuriated thousand hes of israelis and put a dent on his popularity.hes of a dent on his popularity. g emotions were high in tel aviv as they protested against the government's actions. but he says this is a minor correction and not down fall of

israeli democracy. >> in israel, the supreme court has a lot of checks but there are no balances. for example on the decision that we pass ordered on reasonablene understand what that is, it is like that the court can nullify a decision by saying it is unreasonable. not because it is illegal, not because they are using other checks that they have, plenty of things that they can to. they can -- like the supreme court would be able to nullify an appointment by president biden not by saying that there is a conflict of interest, that there is undue process, that it is not proportional, that all exists in israel, but just by saying we don't think this is reasonable. that doesn't exist in america, it doesn't exist in most democracies, not to this scope. and that is the minor correction that we that that is now called the end of democracy. if that is the end of democracy, there are no democracies because

none of them have this. >> and elliott gotkine is joining us. so many are asking what happens if the supreme court strikes down netanyahu's new amendment. and constitutional crisis that that might bring. >> reporter: and that is one of the questions that he declined to answer directly. he simply gave examples of how it would be unheard of. he did have a point in that respect because the israeli supreme court has never before struck down one of israel's so-called basic law, these quasi constitutional laws. but it has accepted seven petitions to hear, to look properly at this law to decide whether it can stay or whether it should indeed be struck down. and i suppose one interesting aspect of that, i mean, it could take weeks or months, by that time of course the government could have prevented other

elements of its judicial overhaul which could again be scrutinized by the supreme court as to their reasonableness or as to their legality as well. and what we've also heard from the leader of the opposition national unity party, and he has said that if netanyahu were to not abide, if the government failed to abide by a supreme court decision striking out or striking down the new reasonableness bill, then that in his words would amount to a coup. so very strong words coming from the opposition. of course it is all -- we don't know this way the supreme court will go, we don't know which way the government would go if the supreme court were to rule against it. it could say the law is perfectly fine and that could take wind out of sails of netanyahu's oopponents. but for now the supreme court can no longer strike down decisions or appointments on the grounds of reasonableness.
1:10 am
whether it will stand long term will depend on the supreme court justices decisions which they will begin deliberating on in september. >> whose job is to resolve any deadlock if it does occur? is it the president? >> we'd be in unchartered territory, so i don't want to start suggesting this or that would happen. but it would be unprecedented for the supreme court to strike down the law and it would be unprecedented for the government to refuse to abide by it. earlier this year one of netanyahu's allies, head of the religious party that represents many jews, he has been convicted three times, most recently of tax fraud and the supreme court said that it was unreasonable for netanyahu to make him a minister. what we could see in the short term is netanyahu trying again to appoint him because that decision can no longer be struck down right now on the grounds of reasonableness. and that is something that netanyahu indicated he might do

we're getting word of an alleged ukrainian drone attack near the russian capital. russian defense ministry says one drone was shot down in the moscow region without causing damage or casualties. cnn can't independently confirm the report. meanwhile the counteroffensive is keeping up the momentum after kicking into high gear in recent days. new video shows ukrainian troops rolling in to a village thursday after fighting for it for weeks. and for the first time ukrainian military vehicle was detected,

might be caught in the crossfire. the u.s. says for its part that it has received assurances that ukraine will only use them in legitimate targets on the frontlines in a limit ed way an the u.s. says that it is just a temporary measure, that the munitions that ukraine needed weren't readily available and in the meantime they are giving cluster munitions to ukraine which just a few days ago are already starting to be used on the frontlines. there is evidence as well that russia is using cluster munitions as well so sort of calling the kettle black here, but it does continue to be a controversy, but of course nothing very shocking about saying that there is just crumbs left. we very much understand that russia/american relationships are at best just crumbs left. and it comes as ukraine ramps up its attacks outside the battlefield. we're talking about the drone attacks today. in the past ukraine was reticent to claim any attacks on russian

occupied territory, but increasingly they are being becoming more vocal saying yes, we're he caming out these attacks and we are trying to weaken russia's military outside the bounds of that battlefield. >> doesn't that help the putin narrative that the country is under attack? >> it does in many ways. this brings the war closer and closer to russians inside russia, but that is sort of the point i think for kyiv, that russians shouldn't be separated from this conflict. we know that thousands of russian troops, russian soldiers have come back in body bags. we've seen how a partial mobilization some months ago, you know, instigated mass rallies against the government. we've seen a few weeks ago of course the attempted mutiny on moscow. i think at this point ukraine is very much wanting to make sure russians are not sheltered in any way from this conflict,

whether that is economically, whether that is seeing the mobilization of the soldiers at the frontlines with very little training. >> salma, thank you. day two of the russian summit with african leaders is under way. president vladimir putin trying to erase concerns of countries losing out on grain shipments. he is promising food supplies for six countries and that russia is still a reliable source and key partner in a new multipolar world. and a number of african leaders say they want to discuss their plans for ending the war in ukraine. let go to our correspondent david mckenzie. how is all of this playing out there? >> reporter: well, you look at those pictures, which are quite extraordinary, all the african leaders with putin, the family photo as it were, meetings in st. petersburg. and i want you to look at this video as well.

this is president of south africa arriving at the summit, warmly greeting vladimir putin. and this is significant because he took several senior ministers to that conference and despite multiple african leaders staying away, the south african president is there. many people have scratched their heads, south africa an important cog in the overall space in africa and its role in criticizing at times the u.s., siding at times according to western diplomats with russia and we investigated where there is anything behind the foreign policy. south africa's policy on paper is not alignment on the ukraine war. but its actions have deeply angered western powers, consistently refusing to condemn russia's invasion of ukraine at the u.n. general assembly.

afternoon. most of the heat has shifted into the midwest and northeast. and even for new york city all the way down through philadelphia and the like, we will have this excessive heat warning for friday. that is all part of a heat index that will be 105. now, the good news is for most of the east coast cities, this is only a brief warm-up. short heatwave, not a big long heatwave like they had in the west. but still 200 record highs will be set across the united states just from now to the end of the weekend. chicago, you have one more hot day and then the cool air gets there. could there could be some showers and storms around too when you start to break the temperatures from the 90s all the way down into the 70s, st. louis, you could get some thunder and lightning as it transition with the cooler air comes down from the north. but i don't like 102 on the thermometer. rnl wit warmer when you add in the humidity. and 96 in d.c. for the next couple days.
