he is still the gop frontrunner, but are these legal troubles going to leave an opening for the other candidates. and now, the climate is pushing the power grids to the limit. with rahel solomon, i'm john berman. this is cnn "news central." well, hours from now, donald trump is going to take the same campaign stage as his republican rivals as the legal peril takes a serious turn as there are new charges in the classified documents case. special counsel jack smith says that two employees walt nauta and carlos de oliveira tried to conceal evidence at his request. de oliveira says that the boss

wanted the server deleted, and now there are new details that at times and minute-by-minute time line of the events including what allegedly happened right after trump was told that the surveillance video was being subpoenaed. so according to the indictment, nauta who was scheduled to travel with illinois the next day changed his travel schedule and made arrangements to go to palm beach, florida, instead. this is as trump is preparing for another criminal indictment to drop. evan perez, a lot has happened in the last 24 hour, and fill us in. >> absolutely. absolutely over the last 24 hours. we have now learned that the former president and the co-defendants essentially have committed new crimes according to the justice department after the justice department asked for surveillance tapes from mar-a-lago, and here is what the prosecutors allege according to

the new superseding indictment released yesterday, that the former president and two of his employees walt nauta who is already charge and a new co-defendant whose name is carlos de oliveira, that they and the former president discussed a way to delete the surveillance footage, because they knew it showed damning evidence of them moving boxes and perhaps hiding some of the classified documents that the government wanted former president to return. i will read you part of what the indictment lays out. it says that mr. de oliveira asked trump for how many days the server retained footage, and the trump employee said that he believed it was approximately 45 days. de oliveira said that the boss, again, referring to mr. trump, wanted the server deleted. he says that he told the trump employee number four, that the boss wants server deleted, and he asked what are we going to

do, and this is laying out this new allegation against the former president three new obstruction-related charges against him. there is also a new charge related to a 30-s32nd classifie document that the president is accused of obtaining illegally and that is the document that is the subject of a lot of our coverage, and it is a document in discussion for some of the writers who are working on a biography of mark meadows who met in july of 2021 at bedminster, and the former president's club in new jersey, and during that discussion, the former president is accused of holding up a document that referred to attack plans related to iran. now the prosecutors have added that is one of the documents that the former president is alleged to have withheld from

the government illegally. rahel. >> and now, questions of the defense strategy now that the prosecutors do in fact have that document, but the trump defense team is asking to discuss classified information in a location of their choosing, and what exactly are they asking? >> yes, the former president says that for the legal team and for his convenience, they want to be able to discuss some of the classified documents at his homes or in other locations, of course, that are not cleared to have any kind of classified documents or any discussions of the classified documents, and the government is objecting to that. they say that defendant, former president of course, he wants to be permitted to discuss classified documents with his lawyers that are places that are not cleared for classified documents, and the government says that cannot go. >> evan peres, great to have

you, thank you. and now, with us is the former white house lawyer jim schultz, and special watergate prosecutor nick ackerman, and now, nick, let us talk about the watergate word here, because we are talking about destroying the evidence, and mutilating and altering and so, it does sort of ring a bell of some of those who remember watergate and some the evidence that went missing there. >> absolutely. this is really mirroring exactly what richard nixon did through his secretary rosemary woods where she deleted 18 minutes of a critical tape that was turned over to our office. this is one of the oval office tapes, and famously known as the 18-minute gap. richard nixon was successful in doing that, and according to this indictment, trump was not successful. they tried, but they couldn't

find anybody who knew how to delete the server. >> and jim, let me bring you into the conversation, and what is it like on trump's defense team, because they were not expecting this, and so what is the mood like today? >> look, i think that the most significant piece coming out of this is that 30-second document that they discovered and how they got it. we are not sure how the government obtained that document. what is important about that document is that they didn't have it before and it was not part of the prior indictment, and why that is significant is that they have questioned folks saying, is that the document that they were talking about iran and laid out in the first indictment, because before it

could have been pap ers or news clippings or something like that. >> and we have heard trump say it is not a document, and i was shuffling around papers, and how much does that complicate things about his team because he is out publicly talking about it? >> no different than saying that he can declassify these documents by waving a magic wand. it is another chip in the defense that he is positing every time, and it is creating a problem from the public perspective and those who have to go in to defend the case for him. >> and one thing is lying to the american people is not a crime. >> fair. >> but the more you say things that are not true in public particularly after you have been charged with a crime, it can ultimately, i think have impact on the case like that. nick, you are talking about

trying to destroy the evidence, and you suggested that trump failed, but it gets to the mindset and some say a consciousness of guilt, or a consciousness of something going wrong here, and how could that play into the larger case? >> well, the larger case which is really the obstruction of justice. and trump would have never been charged with any crime except that he obstructed the first grand jury subpoena that asked for all of the classified documents, and now he is obstructing another grand jury proceedings that he obstructed the camera view photos. now you have video of two other people nauta and de oliveira,

and it is tying into the guilt and keeping government from these documents and ties into be the government from obtaining critical evidence of the guilt. that could not be more powerful evidence. when you put the whole thing together, you have proof beyond a reasonable doubt, and beyond any doubt that has no defense to it, even though ithe fact is tht trump was there without a subpoena, and all of the emails and the conversations go against donald trump in statements in furtherance of the conspiracy to obstruct. >> nick, i wanted to ask and don't say that the person of

trump employee number four, what do you read as a prosecutor? >> as a prosecutor, i realize that the statements that were made and set out number 84 have to be elicited from employee number 84 before the grand jury, and the evidence never would have gone in there without locking it down rock solid. so they have a evidence of it,

but in terms of the witness that you would most want at trial, it is not clear who would testify saying that donald trump told me x. so how much does that create a challenge for prosecutors here? >> look, that is all fodder for cross-examination for the defense. what beef this person may have had with donald at trial, and it is going to poke holes against him, and you are right that if you have a loyal person who had worked there for a impugn that testimony, and we don't know what we don't know. >> we are learning that

the rookie police officer shot in the head while responding to the shooting in louisville has been in the hospital since april. he had graduated from the police academy just 11 days before the shooting at the bank. he was one of the first officers at the scene and ran toward the gunfire. the emmy awards is going to be postponed. we are told that the air is not going to show. it was scheduled for september 18th. the spokesman for the television academy has declined to comment on this. a founding member of the eagles has passed away. randy meissener who was a bassist and vocalist has passed away, you will recognize voice on the smash hit "take it to the

welcome back. 13 republican presidential candidates are heading to the early primary state of iowa to speak at a gop fund-raiser and that does include donald trump and ron desantis. it is the first event with the documents probe into donald trump, and ron desantis is heading up a revamped campaign as he is trying to make up ground in the trump's lead, and

jessica dean is on the campaign trail this morning in iowa, and what can we expect? >> well, rahel, we are seeing the example that we are seeing play out as the republican primary is coming in front of us as the legal issues are slamming rite into the 2024 race which is happening tonight. we have so many candidates appearing on the stage to pitch themselves in the first state that is so critical, iowa, and we have recent fox polling that shows trump at 46%, and everybody else so far behind him, and ron desantis is coming in at 16% which is in second place. and that is the hold that the former president has on the primary, and the challenge for all of the contenders who are hoping to breakthrough with the voters like this hoping it is the moment, and then trump blows

in, and he,s all of tempt aside from chris christie and asa hutchinson going after the president, and talking around it in a way, and we saw governor ron desantis on the campaign trail yesterday, and he is on the campaign trail again today in iowa on a tour, and bus tour of rural iowa, and the most direct that he would come at former president trump is when he was asked about it by reporterssh and he does not do it on the stump, because he is trying to thread the needle. these are the people they talked to, and voters who supported the first president in the last two elections there. and so he is trying to make an argument of independent voters in florida like he had done previously. but it is going to be quite a scene here as they all descend're in iowa at a critical state at a critical moment about

haley had appointed tim scott to the senate, and we didn't want to lose him, because everybody likes tim scott, but we like him so much that sometimes with e forget that he is smart and shrewd. looking at the comment, he said, hey, press, keep asking ron desantis about this, and let bit the message as he is trying to roll out the desantis campaign 2.0, and really smart and shrewd. >> what about that? desantis has three problems. he has a donald trump problem, and a ron desantis problem, but now he has to deal with tim scott as well. and what about the fact that it is vailed criticism, but criticism nonetheless. >> yeah, it is what we are seeing so often is a fighting among the scrum. if this were the tour de france, the members of the peloton would be fighting about who is coming in second, and not worrying about the leader, but it is not what i would advice. because it is not going around
