forward new crimes that the former president and now his two co-defendants are accused of committing after the prosecutors came and provided a subpoena asking for the trump organization to produce surveillance tapes of that area where the classified boxes would be stored at mar-a-lago, and i will tell you what the prosecutors have laid out between carlos de oliveira who was the head of the maintenance there at mar-a-lago, and also to this employee off to the side, again, discussing surveillance tapes, and de oliveira was asked by the ther employee, how many days of surveillance were on the tapes, and he said about 45 days, and jumping to another part of the conversation, where de oliveira, where he says, the

crime. carlos de oliveira who is a criminal defendant added to the case is due in miami next week. >> that is going to bear watching in and of itself. rahel? >> now, john, what we know about the third defendant. it is not much right now, carlos de oliveira, and he is 36 years old, and this is is accused of moving boxes after the justice department first subpoenaed the former president in may of last year, and de oliveira first spoke to him in january, and this is when the investigators helped to move or knowing about moving the boxes, and he has been charged with conspiracy of and also making false statements.

cnn has reached out to his lawyer john irving, but irving has obtained $200,000 money from the save america pac, and deo oliveira is expected to be arraigned monday, and so a lot to be watching there. >> and elie honig is here, and so is david axelrod. looking at this, the strength of the allegation, and the quality of the proof. >> right. >> where do they line up here? >> well, it is an important distinction here, because if you take everything in the indictment as gospel and the prosecutors can prove everything beyond a reasonable doubt, and it is open/shut case, but we have to dig further, because system of the allegations are rock solid, and for example, the audio recording of donald trump to show an actual document to people at bedminster, and that

has gained momentum in the period, because he has persuaded the republicans that he is a victim of the deep state, and speaking to the members of congress, and even his own opponents have ratified it, because rather than attacking trump or going after the justice department and the fbi and giving credence to their channels, we will see what is going to -- because i don't think that you will get to where you want to go be i this way, but there is a hope that trump is going to implode, and if they take him on, they will antagonize the voters. there is no look that is going to happen. but ron desantis has been steadily declining since the

showed that trump came in at 46%, and ron desantis came in at 20%, and you can see how far they are apart. and ron desantis came in with a campaign reset. we saw him lay off one-third of the campaign staff. they said they would have a leaner and more insurgent campaign to drill down on the argument of the electability. we caught up with him yesterday, and i asked him about this. you have made some changes to the campaign in the last several day, and what should the voters think about that since you have asked them to make you the top executive? >> focus on the substance, and things happen. as an executive, you have commander's intent, and if that intent is not followed, you have to make sure it is followed.

>> and so he continues to lean into that electability argument, and he won't take on trump directly. he will take him on when he is asked about him, but he asks how he convinces voters who supported trump in the last election how to support him, and he said that trump won it by 20, and he won it by 40, and he can do it nationally. but rahel, all of the candidates and desantis included are trying to breakthrough and make the case that they can take on president trump and then joe biden in 2024, and at this event tonight, it is one of the events where they could do it, but again, we will see the former president sweep into town with all of the activity around him, and one thing to note, i talked to the voters yesterday, and the word indictment did not come up, because they want to know who can beat joe biden. that is who they want to know

into the police department of memphis nearly seven months after the deadly beating of tyre nichols, and the question is if they have systematically used excessive force against black citizens. tyre nichols was beaten and tased and died from his injuries. nick valencia has more on the investigation there. nick? >> yes, since the death of tyre nichols, the community leaders are vocal about the desire of the department of justice to come in and investigate. the dodge is saying that they would like to grant that request and a civil rights investigation into the police department based on the public information that was provided to them. they did not give a time line as to when this investigation is going to be wrapped up, but they do expect to release their findings soon, and it was the department of justice that

started to work the memphis police department in march, and it is going to work in parallel with this investigation, and it is going to be looking at the use of force as well as the motorists to see if this memphis department engaged in a pattern or pattern of discriminatory policing. it is going to look at whether or not any constitutional rights or federal law was violated. it is at the press conference to announce this decision by the doj that the district attorney in memphis says that they will fully cooperate with the department of defense. >> there cannot be one rule of law for the powerless and one for the rich or the poor and there cannot be a rule of law for people who look like me, and a rulef of law for people of color. and so i know that there is going to be an important

conversation of the people of memphis, and together, we can build a stronger memphis. >> this is coming after the brutal beating of the hands of the police officers of tyre nichols. five police officers have pleaded not guilty as well as other charges related to the incident. and we are waiting for upwards to 20 hours of audio and video from that incident that has not been judged on from the judge. >> thank you, nick valencia. rahel? >> john, digging deeper into what the investigators are going to be looking for in this new probe. senior analyst and criminal attorney joey jackson is joining us. and nick laid out what the investigators are going to be looking out for, but explain the criminal investigation is very different and ongoing, but this is the civil rights investigation into the police department as a whole. >> yes, it is a significant development, and we have seen this under the biden

administration, and we have seen a department of justice committed to looking at patterns and practices throughout the country, and this is the ninth one. as you recall it was related to george floyd in minneapolis, and in louisiana related to louisville, and breonna taylor, and looked at it there. and so what happens is the department of justice goes into that area, the community, and a number of interviews, and they will look at the prior stops, and reports, and speak to the police, and community residents, and try to learn and discern the focus of three things, and number one, the stopping of residents, and was there a reason, and was there excessive force and justified or not and a component of racial profiling. it is very important, because you want the policing and the justice system relies on the public confidence. is there a place for the federal government so that the residents

know that the concerns are being heard, and that public policing is being addressed. it is important. >> and after the death of tyre nichols, we heard from different members of the community who said, look, i have been stopped and they had incidents of misconduct, and is that the type of the people that the doj want to talk to, and say, hey, what was your experience, and what happened? >> without question. these take a long period of time, and sometimes a couple of years, and they want to pull body cams, and look at the surveillance, and see if the reports refer to how it occurred, when it occurred and get the data together, and if there are patternsf violations,s they will look at the systemic changes to address any deficiencies to what they find. it is very important to what they are doing here. >> joey, racial profiling can happen even if the officers are officers of color.

>> exactly. we saw it in this specific case and so, there is a particular council here, and they are say, we are not stopping people because of a broken taillight or minor violation, and there has to be teeth to it. so people looking at this, they have to understand that at the end of the day, there has to be things to happen, and whether it is more training or recruitment or a reinforcing or really a reimagination of the policing, and that is what is going to happen, and after this happens, rahel, it is going to be institutes a number of reforms, and it is going to be how they are implemented as to how is going to be moving forward and whether or not it has teeth, and the desired effect and that is to change the policing which is disproportionate to certain communities. >> joey jackson, thank you.
