willle fall retense of national defense information and obstruction. there are a lot of angles to cover. evan perez, a zach cohen, jessica dean is in iowa and former a former prosecutor is with us. and there is one related to evidence and the other seems to cooperate that trump was speaking to folks without a security clearance that he was waiving the right to see a classified document. what do we know on the new charge? >> this is the 32nd documents listed in this indictment and it shores up one of the most damning examples of the former president sort of being cavalier with classified information, at least in the way that the prosecutors presented it.

and we know, you know, that that document is obviously one of the ones that was being discussed in that recording that prosecutors have. that's one of the biggest, most interesting pieces of evidence that the prosecution has in this case. and now the fact is that they have, you know, brought it into the indictment. it tells us that either they have evidence from other witnesses that gives them the confidence to be able to show this, to a jury. and of course the rest of this indictment is, you know, pretty damning for the former president. it really describes a scheme by him, orchestrated by him with his two employees to try to destroy, at least according to prosecutors, to try to destroy surveillance video after they received a subpoena to produce that. that example there that is listed in the chapter and verse from prosecutors with del rivera

corroborated this. >> what folks were looking for was the possibility of the grand jury making a decision on a whole other category against the former president and that was is his and his allies' efforts to overturn the 2020 election. it didn't happen yesterday but you have reporting indicating a decision is coming. >> sources are telling me and evans that law enforcement officials are still preparing for this thuird indictment that could come down within the next week. obviously they're still waiting on official word from the justice department and special counsel's office because nothing is set in stone until that happens. it's a good perspective how law enforcement is viewing how this could happen in the near term. >> it's also in fulton county, georgia where we're seeing movement involving his efforts to overturn results in the peach state. >> we saw some barricades set up

around the courthouse. you know, it looking ahead to this monday window, the opening of this window where the prosecutor in georgia has said, look, any time between monday and the next several weeks is when i can announce indictments. there's a lot of people in that georgia case who believe they're nervous are nervous because of the reico statute, it could encompass a wide group of people. >> jessica dean, i'm sure you've had this experience wb here the former president would say something in public. they're going to hear from them.

do you here candidates saying privately, wow, this is bad news for the president? >> reporter: jim, they are owe focused on getting their message out now, they really don't want to be seen as responding to trump all the time, yet there are a couple of candidates which we've heard from on our air and other places, chris christie and asa hutchinson, weaving in reasons why he should not be the nominee and he should. we're told former president mike pence will be more aggressive towards former president trump and the others. we'll wait to see if that happens. what's happening is watching to see candidates thread the needle. a lot of these voters voted for trump twice. making the case it's time to

move forward. we did hear from the former president. i want you to listen to this clip about all of this. >> i just heard of this as i'm sitting down. this is harassment, this is election interference. i wouldn't keep him. jack smith, why would i keep him? he is deranged. look, he's gone after other people, been overturned unanimously in the supreme court. he's destroyed a lot of lives. what's he's done is horrible. the abuse of power is prosecutor misconduct. >> they're saying if he were president that he would fire the person who is investigating him. and, jim, it will be interesting to see over the next several days and weeks as we lead up to the debate if any of the candidates start to take this on and usually more than we're seeing now and try to contrast themselves to the former president in this way. i will say in the voters that i've spoken to and this is just anecdotal, these are people i'm

talking to, there are obviously many, many voters across the country, but here in iowa they're not focused on indictment. that is not a word that came up. they will talk about trump's demeanor. there is certainly trump fatigue. they'll say i supported him in the last elections, i'm ready to move forward. but they're looking at who can win in 2024. that's what i'm hearing from them. so if they make the assessment that these legal troubles and this legal peril is going to make him unelectable, that's going to weaken him. but if he can make the case this makes him stronger and he's being prosecuted unfairly, that's going to be up to the voters to decide. >> that's interesting. that is a path that some of the republican candidate, chris christie, for instance, who say he's not the guy who is going to win. >> and even ron desantis, he says i'm trump without the

baggage. let's pivot from the political to the legal question. we have former prosecutor kristy greenberg with us. right off the bat, what stoot ou stood out to you about the superseding indictment? >> what stood out to me is the additional charges enhance the jury appeal that his prosecutors are going to present at a trial. you have a lot of times it's the coverup and here the coverup just got a lot juicier, this idea of deleting security camera footage of the conversation about the boss telling me to do it, that it was clear that these are directions coming directly from the top, from donald trump, and that he's the one telling them here's what you're supposed do, get rid of the evidence, anything incriminating that could hurt me, get rid of it and that he is demanding loyalty like a mob boss. that is the kind of evidence that jurors are really going to

understand, and it so removes him from this idea of the cache of being a former president. here he is just acting like a criminal who is trying to cover his tracks. >> the parallels to nixon and the tapes, interesting to see the least. let's talk about timing if we can. there's another defendant added to the case. carlos de alovara. you have a schedule for a trial day. does that schedule look reasonable to you? >> it does. now that we're not looking at the dates prosecutors initially put forward and we're looking at may, there's still plenty of time for this new defendant to get the discovery, for his attorney to get up to speed. no motions have been briefed yet so there is ample time in this schedule now for these new charges and this new defendant to be part of that schedule for

we've been watching since the beginning of the war. how much is china helping to support russia' war effort? a newly declassified effort says increasingly so. it is worth noting some of this is based on western media reporting and open source but there is a u.s. intel assessment that russia is becoming increasingly reliant upon china for its war effort. now, it doesn't say china is shipping in weapons but it does say there is dual use equipment. semiconductors, some of which china sends in from the u.s. and as well as drones and other equipment that russia uses as part of its war effort. the chinese embassy and u.n. did respond saying all of their economic and trade partnerships are above board, jim. >> and it's a key distinction. not direct weapons shipments but dual-used technologies that can be used to help the war effort. >> boris.

>> the war in ukraine appears to be spilling beyond its border. there have been several missiles launched, including one today shot down. and alex, there is late word of a missile strike somewhere in dnipro. what are you learning about that? >> reporter: yeah, boris, a friday night missile strike in the center of one of ukraine's biggest cities, dnipro. we heard from president zelenskyy. he says there has been damage to a high-rise building and the headquarters of the ukraine services, the sbu. in terms of people injured, hurt or killed, we don't have any sign of that just yet but it is of course still early. a member of parliament in dnipro says he has not heard of anybody

being hurt or killed. boris, this is ukraine's fourth biggest city. it's quite far from the front line. it's about 60 miles from the closest front. we were there just two weeks ago. we actually spoke to our hotel tonight, which is about a third of the mile from the strike site, someone at the hotel saying it was extremely loud, they heard two explosions, it rattled the entire area. this is a city that doesn't come under regular missile attack, but it speaks to the fact that russia continues to target cities all across the country with what president zelenskyy described tonight as terror. now, meanwhile, boris, this comes just hours after we heard about missile strikes inside russia, which they are blaming on ukraine. the russian military says that two s-200 missiles, air defense missiles, were fired into the southern part of russia. they were taken down by air defenses, they say, but falling debris landed in the city a city

we have new details in the case of an alabama woman who faked her own kidnapping. she is now under arrest, charged in the hoax and her smiling mug shot was released moments ago. kiley russell called police saying she saw a toddler walking alone on the side of a busy highway. when police showed up all they found was her empty car and her belongings and her cell phone, a scene we now now is a setup.

bring us up to speed on the charges. >> she faces two charges, one falsely to law enforcement authorities and falsely reporting an incident and both thousand dollars bonds. talk about that mug shot, that's something we've been able to get in the last hour or so. that news conference happening at 2:00. the police chief saying the misdemeanors were as far as they could go. >> many are shocked and appalled that miss russell is only be charged with two misdemeanors despite all the panic and disruption her actions caused. let me assure you i, too, share the same frustration. i can tell you i'll be contacting our state legislators and ask them to look at this law

and urge them to add an enhancement to current legislation when somebody falsely rerts kidnapping or another violent crime. >> boris, you can tell the chief's not happy about this. a lot of resources were put into this. there was a drone put into the air, canine units were put to work there. they also had other federal authorities come in to help with the search. people from the community came in to help with the search. everyone is trying to figure out where c where carlee was for those 49 hours. they did talk about the fact she went to a target and bought snacks before this happened. she told detectives when she got back home that apparently a man with orange hair kidnapped her. now they figured out it's not true, it was all a hoax. two misdemeanor charges and she's bonded out after taking that mug shot photo you see on the screen. >> a lot of questions. one of them is why.

let's get some cnn legal analysis from joey jackson. always great to see you. first, your thoughts on these two misdemeanor charges and a potential defense she might use in court. >> yeah, ryan, so obviously a lot of concern, right, by the community and others, i think really the country as a community being concerned about her, looking and really leaving no stone unturned so that she can be safe, et cetera, et cetera, coming to find out it was all false. so obviously there's a lot of disappointed people. with respect to the charges, that's what really the law demands as it relates to alabama law concerning you reporting to law enforcement and that being false and then of course filing a false report, that being false also, misdemeanors, what's the difference between that and a felony. a world, right? the essence, though, is only punishable by up to a year in

jail. at the end of the day, this is a young woman and many people for a variety of reasons suffer different things. we don't know what was happening with her. we're not as bad as we are on our worst day and not as good as we are on our best day and the truth lies somewhere in the middle. while of course many people are judging her and what she did was be a abhorrent, at the end of the day she has a long life to live and you can only hope she'll get the assistance she needs and live it and perhaps live it well and i think her attorney will be looking for what we call mitigation and redeeming qualities. her attorney indicated all of this was false, all of it was a hog hoax and i think they're moving forward in a way that she's not so punished that it would cripple her life. >> joey, on the idea that

there's a debt to be paid to society, she may face a potential penalty for this because it was a pretty expansive and expensive search. >> absolutely. so there are three ways this is evaluated in any case. one is punishment, one is deterrence and one is rehabilitation. i think her attorneys will acknowledge that obviously there needs to be some punishment here because this is not acceptable behavior. as it relates to deterrent, you want to be stiff enough where people know that this is not acceptable, that resources being dedicated to her and finding her and people coming together for something as a hoax, we don't want others to do that so we want them to be deterred. at the same time there's a rehabilitative element and that i think her attorneys will seize on saying she is a young woman, she has a lot more to give. we don't know the essence of her

ma maladies would lead her to do this. no one, fortunately, is dead or anything else and i think they'll be looking for the judge and prosecutor to go lightly on her because of that. to be sure based on the resources and the coming to the of the community and the diversion of those resources, there will be a punishment to be suffered without question. >> joey jackson, always appreciate you sharing your expertise with us. thanks. >> thank you, boris. >> jim? >> there are new moving details in the hearing from michigan school shooter ethan crumbley. they're giving emotional temperature describing the terror they felt in the moments the gunman opened fire, changed their lives forever and the lives of several young people. you gave such a moving account of what was heard in the court yesterday, i wonder what you're hearing there today.

>> minors took the stand, former classmates of the shooter, they are still students at oxford high school. one of them did not show them, they are minors. he had a therapy dog in court at his feet through all of this testimony. he said he was in the bathroom. it was lunchtime. all of a sudden he hears shots. there's a senior, jason shilling in with him. he said "stand u p on the toile so your feet don't show." all of a sudden the shooter comes in the bathroom, pushes over the doors of the stall. he comes back in and tells justin shilling, who is a senior, "come out" and the minor hears one shot. and he orders him to come out and says go to where your friend is. the minor sees the gun and runs

the other way. he ran out of that bathroom and his life was saved. now, beyond that, the vice principal of oxford high school took the stand. she had known the shooter since elementary school because she was his principal. she was walking the hall as the shooter was making shots. listen to what she says as she is walking. >> eyes on the shooter. and then did someone respond to you? >> i don't know. i don't remember. they probably did. >> okay. what did do you? >> i kept walking towards him. >> okay. i have to ask why didn't you walk towards the shooter? >> i needed to help. i just thought it couldn't be ethan. he wouldn't -- he wouldn't do that. and so i talked to him.

>> what did you say? >> i said are you okay? and what's going on? >> reporter: ethan did not respond to her. she called him by name, he'd known her for years. he kept walking but didn't shoot her. the defense case now is putting on expert witnesses. they're trying to show the shooter can be rehabilitated in prison. that is one of the miller factors according to this mandatory hearing, mandated by the u.s. constitution and the eighth amendment to see if ethan crumbably can be allowed to have at some point potential of release. jim? >> good lord. the testimony of that one student there, just the decision in that moment, one student dies, the other lives. and of course here are the faces of the four of them that lost their lives that day. jean, thanks so much for bringing us that story.

having an effect on the public. new numbers today show a boost in consumer confidence. vanessa in new york has been looking at this. vanessa, it's a whole collection that have defied some of the more pessimistic expectations. when you look at the market and company earnings forecasts, what is that picture saying about the way ahead? >> reporter: commits aeconomist and analysts have been bracing itself for recession, the federal reserve saying they can still stick that soft landing and saying they're not forecasting a recession any longer. gdp outperforming expectations, the u.s. economy growing by a healthy and strong 2.4%, despite 11 interest rate hikes by the federal reserve and pce, the fed's preferred measure of inflation cooling in june, just

up 3% year over year and .2% month over month. and as you mentioned, consumer sentiment at its highest level since october of 2021. so consumers actually feeling pretty good about the economy right now. and so is wall street, jim. wall street is liking these numbers, that mixed with strong company earnings and with the fed saying that they may pause interest rate hikes for the remainder of the year. we've seen 13 straight days of gains in a row by the dow. that's something we've never seen -- that we haven't seen, rather, jim, since 1987. >> and sometimes consumer confidence can be a self-fulfilling prophecy because then people buy more, increases economic growth. gas prices have been ticking up. i know there's concern about that. when you speak to folks and look at the numbers there, is that considered a cyclical rise, hot weather, et cetera? i know that's been affecting refineries or is there concern that this could add further,

broader pressure to inflation? >> reporter: we certainly always see higher gas prices in the summer because of the summer fuel blend, but we've seen a spike in gas prices, up 12 cents over the last three days. according to analysts, that is because of hotter weather. we've seen refineries having to shut down for maintenance and of course when they shut down, that means less production going out and higher prices. that is certainly something to keep an eye on, jim. and also wages cooling. nobody wants to see wage growth slow because everyone wants more money in their pocket. so that's kind of the conundrum right now. rising gas prices, let's keep an eye on that and then we don't want wages to dip too much because people aren't going to be able to keep up with these prices and still inflation still too hot at 3%. the fed likes to see that target a t at 2%, jim. >> thanks very much for crunching the numbers for us.

a decision whether to indict donald trump and his allies in georgia is imminent. an investigation of efforts to overturn the 2020 presidential election results in the peach state has been going on since early 2021, and some of the biggest players in trump's orbit are involved. security paracades are now going up outside the courthouse in downtown atlanta. charging decisions are expected next month.

are told to convene in secrecy and give a false explanation why they were at the capitol in the first place. obviously there's a lot of nervous lawyers hoping their clients are not charged and still insisting their clients did nothing wrong. >> there are signs statements from the fani willis she's made, guidance she's given to her employees when to come into the office, when to stay at home or work from home and obviously the barricades outside. what can you tell us about the potential charging decision? >> we talked about what the word imminent means in a case like this. we do expect she's going to make announcements on who if anyone is going to face charges in the next couple of weeks. starting on monday that's when she's going to have a number of employees working from home and see some of these enhanced security procedures including what we're already seeing. >> sara murray, thank you for sharing time with us. one hole story, one whole hour
