♪ ♪ happening this hour, another trump employee is set to be arraigned accused of trying to delete mar-a-lago security footage for the boss after the special counsel had subpoenaed it. cnn is the live in miami with the latest. and the trump super pac is shelling out more than $40 million since the begin of the year, but not for the re-election campaign so to speak. where did the money go? >> and now a new plan for student loan borrowers, and what you need to know before the repayment plan resumes in october.

kate bolduan is off today. i'm sara sidner with john berman. this is cnn "news central." right now, all eyes on a miami court, and carlos de oliveira is going to appear in court, because he is accused of trying to delete video after the justice department subpoenaed for footage last year. the defense as we know it so far is that the boss wanted server deleted. he is described as someone outside of the trump inner circle, and we are told by cnn that he is not someone known by the close confidants, and one of the family members is saying that he is likely not telling what the consequences of what donald trump was telling him to do, and he was probably just being loyal to his boss. cnn correspondent randi kaye is

in miami. and what do we know about the charges that are up against de oliveira? >> these are pretty serious charges, sara, all relating to allegations that de oliveira was part of the plot to erase this security camera footage of which showing the boxes of documents at mar-a-lago, and some of them found to be classified. part of it is obstructing justice and making false statements and concealing or destroying evidence. part of it is that he did tell an i.t. worker at mar-a-lago that the boss wants rv deleted and aly asked the i.t. worker how long the v footage would stay on the server, and so these are part of the allegations against him. and we know that at center of the allegations which include de oliveira and the former

president is the i.t. worker known as employee number four whose name we have learned is usyuscil taveras. and these charges are stemming from what taveras has told investigators and the fbi. we know that he has not been charged with anything, but that the person that de oliveira has met in the audio closet to discuss the security footage, sara. >> is this going to be an arrangement or just an appearance in court? >> as of now, we know that he is going to be appearing in court. whether or not the arraignment happens is still in question. he would need a florida-barred attorney, or florida-based attorney to enter a plea, a right now, there is not a florida attorney on the docket, and we know that he is going to be here with the washington,

d.c.-based attorney, and if he shows here with a florida-arranged attorney, and that could indicate when the mar-a-lago case is going to be tried, and people want to know if it is going to happen before the court, sara. >> thank you. and you are looking very cool before the heat. >> and elie honig is joining us and now, what we have learned over the weekend is that yuscil tavarez, employee number four received a target letter at the beginning of june, and he receives target letter, and he is not charged and what does that tell us? >> it is important development, because when the prosecutors send a targe, two reasons to do that. one is a sense of fair notice to the person that he can get a

lawyer, and remain the right to silence. and the strategic reason is to scare someone, and shake them loose, and i could be indicted and that looks like that is what happened and worked with trump employee four who we now know with mr. taveras, and the way to tell that is that if you are looking at the certain allegations that clearly rely on his testimony, and the conversation, that employee four, de oliveira is seeming to come solely from the testimony of employee number four, and so he was shaken loose by the target letter, and he is cooperating now. >> and the fact that he is not charged, does that appear how strongly he was cooperating. >> when you have someone who is cooperating, you have to make a decision, was it engaging so that it was not targeting, and

so conflict that they have to give a pass or immunity or nonhe has not plead guilty, it is the latter, and he is a low-level player and he doesn't have to eat a charge as we say. >> what a term. >> we use it as prosecutors. >> you don't want to leave it hanging there, and that is a good one. look, he is cooperating and not sure if it is a big c or little c. and the prosecution would love to be in a world with either walt nauta or carlos de oliveira would cooperate, but walt nauta does not look like he is going to flip, and no indication that de oliveira is going to flip, and we know that he is going to be charged with giving false statements to the fbi, and there was a point that he had a chance to give more truthful

statements. so that is going to suggest that she is on the trump side. if the attorneys are going to be paid by financial break to get his own attorney. and defense attorneys are crazy expensive and you are talking about six figures if you want a serious private lawyer, and i don't know if a guy like de oliveira can afford that, and sp times people get ted and so you don't even know if he can get out of the trial. >> so his interests,ped the employee's lawyers change their minds. because part of the reason that he was trip and so if and this

is where multiple defendants join together and this is perfectly legal. look, we are all in the same boat, and we are best severed to work together and share the work and the attorney/client privileges which happens in multidefendant case, and that happens a lot. >> and so could the prosecution sever the case here? if they wanted to. >> and so the cases of the three defendants tried together or separately. this is so interesting tactically, because as a prosecutor, i was absesed to try everybody differently, and five cases here and then you are able to give the story all at once. but the defendants want to be broken apart and tried separately, but i don't think that it is going to happen, because if the prosecutors want to try them before the election,

they would do better to break them apart, but whether they want nota and have the benefit of the jury as well, they might put them together. and something is happening now? >> yes, it looks like carlos de oliveira is arriving at the court for the first time. it looks like it is going to be pure procedural. >> but i am going to stick nearby, just in case it doesn't go as usual and goes awry. yes, and now donald trump's campaign is raising a war chest, and now, we are told that save america has spent more than $40

million on legal fees this year alone, and that is more than double than last year. kristen holmes and do we have any idea here? >> well, we are told that big number there is going to cover his legal fees. and that big number $40 million, it is going to cover witnesses in many investigations, witness, former aides and staffers and mar-a-lago, and so when it is coming to the defense fund how broad is this is going to be? as you heard about walt nauta and carlos de oliveira, they are having attorneys paid for by the

trump administration. so the $16 million is all for 2022, but the $40 million is for 2023. i wanted to give a little bit of the reminder of where the money is come from and the smaller number is coming from the breakdown. when trump announced the candidacy in nofb, the breakdown is 1% of every dollar goes to the legal fees and every are amount of those super pac was going to pay for the legal fees. they are clearly concerned about the amount beingorrhaged here for those legal fees.

that is why they created this legal fund and now, going to the former white house secretary under donald trump, and going to the pictures here -- quickly, we saw carlos de oliveira going into miami courthouse, and we are expected him to make an appearance, and we don't know if he has an attorney, but what is it going to go and then what it is like to be represented by an attorney paid for by donald trump. >> we saw this with cassidy who was with a attorney who was paid for by the trump organization,

and she ended up dropping that attorney, and so that is what is worrying me about walt nauta and carlos de oliveira is that their attorney is not putting their best interests in first. and they are very loyal, and nauta is trump's body man, and face-to-face with trump constantly. and so, it is very expensive to have these attorneys, and so i am sure it is to prevent them from flipping as well. >> and so now, the people around donald trump who get into legal trouble have to pay a price, but rarely does donald trump have to. why do you think that people like walt nauta and carlos de

oliveira remain loyal to trump as the pressure mounts on them? >> as noted it is expensive to flip on trump. i had to personally hire a lawyer when i testified before the january 6th committee as well. it is expensive and it is going to add up for lower level folks like walt who have to then take the brunt of to legal fees to tell the truth and cooperate with investigators, but and only time is going to tell what they end up doing. >> can you give us a sense of how donald trump operates in the legal sphere, because we see the angry tweets on social media, but in private when the cases are mounting on him, and the evidence is showing up in the public sphere, and can you give us a sense of what h

>> yeah, i think that politically he knows that this is going to benefit him. we have seen the rally around effect happening with the first two indictments. and then there is potentially a third and fourth coming. they don't seem to hurt him in the polls, and he is able to fund raise off of them. he is in good spirits in that sense knowing that right now it is looking like he is going to be the republican nominee. but he has to be worried from the legal standpoint and that is true in the social truth standpoint where he is lashing out to attacking jack smith the special counsel, and it is slightly deranged, and my belief has always been that he jumped into the race because he knew that he was facing the mounting legal troubles, and he wanted to use it as a shield. he knew it was calculated for him to jump into the 2024 race, because he knew that he would face the legal problems, and on

with the oversight committee, and he is a former business partner of hunter biden, and they were engaged in several foreign business deals. the republicans have hyped this up, and devon archer in as a key witness to say his testimony could connect joe biden to business dealings, but they have yet to produce any evidence, but this is what one house republican said about the expectations with this interview with archer. >> this is a person who was in business with hunter biden and the biden family, and he is a bff of the president's son, and he has information that we can fact check and corroborate with other witnesses and whistle-blowers, and he can tell us if joe biden was in the room and how much he was involved in the mess, and the american people have a right the know whether he was or was not.

launched this beta website which gives them a sense to address some issues that could arise over the process as the full launch is to occur in august, but those applications are open, and people can begin to submitting them now. this is the latest step that the white house is taking to offer some relief to student loan borrowers, and it is not as sweeping as the student loan forgiveness program that was blocked by the supreme court but it is trying to help people that matters to young voters. so if you are taking a look at the details of the plan, it is based on the income and the family size. it only applies to federal student loans and private loans are not a part of this, but some borrowers could see the monthly payments wiped down to zero a month including individuals making roughly less than $33,000 a year, and families of four making roughly less than $67,000 a year. another key component is that interest no longer accrues on

the student loans if people continue to make their monthly payments, and in a year when the program is in full effect, some borrowers could see the payments cut in half. it is one of the proposals to roll out for when the student loans will be due after that pause. >> so after the biden administration had that plan struck down, are they expecting any legal problems with this plan? >> well, the officials that i spoke with feel they have stronger programs with this repayment plan. congress has given them the authority to base these plans on income. the plans going back to 1994, none of them have faced a successful legal challenge, so the officials are optimistic that the program is going to be

in place for the long haul. the wife of the accused gilgo beach murders is asking for privacy. brynn gingras is joining us with the latest. at least of what the wife is saying to her attorney. >> reporter: yes, the suspect there who is accused with three of the gilgo beach murders and could be charged with others. the ex-wife is saying that on behalf of me and my family and the neighbors who have had their lives turned upside down with the news crews and the police and the authorities, i am pleading for some normalcy.
