this is cnn breaking news. this is a live look outside of the federal courthouse in washington, d.c. grand jurors have been hearing evidence today in the special counsel's january 6th probe. they were just seen leaving for the day and we are standing by to find out if they voted on whether to hand up an indictment for donald trump. sources telling cnn that the former president and his advisers are right now preparing for a potential indictment. cnn's paula reid is joining us now on that.

paula, what are you hearing? >> reporter: so, we know that the grand jury that has been hearing evidence in the special counsel's investigation into efforts to overturn the 2020 election, they have been seen leaving the building, but one important person stayed behind and that is the grand juror foreperson. that is significant, because that is the only member of the grand jury that is needed to return an indictment. now, at this point it's unclear if they have voted to indict the former president, or anyone else in this investigation, but one of the reasons we're watching their movement so closely today is because of what we've seen over the past two weeks. we know the former president has received a target letter informing him he is a target in this investigation. he received an invitation to appear before the grand jury which he declined and, brianna, that is usually something that comes at the end of an investigation. and also another sign that an indictment was imminent, his defense attorneys met with jack smith and his team last week, sources tell cnn they did not think they would be able to

successfully change the trajectory of this investigation, but they hoped they might be able to delay it. now, this is the first time we've seen the grand jury back meeting today at work, but, again, at this point we don't know if they have returned an indictment. typically the way this works is that thiltd bring this indictment to a magistrate judge in a sealed proceeding. it is unclear, though, if this is going to go according to the usual script because, of course, this would be once again a historic case, so they may deal with it slightly differently but usually it has to be returned before a magistrate judge in a sealed hearing and the indictment would remain sealed until an arrest, but it's unclear given the historic and the national significance of a possible indictment if this could be handled slightly differently, if we could see potentially documents shortly after any indictment is returned, but, brianna, we have our wonderful team of reporters at the courthouse watching every possible angle of this right now and we'll come back to you if we

hear an indictment has indeed, been returned. >> thank you so much. jim. major potential indictment pending here in washington, another major indictment pending possibly in georgia. this, of course, involving donald trump as well and learning the fulton county district attorney fani willis has issued subpoenas to a former state lawmaker as well as an independent journalist, a strong signal she does intend to seek indictments in her criminal probe of trump because those witnesses relate to efforts to put a fake slate of electors in georgia to overturn the results of the election there. cnn's sara murray joins me now. these newest subpoenas point, it seems, to her focus on this attempt to seat fake electors there. biden won the state, an attempt to seat electors that would have shown trump falsely won the state. >> reporter: yeah, i think that that is one prong of her investigation, and, again, this

has been a 13r5u8ing investigation that lasted 2 1/2 years and these subpoenas for grand jury testimony are the clearest indication that she's putting forward a presentation to put before the grand jury and to seek indictments, of course, as you said, she has not made any announcements yet on when she will seek charges against but gethe independent journalis you mentioned stumbled upon the republican fake electors meeting at the georgia state capitol. he was kicked out of the room where they were meeting and told it was an education-related meeting that, of course, ended up not to be the case and the other person who received a subpoena for grand jury testimony is former democratic state senator jen jordan. she was present when rudy giuliani showed up, again, at the georgia state capitol and shared all of these conspiracy theories about the election being stolen and essentially tried to convince the state legislature that they could be involved in this and move forward with seating electors and, of course, rudy giuliani was there presenting sharing a number of conspiracy theories so these are witnesses that she

seems to want, fani willis seems to want ready to put forward a possible grand jury presentation sometime in the month of august. the subpoenas essentially say be prepared, be ready to go between august 7th and the end of the month and give you 48 hours' notice for when you need to appear. >> goodness, and also that effort to conceal what they were actually up to in that statehouse in georgia at the time. sara murray, thanks so much. joining me now, former federal prosecutor renato mariota and here we are, the former president possibly on the cusp of not one, but two additional indictments or perhaps multiple one here in washington, d.c. and the ongoing case in georgia. if the special counsel, in this grand jury has decided to indict the former president specifically for events on january 6th, also an effort nationally to overturn the election can you place it into context for us, more serious than the other indictments, but

also historically? have we ever seen anything like this legally? >> we haven't, and i think, you know, when you said put this in kong text it is beyond any context we've ever seen in the criminal justice system before. you know, up until the mar-a-lago case, we did not have an indictment of any sitting or former president that was the first ever indictment, federal indictment of a former president. he has two already. it's not just someone, not some oathcareer, the former president of the united states being indicted for a scheme that prevented the peaceful transfer of power in the united states. one thing that's been a hallmark of the united states since president washington stepped down is that we have a peaceful transfer of power in the country so it's certainly serious. i could break it down in a legal sense of whether it's serious or not but it's unprecedented. it's far reaching. it is the first and only

indictment of its kind if it comes out. >> you're at a disadvantage because we are not members of the grand jury, as we all are and have some tea leaves as to the evidence and the witness testimony that the special counsel has in this case, but based on what you know, can you describe the standard, right, to prove this? if you've convinced a jury, a grand jury to indict him, that's one thing. you now have to convince a jury of 12 to convict a former president here. what would you need to see to meet that standard? >> it's a great question. you know, the standard legally is for grand juries, they just need good reason to believe a crime occurred. pretty low standard. at trial it's beyond a reasonable doubt. and the justice policy is not to seek an indictment unless you're confident that you can prove your case beyond a reasonable doubt when it gets into the courtroom. and so what are we looking for here? what would jack smith be looking for in his investigation? he's looking to disprove, you

know, arguments that trump has that he legitimately knew that, you know -- legitimately thought the election was stolen from him. you know, in other words, he wasn't trying to defraud everyone by selling the big lie but generally thought it was true, subpoena witnesses close to trump whether as we've heard jared kushner, we've heard mike pension, others subpoenaed for that. also trying to deal with these, i would say, advice of counsel -- the advice he's getting from dishonest or, you know, crooked lawyers, people like giuliani or eastman who have offered very questionable unethical legal theories. what he would believe about that. what else was he told by legitimate, you know, honest lawyers about what his legal options were? i think that's going to be a focus of what he's looking for. >> now, you, of course, have the georgia investigation which relates specifically to trump

and his allies' efforts to overturn the election there but if you were to have him indicted, both here in federal court, in georgia, the state investigation, in addition to the indictment and that was superseded in fact, expanded last week in the documents case and the one in new york this is a man running for president currently leading the gop nomination, how busy would he be in court in the coming weeks and months? >> for most defendants, for most people, being indicted in one case is an all-consuming matter. it is for many people attempt suicide. they lose their businesses. they lose their marriages. their life is turned upside down by one indictment. dealing with four indictments, i mean, that's the full r. kelly treatment where you're indicted across the country by prosecutors all over the place in federal and state court. that is a very difficult situation to be in and, frankly, that is more than one person could ordinarily handle when

they're not running for president. >> renato mariotti, i imagine we'll have more questions going forward. the gilgo beach serial killing suspect appeared in court and rex heuermann is pleading not guilty to the murders of three women and police believe that heuermann may have committed the killings inside of his family's home when his wife and his two children were out of town. and after an intensive search of the property, his wife's attorney shared some photos of the aftermath. cnn's jean casarez is joining us live from outside that courthouse where, jean, the d.a. as well as the attorney, the court appointed attorney for rex heuermann has just -- they both have spoken. what has happened there? >> reporter: well, let me tell you what happened in the courtroom, because first of all, the defendant was in the courtroom. he was there, and he was wearing khaki pants, a gray suit jacket,

he was handcuffed when he was at the defense table. he spoke a little bit to his attorney, but the focus of today's proceeding was the voluminous amount of discovery. in court it was said 2,500 pages of discovery. there were two hard drives, six discs that will get in the hands of the defense and as we heard the prosecutor say out in the press conference new york has a very broad discovery requirement from the prosecution to the defense. we also heard from those 2500 pages incurred. my colleague told me that it's photos and autopsy photos and lots of paperwork, lots of reports, also from the new york medical examiner's office, the autopsy reports, photos of the crime scene, crime scene processing photos, so much for a 13-year investigation to be handed now over to the defense. we just had a presser from the

prosecution and the defense, i want you to listen to a little bit of that. >> the press has convicted my client without seeing a shred of evidence. so, he doesn't stand a chance with the press. and we're not going to try the case in the press. i doubt that any one of you for a moment have even contemplated the possibility that they have the wrong guy. >> reporter: now, we can tell you from what he just said this will be a very aggressive defense by that attorney for rex heuermann. i can also confirm with you that there were family members of the victims in that courtroom this afternoon. the district attorney said more than one. he would not say who they were. they do not want to be public. they want to stay private. but they are so focused in on this of the family mes that they lost so long ago, jim. >> yeah, he said that some of them are very, very engaged, jean, and certainly many of them have said they feel relief

knowing that someone has been charged with the murders of their sisters, of their daughters. walk us through these photos which we should mention have been released by the attorney for the family, for as have ellerup who has filed for divorce that they have released to the public following this extensive search by police. >> reporter: well, this is what they found when the family returned late last week when the processing was over of that home. things are turned around, turned over. it doesn't look like a home anymore. there's boxes that say evidence with the evidence tape, obviously those are boxes they determined they would not take for processing, because that's what's going on with all this potential evidence they have in their hands now, but they are trying to find forensically and the district attorney confirmed this just minutes ago anything

just days after ukraine's president said they would see more of the war themselves inside russia there's been another drone strike in moscow on a high-rise building there. the same building, in fact, that suffered damage on sunday from a similar drone attack. this appears to have captured today's drone just before impact. wow, quite a piece of video there. the skyscraper that's now been struck a second time houses government offices including the russian ministries of economy and digital development. cnn international diplomatic editor nic robertson has been covering it. nic, big picture seems to be a clear effort to bring the war home to russia and the costs of the war. any sense of why this particular building here? is it because of government offices? >> reporter: potentially it could be. there could be a number of

reasons. if we look back at what ukraine has targeted in terms of the drone targets in moscow, it went for the kremlin in the beginning and seems pretty clear the kremlin put up some kind of electronic defenses. we've seen them target airfields, airports, military civilian airfields around moscow because a couple of times over the past months or so they've shut down their airspace but no reported impacts on the airfield we're aware of so were there defensive measures put in place by the russians? this area they've hit, yes, it does have some government employees but they don't seem to have a particularly important function as we know. one of the departments there is sort of a weights and measures department. another, you know, the -- checks measurements and another has a technical library and another has something to do with electronics and doans but it's not clear. there's no sort of high-value military or commercial target there. so what it may be is just this -- this is a very smart,

fancy, commercial neighborhood that went up maybe a decade or so ago and for this reason and i think another thing about it here, you think about ukrainians connecting a message to russians, this set of buildings is right next to a major route into the central moscow from the suburbs of moscow so a lot of people are going to see it so i think there's a lot of reasons here. >> understood and like we said, last hour, information warfare is always a front, particularly in modern warfare, nic, thanks so much. cnn's senior correspondent fred pleitgen joining us covering the war from ukraine and russia itself. i wonder given nic's point just then, a highly visible target on a highly visible road into moscow where lots of folks will see this and say, wait a second, ukrainians can strike here, what does it mean for me? what is your sense of the impact these strikes are having on public opinion, on the war,

inside russia? >> reporter: well, i certainly think they could have an impact, and it's one of the things nic said, it is a highly visible target certainly in a highly visible area and also i think what we need to point out it is sort of a symbol of the power of russia, the financial power, but also the power that it has in things like hydro carbons and business as well. so certainly this is right -- a strike at the heart of the economic center of russia so i do think that in that respect, it is something that has an impact on the russian population but one of the things we have to keep in mind, jim, is that the russian leadership does not want russians particularly in moscow to be talking about the war, to be thinking very much about the war and especially not to be thinking that the war is going very difficult, of course, one of the things we've heard from the kremlin over the past year since the war started is that everything is going according to plan. well, certainly drones hitting the financial center in moscow

is not something that appears to be part of that plan. and, you know, i think one of the things we've also seen in some of the videos that have come out of those strikes is that those drones don't appear to be very big but they do appear to pack a punch. in fact, i want us to look very quickly at video that came out of one of those impacts. let's have a look at that. >> so, as you can see, those are some pretty horrified pedestrians that were out there. however, one of the things i also have to say i was on the ground in kyiv in ukraine when the russians first used those shahed drones that i'd say are almost the same size and the explosion was about the same and, of course, those unleash terror as well. that's where you get back to the message that the ukrainian president was sending to the russians that the war has come

behind me, david. >> 43-43 is correct. >> 14% out there. what does that mean? >> we should note this poll looks like nearly every other poll we've seen that has done the matchup between biden and trump which is that it's a margin of error race. so the question is sort of like, well, why is that, right, if, indeed, donald trump is now two indictments in possibly facing two more. economic indicators are getting better in the country than they have been before. this seems to something where joe biden should probably have a bierdvantage. we are a polarizedoury and we are locked in to our team's jeeyand that has something to do with it but the 14% that you note that say other or they could not vote at all, they could vote third party, i think they're fascinating to look at because people who are rejecting both choices, "the new york times" this this time did a deep dive and it was like a group that was slight advance biden holding their nose not l

necessarily wanting to do biden but it supported the biden argument don't judge me against the almighty. judge me against the alternative. this is why the white house thinks the matchup for trump works for them. >> that appears to be working a little bit for biden, right? it shows biden is growing on democrats as the nominee compared to last year. >> yeah, now we should say it's still not great territory for him. 50% of democrats today this this poll say they'd rather someone else than joe biden be the nominee for the democratic party. that is not a great number. yes, it's better than where he was a year ago so there's a little bit of shoring up his hometown team, his base, right, from last year, but there are still questions and when you ask that 50% of democrats, well, why is it? just an open-ended question, why is it you want somebody else, overwhelmingly the answer is joe biden's age. >> really? >> uh-huh. >> how troublesome is that for democrats because they've been

burned before when there's a big appetite for another candidate? >> the biggest concern if you're in the biden campaign headquarters, the enthusiasm factor. they saw in their most recent fund-raising reports they did not have the grassroots donation surge and now seeing this, it begs the question, are democrats going to be fired up enough to get out, never mind keeping the middle making the argument donald trump's extreme or the republicans are maga or whatever the argument is that the white house is making to try to woo the middle to stay on joe biden's side. >> such an interesting dynamic. and we don't know how it'll play out. we'll see. >> of course. >> so, for the republican nomination, trump right now is just running away with this. 54%. desantis is at only 17%. pence is at just 3%, a very meager 3%. any chance of that shifting? >> well, i don't think the result is inevitable at this point. we've still got nearly six months to go before the votes begin as you know from being out on the campaign trail this is a

national poll. what takes place in the super concentrated campaign in the early states in iowa and new hampshire could up end the trajectory, but we have never seen a candidate poll with as big of a lead as donald trump had for as long as he had and seen that up ended so donald trump is on course to win this nomination, but obviously there two is a big opening, ruffle half of the republicans don't want donald trump as the nominee despite the fact he has that lead so that's an opening if indeed a candidate could coalesce that whole half of the party. that hasn't happened yet. >> indictments have not slowed him down. >> clearly. >> you would think another potential indictment or two would not slow him down. that's how people, his supporters are responding to him. >> yeah, i mean we have seen -- this is such a bizarre thing we're talking about but we have seen his -- he got a surge of grassroots donations after the first indictment in manhattan. he got donations after the second indictment but not quite at the same level.

right now we are keeping an eye on the federal courthouse here in washington after grand jurors in the special counsel's january 6th investigation were just seen leaving the building a short time ago. sources tell cnn that donald trump and his advisers are preparing for a possible third criminal indictment. cnn's jake tapper is here with us. jake, obviously this would be unprecedented. i now you're going to be all over this in the next hour. >> yeah, and i think we need to take a step back and think about

what exactly we're talking about. you have the new york attorney general and the charges there from alvin bragg, which really has to do with violating business laws, allegations to cover up a scandal. then you have the classified documents case, which is certainly serious, but it's about whether or not he had the docu documents, obstructed justice to keep them, et cetera. no one is alleging he sold them to a foreign power or tried to use them to undermine the united states of america. this in a different way is a much bigger allegation, assuming that charges do come forward and, again, everybody is innocent until proven guilty but basically the case here is about a united states president trying to undermine the fundamental democracy of this nation, and refused to obey the will of the american people, and that -- the gravity of that, i think, is something that we need to keep in mind. >> certainly in talking to legal experts, they're expecting that we're actually going to learn

quite a bit from this indictment. >> well, think -- >> last time we learned so much from. >> but also the best investigation so far other than what the news media has done has been what the january 6th committee was able to come up with. but there are people who participated with this special counsel investigation, jack smith's investigation, who refused to participate with the january 6th committee, vice president mike pence, white house aide danske v-- dan s scavino. it's likely there's a lot we'll learn in terms of allegations as to what donald trump did? >> such a good point. some of the biggest figures participated in this rather than the january 6th committee. >> the january 6th committee did not have the same power the special counsel does. >> really. jake, we will see you here short think. ask you so much. bed bath & beyond relaunched actually today as an online only store. it is taking over the digital space that belonged to overstock.com. nathaniel meyersohn joins us with details. is this bed bath & beyond or rebranded overstock website? >> reporter: yeah, jim, i would say this is more of the ghost of bed bath & beyond coming back. so, overstock bought bed bath & beyond out of bankruptcy earlier this year, and now it's rebranding as bed th beyond the two companies are combining all of their merchandise. they're going to be lling it online, furniture, home good, stuff for your kitchen, but bed bath & beyond has closed all of its physical stores, so you will not be able to shop in stores only online. >> and, i know a lot of folks are dedicated to their bed bath & beyond coupons, famous

coupons. will they still apply on the new website? >> reporter: jim, i have some bad news to report and those coupons will not be valid on the new website. those coupons, you know, they're iconic, they're in our glove compartment, our basements, but they are now just collectors' items so maybe you can try selling them on ebay, but they are not going to work at the new bed bath beyond, although i did check out the new website today, and there are some good deals, so maybe if you're doing back-to-school shopping, back to college, could be worth checking out. >> nathaniel, thanks so much. >> dang it. i love those coupons. you know what else i love, taco bell. a customer filed a lawsuit against them accusing them of false advertising. the suit is focusing in on crunchwraps and the mexican pizza, long-term item, testimony foreman on the item at taco bell. you have all the details. what's happening?

>> reporter: well, what's happening is that this customer is very unhappy up in new york that what they're seeing in the ads and on the menu is not what they're getting. take a look at the documents they have. the crunch wrap supreme, there is what their promise is saying and here is what they say they're getting. look at another one. the mexican pizza which i argue could be a setting for a lawsuit. that's what they're being promised and this is what they're getting. one of the big complaints is look at how small the amount is compared to over here. we think we're getting half as much as we're promised and so upset about the lack of beef they even roped the vegans into it by looking at some of the vegan offerings and saying the vegan crunch wrap is even less than what we were offered before. bottom line is, they say it's unfair to consumers out there. they say, look, in some of the language in the particular argument they say that this is something when the economy is

cases of leprosy, though still rare, are rising considerably in the u.s. with the numbers of new cases surging particularly in some areas. we have health reporter jacqueline howard an this story for us. where are you seeing most of the new cases? >> well, brianna, we know there has been the number of new cases reported in the southeastern states of the country. that number has more than doubled over the last decade. and we also know that in central florida, about one fifth of all cases in the u.s. have been reported there. so those are some regions where we've seen this gradual increase. and we also have seen some new cases in california, louisiana, hawaii, new york and texas. but even though we've seen this gradual rise in some new cases and in those regions, it is important to emphasize that leprosy is still rare. total in the u.s., in the year of 2020, that is the most recent

year where data were available, we have had a total number of cases that year that was 159. so that is a small number for the entire united states. so it is really just this gradual increase is something that public health officials are watching closely. but there is no reason to really panic here, brianna. >> so, how are people getting it? >> that is the interesting thing. what some of these new cases, how they acquired the disease is still unclear. what we do know about leprosy, it is a bacterial infection and could be treated with antibiotics and some symptoms including developing discolored pa patches on the skin but this is not a disease that spreads from shaking someone's hand or sitting close to someone and we know that about 95% of adults here in the united states have natural im -- immunity. it is interesting how public
