investigation of hunter biden, a special counsel has been announced, signaling that a trial is now likely to fall into legal and political implications. plus blunt words from a judge to donald trump's legal team, reminding the former president he can't intimidate witnesses and warning more inflammatory statements lieutenants require a quicker start to a trial. in hawaii, at least 55 killed, thousands displaced, as fires devastate maui. one official says the historic town of lahaina is all gone. this hour, a look at what some has lost to the hawaiians, and what they need most. all of this is coming in right to "cnn news central." it is happening again. another high-profile special

counsel has now been appointed, this time it's in the hunter biden investigation. today attorney garland announced he elevated david weiss to special counsel status. he's been leading the years-long investigation, and he recently requested he be given special counsel designation. the reaction in washington is pouring in, but first, paula reid has been tracking all of this. how did this map? >> according to the justice department, on tuesday david weiss, a trumpppointed u.s. attorney who's overseen the hunter biden investigation for years, requested this special designation. so the first question is, well, why now? th're not providing an official explanation, but the r appears that talks between hunter biden's lawyers and the

justice department had broken down. they went to a hearing where they thought they would solidify, and the judge pushed back, asking for additional briefing. it appears that this case is headed to trial. that may be the impetus here, but we're still trying to figure this out. as special counsel, weiss will now be required to file a final report, and they're committed to making that report with all of his findings, public. the other question will likely come from republicans. how does this special designation impact weiss' ability to answer questions. at this point it's unclear. we know previous special counsels have testified, but they have ohm testified after they submitted their final report. sources also tell me the white house was not informed of this before the attorney general's

announcement, and neither were hunter biden's attorneys. >> we're already hearing complains that weiss has been designated as special counsel. how unusual is it that, in this case weiss would be designated, given the fact he was already the u.s. attorney and will remain as u.s. attorney in delaware. is this unusual, or would they usually find another person? >> this is unique. the trump-appointed u.s. attorney had been handling it, he'll remain that, and now he has at the designation. let's take a listen to the attorney general lay out how he sees this. >> i have concluded that it is in the public interest to appoint him as special counsel. this appointment confirms my commitment to provide mr. weiss all the resources he requests.

it also reaffirms that mr. weiss has all that he needs to conduct an appropriate investigation, based only on the facts and the law. >> it's unclear that this will insulate the justice department from any more questions about this, but the question is whether this will insulate weissing from having to testify before lawmakers. >> it will be interesting to see where he takes the case not only because the plea deal has fallen apart, but now he has special power as special counsel. let's go to the white house, arlette saenz, the white house didn't, they say, gets a heads-up about this move. have they offered a response at this point? >> reporter: brianna, the white house is sticking to the no comment strategy. when i reached out to them, they

simply referred me back to the justice department, as well as hunter biden's personal representatives. i'm told by a white house initial they did not receive any heads-up before this announcement came. they're learning about this as we all did. but this all follows really this approach from the white house, trying to maintain the independence of the justice department. as you have seen in past administrations, they really have tried to stay and refrain from commenting in any manner. this appointment of a special counsel serves as another complicated moment in the issues surrounding hunter biden. from the white house we have learn that they love and support their son. of course, they continue to have him here at the white house, often for family gatherings and other events, showing no indications that they are distancing themselves from their son amid these investigations.

this is a very personal matter for the bidens, but it's also becoming a more challenging legal and political issue for a president biden as well. he has faced a sustained pressure and criticism from republicans relating to his son hunter's business dealings. there's been threats of an impeachment hearing up in the house of representatives, so these are all issues the president will have to navigate, and no there's an investigation into his son enters a new phase. >> arlette saenz, thank you so much for that. congressman, thank you so much for joining us. first off, i want your reaction, what do you make of this designation of david weiss now as special counsel in the hunter

biden case? >> i think all along the justice department said to attorney weiss if he requested the designation, that they would grant it, but i think it doesn't take away the flaws in the republicans' arguments with regard to hunter biden. i had a chance to actually question the whistle-blowers who came forward with allegations of wrongdoing and investigation of mr. hunter biden. the problem with the fundamental allegations alleged wrongdoing t. allegations of political bias don't seem to hold weight when, you know, mr. trump was ultimately in charge of the justice department and its handling of this investigation.

>> do you have confidence that this designation is necessary? >> um, i don't know if it's necessary. i do know mr. weiss has requested it, in light of what happened at this hearing recently, but it appears that mr. weiss had quite a bit of latitude to pursue the investigation in a manner he saw fit. my republican colleagues somehow claims that hunter biden's actions reflect poorly on president biden, and somehow this involves wrong defend doing by president biden, but there isn't a sin till offa evidence that he did anything wrong a. i think mr. weiss hasn't surfaced any evidence, that there is none. >> do you think if this weren't the president's son that this move would be made here? >> that's a good point.

i'm not sure. i know my constituents aren't asking about it. the other dade i heard that richard hudson said that nobody is talking about it back in his district because we don't -- this is not top of mind. >> it is top of mind for a lot of constituents. we know that. maybe not yours, but there are many constituents out there who are paying attention to it, for sure. >> to that point, congressman -- sorry, go ahead. >> i think there's definitely some on the other side who care very much about it, but as mr. hudson himself said, it's just not one of their top priorities, the way that jobs, education and health care, other priorities are. i conduct a lot of town hall meetings. this did not come up. this is a big distraction right now. but this was something that might have gotten away quietly if the plea deal had been agreed to and carried out.

so this promises this is going to stay in the spotlight for quite some time as the presidential cycle is just ramping up. politically speak, sir, as a democrat who clearly will be backing the bandy democratic president, are you wet weather about this dragging out and getting a lot of attention during the presidential election? >> no, i don't think so, only behalf this, which is that my republican colleagues want to somehow connect hunter biden to somehow the president himself committing wrongdoing. again, not a scintilla of evidence has been brought forward, either in the house or otherwise, so this is going to be a big distraction. >> you have seen how democrats who were investigating jared kushner and the trump children, investigating their business dealings, which appeared to be stalled very much after the republicans took over the house.

should the democrats abide by their own principles in the case of hunter biden, even if the republicans are not? >> i think the house has the ability, the authority and they should be able to conduct oversight investigations with regard to the prosecution of anybody. that's what they're doing, but the manner in which they're doing it is highly problematic. remember, jared kushner was a member of the government the hunter biden is not. again, they're trying to attribute somehow wrongdoing to the president, and they can't produce even one piece of evidence to show that. that's why this is a problematic investigation right now. >> we did hear from two obama officials who raised concerns about hunter biden's work, specifically his work in ukraine. so this has been an ethical issue for quite some time.

do you think democrats have not taken it seriously enough? >> no, they have taken it seriously, but mr. weiss has been investigating it for five years. he's investigated even those particular issues you talked about. i had a chance to look at some of this evidence in a scif as well. unfortunate for they cannot produces any evidence of wrongdoing, much as they have tried up to this point. >> congressman, we appreciate your time today. >> thank you. coming up, a dramatic hearing in d.c. today in former president trump's 2020 election interference case, which could set the tone. the judge's warning to the former president, next.

indictment, this morning the presiding judge heard arguments from trump's defense and federal prosecutors for the very first time, a hearing that trump's team didn't even want to happen today. they tried to push it to next week. as we learn how the judge responded to some of the claims inside the courtroom, perhaps we can see why they wanted to put it off a bit longer. kaitlyn polantz is outside the courthouse. it seemed today what the judge was saying was very clear. >> reporter: very clear. let me start with some of her words, just tanya chutkaid the fact that , donald trump, is running a political campaign currently has to yield to e administration of just if that means he can't say exactly what he wants to say in a political speech, that is just how it's going to have to be.

so judge chutkan, she had some legal issues to determine today, which she did, about how evidence can be talked about or not talked about,'s trump awaits trial, as had is team gets to go through evidence, but what she's saying from a bigger perspective is that this is the court of law. it's very importance for american democracy, the government, all of the things set up here in this court that this tay precedence over whatever else you are doing in your day job. she actually mentioned donald trump's day job, with not words, at one point. though the lawyers are arguing that his speech could shot be curtailed because he's running for president, she's saying, no, i do have the legal right, and the courts have a reason there is a legal right to limit some of the first amendment, some of the free speech you get. when you're a criminal

defendant, you can't chill your trial. you can't intimidate witnesses, and you can't obstruct justice. in this circumstance, what she was looking at today related to evidence, she finds that there is quite a lot of law that allows her to place barriers around what donald trump is allowed to share, as he learns it, as they're preparing for trial. this was quite a serious hearing today from judge chutkan. she did infuse it with a bit of humor. my colleagues in the courtroom have been reporting back that it was lighthearted at times. yell parties, but she was very clear she will be scrutinizing what donald trump is saying very clearly between now and trial, and making sure he's abiding by the conditions he's released upon, that he doesn't cross any of the lines he's not supposed to cross and very careful not to talk to witnesses, not to share

what he's learning if it's deemed sensitive by the justice department, and doesn't do anything to chill the justice system to do what it does best, which is to take people to trial and determine whether they're guilty or not guilty. >> and we're still waiting to see when the judge thinking it best for this trial to start. thank you very much for that. let's talk about this now. legal and political implications. well elliott, and david axelrod. i do think we should start with the legal limit. what is your reaction? >> a lot of what the judge said in court today isn't that controversial. noting that a defendant might have first amendment rights, but the rights don't empower that defendant to get in the way of the administration of justice. it's just not that controversy of a point.

everything is a bit controversial when you're dealing with the former president of the united states, but she was basically stating the law. it's interesting to see how she rules in the end. >> on the hunter biden development, special counsel, your reaction to that? >> well, you know, look, it's david weiss asked. i think if the attorney general had said no, thehehehehehe poli even legal fallout would be far wo worse. this is a political issue, not as much a legal one. >> that's your purview, david axelrod. i want to ask you about this. of course, you have all of this going on with former president trump, having been indicted multiple times now, but you also have this hanging over president

biden, which, by the way, we have to remember that when he is -- his handling of classified materials as vice president, that is also subject to another special counsel. now there's a special counsel being deciding eighted when it comes to hunter biden. what is the effect of this on the president in his run for reelection? >> i'm sure this didn't land well in the white house. the republicans are sort of pointing to it for what-about-ism . they have -- they are beating that horse to death, even though they have failed to make the connection between hunter biden and joe biden in the way that

they allege. so, i think that anything that extends the hunter biden case into the election year is not welcome news for joe biden. on the other hand, brie, you listen to what happened in court today. i think what happened in court today was that the judge implied if trump does not abide by the terms of her orders and decorum and goes out to try this case in public or disclose information that he learns through materials that are given to them by the prosecution, that she may go for an earlier date for this trial. that may be one of only ways to discipline him. what if he does? now we know what one of the consequences will be if he

insists on going out and intimidating witnesses through his use the media and disclosing things he shouldn't disclose. >> you wouldn't expect that to be an empty threat, listen, if you're doing these things, we'll obviously have to move that along. what do you think of that? >> it's an interesting warning. in the just department's filing is that they want the idea of moving the whole thing along is for the defendant's protection, but also it's in the public's interest to have it moved, now for the election, but deterring bad conduct. so they -- the judge is piggybacking on that a bit, saying the more the defendant is out there sort of making it bad for himself, but impeding the justice department's ability to do its job, which is to deter this thing from ever happening again. >> let's talk, david, though,

about these continuing proceedings are going to be happening. we're still waiting to see, of course, elliott, when is this trial going to take place? is this going to take place in 2024? is he, the former president going to be jumping around from trial to trial as he's trying to deal with primaries and caucuses? you're also going to have all of this out in the ether when it comes to hunter biden, david, and i wonder, in the mind of voters -- and you know this so well -- a lot of times they don't make distinctions. can you talk a bit about those voters who may be undecided, who really do have an issue with former president trump if he is going to be found guilty, the fact he may be indicted, but now they may be clouded by the fact that, hey, legally is there a connection between the president and hunter biden? maybe there isn't, but certainly

there's this cloud of dust that's kicked up. >> yeah, look, i think that's the hope that republicans have that they can make that case. that's certainly the case you see in conservative media, that somehow hunter biden is being treated differently, and may be treated differently because of the links to the president that so far have not been proven. maybe in some voters it will. part of trump's politics in general is to suggest the waters are murky, everyone swims in them, everybody behaves in the same way, and therefore these offenses are to be ignored. we'll see if that happens, but i do think that at this point, unlike the president who's -- who would love to run on his record, trump has pretty much decided that this -- these indictments and prosecutions are

going to be his campaign, that they are symbols of his potency in fighting the deep state and the corrupt, you know, justice department and so on. he's using it to rally his base. he will be in many ways campaigning from the courthouse steps during this primary season. what we have seen so far is republican voters have responded strongly to it. he has gained with each indictment, which is a peculiar development, something we have never seen before, but this is his campaign right now. how do you think, david, that's going to play with people who are not completely in the column for trump, that are not completely his base? >> yeah, i think the problem for him is outside the base. it's helped hem to rally the base. it certainly will not help in a general election. if the primary season goes on,

starts having setbacks in the court, you can see where it could potentially affect him there, but he's taking it one step at a time. he's using it to rally his base. what we don't know, brie, is what will the aggregation of these mean? so far they've been a symbol to people that they're piling on the president, but if he starts getting convicted, if evidence is presented and he's convicted by a jury of his peers, will that change? no one knows. there's no template for this. we're in uncharted waters. >> yeah, we certainly are. i thank you gentlemen for joining us. elliott williams, david axelrod, solve to cover today. thank you. >> sure think. >> yeah. a catastrophic loss of life in hawaii, and a humanitarians cries mae only have just be gun. we have a look at the damage done, and information on how you

people have lost everything. this is going to take a long time to, obviously either be rebuilt or -- and that's going to be months, years, who knows how long. so we are gearing up for the long haul. we're providing immediate relief just to kind of calm people's nerves and make sure they have what they need star food, water, essentials, cleaning products, hygiene products. we're providing all of that currently to those folks, but it will be a long time. it's so tragic, and these folks have generations have been in line, and then we've also lost homes in the upcountry area as well. that's tragic as well.

you know, maui is an extremely resilient community. we do take care of each other here. we know we're in one of the remote places on earth, unfortunately, or maybe fortunately depending on how you look at it. people here realize that, and we are here to take care of each other. the community support has been overwhelming, and then support from, you know, national companies and feeding america, disaster services. we have a tremendous amount of -- >> go ahead, turn that off, richard. let me ask you, you mentioned that is the beauty of maui, that it is away from it all. that is certainly why a lot of people live there, and a lot of people live there, because they've lived there for generations, of course, but being on an island has its challenges when you are brigging in food.

you already have known that is as you're bringing in food and products. tell us about the challenge. obviously the challenge s. you know, even expedited ocean freight is two weeks out. that's if everything falls right into place. so, yeah. we have limited resources here currently on the island. unfortunat fortunately the harbors did not maintain dan, except for the lahaina harbor. so that's a blessing. containers that had been booked are coming in. we're able to access some of those food resources. you know, i guess the sad part is some of the major wholesalers here on the island no longer have those businesses on the

moments ago, attorneys for the family of suspected serial killer rex heuermann revealed that his wife has cancer. he has pleaded not guilty to charges he killed three women and he's the prime suspect in the murder of a fourth. all of their remains were found on gilgo beach back in 2010. attorneys for his wife, asa ellerup explained what the family is going through. there's a gofundme page, who their lawyers cease they're

in studio with this. how much is it going to cost and how fast do we need to jump on these? >> september, october the shoulder seasons when there's not a lot of travel take place. the message from travel site hopper they say if you jump on it now you could get a pretty good deal. in july it was $274 on average for a domestic round trip ticket. now it's gown down a little bit. if you've got some pto in the bank, the message is use it now. around this time next month is when people look at holiday travel. this is fares peaking in late november, $283 for domestic round trip. there's so many factors that go into airlines price setting, but right now the factors are pretty clear. jet fuel is low, competition is up, and the capacity is up just because airlines have really

recovered from the pandemic. the thing that people are really competing on when it comes to price are these international trips, and that is something because the world sort of opens up for the first time really this summer where people are paying a lot more, $813 for a flight on average round trip from the u.s. to europe, and that's really not far off from where we were last year. folks have shelling out for pretty big trips and you can find a pretty good deal. the places trending where people are going are places served by ultra-low cost carriers like melbourne, florida, reno, nevada, manchester, new hampshire, buffalo, charleston, south carolina. those are typically not the really big destinations like disney world, and disney land, the places you hear all the time. these places show people are so motivated by price. people want to get out if they want to get a screaming deal. >> are you sure they aren't
