♪ a pivotal grand jury hearing in georgia is happening right now, and it is moving faster than expected.

we're live in atlanta where an indictment against former president trump and others could come at any time. plus in hawaii, a new lawsuit blaming the power company for those catastrophic wildfires on maui, but officials have not said what caused them. the humanitarian crisis now growing along with the death toll. the fire now the deadliest in the united states in over 100 years. tense moments in the black sea as russia fires warning shots at a cargo ship, then sends armed soldiers aboard. we're following those developing stories and more coming in to ""cnn news central."" a fourth donald trump indictment could be on the way, and even as soon as today as the grand jury in the trump election subversion case in georgia is rapidly approaching the finish line.

today jurors are hearing from witnesses as fulton county district attorney fani willis presents her case. things appear to be moving faster than expected. two witnesses set to testify tomorrow got bumped up to today. trump has tried to counter the grand jury activity with a flurry of social media posts smearing key prayers including witnesses in that case. cnn's sara murray and elena dreen are tracking this. sara, a couple of witnesses we thought were going to show up tomorrow, they're there today. what do we know? >> reporter: this grand jury is having a very busy day and apparently moving very swiftly. fulton county district attorney fani willis has begun presenting her case against former president donald trump and his allies. we know she intends to seek charges against more than a dozen individuals. we've already seen a couple of these witnesses come in and out today. we saw former democratic state

senator jen jordan going in to testify. we heard from former state representative bee nguyen who said in a statement she testified before the grand jury today. both of them were witnesses to these conspiracy ladened statements. there were two witnesses we expected to see tomorrow, independent journalist george chidi and geoff duncan. we learned both of them have been told to come in and testify today. it's clear the grand jury is moving at a faster clip than what the district attorney's office originally anticipated. >> question. do we know when the grand jury is scheduled to wrap up today? does that give us any indication as to when they might finish up their work for good? >> reporter: we don't have a clear deadline for when they may wrap up today. normally the courthouse behind me closes at 5:00 p.m. when this grand jury is hearing

the normal array of cases, it's not unusual for them to be done by 1:00 or 2:00 in the afternoon. it does not seem like that's what's likely to happen today. it seems like they're going to be here at least for a couple more hours. we're waiting for any indications that things are winding down. again, we're expecting two more witnesses. >> sara, thanks so much. elena, as the jury portion of this nears its conclusion, trump has been attacking it on social media but also it seems applying pressure to witnesses in the case. >> reporter: he is. he's use the sale as the past indictments, trying to get ahead of a possible indictment in georgia and message it on his own terms. one of the most concerning things we saw from donald trump today on social media was go after a key witness in this case, former lieutenant governor geoff duncan he, quote,

shouldn't speak to the grand jury that. post reads, quote, donald trump said, i'm reading, reports that failed former luiieutenant governor of georgia geoff duncan will be testifying. he shouldn't. his post went on to say that duncan was a loser. of course, i want to point out he spelled geoff duncan's name wrong in that paste. the thing here, jim, it's unclear what will happen from these posts. we don't know if he's going to be indicted or if a judge in the case is going to try to put restrictions on what donald trump can say on social media. of course, in a separate case, in the federal case regarding his efforts to overturn the 2020 election, the judge has begun to set restrictions on what he can do on social media. i know from my conversations with donald trump's team, he's not planning to cease posting.

he sees truth social and social media as his way to communicate directly with voters, particularly his base and defend himself. they think it's his first amendment right. >> this or any other case, judges often rule that they don't want them to pollute the jury pool, one, they also don't want to intimidate witnesses. we also will note geoff duncan is a republican. boris. let's break down only of the key details in this case. the infamous call that then president trump made -- listen. >> so, look, all i want to do is this. i want to find 11,780 votes, which is

>> -- overturn biden's 2020 win. this involves potential violations of state law. let's break it down. charges that could include election fraud, making false statements to state and local officials and even racketeering which willis previously used to prosecute gangs and even public school officials who oversaw a cheating scheme. here are some of the key players in all of this. of course, d.a. fani willis, the judge overseeing the grand jury, robert mcbernie. he's defended willis, but then blocked her from pursuing -- meantime you have secretary of state fred raffensperger who is on that call.

the infamous find the votes call. he rejected donald trump's efforts and certified the results in the peach state not once, but twice. then there's rudy giuliani. he's accused of presenting bogus claims of election fraud to state officials. you also have former georgia republican chair david schaffer. 16 fake electors in all which tried to overturn biden's legit electoral votes and give them to donald trump. 16 of them in total. many of them now kword rating with the district attorney's investigation. let's dig deeper in all of this and bring in georgia state university law professor clark cunningham and republican strategist doug heye. clark, i want to start with you. what do you make of the pace of what's happening in the courthouse in fulton county right now? earlier we spoke to former lieutenant governor geoff duncan

who was set to testify tomorrow. turns out he's testifying today. what do you make of that? >> district attorney fani willis kind of set herself a deadline some time ago that if the former president was going to be brought into the courthouse for arraignment, it would happen by this friday, the 18th. she's asked the other judges in the courthouse to keep people out of the courthouse, did not hold hearings, through the end of this week. if she doesn't indict in time to ar rain the former president by the end of friday, there's going to be a problem with all the security arrangements that have been made because they haven't been made past this friday. my guess is she's working to get the former president into the courthouse, my guess is by thursday. of course, it would have to be coordinated with secret service. we're expecting she's aiming to get the indictments out by the

end of today so she can get the former president here by thursday. that's my guess. >> doug, we've seen donald trump go after people like geoff duncan and the judge overseeing the special counsel case over his efforts to overturn the 2020 election here in the nation's capital. how does that work as a political strategy? it doesn't seem to be hurting donald trump in the polls. >> this indictment looks potentially to be very different. with the previous indictments, we've seen a rallying around trump and a big fundra-raising boost. people who voted for donald trump in 2016, but joe biden in 2020, a very real difference here, boris. that's that this is georgia. jim alluded to this earlier, about the people he's attacking are republicans. as we've seen in previous elections, whether they're senate elections or presidential, donald trump's

behavior in the state of georgia hurts him politically in the state of georgia and in a way that can really determine who wins in 2024 or not if donald trump is the nominee. we know he lost the state. we know he lost the state last time and he cost republicans two senate seats which is one of the reasons that a lot of republicans would prefer to see donald trump go away one way or another. this further exacerbates that. if you're a georgia republican and donald trump is not just attacking you but your colleagues who won primary ess in the republican party, this is not good politics. >> we saw how his argument for the 2020 election became a central focus, not just in the last midterm but the special election in georgia. clark, to you. geoff duncan, a cnn contributor was on a couple hours ago with us. i asked if he felt intimidated

by the former president insulting him on social media saying he shouldn't testify before the grand jury. he was a very disciplined witness and would not share his perspective. but from a legal standpoint, does a witness need to feel intimidated for it to be witness intimidation? >> no, no. it could be attempted intimidation. it's possible that the former president got himself a couple extra criminal charges against himself today. they may be revising the draft indictment to add a count -- really two counts. one count of witness intimidation and then attempted witness intimidation becomes another basis for that big racketeering charge that carries a minimum five years in prison. it was an extremely unwise thing for the former president to do, to write something which so clearly -- it says he should not testify in front of the grand jury. that's pretty clear. >> it's also detached from the

reality of the situation in georgia in terms of what the former lieutenant governor was trying to do after the 2020 election and get the truth out there to the people of georgia and to the country. doug, i wanted to go back to a point you made about this hurting donald trump in georgia. obviously the backdrop of this is the 2024 presidential campaign, and he's leading pretty broadly across the map, in iowa, new hampshire, et cetera. how do you think this plays out when it comes to his effort to take the republican ticket in 2024? >> it shouldn't hurt him. it shouldn't hurt him for two reasons. one, ultimately and bizarrely this reenforces donald trump's message. he's said all along the system is rigged, rigged against me and rigged against you. this becomes evidence to his base. his opponents by and large seem hesitant to attack donald trump on the things that any other candidate would do in any other

race for any other office. in your opponent is indicted, whether it's one time or multiple times, you go after them. donald trump, by and large, has been free from that process which makes the debate coming up more interesting. also this hurts him not just in georgia, but we learned from georgia how it can hurt him in other states. donald trump argued over and over again that the process is rigged, the elections are rigged, and enough republican voters believed donald trump, they didn't fill in mail-in ballots, didn't vote, didn't vote in the runoff, in the senate races, that's not going to affect georgia, that can affect my home state of north carolina, arizona. >> fascinating point. doug heye, clark cunningham, we have to leave the conversation there. appreciate you joining us. >> thank you. >> glad to be with you. we are going to take you live to maui where multiple

the fire. >> this is the line that the fire department on this part of lahaina held. they decided we're going to keep it here, this particular neighborhood. most of it survived as a result. let me show you the contrast right here. this is the home of archie kalepa. he's legendary surfer, lifeguard, a hall of famer in maui. ninth generation familhe lahaina area. you can see what the spirit of ohana means, as everybody from maui and islands begin flooding donations here. they set up a command post, improvised first responders here, all volunteers, all people from the community. they've created several of these pods around the burned area of the fire zone.

you can see all the diapers and critical supplies, the water and food, people just coming in here and it's sort of a self-organizing system. archie has great leadership experience as a lifeguard extrao extraordinaire. it's all coming into play right now. people trust him. he does say the state and federal response is getting a bad rap. let me ask you about the immediate response right now. there's a perception as we've been outside the perimeter that there's no federal or real official state response, and most of the work on the front lines is being done by people like you, grassroots, just improvised first responders. is that fair? what's really happening. what do you need? >> i don't think that's fair. i don't think that's fair. this is a crime scene. this right here is a crime scene. so what people don't understand

is the government has to do due diligence before they start moving in. so they're at 30,000 feet. they're looking, evaluating about how they need to come in to begin to facilitate this oper operation. at the same time, they have to figure out how to take care of this operation. so, you know, that is not easy. >> so it's a humanitarian response in the middle of a working crime scene. >> exactly. the truth of the matter is, when you look at the overall devastation, we are not going to be ready to allow people to see what we're living through in six months. >> we're hearing from a lot of people outside of the sort of quarantined zone right now, the fire zone.

they're frustrated because they can't get back in to see what happened to their homes or belongings. they're afraid people up here aren't getting the help they need, that there's too much red tape. and the shelter is down in the center of maui. those folks here say right now it's a matter of managing the outpouring of aid. they don't want a lot of this to turn into trash. they're trying to manage it as it's coming in. fema is starting to bring in shipments. right now the message from here is they have plenty of tangible supplies. they would love to get a dust shield to protect this community from all the toxic dust that's blowing up the hillside from down below, containers to store a lot of this stuff and keep it to when they need it, maybe months from now. they're really begging for sustainable compassion and grief. they're afraid that our attention here will run out and shift elsewhere, maybe another tragedy on our overheated planet

military helicopter hovers and soldiers born the ship. cnn's nic robertson joining us. nic, walk us through what happened during the incident. >> reporter: this is a turkish operated container ship on its way to go and pick up ukrainian grain. it's going to do that along a route it's been using for the past year, a system that's been in place for the past year. the russians, though, are taking exception to what the ukrainians are doing, allowing ships like this to come in and get their grain. russia was part of this grain deal, the black sea grain deal which it pulled out of and ukraine has said we're going to keep going. the ship appears to be part of that. the captain, when these russian troops came aboard from this helicopter along with what looked like a senior civilian, clamored aboard the ship, jumping out of the helicopter as it hovered low, the captain was

asked, well, why did you try to steer away when we fired warning shots from the ships and lofts. he said, i'm in international waters, and i was trying to get to a place where i had better communication with the shore. the russians looked at the documents of the crewmen, passports, et cetera, they're all turkish. then the captain says the russians didn't really do anything about searching everything else on board the ship. after about an hour they took off. for this crew and certainly for the ukrainian government this feels like real intimidation on them trying to get their grain to international markets, which is really needed. >> nic, we're also learning new details about a plan from the kremlin to equip nuclear submarines with hypersonic missiles. >> yeah, these are the super fast, five times the speed of

sound missiles that are hard to intercept. these sir con missiles are the variant of hypersonic missile that russia uses from ships at the moment. it already has them armed with that. to put it on nuclear-powered submarines, that makes them harder to detect. you don't know where they're going to pop up. they can stay submerged for a long time. this increases the threat against the ukrainians and, frankly, anyone else within reach of these missiles. we know russians have fired hypersonic missiles at kyiv before, and they've been intercepted. but when these missiles are on a submarine and you don't know where they come up, it's harder to track them. if you can't track them, you can't shoot them down. this escalates the tensions, makes the situation more dang dangerous. >> stunning escalation. nic robertson, thank you. jim. coming up, a new twist in the hunter biden case.

lawyers for hunter biden are working to keep at least part of his collapsed plea deal in court. in a few court filing they say the deal they made with federal prosecutors to resolve a felony gun charge is still, quote, valid and binding. that's separate from the tax charges. it comes after trump appointee david white was appointed as a special counsel. the white house declined to weigh in on a special counsel appointment, repeating that president biden wants the doj to be free of political interference. cnn's kara scannell is covering the story for us. kara, on this plea deal, one related to taxes, the other to felony gun charges here. attempting to resurrect one piece, what would that do exactly, if they were able to do that? >> this investigation had been going on for five years looking

at a broad range of conduct. it was just in june that prosecutors and hunter biden's team reached a deal on misdemeanor charge for tax-related charges that he would plead guilty to. then this diversion agreement involving possession of a gun while addicted to a controlled substance, that would have been a deal where the felonar would have gone away if hunter biden agreed to certain things during this 24-month period including don't commit any other crimes and don't use any drugs. what his legal team filed yesterday was their position saying that they think that agreement, this diversion agreement is still valid and still binding, and that's because both prosecutors and the biden team signed this deal. the kind of diversion agreement usually is something between a prosecutor and a defendant and it doesn't go before a judge. in this case they did include the judge in it because they wanted her to be a neutral arbiter if there was a question of whether he violated the terms of the deal. that was the rub at the plea

hearing last month, the judge saying she wasn't sure if that was constitutional or not. she asked the parties to brief on this. on friday the department of justice elevated david weiss to special counsel and saying they no longer had a deal on the plea deal or the diversion agreement. this is the split here. if they are able to get this diversion agreement to stick -- that's still a big if because the judge isn't keen on how it was structured -- that would alleviate at least one big issue here. although the disagreement on or falling apart of the tax deal now appears to be very much alive. one of hunter biden's attorneys, abby lowell, was on news shows over the weekend where he was asked about this tax charge and if it was inevitable that they would be going to trial on it. he was on cbs "face the nation" yesterday. here is what he said in response to that question. >> it's not inevitable. >> you're trying to avoid one?

>> yes, we were trying to avoid one all along, and so were the prosecutors who came forward to us and were the ones to say, can there be a resolution short of a prosecution. they wanted it, and maybe they still do want it. >> so biden's lawyers there saying they are still interested in a plea deal. of course, with weiss elevated to special counsel, that indicates a decision or potential negotiation on that seems now a bit far from now versus how we seemed so close to a deal just last month. jim. >> and now it's a special counsel investigation. kara scannell in new york, thanks so much. next, an update on evan gershkovich, the american held in russia. the u.s. ambassador meeting with him today. the connection between air pollution and dementia when cnn returns.

as runway incursions. this is the seventh such case as a major airport we've seen since the start of this year. this one is interesting because it involves this private jet as it was coming in to land at san diego international as this southwest airlines flight, a 737, was told to pull on the runway and stand by for takeoff clearance. what's so interesting is the faa now tells us the air traffic controller in the tower cab heard alarms sound warning of a potential collision and told that private jet to go around, abort the landing and come back to land later on. now we're finding out from air traffic control audio where the private jet pilot noticed this collision was imminent as well. you can listen here. >> verify you're still clear to land? -- >> say again.

tomorrow morning at the cincinnati open. jim. where you live could increase your risk of dementia later in life. people living in regions with air pollution linked specifically to wildfires in agriculture were more likely to develop dementia than people that didn't face that sem exposure. cnn medical correspondent meg tirrell has been following the story. particularly agriculture and not safe from factory emissions. why exactly? >> jim, this is one of the first studies that actually looked at these specific sources of exposure to this fine particulate matter. they did find the most robust connections between agriculture and wildfire, living in areas where there's pollution from those kinds of sources. in terms of agriculture, the theories include the fact that this is a source of ammonia, also the use of pesticides. that could potentially contribute to some of this
