new charges against donald trump. new co-conspirators, this time indicted, and a new defense strategy for the most indicted former president ever. >> trump says he will have a major press conference on monday.

the timing is exactly four days before the august 25th deadline for him to surrender in georgia. the same goes for his 18 co-defendants who also have to surrender before that date after a grand jury voted to indict them all. >> the indictment argues all of them, quote, refuse to accept that trump lost and knowingly and willfully joined a conspiracy to unlawfully change the outcome of the election. trump himself is accused of 13 new crimes. his first response to the charges, calling them politically inspired. fani willis plans to ask for a trial date within the next six months. walk us through the nuts and bolts of this case. >> this was the fourth criminal indictment for former president trump this year. but in terms of the scope, this

is definitely the most broad case that he is facing. it encompasses not only the allegations here in georgia, which our colleagues have been reporting on, but also allegations of the effort to overturn the election in arizona, pennsylvania, and michigan. and in addition to being the broad conspiracy that they are alleging, he's also charged alongside 18 codefendants, including some of his close st advisers like former chief of staff mark meadows and rudy giuliani. and mark meadows for the january 6th committee concluded was at the center of all of this, he's absent from the federal indictment. so seeing him here charged for his alleged role in this conspiracy was significant. it's art of what makes this case different from the special counsel's probe.

former president trump denied all wrong doing, but i expect one of the first things we're going to see after he gets through surrender, initial appearance and arraignment, his attorneys are probably going to try to move this from democratic fulton county to the federal level, so he can have a much more broad jury pool. >> you asked a question to fulton county da about how she's going to try this case. what do you know about the timing of all this? >> reporter: i think one of the questions is how this is going to practically play out. donald trump, obviously, has a lot on his legal calendar already. and when you're alongside 18 other defendants, that means you have a lot of attorneys bringing a lot of challenges. so i asked her if her intention was to try all of these 19 defendants together as we have seen her do for other racketeering cases. take a listen to what she said last night. >> have you had any contact with

the special counsel about overlap between these cases and do you intend to try all these defendants together? >> do i intend to try the 19 defendants in this indictment together? >> yes. >> yes. >> have you had any contact with the special counsel about the overlap between this indictment and the federal indictment? >> i'm not going to discuss our investigation at this it time. >> reporter: it was also telling that she wouldn't answer the question of whether she's had communication with special counsel jack smith, because in the past she said i haven't heard anything from him. i wouldn't recognize him if i saw him. it's unclear what that means behind the scenes, but trying to bring all these defendants to trial together, you would expect it's possible some could take deals. we could maybe not end up with 19 defendants at the end of this, but that's very difficult. >> you had the best questions yesterday. those were the two most news making things. how to charge all these people

at the assignment saim time and disclose if you're talking to jack smith because there's nothing wrong with that. >> that was strange she decided to keep whatever conversations maybe happening private. >> sara murray is legit. we can all agree on that. it was no surprise at all that her questions at the news conference that came at like 2:30 a.m., were truly fantastic. let me ask you something here. besides the new georgia charges, why are they different? >> i would say that the breadth of this indictment much more ex-tensive. you saw charges 19 defendants. the special counsel's case in terms of the election subversion case, that only charges donald trump, even though it does mention those other unindicted cocon spear tort. this that case, it brought four charges just against trump. this georgia indictment lays out 161 separate acts that span all the way from november 2020 through 2022, prosecutors in

fulton county saying all of these acts were in furtherance of the broad conspiracy to flip the election. subvert it for trump nationwide. this indictment really does lay out the acts that were taken not only in georgia, but also in other states. what's interesting here is because the district attorney is charging this under this racketeering statute, she said it. she can really paint this broad picture and tell this overarching story of an enterprise and criminal scheme, what's notable is that fani willis repeatedly gone to this statute in georgia in other high-profile cases in the state. just recently, she won convictions against 11 educators in the atlanta public school sl. they were accused of this broad cheating scandal, where they inflated test scores. so she's used this statute before successfully, and also, this statute, if convicted, it mandates a minimum five-year prison term, maximum of 20

years. so the penalties for this are very severe, and fani willis has tried and tested this statute in other realms. now looking to try it against these 19 defendants. >> we have talked about how one of the first things that is expected after arraignment is for trump to try to get to this moved to federal court. what are you hearing about the chances of that happening? the likelihood of that happening? >> reporter: i'm saying there's a chance that that could potentially happen. his lawyers believe that this is a possibility for him. they are going to lean heavily into what he faces here. heavily democratic fulton county, there's a larger argument they make in the court of public opinion. they argue there should be limits on the ability of elected prosecutors to bring charges against former presidents. they will argue that what goes around comes around. we could be opening a pandora's box. this is a theoretical argument.

charges. one true social post wrote, so the witch hunt continues. 19 people indicated. i think he meant indicted. me by ab out of control and very corrupt district attorney who campaigned and raised money on, quote, i will had get trump. the post goes on to say, why didn't they indict 2.5 years ago because they wanted to do it right in the middle of my political campaign. witch hunt, donald trump said. of course, there are cautions of whether the district attorney is campaigning on this and false allegations a about that, but this is donald trump's strategy. he wants to get ahead of the charges. he wants to frame this on his own terms just as we have seen him do with the previous three indictments. and i know from my reporting as well that his team was pretty prepared for this. they spent most of monday lining up their surrogates and allies, as they have done with past indictments and readying them with talking points so that immediately once an indictment

was dropped, they would come to his defense. we saw them do that last night. we saw people like house speaker kevin mccarthy post on truth social. same thing with jim jordan arguing that trump did nothing wrong. this is the playbook that they have cultivated over the past several months. we're going to continue to see them use exactly that over the next couple weeks. >> alayna treene, thank you very much. she talked about the a play bock. they have used it before. it might help them politically, but don't know if it's going to help in those criminal indictments. >> among the indicted is trump attorney and mayor rudy giuliani. according to the indictment, on or about the 10th day of december 2020, he committed the felony offense of false statements this writings in fulton county, georgia, by unlawfully making at least one of the following false statements and representations to members of the georgia house.

aside from former president trump, 18 other people are facing criminal charge this is morning in the sweeping georgia indictment. so let's break down who they are, starteding at the top of the trump administration. measuring meadow was the former chief of staff engaged in the efforts to contact state election officials, include ing that infamous call where donald trump asked the georgia secretary of state to find votes that he needed. jeffly clark wri clark urged th acting attorney general to sign documents that made false election fraud claims. and there was an entire legal team pushing those claims as well, according to the indictment. chief among them, rudy giuliani, but also john eastman, who wrote

the memo that mike pence could single handedly reject the vote certification. and kenneth chooez bo ro detailed how states could elect lek tors. zlectors. the three other attorneys were also intimately involved in pressuring georgia officials to subvert the true outcome of the 2020 election. shawn still was a fake elector who allegedly encouraged others to sign. mike roman was said to be a go between on both the fake elector scheme and the efforts to breach the election system in georgia. scott hall and misty hampton are

accused of giving pro-trump officials access to ballots, computer systems and voting machine there is. the indictment alleges that harrison floyd, the leader of black voices for donald trump, a publyist used to work for kanye west, and a pastor named steven lee were all involved in the effort to intimidate two georgia election workers, who were wrongly accused of tampering with ballots and said it ruined their life. >> joining us now is legal analyst joey jackson, and former prosecutor shan wu. sara laid out the co-defendants, if you will. now we know who they are. what do you think of the fact that the da says that she intends to try all of these defendants together rather than separately? >> so prosecutors like to do that for a number of reasons. number one, you get all of the

information out. that's compelling to everyone. number two, that means you dirty everyone up. there maybe facts unrelated to another person, but guilt by association. so it makes it more compelling. there's judicial efficiency, why are we trying a case five different times when you can try it once. but it's important to mention that there's a number of considerations. the first consideration is that defense attorneys are going to make motions to sever. what that means is that, hey, i don't want my client muddled in with everyone else i have a right to have my client tried separately. this is prejudice ishl. people who might plead because the evidence is so compelling. you ask the question of whether there will be people who may cooperate. i look at this ask i don't even know the prosecution needs people who they are trying to flip because it's so precise,

it's so factually detailed. it doesn't mean that it's provable. we'll wait and see. that's for another day. with respect to the indictment, it looks like they have the goods and then some. so the bottom line is although the prosecutor wants to i try them altogether from a practical perspective, for all the reasons i mentioned, that may not happen. >> super interesting. it's also expect ed that one of the first -- i'm going to call it one of the first moves that trump's team could try to make is try to get this moved out of state court into federal court. pros, cons, likelihood, what do you think? >> a lot of pros for trump for it to go to federal court. he may get a broader jury pool than just in that county. and theoretically, maybe he thinks were he to win the presidency, that having been in federal court would give him greater control over trying to pardon himself or something of that nature. don't think that's going to

succeed here. a similar move failed in new york. i think this is something that is squarely within the jurisdiction of the state prosecutor, and so i don't think he's going to have much success on trying to move it out of there, although i would say why he'd want to do that. with this level of specificity in the indictment, it's not looking that great for other defenses at the moment. >> that's very interesting. add into this that in georgia, rico charges carry a mandatory minimum of five years behind bars. i have heard some attorneys theorize because of that element of a mandatory minimum, that could lead to some of the co-defendants, if you will, trying to enter into plea deals. do you see that? could that be part of a strategy here? >> i do. whenever you get an indictment, you sit and what's next that's

going to drop is you're going to get discovery. that's relevant to your question, becauses now you now how compelling the evidence is. what are we arguing about here? you go to the prosecutor. you say, look, what deal can we cut. is my client going to have to do anything, will they have to turn evidence, so i do see that happening. >> who decides that? is that fani willis? >> prosecutors are very powerful. they control the cards. they control the cards with respect to if we're going to make a reduction in the charges, are we going to put you on our team, such that you will give evidence against someone else. a lot of different things. then ultimately if you plea, the judge has to go to the judge who says what's going on here. i see a lot of things here. in terms of the order of when these cases maybe tried because of the compelling nature of the georgia case, are there conferences with respect to the other cases. we have two pending federally.

as far as i know, calendars do move. let's see where it goes in the pecking order. >> one thing and speaking of i won't call it overlap, but when you're looking at the federal indictment that trump is facing over 2020 election subversion, mark meadows noticeably absent from that federal indictment over the election. measuring meadows is charged in georgia. should people take something from that? >> no. there's been a lot of speculation that meadows being mising that he's cooperating. it's possible. it's not an unreasonable assumption. however, i will say from the point of view of the prosecutor and defense attorney, it would be inexplicable that he cut some kind of deal to cooperate in the federal case but yet he's

full-blown charge d in the stat case. i'm not sure what his counsel would be up to. there are very different indictment, even though it's the same set of facts. and in many ways, the georgia indictment is the case that jack smith would have brought. he might still bring it, if he had more time. because it names all these people. as joey was pointing out, that can make it more complicated because there are legitimate reasons you couldn't get the scheduling together with this many defendants and maybe that was part of why the federal strategy was to streamline it more only charging trump. but as to meadows, it's puzzling to me that he's missing from one but fully present in the other. >> it is interesting. for both of you, if we have the time, this case is unique, as has been pointed out. unique because it is basically because it's pardon proof. given how unprecedented though

this could be, a state case moving ahead after an election is decided for a federal election for the president being decided, adding how unprecedented it is, even though we know that it's pardon proof in georgia, is there any gray area here? >> there could be. so think about this. i think it goes back to the point of there's a lot at stake everywhere in terms of the various indictments, but this is so much at stake for the reason you mentioned. you talk about the issue of pardons. the federal cases, it's around open question as to whether the president will pardon himself. but i'm sure he will attempt to do that. many people not so high on that case thinking it's not that significant. this georgia case is the real deal. it lays out chapter and verse.

there's so much suffering, but help is pouring in from all around the world for those affected by the devastating maui wildfires. officials say 2,000 housing units have been secured for people whose homes and businesses were destroyed by the flames. right now, the confirmed death toll is at 99, but that number is expected to go up as search efforts continue. the red cross spokesman join us now. we have seen some of these devastating pictures, but when you're there and come across this enormous amount of destruction, what do you see? what is it like being there right now? >> as you have seen these images, whether you're on maui or the other islands here in hawaii, it's impossible not to be impacted by this. when i was flying in yesterday, i was speaking to a gentleman who was actually in maui on a

boat by coincidence when the fire broke out in his area. and he talked about feeling to helpless, but also so fortunate because he didn't know what would have happened had he not been on this boat. we heard so many stories about how people were running and it's so traumatic. and it's why we're so fortunate to be here as an organization that to lend an ear, to meet them where they are and give them the services they needed. >> they were the physical needs and then the emotional and psychological needs after something like that. i do want to ask you what is the most immediate need? had what do people need now that they mite may not be getting or how do they get it? >> i would say one of the biggest challenges we are facing right now is just dealing with connectivity on the island.

our organization has been on the ground in these communities and staying in constant communication with partners and organizations on the island as well as county and state officials. so word of mouth is a really big part of that. people are talking to their neighbors, they are talking to their family members. if it we can get some information in their hands, that will be disseminated out to the community. when it's safe, when we're told by officials and fire fight ing crews it's safe to certain areas, there's still a danger in and threat there, we are sending volunteers to deliver service in person. so by doing that, by staying constant and opening up to all lines of communication, our red cross number. we're trying to meet people where they are. >> people are the outside can do to try to aid this effort. >> one of the best ways to
