$200,000 bond and a promise to behave on social media. can he live up to it? what happens if he doesn't? employees at the fulton county sheriff's office are being threatened. details about the threats. eight republican presidential candidates will take the debate stage tomorrow for the first primary debate. is that enough to keep donald trump from grabbing the spotlight with his counterprogramming push. this is "cnn news central." by this time on thursday, donald trump could be the only presidential candidate to be arrested, skip the debate and released on $200,000 bond, all in the same 24 hours.

a lifetime of achievement in the snap of a finger. trump's legal team agreed to the bond deal in fulton county, georgia and including strict guidelines of what he can put on social media the. trump posted this. i'll be go to atlanta, georgia, on thursday, to be arrested. can you believe it? only because it's happened in new york, florida and washington, d.c. this year. trump to be the only former president ever with a mug shot. he could be fingerprinted as he faces 13 counts in georgia for crying to overturn the election there. as for the candidates he's running against, they are now doing debate prep. how 2020 of them. this is for the debate that trump says he will skip. let's start with breaking news out of georgia. cai k outside of the courthouse in atlanta, the first of the co-defendants has arrived to

surr surrender. >> at the jail. at fulton county, leave it to the man whose profession is a bail bondsmen to be the first defendant among the 19, including donald trump, to surrender to jail. scott hall is this defendant. he is accused of seven different counts, including racketeering, alongside the former president. he's accused of taking part in a scheme to commit election fraud, for computer theft, to trespass on computers to invade privacy, all related to trying to access vote tabulating machines in coffee county, georgia. we will see what happens with the 18 other defendants, including trump himself, in the coming days. we're in the middle of a process this week where they all are negotiating bond first. and then, trying to go to the jail after that. they don't have to spend too

much time in that detention center. as they negotiate bond, we know what the bond is. it has more restrictions on the other indictments he faces. he has a $200,000 bond. and he has several restrictions placed on him about communicating with witnesses and defendants in this case. he's not allowed to do that. on top of that, he had spifk instructions not to use social media to intimidate anyone affiliated with this case. we are going to be waiting for today and for the rest of the week, as more of the defendants begin reporting to jail to be arrested, to be processed and to enter the pleadings of not guilty. we're waiting for donald trump to report to jail. we believe that is going to be on thursday. some of them have to have the bond terms set, as well. rudy giuliani, sidney powell,

mark meadows, the chief of staff. we haven't seen them in the system at the county courthouse or working with the d.a.'s office. it could be a momentous day. a lot of action in this criminal case. >> to be clear, it's tuesday morning, if i'm not mistaken. and they have until friday. >> i'm sorry. >> i'm the one who is lost. you have until friday morning to turn themselves in. the first of the co-defendants just did. we could see a lot of activity in the jail, first off, and also in the courthouse, over the next several days. they have to surrender at the jail, each of the 19 defendants. and they have to reach the bond deals. rudy giuliani, who may not be able to pay virtually anything, we don't know what his deal will be. >> we don't. that's something to watch closely. who shows up for rudy giuliani as a lawyer. how he brings himself to

georgia, to get this done. he does have a deadline that he's going to have to meet. he is a lawyer himself and could represent himself, as he may be interested in doing. although, rudy giuliani, his law li license is suspended because of some of the actions he took for donald trump after the presidency. and he is out of cash on a lot of fronts. he couldn't pay for some of the intermediary steps he needed to just respond to lawsuits that are involving him that are against him in the 2020 election. so, we'll have to wait and see how much he is able to put up for bond, when that comes down and what he had to be negotiating. >> in georgia where the action is. great to see you, as always. we'll check back in with you, as soon as we hear more news. thanks so much. fulton county district attorney fani willis, now reaching bond agreements with four former president trump's

co-defendants. tomorrow, john eastman, whose bond was set at $100,000, is set to face the fulton county jail. ken choseboro agreed to a $100 bond packet. he is the architect to put forward a fake slate of protrump electors. and ray smith has agreed to a $50,000 bond. he's facing 12 charges. including violating the rico law. conspiracy and oath. as we mentioned, the defendant, scott hall, the first that is supposed to turn himself in to jail today, he works at a bail bondsman in georgia. he was a poll watcher and spent hours inside the prestricted area of the voting office. it shouldn't be lost on anyone,

that the defendants are all professionals who are trained to defend or a z the accused in legal battles. that's their normal job. now, they are the accused. >> joining us now, elliot williams. we're hearing what we think is the first known co-defendant or defendant in the trump case to surrender. scott hall. being the first to report, does that do anything? >> it really doesn't. everybody will have to report, kate, by friday or they face very serious consequences. he's the first of 18. you're going to see a frickle of folks coming in over the couple days. he doesn't get a prize or a benefit. >> there's a door prize for reporting first. not to make light of it. i was wondering if the judge or the d.a. looks -- the judge looks kindly on someone who comes first and gets in there first.

>> you know, that's not an unfair point. as a general matter throughout litigation, you want to stay in the judge's good graces and on the judge's good side. that's prosecutors or defense. really don't want to be seen as playing with the court or messing around with them and complying with the court order is the kind of thing that a party can do to get in the good graces of the court. you have a good point there. >> let the record show, i finally made a good point when it comes to elliot williams. i can end my day already. as we were going through -- there are 19 of them that will be surrendering at some point. today, let's talk about donald trump and the bond restrictions that we know the judge has put on trump. what do you think of the bond restrictions? and how much latitude does the judge have in this regard? >> doesn't have a tremendous amount of latitude. every defendant in this case, the band bond is different.

the level of risk or the nature of the crimes that person has been charged with. the uniqueness of former president trump, they are surprisingly normal. the idea that a defendant should not threaten other witnesses or should not talk to co-defendants about the case isn't remarkable. it's remarkable when we think about who the defendant is and what his history of bluster and statements and even threats, towards other personnel. but the specific provisions in there aren't that remarkable. how do you find the line and where is the line for valating the agreement? especially talking about the social media aspect. what is likely to happen to him if he does step over that line? >> that's the $1 million question. i guess the $200,000 question right now.

when you're talking about you can't go to x, y, z supermarket and you can't go to a place, that's a very specific bond condition you can put on somebody. he does it or he doesn't. here, when you're talking about speech, it is a little blurrier. and a gray area. how do you define what constitutes a threat? how do you define what constitutes speaking about the case? and we get back to the question of the latitude that judges have. the judges have to pick out and sort what the nature of the communication was. any such statement from the president will be blasted around for the world to see. but it will come down with the judges on whether it did cross that line. >> thank you so much. once again, the cases surrounding trump are leading to threats, intimidation against people who are doing their jobs.

this time, the staff of the fulton county sheriff's office, who operate that jail where trump will surrender, have become the targets of threats. nick valencia is joining ugs outside of the fulton county jail. this is a disturbing norm, is it not? >> well, it appears that anyone who dares hold the former president or tries to dare to hold the former president accountable is at risk of receiving threats. now, a law enforcement force with knowledge of the information tells me, the leadership are receiving death threats, including threats to her residences. the fulton county sheriff here, in addition with dealing with the nightmare of the surrender of 19 co-defendants, including a former president, is having to deal with safety issues when it comes to the sheriff's deputies. the threats are under investigation, as are the threats of the fulton county grand jury. the authorities tell me they are

we know that some of donald trump's co-defendants are beginning to report to jail to be processed. president trump has said he is set to surrender himself to do that on thursday. the day after the first republican primary presidential debate. and it is official, that's happening in georgia, eight campaigns are headed to milwaukee to kick off the first presidential primary debate. the capped dates who met the rnc requirements are these eight. the offutt used and probably overused phrase, make or break, applies to this meeting for all of them. the debates are hard enough. an additional complicating factor is that they won't be facing off with donald trump. he is choosing to skip the big

night. steve, what are you hearing from the candidates on how they are preparing? >> one of the things we hear from a lot of the candidates is they are criticizing donald trump for his decision not to show up. that's something we heard from desantis, who has been hammering trump in recent days. listen to what he said over the weekend about trump's decision. >> nobody is entitled to anything this world, less of all, the republican nomination for president. he has a great opportunity to come out and do this. i think he owes it to people. i don't think our voters, even those that appreciate what he did, i don't think they look kindly on somebody that doesn't think they have to earn it. >> desantis' campaign believes without trump there, he will be the focal point of this debate.

they have him preparing to take fire from all sides of the de debate. they put emphasis on this debate for him to demonstrate he is the front-runner in the trump alternatives. there's a lot of candidates trying to break out, as well. a lot of them have a lot more experience on a debate stage than desantis. it will be interesting to see if he can stand up to the lofty expectations his campaign has set up for him. >> jonathan, would you like to join us? >> i'm going to walk in. they put me in the corner. >> no one puts john berman in the corner. >> they didn't want me distracting you. >> can we discuss, how you take over, when we are talking about ron desantis, he has one of his coaches that we often have talked to in previous cycles.

spin room. donald trump is not participating on the debate stage tomorrow night. but many of his senior advisers and surrogates are still planning to go. i'm told that many of them have been given outside media credentials. including byron donald, and kari lake and congressman matt gates. they are expected to be there. trump's advisers were frustrated by this news. they tried to come to a resolution with fox about this, to be there and represent the former president in his absence. they have found a resolution. outside media organizations can allow them in the spin room. that's what they're planning on right now. many of them, many trump senior advisers are headed to milwaukee or already there and are expected to be there tomorrow night. >> it will be interesting. you give them the circus they are looking for.

how about trump himself? what will he be doing during the hours of the debate? >> we know he is not going to be on the debate stage. he prerecorded an interview with tucker carlson. he will remain in new jersey, near where i am now, at his golf club in bedminster. while his opponents are on the debate stage. a great opportunity to counter program with the tucker carlson interview. another opportunity he'll have to upstage coverage of the debate, is on thursday, when he travels to georgia for his surrender. this is something i'm told that trump's team welcomed. they welcomed the idea of overshadowing the debate coverage.

able to separate themselves. i'm 65% of the group that's persuadable. i'm looking for an adult in the room. somebody able to rise above the fray and to arcticulate and pla. the kitchen table costs more today than four years ago. there's an opportunity for these folks to rise above. and i think america is begging for an adult in the room in this situation. >> the result that everybody will be watching for, is whether they come at each other or only concentrate on joe biden. they have said, we can't have this many candidates. some of you need to drop out of the race. he's not the first to say this. are those folks who say, with all of the people, trump is going to take this, all the way to the end.

>> yeah. it's easy to feel like this is an overwhelming situation. if you're somebody that wants to nominate somebody other than donald trump, as a republican, it can feel overwhelmed. if you break down the situation into smaller projects. there's going to be 300,000 people, republicans who vote in the primary up there. and donald trump is ahead of chris christie by 30 points. if you get somebody that's been indicted, shouldn't be the next president of the united states, you can see chris christie in one news cycle, one debate, climbing up and being even and flip. and the same thing with iowa. ron desantis is only 20 points behind. that's only 20 points. but that's 200 people that show up to vote in the iowa caucuses. we have to determine to step up and garner support of 65% that

is persuadable. there's 35% that will be his pen pal in prison. we need to focus efforts on the 65%. the pot of gold is the middle that are disillusioned with joe biden. i can see a landslide for a republican if they're name isn't donald trump. >> that's quite a statement there. here's what he said about the debate. >> if he refuses to debate through the debate season, i have issue with that. i have no issue of him the skipping a couple of debates. this is a good opportunity for me to introduce myself to the country. >> he's talking about donald trump skipping the debate, saying the first couple don't matter. he would be upset if the rest, he didn't show up for any of them.

first on cnn, the biden administration is getting a new white house counsel. president biden has picked ed s siskel for the job. he handled the obama administration in response to the benghazi demonstrations. he comes at what could be a pivotal moment for this white house, jeremy? >> no doubt about it, john. this will be a politically charged environment he is walking into. the congressional investigations led by republicans. also some potential legal peril for the president, as he faces the ongoing special counsel's investigation into his handhands handling of classified documents. there's the matter of the president's son, hunter biden. the u.s. attorney investigating him, has been named a special counsel. all of this will in one way or

another, fall on the plate of the white house counsel. that will be ed siskel. a person familiar with siskel's selection, told me his investigation in managing the investigations into the obama white house, the benghazi investigation, that was a key factor in his selection for this post. it's viewed as an asset for him. for four years when i was vice president, he helped the counsel's office navigate complex challenges and expanded the agenda on behalf of if people. ed has shown a deep commitment to public service and the law. i spoke to several colleagues who said his time as an attorney at the justice department headquarters, his time as a federal prosecutor in showing,

evidence to review. comparing that workload to the height of the washington monument. cnn's marshal cohen is responding to this. how is the justice department spontding to this? >> reporter: they are holding deadcy, comparison to the washington monument. they are holding for the case to go to trial in january of next year. this is not just what they want. this is what the dcountry deserves. there's a national interest when a former president and possibly future president goes on trial. that's the argument from the prosecutors. they've accused the trump team of basically cherry picking the data. cherry picking the numbers. as they were arguing to stretch out the case, delay the case. they want the trial to go in 2026. that's really far in the future.

minutes from now, a federal judge is going to consider whether the state of texas should be required to remove the controversial buoys on the border of texas. they were ordered to remove them. it says that floating barriers violate federal law and could impact relations with mexico as well as pose environmental risks. cnn's rosa flores has the details for us. >> sara, the fight over the controversial border buoys is going to be happening today here in texas, in the federal courthouse that you will see behind me where an injunction hearing is going to be happening today. here is the back story though, the state of texas in early july deployed the buoys in eagle pass, texas, shortly thereafter

the federal government filed a suit against texas saying they were deployed unlawfully without permits and today, the federal government is going to ask a federal judge to force the state of texas to remove these buoys within ten days of the requested order. through the court documents we have learned that the state of texas plans to argue and expected to argue that the rio grande is not a navigable waterway and these buoys are not a structure. now the usdoj according to the court documents as well plans to argue that it is a u.s. waterway and the international boundary between the united states and mexico which is the u.s.'s largest trade partner. further the usdoj further alleges that the survey based on gps technology that the state of
