♪ ♪ ♪ two people have surrendered and 13 more to go. for trying to overturn the 2020 election results in georgia. trump's take, saying he will proudly be arrested tomorrow. rudy giuliani about to land in atlanta to surrender at the fulton county jail.

he has been spilling this morning as we are getting new details on how he will pay his legal bills. >> all of those legal developments coming on the same day, presidential candidates and the republicans, at least, will take the stage for the very first primary debate and the lineup still in question after an unexpected injury on a basketball court. i'm sara sidner with the impeccable john berman and kate bolduan and that's all coming up here on "cnn's news central." ♪ ♪ any moment now rudy giuliani's plane will touchdown in georgia. he's set to work out his bond agreement before heading to the fulton county jail to turn himself in. giuliani faces 13 charges, the most along with donald trump, for his efforts to overturn the 2020 election in georgia, his alleged efforts. he spoke to reporters in new

york as he was leaving a little earlier. >> they destroyed my right to counsel, my right to be a lawyer. they're destroying his right to counsel and they've indicted lawyers and i've never heard that before in america. i don't know who they are. these are just regular people making a normal living. they're going to bankrupt. they won't convict them. >> as of this moment, six of the co-defendants have turned themselves in. 13 others including donald trump have until friday to surrender. cnn's paula reed is outside the fulton county courthouse where not too long from now we could see rudy giuliani or at least he touches down here, paula. >> that's exactly right. giuliani is expected to land any moment here in georgia and then we expected his team will come here to the fulton county courthouse to meet with the district attorney's office and negotiate a bond agreement, so the terms for giuliani's release

and once that is in place then giuliani can head to the fulton county sheriff's office where he will surrender. that's a process that includes fingerprints and even a mug shot. it's interesting that he's doing both of these things on the same day because most of the other defendants have spread the two things out, the bond agreement and the surrender out over a few days, but a source tells me that giuliani wants to get this all done before former president trump comes to town tomorrow. traveling with giuliani today is his spokesman and his longtime friend bernie kerik. he is the former new york police commissioner. he also had his own criminal trial where he was convicted. he was ultimately pardoned by former president trump, but he's been helping giuliani sort of through this process and trying to help him find a lawyer. kerik is not an attorney. giuliani has had difficulty finding a lawyer to represent him. many of the people who he previously worked with, he owes them money. some he owes over a million dollars to and it is difficult

for him willing to find a lawyer willing to represent him and he does have someone who has a georgia law license that can sign a bond agreement and that's all he needs today and it is unclear if that person will be willing to represent him through an entire trial. bernie kerik is an unindicted co-conspirator in this case and some have restrictions in which you can talk to other people involved in the case. we'll be watching the restrictions with giuliani. he could have more money flowing into his coffers helping him with his legal debt and maybe helping him with his former attorney and former president trump is set to hold a fund-raiser for giuliani in the coming weeks. >> as for donald trump himself, we're getting new details, i understand, about his plans to surrender in prime time? >> pretty much. where else would he surrender, john? his lawyers came earlier this week to negotiate his bond and that's already in place and he

chose to surrender tomorrow. we expect him to come to georgia in the evening to go through that process. now that, of course, should be after rush hour traffic which you know is really bad here in atlanta, but as of now the district district attorney, they will all be treated the same and it will involve fingerprints and a mug shot. at the federal level, his manhattan case as well they didn't do a mug shot because they argue that law enforcement uses mug shots to identify people when they go on the lam. former president trump is one of the most famous people in the world and they didn't opt to do the mug shot there, but here, as of now it does appear they will likely do that mug shot and of course, those are released. we've only seen two of them so far, but those would be released to the public. i mean, a truly extraordinary moment in american history, john. >> you can say that again. paula reid, thank you very much for being there.

we will talk to you soon. there are two co-dfsefendan in georgia who are hoping to skip this step and process, mark meadows and jeffrey clark, both are also asking a judge to move their state case to federal court, and in the process, kind of let them off the hook for facing arrest this week. cnn's jessica schneider has more on this, and joins us now. jessica, what are they asking for here? >> yeah, kate. they're really banking on these motions to move their cases to federal court and in the short term, anyway, that would be so they could avoid arrest before the noon deadline friday that was set by the fulton county d.a. so it's both mark meadows and jeffrey clark. jeffrey clark was a justice department official and they've argued that their status as federal officers when their alleged conduct occurred forms the basis of this indictment, because they were federal officers it requires their cases to be heard by federal and not state court, and the advantages, in their view, would be that

they would be taking it to a higher level court with different judges and a different jury pool that would draw from the suburbs of atlanta rather than the city of atlanta and in the suburbs maybe the jury members would be more sympathetic to trump and his allies and that's the thought. the d.a., fani willis has until noon today to respond to the motions made by mark meadows and jeffrey clark. a hearing on this case whether to move it to federal court has been schedule for monday and because the deadline for mark meadows to turn themselves in, kate, is friday at noon. a court in this case could actually rule on parts of this and they could issue an order in the next day or so that could help meadows and clark avoid arrest and this is unswirling at a different court, while these charges still remain in state court they're trying to get them removed and we'll see what happens here. kate? >> thanks for laying it out,

jessica. >> with us now is cnn anchor and chief legal analyst laura coates. thank for being with us. i know you have a late show to do tonight. >> why? do you mean, sara? is there big news? >> apparently, there's something going on and some debate that is happening which i'm sure you will be a part of, the a nal sir, of sis, and mark meadows asking the federal courts for an emergency order to move his case out of georgia. what do you see happening here? >> well, jessica is so right about the factors involved in trying to get something removed and by the way, it's not a slam dunk to simply say, you know what? i prefer federal court. i don't want the state court level and it's easier for my schedule and my life and you have to meet some criteria to do so. and you will tell the court, look? what i was doing is under the

color of my office. it is part of my job description, you can't criminally indict me for doing what was required of my job. if this goes beyond your job or at all, not even a part of it because elections are the purview of the states and not the federal government, please explain to us how a chief of staff is going to be involved in that particular process. that could fail. second issue and criteria is whether you have a viable federal defense to what you're talking about and if you don't then it's not likely to be removed, but the demographic notion of having jurors and the pool maybe in your mind more favorable is part of the consideration for likely mark meadows, but even if it's removed to the federal court, it doesn't automatically go to a federal charge now. it's still a state charge against the defendant. if convicted it would be a state-level conviction which means not pardonable. >> that's an important point

there. i do want to ask you, rudy giuliani is on his way as we understand it to atlanta to turn himself in and he had a whole lot to say, basically just going on the attack against everyone and everything saying this is all basically a conspiracy to take away his rights. should he be talking? >> oh, gosh, is that the question, sara? because the answer is no. he has the right to remain silent and probably should for so many reason as are all of the defendants and it's a very important question, and it's tongue in cheek with you. should you be talking and should you be articulating all these things in the court of public opinion when you know they can be used against you and can be used to compare and contrast what other statements you have made. are they consistent? have there been others to corroborate what you said or undermine it? is anything going to be different in the future, but as

we reported just yesterday he's had some trouble getting counsel and part of that reason might be financial. another part of it might be defense attorneys, while everyone certainly has a presumption of innocence, at times you might consider the juice not to be worth the squeeze. and so if you do not have a viable defense, if you are entangled in some way with another co-defense such that you can't cannot make a separate argument or distance yourself from that person then you might be undermining your own ability to have and mount the defense. so when you think about whether he's talking or not, it might be the attempts of an otherwise desperate person who is hoping to argue in the court of public opinion and to carry favor in one direction and to extend a ten-foot pole. in the end of the day, we are not talking about a layman. we are talking about rudy giuliani. he knows rico very well and if

anyone should know to stop talking it should be rudy giuliani, and yet here we are. >> he's not the only attorney talking and there are a heck of a lot of attorneys who are charged in this case, and no shade to attorney, but i hear that they could be the worst kind of defendants. i want to ask you about john eastman. you know better than i do, but that's what i hear. >> doctors are horrible patients, right? it's not just that. doctors are horrible patients, so there you go. >> to be fair, but john eastman has also said -- come out and spoken -- actually, i'm going to hold on one second because we have a little bit of news for you. giuliani's plane, the plane that we believe giuliani is in as he has flown from new york into atlanta, landed there, going along the strip there. he will have to, of course, do the whole thing and get off the plane and get in the car and go down to the jail, but that is

believed to be giuliani landing there in atlanta as he prepares to negotiate bond and then surrender in fulton county at the jail that we've been watching where at least four or five other people have now already surrendered. this is a big moment in that everyone knows giuliani and not everyone knows all of these other defendants and he is a very well known former mayor of new york. someone who is very versed in how this is supposed to happen although georgia is very different. once he is done with all of this, laura, he is going to be booked and he is going to have bond and there will be a mug shot of him according to the sheriff. everyone will be treated the same. when you consider what has happened with rudy giuliani, as you mentioned those rico charges, tell us about these moments that we are watching as he lands there in the plane that we think that he has taken from new york to georgia, about his fall, if you will. putting aside that we know that you are innocent until proven

guilty. >> you know, we did a wonderful special talking about the fall for rudy giuliani, once known as america's mayor, but he's also the top prosecutor in new york and he was somebody to use the rico statute which, of course, he has now been charged under in spite of this to go against crime bosses and mafia and the mob family, knowing about the criminal enterprise. it's actually a pattern and a blueprint that now other prosecutors follow including one, fani willis out of fulton county as the d.a., but taking a step back, the fact that he has not perhaps already negotiated bond terms is very significant here, sara, because the reason you're hearing about bond agreement in advance for people like john eastman and for people like sydney powell and for people like donald trump is because in fulton county, i believe, if you do not otherwise have it pre-negotiated, you will have a lengthier process waiting

for a judge to sign off on your bond terms to go through the rigmarole of conditions of release to have you sitting there longer like you would for every other defendant and not just this fulton county 19 to pre-negotiate terms and you want in the interest of court, and efficiency have the opportunity to do so. fact that he has not yet done so enters a kind of general population of those who might have court appointed attorneys, who might not have had the opportunity to negotiate in advance and are now in a line of people and i expect there to be some delays in hearing that and for the very reasons that you are intimating that this is a former mayor, former prosecutor who knows rico and knows the law quite well, knows federal law quite well in spite of what we have been seeing and perhaps he feels he is best positioned to negotiate the terms of what he would like to do and are we maybe getting a preview of a pro

se litigant here in rudy giuliani in someone that is able to represent themselves? most representatives would be counselled against representing themselves in any court proceedings let alone court negotiations, but if he is landing and negotiating this now. he has to have a judge sign off on it and he gets to the back of the line and as we heard from fani willis yesterday, there are no extensions being granted. noon on friday is the deadline. >> well, it's interesting that the thought of him basically trying to defendant himself in the case, we know that he's having real, major money problems. we'll have to see what happens there. laura coates, we're watching that plane as it taxis there in chamblee, georgia, and we believe rudy giuliani is on that plane headed into court and to be booked into jail.

i want to go to paula reid, do you have information as to whether rudy giuliani is headed to court first or is going to end up sort of waiting at the jail for the court to make some decisions here? >> well, down here in fulton county is first, you need to negotiate your bond and with this particular case the district attorney's office has asked the legal teams to go and meet with her in person and they had to travel on monday and meet with the district attorney's office in person to negotiate that bond and that's exactly what will happen with rudy giuliani. his team is scheduled to meet with the district attorney midday today at the fulton county courthouse. it is unclear if rudy giuliani will attend that meeting and then after they get the bond agreement in place, then he can go to the fulton county sheriff's office and surrender. most of the other defendants have done this over the course of a few days and they have the bond agreement and they come in a day or two later.

rudy giuliani wants to do all of this in one day. he is keen to get out of georgia before former president trump comes into town tomorrow. that is not hartsfield jackson, airport. he flew in here private. this is a man who currently has seven figured in unpaid legal debt. and bernie kerik, an unindicted co-conspirator in this case, and longtime friend of rudy giuliani and has been helping him and it's notable that somewhere he got the money to be able to fly here to georgia today private. that is significant for someone that is in such debt and is unable to pay so many of their legal bills. he has at least one lawyer with a georgia license who will help him through this bond agreement today. there are also at least two other lawyers traveling with him and it is unclear if these people have agreed to represent him in this full case or if

they're just willing to help over the course of these few days as bernie kerik is, as well. kerik is not a lawyer, but has extensive law enforcement experience not only as a police commissioner and also as a defendant and he's helping rudy giuliani as he gets through this initial stage and at this point, it is unclear if any of the lawyers he has today will be representing him out this this case in fulton conte. >> it is really interesting, those developments hearing from laura coates, he could represent him and having a attorney alongside and your comment about how much he owes and the fact that he has taken a private plane, clearly landing in a different airport and not atlanta hartsfield. if you see the plane in the background there. you see the stairs are down and clearly, we'll see people start coming off that plane. we do believe that rudy giuliani is on that plane. paula reid, thank you so much to you and laura coates, as well. now over to you, john. ? we'll continue to watch that plane and we can notice rudy

moments ago, this was rudy giuliani's plane landing in atlanta. he is on his way at this moment, we believe, to the fulton county courthouse where he will negotiate the terms of his bond agreement, then he will report to the fulton county jail and surrender there. the former mayor of new york city will surrender. we believe he'll be fingerprinted and have his mug shot taken and this is all part of the georgia case, the case against 19 people with charges that they allegedly tried to overturn the 2020 election results in georgia. we expect donald trump to surrender tomorrow night in prime time. so that's the legal ring. while all this is happening the first republican presidential debate is tonight in milwaukee. of course, donald trump will not

be there. there will be eight candidates on that stage assuming that north dakota governor doug burgum who got injured in a basketball game is okay enough to take that stage. nevertheless, the debate will take place. with us now from milwaukee is former wisconsin governor scott walker. it's good to see you. this must feel like having your friends over to play at your house in wisconsin. look, you have been on the presidential debate stage -- >> well, only if you elbow them when you're playing them one on woen. >> you've been on the debate stage many times in the presidential ring. what warning do you have for those candidates as they take that stage. what have you learned? >> yeah, the biggest thing i learned from having been at that first debate and a month later that cnn did at the reagan library was that forget about the consultants. forget about the d.c. insiders and forget about the pundits and

be as bold as you were to get you there in the first place if you're a governor, senator, business person, do the thing that got you on this platform. be as bold or bolder than you've ever been before. may mistake was listening to consultants who told me to run on my record. that's not enough. you have to capture the attention, and the millions more that will be watching at home. >> don't listen to your consult apartments who tell you to run on your record. is there a candidate right now who you sort of, you have the sense that is mirroring that mistake you feel that you make because i ask you that governor desantis is seen by many in the republican party to be successful. you were seen in the republican party as a successful governor. is he making some of the mistakes you think you made? >> i think so, and i think he can correct a fair amount of that tonight. he has a big, bold record and a lot of people see his record in florida and there are positives there, and as governor and

governor, you're not running for election to be the nation's governor. you're running to be president, so you have to escalate things. you have to raise it to a whole new standard. you have to talk about not just the things that you did, but the things that you're going to do going forward. i think you can have that breakthrough moment and i think he has to have that breakthrough moment if he'll be continued to be viewed as the most viable alternative to president trump. >> has to? >> i think he has to. i think it's a make or break in that regard. it's not enough just to have a competent debate. remember, this is not just a head to head. many of us have gone head to head with our general election opponents and you're trying not to stumble and you make no mistakes, when it comes to a multi-field debate like tonight, you're competing with seven other candidates and you can't afford not to capture people's attention early on. that means he's got to be bold. he's got to be decisive and probably most importantly, he's got to have some passion. i would expect, for example, another friend of mine, chris

christie to come out swinging not just at president trump and very well will go after desantis and that will be a moment for him and the public, the voters and the public will be watching to see how ron desantis responds and i would expect he'll push back that could help him. >> do you think it's a good idea for christie to come out swinging against both trump and desa desantis? >> i think he has, if you look at the margin that president trump has by these indictments if you're a republican voters and even if you're not 100% behind trump for reelection or the nominee, you feel like it's a member of the family being attacked and so there will be escalation in the coming days, but to break through one or more of the candidates on the stage tonight has to make a compelling case. i think for christie, that's when he is. he's got to be who he is. he's an attack dog and he goes

after people and he's going to have a shot and the key is whether it's desantis or any of the other candidates out there. they have to respond and not just defensive, but bold and transfer and say i'm willing to fight and not just to defend my record, but i'm going to fight for the american voter. >> do you think trump is beatable? >> i think right now it's a very, very much a long shot. obviously things can change dramatically between now and early in 2024 when he's primaries and caucuses kick off and if i was a betting man i would bet donald trump is a nominee and i would say he has a good shot at being president of the united states and none of that will be easy. i think in wisconsin and another race against joe biden and donald trump will come down to a handful of votes in places like milwaukee, madison and a handful of other cases across the state. >> what's your advice to the candidates who are polling in the low single digits about whether or not they should stay in the race? >> to me, they have to have a

breakthrough moment tonight. if they don't have that, to me, i would get out and maybe stay in through the second debate, but i don't think it's worth it for them, their supporters or others and to have the debate stage after you've had one or two, when you've got maybe three to five tops that are in any position to be able to take on the current front-runner and obviously, president trump as people don't live up to the moment. >> i know you just said you're not a betting man and i'm going to ask you who you think will emerge from tonight's debate as the winner and as having the best performance? >> well, i think, like i said, to me the desantis campaign is putting maybe not all, but a good chunk of their chips on a strong performance tonight. i think he needs to have that, and i think he can counter the chatter about whether or not he's up to the challenge of being a contender and having others attack him i actually think is good. we saw that in the first debate

with donald trump years ago and almost everybody was attacking him and he took them on and he looked like he was the guy in charge. if ron desantis has done that he's the winner and the outside of the box thought is i would look at someone like senator tim scott, and i think he's got a compelling story. he'd have to rev it up a little bit and i was advising to have a couple of cokes and up your caffeine level and if he comes out swinging with passion, he would be someone that people might not expect to have a big win tonight. mike pence and nikki haley should have a viable -- >> don't listen to consultants and do listen to scott walker. have fun playing with your friends at your house as we like to say, nice to see you, governor. >> although hopefully nobody breaks a knee. >> let's hope. >> sara. i have a promo to read, you know what? i can't actually read it. >> wait! >> excellent, john. get the critical context and

basically there will be a reckoning, he said, if donald trump attempts to block georgia's justice system or bully district attorney fani willis. this prayer vigil that has been going on this morning is for the personal protection for district attorney willis, her staff and those members of the grand jury as cnn has reported who have experienced threats since these indictments came down. those threats, of course, are still under investigations, but they're also talking about political protection here to prevent any sort of political retaliation from state lawmakers in georgia, republicans in georgia that have talked about potential for them to use resources like a law that was passed last year that does give the state more power to remove duly elected district attorneys. this is about getting their supporters, their clergy members and as well as people in the

gathering in milwaukee to watch it all play out and also headed to wisconsin today, president biden's campaign. the campaign has installed dark brandon ads at billboards across milwaukee. they'll be flying planes overhead. the chairman of the dnc and others are planning on holding a press conference in more than an hour and the campaign gave a preview in the message around their first republican debate. >> the truth of the matter is it doesn't. they're all playing out of the same playbook and they're all espousing the same, unpopular positions that donald trump lead with and he continues to drag this party to the extreme, and so whether he's on the stage or not, his extreme agenda will be. >> joining us for more on this is former obama white house senior policy adviser ashley allison and political analyst the onand only john ashrom.

to me, it sounds like the 2022 strategy all over again. wash, rinse and repeat. will that work? >> i don't think that's the only strategy there to play, but i do think it's an important one. look, the democrats' agenda is fairly popular with both democrats independents and some republicans, whether it's talking about improving the economy, whether it's talking about a woman having access to choose through abortion rights and whether it is talking about making sure college is more affordable, people find these policies overwhelmingly popular and so to talk about that is smart especially when you look at the president's record. what i do think, though, what the camp company can do at their press conference around 1:00 is also talk about donald trump and the type of person he is and the fact that he's facing indictments and how he threatened the democracy and the campaign joe biden has talked about the threat of democracy

and they haven't leaned in on those indictments just yet and there's an opportunity to do that because we pretty much know that very few republicans will actually do that on the stage tonight. >> that is an interesting point. leaning in on the indictments especially, john, when you think of the timing. you will have this debate tonight and you have donald trump surrendering to be arrested tomorrow. with the timing -- what do you think about that strategy leaning into the indictments at this point with this debate tonight? >> the news cycle will do a lot of work for you in that regard, but it raises some of the basic question it is. who on the stage, not chris christie and asa hutchinson, has what it takes to overturn the election? that should be disqualifying and for reasons of cowardice if nothing else. debates will be largely about from the candidates' standpoint, me, and elections are about you. how are their policies going to help you and it's an opportunity

to raise policies and shift that focus. >> i only giggle because it's been a policy like conversation in politics for quite some time. >> it shouldn't be and i think there's a lot of space there for someone who has to stand up and say here's my vision for how i will help you. >> he's not going to be on the stage tonight, but john, do you think it will be better or worse for democrats if we're looking at that perspective, if joe biden is making the case, had donald trump made the debate stage tonight? >> i think trump will dominate the debate whether he's on the stage or off the stage because in this case, absence is the highest form of presence and we're always talking about the -- these indictments which are completely unprecedented. so i think it's really about saying who on the stage will have the courage of their convictions to tell the truth which is that trying to turn an election is unacceptable and that's what's un-american and how much of the gravitational pull has to do with cultural war

issues is economic and how can we rebuild the middle class? that should be a big issue both parties can debate about, but not if you're interested on the former. >> that would be interesting to see the breakdown of minutes in terms of what's spent on culture war issues and the economy, for one example. ashley, we've already been asking this morning to republicans leading up today, what does a winning night look like for anybody standing on the debate stage. what does a winning night tonight look like >> well, i think there's an opportunity for the democrats to seize if no one stands up against donald trump. it identifies that they are all dealing to him being the leader of their party and most likely the nominee. i think democrats should seize on that. to that point, we haven't had a debate about policy. there's an opportunity to introduce policy conversations

to the floor. as democrats i would come back and respond and say, this is actually what the republicans want. remember when donald trump was president and they separated children from their families. that's not the immigration policy we're talking about. so i think there's a real opportunity to lean in both on donald trump and policies and democrats should do that immediately. >> and no one should be surprised that a former senior policy adviser to the obama white house really wants to lean in on policy. let's go. >> we should all want to lean in on policy. biden's campaign laid out a little bit of how they are definitely becoming omnipresent in wisconsin. they have also just launched their first state specific ad just yesterday. let me play a little bit of that.

>> i feel like joe biden understands people like me. all of the things that biden fought to get passed helped the middle class. >> we know biden won wisconsin in 2020 with just over 20,000 votes. it's key or else you wouldn't have a debate in wisconsin, a republican convention going to be in wisconsin. >> 100% essential. one of the things during the campaign was the fact she did not campaign in wisconsin. trump won it narrowly by less than 1%. biden won it by about .5%. making a middle class argument reminding people what his administration has done, that's essential because that message actually hasn't gotten out. biden, there's been a lot of consequential legislation in this past. but biden does not get credit for it within polling.

eviction notice in the garfield section of pittsburgh when police came under heavy gunfire from one individual. it does appear, according to the people we have spoken to, that there is only one suspect in the case, but as you just said, this is a very active situation. you can see the scene. we're told there's a number of law enforcement agencies there on the scene, including a s.w.a.t. team and if you listen to some of the video come ing io the newsroom, you can hear a lot of that rapid gunfire. there's no confirmation of how many shots were fired as police were trying to serve this eviction notice, but we know, again, there were a lot of shots fired. just listening for ourselves. and we don't know much more than that. we believe there's no suspect in custody at this moment, but we believe there's one suspect they are honing in on. but you can see the scene right

for yourself. officials talking to people in that area. it's a heavy car donned off area. we have reached out to the fbi to see they involved themselves as well. we're trying to get those answerings. but an area that law enforcement is i saying stay away from all the this moment. the garfield area of pittsburgh, as they have a very active situation after law enforcement tried to serve this eviction notice on someone in that area. >> an extremely active situation. i'm not sure i have heard those words used before. there's an exchange of gunfire. >> one neighbor in the area saying in terms of the what he heard more than 100 shots fired saying i have never heard bullets like this. it's something you would see in a movie. >> we have to let you go, but it's one suspect at this point? >> at this point, it appears to be one person that law enforcement is focused on.
