workers. overnight five others turned themselves in. the number of missing in fire-scorched maui has fallen significantly, now officials are turning some of their attention to what started the fires. a new lawsuit is charging hawaii's electric company. i'm sara sidner with kate bolduan and john berman. this is "cnn news central." ♪ this morning a photo that has become the greatest political rorschach test in history, the mugshot of a former president, dramatically unprecedented says "the new york times," a sinister apparition over on also nbc, a master class on capitalizing on one's super villain era on business insider and yet another extraordinary moment for trump reports reuters. indeed donald trump used this photo almost from the moment the flash bulb went off, it is part

of a new fundraising email. he even posted it on twitter or x or whatever it is, which is no small thing. this is his first post since he was banned from the platform after the insurrection. the biden campaign send its own fundraising pitch titled approbo of nothing and says i think today is a great day to give to my campaign. they did not use the photo per se but it was clearly hanging over everything. in fact, it now seems more clear than ever that this photo of inmate p-01135809, the best here rick from lay miss, by the ray, this photo will maybe literally but definitely figuratively be the centerpiece of the 2024 presidential campaign. for trump the legal battle is the campaign. trump is listed as 6'3", 215 pounds on the booking sheet. all of us who can dunk a basketball can see that the next

big legal and campaign decision will be about the timing of all these cases against him. especially now that one of his 18 co-defendants in georgia is scheduled for trial in october. that is single digit weeks away. cnn's zach cohen is live outside the courthouse this morning. the action is not over there yet, not even close, zach. >> reporter: john, it's been a whirlwind 24 hours here in atlanta, but, you know, with he saw a parade of witnesses -- or a parade of defendants and their lawyers here at the courthouse yesterday and then eventually surrendering before donald trump came down at the fulton county jail down the street. now, look, we still have a lot of moving pieces in play here. looking ahead the legal challenges for the district attorney fani willis as she tries to prosecute all 19 of these people including the former president at the same time are already starting to pop up. you mentioned that the trial date for one of these defendants ken chesebro who was a lawyer

helping trump at the time that was set tentatively by a judge yesterday but the judge played clear that that only applies to chesebro and not the other 18 defendants who fani willis says she wants to try all together. we are starting to see maybe some cracks developing or at least complications developing in that effort to try them all together. we also know that there's several defendants trying to get this case moved to federal court, among them is former white house chief of staff mark meadows. he is arguing i was operating as a federal government employees at the time, the federal government -- sorry, the federal court should throw this case out because of it. fani willis does not buy that argument and she's arguing you were a central player in this broader conspiracy to overturn the election and this case should stay in atlanta. we are seeing the legal challenges popping up with a sprawling rico case like this. yesterday's action leading into more action looking ahead. >> yes, trump did surrender, we see the mugshot -- that's mark

meadows right there, but we know for sure next week comes big legal moments as well. thanks to you for that. and also this morning donald trump is already trying to capitalize on being the first -- the first person -- a first that no one strives to be, which is the first u.s. president sitting or former to have their mugshot taken. the former president pushing out a fundraising appeal with his mugshot attached very quickly. here is what he told reporters after he left the jail. >> what has taken place here is a travesty of justice. we did nothing wrong. i did nothing wrong and everybody knows it. >> cnn's kristen holmes joins us from new jersey this morning near trump's bedminster golf resort. kristen, what else are we hearing from donald trump about all of this now? >> reporter: well, kate, let's talk about that mugshot really fast. i talked to a number of advisers yesterday when they were still trying to figure out she was going to have that mugshot taken

and many of them did not want that to happen, but once it became clear that they were, in fact, going to take a mugshot of the former president they tried to shift the media narrative around it and use it to their advantage. we know they had multiple conversations about how exactly he should pose for that mull shot and they came up with the idea he should not smile and instead look, quote, unquote, defiant, that is not surprising as the former president cares very much about his image. in fact, after he took this mugshot, after he looked, quote, unquote, defiant, they put it out into fundraisers. they also posted it on twitter, x, formerly known as twitter. this was a big deal. for months there was speculation of whether or not former president trump would ever get back on the platform. this was them trying to take control of the media narrative of the fact that he was the first president or former president to have his mugshot taken. and that is what donald trump's team likes to do. now, just to be clear, the president himself or former president is not happy about

these arrests, he was not happy being processed. take a listen to what he said yesterday after he went to the jail. >> terrible experience. i came in, i was treated very nicely, but it is what it is. i took a mugshot, which i never heard the words mugshot, they didn't teach me that at the wharton school of finance. >> reporter: now, i'm sure that they did teach him mugshot at some point and he did know that word before yesterday, but it is clear from his voice and from people i've talked to who are close to him that he is exhausted by this, he is agitated by these cases. this is not something that he wants to spend his time doing, as we have reported, he wants to be running for president. he wants to be campaigning out there and talking about his poll numbers, but i do want to stress one thing and we talk about this a lot, that even with this fourth arrest, even with all of these looming charges as of now he still is the front runner in the gop primary field.

>> absolutely. and only because i did not go to the wharton school of finance do i know what a mugshot is. it is good to see you, kristen. thank you so much. sara? >> all right. joining us now to discuss is former georgia state senator jen jordan and elliot williams. thank you both for being here. elliot, kenneth chesebro has demanded a speedy trial, but fani willis has said we're going to do this october, she's trying to set that for the date. what significance here is in this case being tried first? >> sure. chesebro going first means that he may well get a trial before everybody else but the mere fact that one defendant's trial is scheduled doesn't compel the court to be ready for all the other defendants. here is why, every defendant, no matter who they are, has a right to prepare for trial and be ready -- you know, to be able to

get ready for trial. by forcing some of the other folks to trial you could actually be jeopardizing some of their constitutional rights. here is where you start to see cases or at least relationships between defendants fray, where they might have worked together at least have been accused of working together on a criminal enterprise but they all have different interests and different lawyers and different needs and some are going to start to break off. i think chesebro won't be the first you will see taking a position slightly different than the rest of the folks who were charged. >> i want to go over to you, jen. politically speaking when you look at this there's the ex head of the gop in georgia, several republicans, obviously you have the former president who is a republican. is this having any fallout or are they rallying around the troops when it comes to the republicans in georgia? >> there's no fallout. one of the unindicted co-conspirators, number eight, is the current lieutenant governor in georgia, burt jones. you know, all you have to do is go to x or twitter or whatever you call it and you can see sitting state senators, house

representatives that are serving in georgia that are actually going to social media and trying to attack fani wniei willis, ca for a special session, saying they want dis bar her which they don't have the ability to do. this could be a pivotal thing for republicans especially in our state. instead of thinking about the seriousness of the allegations and stepping back and taking a breath, they are actually going all in and following the former president's lead. >> except for you see people like brad raffensperger who has really stood up. is he faces consequences of that? >> what's interesting about raffensperger is that if you talk to political types who looked at the number really the only reason that he made it out of his primary was because thousands of democrats actually voted in the republican primary for raffensperger. and they also did it with respect to governor kemp, too.

they got major kudos, you know, plus one credit for standing up to trump and that was how raffensperger was able to get out of the republican primary and then ultimately win by really one of the highest margins in the state. >> all right. i'm going to go back to you elliot to talk about some of the defenses that we are starting to hear come out of some of these 19 defendants, one of which sean still who is one of the fake electors in georgia is basically blaming donald trump for his actions saying he was acting at the direction of the president. i have heard this before in many of the other trials including the oath keepers and proud boys who were all convicted, but is this a defense that is workable here? >> it's workable but you're going to have to establish that you did not have the criminal intent in your mind to commit the offense and were acting specifically at someone's direction. prosecutors will not have a very hard time, i think, establishing

that each defendant, number one, was aware of the actions they were taking and, number two, was aware of the actions they were taking were incorrect. this idea that, well, i was -- i'm just a simple country lawyer, i didn't quite know that i was doing and someone was directing me. sure, it could work, but the weight of the evidence -- all this evidence that is being presented against them sort of seems to debunk that. they can try it, it's a defense you see from defendants quite often, but here at least based on what's alleged doesn't look like that works. >> what's interesting about sean still is that he's a sitting state senator right now. what's going to happen with him is that there's this whole process now that has to happen with respect to the governor to make a determination whether he can continue to serve or not. in terms of these filings and him pointing the finger the trump, too, you have to wonder if he's already given up on his

political career anyway since he represents a deep red district. >> if he goes after trump to defend himself. >> that's right. >> the people who put him in office may not like that because you're saying they're rallying around donald trump and others. that is a really interesting point. i do want to talk about the significance of this day yesterday, where you have a former president going into a state jail, being -- having his picture taken, the picture is now out and they are all fundraising off of it, both he and the biden administration, they are looking at this as a fundraising event, but tell me about the significance. you were in office, you were put there, so was he. the significance of all of this is happening in america and how you see it from your perspective. >> it's jarring and i know some of the news reports from talked about how trump and his advisers talked about what kind of facial expression he should make, you know, what should the picture look like. i mean, it's just ridiculous, right in the idea that you are

new this morning, the kremlin is promising a full investigation saying all necessary examinations will take place to determine whether wagner leader yevgeny prigozhin was killed in that fiery plane crash in week, but just as quickly they're denying any involvement in the crash. putin also is now offering his first comments on the presumed death of his one-time ally, calling prigozhin a talented man who made serious mistakes in life. cnn's matthew chance is live in st. petersburg with more. what more are you learning? >> reporter: well, i mean, we're here at this make-shift memorial in st. petersburg outside the headquarters of wagner in the city from where they ran their operations, also the home city of both yevgeny prigozhin and vladimir putin, where the two men met in the 1990s.

there's all these flowers that have been laid as people all over the city come out and pay their respects to yevgeny prigozhin, even though it's not absolutely confirmed officially that he was on board that plane, he was on the passenger manifest but they haven't done the proper forensic tests to make sure he was one of the bodies that have been recovered. nevertheless people are treating him and talking about him in the past tense. this photographer the last known picture, i think, of yevgeny prigozhin saying in russian in this hell he was the best. there is a picture of him in what is said to be in africa. flowers as well. patches that people put on the side of their wagner uniforms. a lot of the people that are coming out at the moment are wagner members, people who respected yevgeny prigozhin as their commander, as they called him, also family members of wagner fighters as well who have got a very strong loyalty to the organization, despite the fact that wagner staged the biggest

challenge to vladimir putin's authority in 23 years. this is something i want to show you, it's a sledgehammer, really heavy, sledgehammer with wagner written on it, a potent symbol of the violence the organization used because it was with a hammer like this that infamously wag they are executed someone regarded as a traitor, they videoed it and that video image, that footage really consolidated the image of wagner as utterly violent, utterly cruel and an organization that would do anything to what they believe fight for their mother land, fight for russia. that's one of the reasons why along with the -- you know, the tirade that yevgeny prigozhin launched against the military establishment in russia, saying it was incompetent, it was waging the war in ukraine very poorly, without proper resources and being corrupt, it struck a chord with russians and why

we're seeing people out now in st. petersburg and also moscow and cities around russia to pay their respects. he is not confirmed as dead yet officially, but everyone believes that he is and the question is really, you know, has he become a martyr? will he encourage further -- will his death encourage further opposition to the authorities or will this become just another forgotten chapter in the very turbulent recent history of russia? >> matthew chance in st. petersburg. thank you for being there. >> john, it's so strange to see such delicate things as a memorial with flowers and even a teddy bear there for a man known for such violence and cruelty like yevgeny prigozhin, completely separate from an investigation going on of what happened in that crash. >> how about that sledgehammer. >> right. >> and how amazing is it, i have to say, to have matthew chance right there, such a wonderful reporter and such an important perspective right now. penitentiary gone officials believe prigozhin was likely killed in that plane crash but

say there is no indication it was a missile that downed the plane. among the possibilities, u.s. officials are still evaluating an on board explosive device. oren liebermann is at the pentagon. missile, on board explosive device, you know, distinction may be without a difference there. >> reporter: there is nothing that has been ruled out yet fully in terms of what may have caused this crash except at this point according to officials we've spoken with a surface to air missile. it is because you see that open question that it touches on something matthew chance spoke about and that's the russian investigation having spoken with several officials here there is healthy skepticism of that investigation as the u.s. intelligence community looks at all the available information and tries to come to their own conclusion. they have reached at least based on early assessments and early indications some conclusions. first n terms of what took down this private jet, perhaps one of the obvious answers would have been a surface to air missile, especially so close to moscow

where there are air defenses, but officials we've spoken with say there was no indication of a missile launch, not they do bel prigozhin killed in that crash. the uk also saying it looks likely so converging on that conclusion. >> healthy skepticism on the russian investigation itself. that might be the understatement of the century. any other scenarios being looked at here besides on board explosive? >> reporter: that's one of the big ones, whether an on board explosive device or on board ex cloegs, those are viable possibilities being looked at. again, the unt jens community going through all the data and information and intelligence they have to try to figure this one out but it's obvious to say it's difficult without having boots on the ground in russian. we've reported that the last couple minutes of the flight, the last little bit showed

time is ticking for trump's co-defendants after former president donald trump was processed and released in georgia yesterday. there were three more co-defendants who surrendered, among them jeffrey clark, the former justice department official indicted after trying to overturn the election. now there are two defendants who have just three hours until the deadline to report to the fulton county jail. cnn kes dent nick valencia is live outside of that jail. nick, who is left at this point? and i think we know what happens, fani willis has been pretty clear about what happens if they do not show up in time. >> reporter: so two co-defendants left of the 19 who have yet to surrender trevian cutie who has been charged with her scheme in trying to allegedly pressure election

workers to overturn the election results as well as pastor steven lee charged with doing the same thing. both of these two co-defendants remain. they risk seriously complicating what has been a smooth process for the other co-defendants who have turned themselves in ahead of the deadline. one co-defendant who is still in custody. he did not work out a bond agreement, he is still in custody inside the fulton county jail, but these other co-defendants ticking against the clock with hours remaining to turn themselves in are running a serious risk of being in custody for days. earlier i spoke to a local defense attorney who talked to me about what to happen to the co-defendants if they miss the noon deadline. >> that noon deadline was a gift. it is so generous. it's telling somebody there are criminal charges against you, come turn yourself in before we go look for you. that is rare. if they do not turn themselves in the warrants will be active and any law enforcement nationwide will have the duty,

they have no choice, the duty to arrest them, take them to the local jail and expedite them. >> reporter: so about two and a half hours left for these co-defendants. as far as what's next in this case on monday a federal court hearing for mark meadows who is trying to argue that his proceeding should be moved to federal court. he said it -- we also have this october date that's been set by fani willis, fani willis has suggested the october trial date happened. we should -- we should expect a flurry of legal filings before now and then. sara? >> all right. nick valencia, thank you for that update. so donald trump's campaign is already trying to make money off of all of this. it is selling $34 t-shirts with the mugshot and the phrase "never surrender" even though he d in fact, surrender.

i'm joined by senior columnist from "the daily beast" matt lewis, also the author of "filthy rich politicians." matt, at the top of the show i head some of the analysis in the papers and whatnot about this mugshot and the role it plays in american society. msnbc called it a sinister apparition. i think we have a picture of this. reuters said yet another extraordinary moment for trump. you're so good at explaining things. how can all of these things be true at once? >> well, look, i think that this is donald trump in a nutshell. he has never wanted to be a uniter, he has never wanted to be a mainstream political figure, the things that a normal politician would do to try to grow their coalition, to try to

become mainstream. donald trump doesn't do. what he is instead he wants to be a cult leader, therefore, things that simultaneously make him beloved also make him hated. he is an incredibly divisive figure and this is something he has actually pursued intentionally as a strategy and i would say the mugshot is merely the latest example of this. >> and you take this on head on in a new column where you address the conventional wisdom that he can't lose a primary, can't win a general election. again, how can all these things be true at once? >> it is wild, john. if you look at three of the most recent polls that got a lot of traction, the conclusion would be -- and, by the way, the caveats apply, right, polls are a snapshot, polls can be outliers, but if you just look at those recent polls, you would conclude that donald trump cannot win a general election

and he cannot lose a primary. it's really hard to dispute that. there was an ap poll that came out a week or so ago that showed that 53% of americans would not vote for him under any conditions in a general election, which that's rough. it's hard to win a general election if 53% of the voters start off saying they would never vote for you. of course, trump found a way in 2016 to pick the lock of the electoral college and win anyway but this poll showed even more concerning for donald trump is that in addition to the 53% who say they won't vote for him there's another 11% who are highly unlikely to vote for him. so it becomes very difficult to win. at the same time, john, as you know we've seen poll after poll who show he is dominating the republican primary winning by something like 40%. >> let's talk about the republican primary and some of

the other people running. there was a debate the other night, a lot of people watched the debate, by the way, and you wrote of vivek ramaswamy and i want to read this out loud here. you say out of the gate he looked pompous -- and i actually don't know this next word which is why i'm asking you the question. what's that? >> i think it's pronounced oliagenoues. there is things you know how to spell but not pronounce. it means oily, he's slippery and devious i would say. >> and you wrote in this piece the thrust of the piece besides the have vocabulary instruction was that it's like everyone hates vivek ramaswamy. why does everyone hate vivek ramaswamy? >> well, i think there's several reasons, right? for one thing he's a line skipper, a line jumper.

steep drop from the nearly 1,000 people that were believed to be missing in the days after the fire, now more than two weeks, i believe is where we are now. the death toll, though, remains at 115, making it the deadliest wildfire in the united states in more than a century. crews now report that they've searched 100s% of the single-story homes in the disaster zone. they are now focused on searching the multistory residential homes and commercial properties. now for the first time maui county is placing blame for the fires, pointing the finger directly at the local utility companies and the county has filed a lawsuit claiming that the company's inaction caused the loss of life. cnn's natasha chen has more on this, she's been tracking this now. natasha, what is the county pointing to and blaming the utility companies for this? >> reporter: kate, they're point to go negligence. it's notable that in the lawsuit they're calling this a human-made disaster. i want to read this quote from the county in that suit, saying

the defendant's inactions caused loss of life, severe injuries, complete destruction of homes and businesses, displacement of thousands of people and damage to many of hawaii's historic and cultural sites. they're saying specifically that the utility did not maintain the poles, that they were seeing advanced wood decay, not doing the upkeep and not powering down, not deenergizing those lines knowing there was a high probability of fire, especially in those days leading up to the fire where the national weather service had issued high wind warnings, high wind watches and red flag warnings. the lawsuit cites how successful powering down lines has been to prevent wildfires like here in california, oregon, nevada, but here is a sound bite from the president and ceo of hawaiian electric company on august 14th talking about that issue. >> it's worth noting that even in places where this has been

used, it is controversial and it's not universally accepted. it's seen -- it can be seen as creating a hardship for those customers that have medical needs, that are at higher risk. >> reporter: so you see there is some disagreement about that. the company did tell cnn they are disappointed that the county took this litigious route. separately the "washington post" is reporting that the utility actually removed poles and lines, other equipment, from where the lahaina fire reportedly started and that's from the "washington post" obtaining court records, letters, documents. cnn is still working to independently confirm that. the post says that this action violated national guidelines on how utilities should handle and preserve evidence after a wildfire. to that, the company spokesperson told the "washington post" that they are in regular communication with the atf and local authorities and cooperating to provide them,
