roughly 2$2.2 billion, new york's top prosecutor claims that is how much donald trump may have inflated his net worth in one year. we have the details behind some new allegations.
7:01 am
also, a major sentencing today in washington. two members of the proud boys convicted of the seditious conspiracy roles, and we will find out if they spend decades in prison. and now, more than 70 people killed and others injured after a building goes up in flames in johannesburg. i'm boris sanchez with rahel solomon in for john, kate and sara. you are watching cnn "news central." this morning, two of donald trump's co-defendants in the georgia election subversion case want separate trials. sidney powell and kenneth chesebro are asking a fulton county judge to sever their cases. both have denied any wrongdoing, and they have invoked their
7:02 am
rights to a speedy trial. for chesebro, the judge has set a trial date for october 23rd, and no date for powell. the trump team have opposing the time line, and they say that trump wants to sever his case as well, though no motion has been filed. we go to katelyn polantz with the details. why the argument for separate trials? >> well, both of the lawyers who were working around donald trump after the 2020 election, they want distance from others. boris, in this case, there are 19 criminal defendants including donald trump. they are all accused of this sprawling racketeering criminal enterprise conspiracy, and what ken chesebro and sidney powell say they want to go to trial fast, and looked at by the jury separately from the other defendants, and the accusations levied against them are not things that pertain to them. so in this racketeering
7:03 am
conspiracy there is 160 overt acts, and sidney powell is saying that she only knew about some of them that she wants to be tried on and contests they are going to be crime, and she does not want to be lumped into the rest of the case, and ken chesebro is making the similar case. and whether or not that is going to be allowed is the decision for the judge. >> and also, rudy giuliani has been found libel for spreading lies about two georgia election workers. >> yes, he is going to be found libel, because he did not show up to fight this lawsuit which is a defamation case that was brought. so what happens next is that he shgoing to go to trial not on the facts of the case, and he has conceded those and the judge has ruled against him, but he is going to go to trial on how much he has to pay both as punishment, and to make these
7:04 am
two women whole. their lawyer was on cnn last night, and this is the amount that giuliani could be fined. >> but in our expectation is that we will be able to prove tens of millions of dollars in compensatory damage before we get to punitive damages, and so we expect it to be a significant amount, and we are confident in our ability to document it. >> tens omillions? >> yeah, you heard me correctly. >> so that trial for giuliani related to damages in this lawsuit will take place either this year or the beginning of next year, but remember, boris, this is only one of the legal fallout pieces that giuliani is facing, and there are other lawsuits related to his words about companies after the 2020 election and also, he is a criminal defendant in fulton county as well. >> and recent reporting that indicates that he is inundated with legal bills and unable to pay them off.
7:05 am
now, rahel? >> and at the attorney general's office, there are rare reports donald trump inflated his net worth in lawsuits against the former president and his adult sons and in a newly released deposition, trump testified that he had very little if any involvement in putting the documents together. and kara scannell is joining us now, and this is documentation spanning a 10-year period. what do we know? >> this is from the new york lawsuit, and what they found is additional material saying to the judge that we don't know how to go to trial, but we can rule just on these documents, and saying that over the 10-year decade every year in the financial statements the former president inflated net worth that ranged from $812 million in one year to as much as 2.2
7:06 am
billion which is in 2014 alone. they were also saying that the big question has always been how much is donald trump really worth, and so they try to answer this, and do the math based on their own appraisers and experts, and they say that his net worth between 2011 and 2021 would be no more than $2.6 million rather than stated of up to $6.1 billion and likely less if the properties were valued in a formal appraisal, and so in two of the years that he was worth $6.1 billion and they are saying it is only 2.6 billion, and trump's lawyers say that the financial statements are not inaccurate, and the banks made billions of dollars in interest and they want the judge to rule in his favorite and not expecting the judge to rule in september, and the trial to go
7:07 am
to trial october 2nd. >> but the a.g. is saying that he overcounted his net worth three times? >> yeah, and that is a pretty big swing. >> thank you, kara. boris? well, we are going to keep going, and talk with former prosecutor in georgia zelden. >> well, in response to the fani willis trial, they may have wanted to call her bluff, and saying that it takes time to prepare, and fani willis said, fine, you want to go trial, we are ready. so now, if they want to ask for the continuance of the speedy trial motion, we will see. but if it is a real motion to go
7:08 am
to trial early, it is because they want to separate themselves from donald trump to say that we were not the real culprit, and he is the culprit, and jury, if you want to convict somebody, convict him. ed and they h-- and now they hae the advantage to say, we didn't know these people, and we acted under the auspices of legal advice, and wait for the big trial and then go get them, and they want to insulate themselves from what is a broader rico sort of case. >> what about the prosecutor fani willis, because she wants to try all of the defendants together, and what are the advantages, but also the disadvantages for fani willis? >> the advantages are that as a rico case, and she can tell a story, and you see, jurors, all of these people, all around us, they were part of a wheel. donald trump was the hub of it, and they were the spokes doing all of the bad acts. they don't need to know each
7:09 am
other, but they needed to act in concert with someone, and that is what we are going to show you, and this is why you do a big rico case, because it gives you full view of the case. now, the disadvantage for them is that there are 19 people, and very few courtrooms in america that can have 19 people sitting around the table, and everyone can pick their own jury, and with their own reasons to exclude jurors and cross-examine witnesses, and the trial could last a year, and so there is a big problem logistically, and advantage, storytelling, but the disadvantage is logistics. >> fascinating. michael, moving on to another case, and rudy giuliani losing this defamation case with two georgia workers now moving to the next phase where the damages are going to be determined. and we know the lawyer for the two georgia workers said that they will be seeking millions
7:10 am
potentially, but how are the damages determined? >> two types of damages. damages, you know, harm. did you lose your job? did you suffer injury, and all of those standard damages like in a car accident, you broke your leg and you had to go to the hospital. then the cases where you have special damages for bad behavior. they are prejudicial damages based on it, and the jury can generally speaking be free to say that you were so bad, your behavior was so sanctionable that we will and what they call punitive damages, and punishment, so it is not just the injuries that you caused directly, but the way that you behaved so recklessly, we will punish you and send a messages to others who might want to do the same. so the actual damages may not be in the million, and i am not sure that the two women can show that level of daniels, but the punitive could be severe, because they are going to show
7:11 am
that giuliani lied, and lied purposely, admitted the lies and they suffered threats and life ruined, and this is a basis for a lot of the punitive damages and this is where the giuliani team has to work the limit that claim. >> yeah, i mean, you remember the sort of example of not feeling safe even going to the grocery store because they were afraid that someone would hear their name, and lot the come here. michael zeldin, thank you. there are so many coastal towns in florida having a difficult times to get back on their team after idalia struck, and in an area that has not seen direct hit like this in 125 years. t this hour, the storm is going back out to see, and with the threat diminishing the long road

this just into cnn. just as clarence thomas is disclosing private jet trips and private vacation paid for by a republican mega donor, harlan crow paid for private trips for him to attend a speech in texas, and also private vacations at his estate. joan biskupic has been following this. tell us about this disclosure? >> sure. this is a disclosure that he was supposed to file in may, but he got a 90-day extension to follow up on the requirements of it.
7:21 am
it shows the tight relationship of clarence thomas and wealthy conservative benefactor who has helped him over the years. it is the first time that clarence thomas himself after many years of travel with harlan crow has disclosed it on the report. two trips to dallas, texas, and another one where he vacationed with harlan crow many, many years up in the adirondacks, and a very expensive estate where clarence thomas has summered. these were first reported by pro republica, but this is a report in april that showed lots of really lavish travel that the justice has had taken, but the first time on the forms, and taking place in the backdrop of the new scrutiny of the supreme court justices, and the lack of transparency and the lack of a formal ethics code, boris. and let me tell you one more thing that we got today in
7:22 am
addition to the reports that i wanted to add in this first part is what clarence thomas' lawyer said about this filing. he said that the attacks on justice thomas are nothing less than ridiculous and dangerous, and they set a terrible precedent for political blood sport through federal ethics filings. his lawyer said that clarence thomas has always tried to be up front about what he had to file, and it is just that he now knows more about what he should file, and in actuality, boris, there have been some confusion in the rules about personal hospitality of the kind that harlan crow had given clarence thomas, but many ethics experts say that private jet travel, yacht travel which clarence thomas has also enjoyed with harlan crow, that it should have always been reported, boris. >> and there was some
7:23 am
disagreement over that, and it is not just clarence thomas under scrutiny, but judge alito is under focus as well? >> he was, too, and he had also gotten an extension and submitted his filing today. and some of the controversy over sam alito before again arising from the news reports from pro republica involved trips from a decade ago and none of them listed on the report, and what we got on the sam alito report was extensive travel for speeches that he gave including a very provocative speech that he gave in rome right after the dobbs decision that reversed "roe v. wade" and so some of that arises in that context. and what clarence thomas himself put on the form about one of the private jet trips that he put on harlan crow's dime came in may of 2022 about a week after the dobbs leak, the leak of the
7:24 am
decision reversing "roe v. wade" and he said that he had been advised to be taking private travel instead of commercial instead of safety concerns, and it is the first time that it has been in writing and the first time of assertion, and we are not sure if the justices are taking more private travel rather than commercial because of the security considerations. >> yes, it is interesting, because the polling has shown that popular opinion of the supreme court is near all-time lows. on the that point, joan, you had reported previously that chief justice john roberts has been trying to get the same justices on the same page with a code of ethics, and some kind of agreement to say this is okay, this is not okay, and this what we need to report, and don't need to report, and what is the status of the agreement? >> it a great question, boris, because there is so much scrutiny on the justices, and
7:25 am
justifiable scrutiny on the justices that decide the law of the land, and the chief has wanted unanimity, and he cannot get that among his colleagues. when they left for the recess in june, they were deadlocked on it. they are coming back at the end of september, and early october, and it is the first time that they are all actually in a room together. no doubt, this issue is going to come up. but for this point, it is a stalemate, and the chief justice has not been able to through his usual powers of persuasion to get them on board. we have seen the justices, thomas and alito who we just found the new reports from them today, boris, they have been signaling that they believe they are already following rules, and that this scrutiny is politically motivated adds clarence thomas' lawyer said that the statement today, and justice alito has said publicly, too. >> joan, if you can hang with us
7:26 am
a minute more, because we want to welcome into the conversation cnn analyst and ethics analyst norm zhar, and with this new report, what are your reactions to what we are learning? >> well, thanks for having me, rahel and boris. i think that the thomas report and the alito report even more so are too little too late. thomas does make a number of 2022 disclosures, and he discloses a older real estate transaction involving harlan crow, but there are many more trips, luxury travel, yacht trips, visits the crow's properties, payment of a family member's tuition, and those are not disclosed in here. there is a footnote saying that
7:27 am
he is still working on it. most ethics experts believe that the disclosures were required, and there is a debate about it, and some of them, private travel were required to be disclosed years and years ago. and then alito has a much skimpier ethics report where he doesn't for example get into a luxury fishing trip that he took years ago that has come under scrutiny. so, it does speak to the issue that boris was asking joan about. how is it possible that we don't have a code of ethics that is binding upon the highest court of the land. i can tell you that when i was doing ethics in the obama white house for the former president and his administration, not only would i have required anything like this to be disclosed, i wouldn't have allowed it in the

it is on the court, and it is clearly within the constitutional structure, and there is an existing law that i believe is already on the books that applies to the court. no less than authority than liberal members of the court have said that they believe there's ethics authority here for regulation. and the conservative wing disagrees, and this is particularly the case with justice alito who has been one of the most outspoken about this, and even taking to the pages very unusual, taking to the pages of the "wall street journal" to defend his ethics, but he is in a public debate. i think that the better of the argument is constitutional. >> joan, let me bring you back into the conversation of someone who has covered the supreme

court for some time, and do you think that the backlash and the transparency that we will see is going to create a difference or see a difference in terms of what we will be seeing moving forward. >> i think that some of the justices themselves will hope that it does, because as i said to boris, they are divided, but the one way to get congress off of their back, and give the public more confidence, and that is what this is about, because it is our supreme court, and the way the give the public more confidence, and to have the congress standdown is for them to adopt their own rules, and then you don't have any tension of between what can congress do or not. i know that there are members of the nine who want that. they just have not been able to get it. they are starting to realize that this, you know, they don't like the word crisis. crisis is a word that is overused, but it is something that has provoked the public,
