another major sentencing day for former leaders of the proud boys group is now getting under way. the prosecutors today seeking 27 years' jail time for at least one of the capitol attackers, and will he spend decades behind bars. and plus a new snapshot of the economy is in, and it is triggering phrase that everybody wants to hear, inflation could be cooling. and we will ask the white house about it later in the hour.
7:02 am
and donald trump avoids being on camera in court this time, but he won't be able to avoid it for long, and the judge is sure to make his trial must-see tv. with boris sanchez, and rahel solomon, i'm kate bolduan and this is cnn "news central." any moment now, the sentencing begins for two members of the far right group the proud boys for their roles in the january 6th attack on the u.s. capitol. right now, dominic pezzolla is getting ready to learn his fate for his role in smashing the window, and once inside, he lit a cigar and he took this video of himself. >> victory smoking in the capitol, boys. awesome. i knew we could take this
7:03 am
[ bleep ]. >> another proud boys member ethan nordean will be sentenced as well, and they may turn out to be the harshest. evan, what can we expect to happen so far today? >> well, we will be seeing some harsh sentences from the judge timothy kelly. look, i sat in on this sentencings that happened yesterday. and you just can't come away without feeling that these were the people that were victims of the lies told by the former president who urged his followers to come to the capitol hn january 6th, and these are the two men sentenced yesterday. joseph biggs got 17 years and zachary reel got 15 years and they spoke tearfully to the court, and they were very, very
7:04 am
sorry for their roles in the events on january 6th. and both of them, military men in the case of biggs who is a former army man and reel was also a former marine. both of them are going to have their daughters grow up without them being around. that is something that was weighing on them, as they spoke to the judge and spoke to the courtroom yesterday. their lawyer who i think spoke to the lawyers after the two sen tenni sent sentensings put the blame squarely on the president. >> it was unfair and we felt that the judge was in the probation department of the 10-year range was what we felt was high, and 10 to 17 years is too much. >> and rahel, the judge
7:05 am
emphasized that part of the reason that the sentencing was so harsh was because he said that what these men did were participating in what happened on january 6th took away from the american public one of the great traditions is that peaceful transfer of power, and they have taken it away from the american public, and that is something that he said was very important to emphasize as part of this. and look, before this sentencing, we heard from some of the police officers who were at, who bore the brunt of those attacks on january 6th, and one of them said that i was not sure that i would come home that day, and it was the first time she ever felt that way while on the job at the capitol. rahel? >> we will have to wait to see how the sentencing goes this morning. kate? any time a judge could make a critical ruling if the case against mark meadows is going to stay in the state courtroom or out to a federal one, and this
7:06 am
is a decision to impact far more than just mark meadows, because the ripple effects could impact mark med dose and the others and could push off the start of his trial just as some of the co-defendants are acting to speed it up in georgia. with all of that happening, i guess that we could describe it as behind the scenes, and just yesterday donald trump formally entered a plea of not guilty in that subversion case and waived the right to appear in fulton county for the arraignment set for wednesday. zachary cohen has all of these moving parts, zach, and there are a number of them around this case. what are you hearing about the timing and also how this decision can impact the rest of the defendants. >> yes, this ruling in meadows' case of trying to move his case to federal court could come at any point, and one of the several ongoing moving piece, but it is important, because it
7:07 am
could impact several defendants in the case and people like former doj official jeremy clark, and others who are former government officials who are arguing that the role they did around the 2020 election they did under the auspices of their government job. trump is not looking to move his case, and it is likely that his lawyers are watching and waiting to see what happens with meadows' case, but this ruling of meadows' case of whether he can move it to federal court is a very important one. >> thank you, zach, for your reporting. boris? >> and now, let's discuss this with what we just got this news in from marshall cohen, kenneth chesebro, one of the architects of the fake electors filed a plea of not guilty, and he like donald trump has filed to skip his arraignment next week. and renato, just quickly, your
7:08 am
reaction to that? >> well, i am not surprised. that initial appearance is called the arraignment and very little happens that is not perfunctory and usually the defendant pleas not guilty and the judge sets deadlines and skipping it to avoid the media circuit is making sense. >> and bit counter intuitive in that donald trump has not avoided the media circus at any point in his political career, and let's talk about mark meadows and the situation with him. the judge steve jones on that case could make a decision any moment as to whether to move the charges of meadows from state to federal court, and what are you looking for when that decision comes down? >> okay. a couple of things. first of all, as starting point, the issue here is whether or not the crimes that have been charged were essentially for an act under the color of his official duty. the bottom line is that the
7:09 am
judge has already signaled that the rico, you know, the rico crime that has been charged, the full scope of that was not part of meadow's duties, but certain pieces of it, and what was called the overt act were part of the official duties of meadows or at least the judge hinted at that. there's really nothing like this in the past, and there has been no case quite like this one. it is going to be interesting to see what the judge does. what i expect for the judge to do is to decide with prosecutor here, because the prosecutors are the ones who write the indictment, and i think they wrote it in a way to make it sound like it is not official, and they have the upperhand here and the argument. >> unchartered territory on a number of levels here. if meadows does not get his case moved to federal court, and he was chief of staff at the white house, and it is not more official than that to carrying out the wishes of the president,
7:10 am
right. so if he doesn't get his case moved, what does it mean for the other co-defendants who are trying to move their cases to federal court? >> very difficult. not only was he, you know, someone who was acting, you know, as the chief of staff to the president of the united states at the time, but his role was more advisory, okay. he was not somebody who was, you know, more decisionmaker, but somebody who was involved in the discussions and aiding trump, but he was not somebody out there submitting and writing the fake elector certificates or something that was hands on. he has pretty much the best argument, and this is why he is going first and others will try to follow. i will say for meadows who i think that is likely going to be avoiding the indictment in d.c. by becoming a witness for jack smith in georgia, and fani willis is having none of that, and he is a tough situation in a trial with a whole bunch of
7:11 am
others in state court. >> on the thought that he will be on trial with a whole bunch of others and one of the co-defendants ray smith filed a motion to divide the defendants into more manageable groups, and fani willis, the d.a., she wants them tried together, and what is the likelihood of that succeeding? >> well, prosecutors usually succeed, because the judges don't want to retry cases over and over, and they are agreeable people. the people who asked for the speedy trial, kenneth chesebro and the other trump lawyers who want a speedy trial will get their own, a everyone else is stuck tried together whether they like it or not. because the bottom line is that the judge doesn't want to try the same case multiple times over and over again. >> a lot of complicated legal maneuvers to walk through, and
