cnn's paula reid starts off our coverage. >> based on what has been presented today, i am not finding the severance from mr. chesbrough it is necessary for other defendant in this case. >> fulton county superior court judge, scott mcafee, in court wednesday, giving the first glimpse into how he plans to handle the sweeping election subversion case in georgia. all in front of cameras allowed in the courtroom. mcafee, ruling wednesday, but defendant kenneth chesebro and sidney powell, who both filed for a speedy trial, cannot be separated and will stand trial together in a matter of weeks. >> obviously we are a little disappointed. we filed a motion and it was denied, however, we respect the courts ruling. >> now, the issue before the court will be whether it is

going to have 17 defense attorneys appear and file motions for continuous saying that they are not ready? >> this, as some defendants, like trump's former white house chief of staff, mark meadows, are trying to get their cases moved to federal court. >> i think we already had some council indicating there on trial and other cases in federal court. >> paula reid joins us now. mcafee may be a young judge, but he is a former prosecutor and he was very skeptical about the prosecutions timeline for the rest of the case. >> that is exactly right. for the first time, the district attorney said that she wanted to try all 19 defendants together, they have had so many questions about whether that is logistically possible. and the judge really brought that to the fore fraud today. saying i don't know if it is possible to do 19 defendants all that once on this timeline. and the timeline, right now, it is in october 23rd, sydney powell, kenneth chesebro, we'll go to trial. now the judge needs to decide

officially, whether the other 19 defendants will be there alongside. him he's asked for additional briefings but we know other defendants, mark meadows, other folks have asked to sever their cases, it appears highly unlikely that we are going to see all 19 defendants go to trial on october 23rd, but one significant development that we saw late today, the district attorney, fani willis, asked the court to issue protections for any perspective jurors, this is incredibly significant because of, course members of the grand jury, their names were published in that indictment that went out to the entire world. they were all, doxxed and many of them faced threats at the fact that she is taking this step is incredibly important. >> joining us now, a legal analyst and former u. s. attorney of georgia, michael moore. former federal prosecutor, jessica roth, and the mayor of atlanta. so, jessica, obviously a big day. the first time that we've seen any of these cases televised or someone saw this judge in the way he approaches it. i am wondering what you made of it all in substance and style? >> in terms of substance, we saw the judge asking all of the right questions, whether he

should glance severance for these defendants. one from each other, initially, that was a motion that was pending before him today. he was asking them, the, lawyers to articulate how their current would be harmed if they were tried together. powell and chesebro. and they really were not able to satisfy him. the arguments that they made seem to backfire, they were claiming that the allegations suggested that these two defendants were part of a very different schemes, and they were essentially, those would be unrelated trials but joined together. and the judge said, wait a minute, one of the reasons that you are arguing for a severances because you say that your clients would be harmed by the jury using evidence admissible against the other defendant. but inadmissible against your client, despite my instructions to the contrary, but if the schemes are as different as you allege, the jury should be able to follow my instruction and keep the scheme is different and decide the guilt of each defendant, or innocence on its own merits so he just was not persuaded and the defendants did not satisfy their burden. and the law express a preference because of efficiency. >> were you surprised that chesebro is not able to get his

case severed from powell's? >> well, i am glad to be with all of you. i really was not surprised. what is interesting here is, these two individuals, they both filed for a speedy trial under the georgia statute. they could have secured without question the chance to have the cases tried separately, and ms. powell simply waited a few weeks to file her motion for speedy trial. she, in fact, had through the end of october to even violet so that she could affect fully lead the chesebro vial start and then that would have pushed her trial and to the november, december timeframe. so, i do not think that it came

as a great surprise, i also think that these are lawyer defendants, and there is some argument to be made about efficiency and moving forward together, and i think that at the end of the day, you will likely see the defense team, in fact, team up as they question each of these 150 witnesses of the state. >> i mean, the judge was obviously skeptical of the d. a. 's position that all of these defendants should be tried together in october. it doesn't seem realistic at all for somebody? >> i think it will be very difficult. you have to remember, we had this big rico trial that is going on right now. i think that it is not month eight. you are still not a juror said in this trial, even if the

judge says you all go the trial on october 23rd, it is highly unlikely that you will have a jury seated anytime soon which is why this trial has hundreds of people come in and at the point where you project to the public that you are going to have a trial that will last months, people will have all sorts of conflicts that will make it difficult for them to sit that long as a juror. i do not think that all 19 will be tried october 23rd. you have got to remember that you have multiple attorneys who will have absences in place, conflicts, federal courts take precedence over state courts, that is highly unlikely. >> jessica, prosecutors have claimed in court that this would take, in their prediction, for months, with 150 witnesses. i'm not an attorney, but is that realistic at all? >> that is very ambitious about how quickly they could try cases of that magnitude. and the judge expressed skepticism. >> the judge said it could be eight months. >> he said it would be double. that's what he thought. that was based on his own experience as a prosecutor. so, if the more defense attorneys were present at the trial on behalf of the defendants who are joined in the trial, the more cross examinations each and every government witness we can see, the more witnesses are called by the defense, and the more closing and opening arguments we will see any more motions we

will see by each of those attorneys on behalf of their clients that the judge will have to hear, and rule upon. so i think that four months does seem unrealistic. >> michael, do other defendants, do they have the opportunity to push for a speedy trial? i mean, if they suddenly decide a month from now, or to your earlier point, could they apply for that? >> they can. you have to file your motion under the statute. either it is a term that you are indicted, or the next term. so that will be the september, up to over term of course. so they could file for a speedy trial, but i guess why would they, at this point, because we

are going to get a free preview of whatever evidence the state is going to put on. i think it has been disingenuous from the state to suggest that somehow they are going to try these 19 defendants by october 23rd. and that really was the win, i think, for mr. chesebro and mr. powell. because they have effectively made a good argument with the judge on the case, saying it will be moved, not, likely severed from the other 17 defendants. that separates them from trump. it was a little ridiculous, i thought, at one point, the judge ruled that there was going to be some briefing. and the judge asked the state, how long do you need to provide a ten page breathe? they suggested two weeks. well, think about how ridiculous it is to bring 19 defendants to trial with 150 witnesses to get for six weeks. this will take you two weeks to write a two page paper. so it is just a little bit wishy-washy and sort of, i think it has been good theater for the state to suggest that they are going to try this case together, but i think that it isn't realistic from the house. >> do you think it is a good idea that cameras are in the court? >> absolutely. that is customary and state courts in georgia. cameras are in the court.

so i think that for the judge to do anything differently would be out of the ordinary. >> and jessica, what is the next up in the, snow? >> the judge said that he is reserving the decision on whether to sever the other defendants. the other 17. but he noted, of course, we have the pending motion in federal court to remove the case of some of the defendants led by mark meadows. and of course, that hangs over all of this, because if mark meadows and any of the other defendants succeed in their motion to remove their cases to federal court, that really throws a wrench into whatever scheduled this judge says. so he is cognizant of the fact that we need to wait on that ruling from the federal district court judge and then 90 appeals on means to from that before we have a schedule as to the other 17 defendants,

that really starts to look anything close. >> do you think that the judge will grant fani willis's desire to have the identity of jurors kept secret? >> i do think so. in a case like this, when you could see what happened with the grand jurors, absolutely. what will happen is at the jurors will be assigned a number, as the attorneys are going through their questioning, they will refer to them by their number. and one of the most high-profile cases that most of us remember that this was done in, i believe that it was done in doj some some trial. then after, of course, the trial is over, it is some of the jurors that will decide whether or not they want their identity known publicly. >> mayor bottoms, thank you, michael moore, jessica, thank you. the political climate the trial is in, and the trump trials. we are joined by senior reporter harry enten. you talked about the former president's approval ratings the last time. how do republican voters we would have been on january 6th? >> sometimes, i look at polling data and i go what the heck is going on? and this is one of those instances. republican voters do not seem to blame donald trump for anything. that includes january 6th. and there was a fantastic poll question that ipsos last month asked, which was do you believe that it was left-wing agitators who essentially forced this ride on january 6th at the u. s. capitol? look at this. 51% of republicans agree that it was left-wing agitators. that is a conspiracy theory. i'm not even sure where they got that.

>> those were the early day conspiracy theories, this was antifa disguised, this is ridiculous. >> it is ridiculous. this is where the republican base is right. now that gives you a very good understanding of why poll, after poll, after poll finds donald trump so far ahead in this republican race. >> what does the data say, is a data, or -- >> i think you can go either way on that. >> how much of a factor is 2020 in 2024? >> yeah, so, sometimes pulling to me presents interesting questions that i cannot quite figure out. so, we know for example that in a horse race between joe biden and donald, trump we are dealing with a tight race right now.

with more. what more are you learning? >> in this new development, we were just going to get a status report in this case but special counsel's office is saying, we will move forward with an indictment related to this gun possession by the end of this month, by september 29th. that is a pretty significant development. one reason maybe because the developments around the gun possession expires and october. they have to move quickly. >> they have not been doing a whole new investigation. the plea deal fell apart so they decided that we are going to go and charge it? >> yeah. this is a fairly straightforward issue. he possessed the gun, and filled out paperwork while he was addicted to cocaine. that is against the law. he falsified the document by saying that he wasn't. >> it is illegal to falsify the

document. >> both of those are legal, he has acknowledged this in court and he is prepared to plead, so it is a fairly open and shut case. it is just a question of what he will charge them with, because you have this deal that was a pretrial diversion meeting, if he abided by certain conditions for 24 months it would go away. if he's charged with a final any that is a serious charge. it has a maximum penalty of ten years in prison. highly unlikely he would get, that but it is a much more serious issue here in this case. his lawyers are signaling that they are going to find this because you will remember, they thought that they had this. deal they went to the judge after it went apart, saying that we believe it is still binding because we signed it and the prosecution signed it. prosecutors said, well, it is missing another signature. >> the probation officer had not signed it. >> exactly. so they said it was never executed. and biden's team was signaling that they will fight this. >> what about the possible tax charges? >> the judge already dismissed the misdemeanor charges because both sides agreed that there was no deal that fell apart. and he pleaded not guilty. here is an interesting question, and prosecutors, will they move forward with the same misdemeanor tax charges? will they cause tax evasion as a felony? hunter biden admitted all of this under oath of the plea deal that fell apart on the other question here is are they investigating anything else? that is what collapsed this plea deal. because they were not on the same page about what was

covered and what his immunity was. that is not addressed in the filing and it is really unclear. we have not seen any indications that they're investigating bribery or acting us -- >> but they had looked at that over the years. >> right. this has been a five-year investigation. this was a key part of it for a while. then it was negotiated into this plea. but the question remains, you know, are they going to continue to investigate? there is all of this republican pressure. david witnessed for a special council status which enables him to take a broader look at it and for these tax cases, they've indicated that they are intended to move forward for them. it is just a matter of bringing it into l. a. , or d. c. where the alleged crimes took place. >> i appreciate, it thank you very much, coming up, now perspective from a former colleague of then vice president biden, and senior adviser, president obama. cnn senior commentator, david

axelrod. plenty of presidents have had embers saying family members, how big of a problem could this be for president biden, personally or politically? >> well, look, i have divided into two questions, anderson. the first is the political, they are related. the first is the political. the president was not involved with's very clearly. this was something that involves something that hunter biden did on his own, and it involved his own drug addiction and his own misrepresentation. but it fuels why the republicans and congress are trying to fan, which is the idea that hunter biden is involved in a bunch of illicit activity is, and they want to try to link the president to these. this will be a log on that fire even though he has nothing to do with this, and certainly if they go forward with some of the other issues that they have explored, that would be more fire for them. but even as we speak, they are talking about an impeachment inquiry in search of proof that the president had some sort of involvement. this is just the leading republican candidate that you just discussed has 91 felony counts against him right now. they would love to muddy the waters. for the biden campaign, this is unwelcome news. the second issue is for biden as a father, i think that that

is under reported or under discussed. there is, if this goes to trial, there is potential prison time associated with it. it is a felony. joe biden obviously cares deeply about his son. he's experienced a lot of loss involving his children in the past. that is a heavy burden to carry into a presidential campaign. and i think that that is under discussed. you know, when we are talking about the hunter biden case. >> is there a consensus in terms of how prominent democrats view all of this or even democratic voters? >> you know, i do think that people are not dismissive of the hunter biden charges. i do not think that democrats are believing that they will sully biden himself. but it is a burden and another burden into a campaign. i think that there is concern

about it. >> it can be used by the former president or husband as muddying the waters saying what i have done compared to that. >> however hunter biden is treated the president trump is going to claim that he was treated differently then he was treated even though the charges are different and the circumstances are different. anything to muddy those waters is helpful to trump. i think that democrats recognize that. >> what do you think the best-case scenario for president biden and his campaign is? obviously that plea deal seemed like it would have been pretty good regardless if it was for hunter biden or the biden campaign. >> anything that would end this quickly would be better for them if they could reconstruct the plea deal or make it different -- a new one would be best. the second thing is if it becomes clear that this is the end and that other charges are not coming related to his taxes, or foreign lobbying. what do you do not want is to drag on from now until

argument, wolf it's so serious why not have schumer put up in a vigil nominations? >> welcome, i can say, fine let's do it this way. let's have a running schedule, they can deal appropriations. and then starting at 7:00 until midnight, start doing the nominations, call up, no more recess, no more time and more time off for thanksgiving and no christmas recess. we will stay in session, every day, all the way through monday through friday and saturday. we will have sunday off, but you gotta finish one of these nominations. then you won't be allowing one senator to set a precedent that only use in the future. this is an abuse of power, abuse of process. ought to be discouraged. it is shameful what we are doing to ourselves but sending this kind of signal of weakening our military, weakening the leaders. >> as a former, you indicated this but as a former senator, if you ever see anything like this happen in your time on capitol hill? or is specific to this current era of scorched earth politics?

tonight, new details on the convicted murder who escaped a pennsylvania prison last week and is still on the run. officials that releasing video today showing how he got out, and it comes as authorities are once again expanding the search area after yet another sighting. cnn's brian todd has the latest. >> this is the modest convicted murderer danelo cavalcante escaped from chester county person in pennsylvania, prompting an intense man hunt that is now in its seventh day. from the exercise area, he grabbed walked up the wall and apparently dropped down the other side. >> cavalcante escapes from the president having crab walked up a wall, pushed his way through razor wire, run across the roof, scaled another fence, and pushed his way through more razor wire. >> a tower guard in an observation post did not see
