crab walked his way out of prison right under the guard's nose. to those of you here in the united states and around the world, welcome to "early start." i'm david culver. we want to start you off with the sprawling georgia election interference case starting to take shape and playing out on camera. wednesday a televised hearing addressed how the trial will be scheduled. judge scott mcafee says he is skeptical about the d.a.'s plan to try all 19 co-defendants in october. prosecutors also revealing that they expect the case to last about four months. as they call more than 150 witnesses to the stand. cnn's paula reid starts us off. >> based on what has been presented today, i'm not finding the severance from mr. chesebro or powell is necessary to

receive a fair determination of the guilt or innocence for either different in this case. >> reporter: judge scott mcafee in court wednesday giving the first glimpse into how he plans to handle the sweeping election subversion case in georgia. all in front of cameras allowed in the courtroom. mcafee ruling wednesday that defendants kenneth chesebro and sydney powell, who both filed for a speedy trial, cannot be separated and will stand trial together in a matter of weeks. >> obviously we're a little disappointed. we filed a motion and it was denied. however, we respect the court's ruling. >> reporter: now the issue before the court will be whether it is realistic that all 19 defendants including former president trump be tried together. >> to say that all 19 defendants should be tried together including ones that don't want to avail themselves of the speedy trial demand is really just nonsensical. >> reporter: fulton county district attorney fani willis has said from the beginning that

she wants to do just that. >> do i intend to try the 19 defendants in this indictment together? yes. >> reporter: but the judge expressing skepticism about that plan and whether they can put on a massive trial for all the defendants as soon as october 23rd, the date now on the calendar for chesebro and powell. >> just seems a bit unrealistic to think that we could handle all 19 in 40 something days. if we say no severance, aren't we going to have 17 motions saying they aren't ready. >> reporter: and some defendants like mark meadows are trying to get their cases moved to federal court. >> i think we've already had some counsel indicating that they are on trial in other cases in federal court. >> reporter: late wednesday the district attorney fani willis asked the court to issue protections for any potential jurors who work on this case. this request comes after members of the grand jury, their

identities were published in that indictment that went out to the entire world, many of them were identified online and then faced threats. so the fact that the district attorney is taking this step ahead of a potential trial, incredibly significant. paula reid, cnn, washington. so we could use? legal perspective on this and for that, we're joined by joey jackson. there is so much to this case. i want to start though with the time line. as we heard, judge mcafee seemingly skeptical of the ability to hold a joint trial with all 19 defendants as soon as next month. prosecutors also said that they plan to call at least 150 witnesses and they are expecting this trial to last four months. what do you think is reality when it comes to the timing? >> yeah, good morning. great question. and so there are so many variables here that i do not believe that that is realistic beginning on that time table.

here is why. think about the practical considerations as we look at all 19 defendants. so we have two defendants that we know with respect to chesebro, with regard to powell who will be tried together. their severance motions that been denied. but then you have the other issues, will there be any of those defendants that turn state's evidence, that means that they say hey, you know, what i'm pleading guilty, i don't want to move forward, and as a result of that, you know, i'll be supportive of the government's role to convict the others. will that happen and when. think about also the removal motion by mr. meadows. how many others will make motions to remove including mr. trump himself. removing it to federal court. how many others will come forward as the judge noted and say hey, i need a continuance, i'm engaged in another matter. and so right now i think to the judge's point, i don't think that we can expect nor anticipate that many of the 19 defendants will -- or at least

some will be tried together. and so i think there are so many variables and that time line is not realistic at this point in my view. >> so how do you separate them? as you point out, powell oiand chesebro going to be tried together and the other ones looking to move it to other courts potentially. and also those deciding that they should be severed from each other. so where does it fall? >> so it falls in one line that we call the interest of justice. how is the interest of justice furthered as we look at chesebro and sydney powell and what does that interest of justice mean. the reality is that it needs to fall where are attorneys ready and prepared to go to trial. you have a right to have a fair trial. these two have indicated that they want to have a speedy trial. that is also your right. so hey move forward. to what extent are other lawyers just not ready. there is a lot of documentation, are they involved in other matters such that they cannot become ready and move forward?

will the motion for mr. meadows be granted such that his case is elevated to federal court? if it is, does then the district attorney say hey let's try the other defendants who have made motions to go to federal court at the same time. so just so many variables and so drekts direct answer is we don't know where it falls, but we know interest of justice will be first in mind. >> and now federal court and another defendant all together, new developments in the hunter biden case. federal prosecutors say they intend to indict the president's son by the end of this month and that is based on that 2018 firearm purchase. does that surprise you at all? >> so it does not. what did surprise me and everyone else was the fact that there was some initial plea deal you might recall as it related to two tax charges for hunter biden and in addition to the gun case and we thought theres of nothing to see here, right? it would be resolved, all good.

he will be in this diversion program which means that as long as he abides by certain conditions the case goes away and then that ways off the table. and now a special counsel has an interest in moving the matter forward and that interest will result in the special counsel noted in an indictment by at least september 29 and we'll see what that indictment is about. we expect it to relate to the gun charge and we expect as a result of that that, hey, the prior deal would be off the table and what does that mean. and don't forget that we also have the investigation for five years in to the business dealing of hunter biden and what is that all going to mean, will those charges be added and if not by september 9, we've seen super cree seeding indictments before, think about donald trump and his case, will there be other charges coming down the pipe.ths case, will there be other charges coming down the pipe. so ultimately we'll see where that land. >> and if other charges are added, does it delay this even

further and thinking about the political repercussions, but from the legal aspect, where does that put the time line in any resolution when it comes to hunter biden and facing what could be multiple charges? >> yeah, without question when ever you have charges added, the defendant has due process rights. what is due process? notice and an opportunity to be heard. and that due process usually comes forward as we look at hunter biden there with a number of motions. was what you did to my client fair. what other legal motions do i have to challenge the evidence at issue. do i have everything i need to move forward as it relates to discovery to try the case. and so delay, delay, delay. but those delays are for good measure. not just for delay sake, but so that you can ensure that the rights of your client certainly are protected and that if there is a trial, it is fair, it is responsible and that the airing of all the issues is out there for the jury to hear and for the defendant to get the measure of justice that they deserve. >> joey jackson always putting it into a concise context.

doesn't mean they are completely in the clear. i'll get to those details in a moment. here is the latest from the national hurricane center. remember we get a 5:00 a.m. eastern standard time update from the nhc. still a category 1, but they stated in one of their first paragraphs that this is basically off to the races. we anticipate this storm to rapidly intensify again and you will see that in the official forecast track. by the way gusts 100 miles per hour. and this is just with that look to it. as a meteorologist, you analyze it and you have the spiral bands wrapping around the center of a closed circulation. so this thing is ready to form and ready to strengthen. so there is the explicit rapid intensification from a category 1 to a category 3 within a 24 hour period. then it will strengthen even further. category 4 right through this entire five day forecast. notice the cone north of leeward islands and north of puerto rico, but something to keep in

mind, the average error in the forecast cone at day three is roughly 100 miles. so any jog or deviation to the south and west can bring the outer rain bands and some of the tropical storm winds into the puerto rico as well by day three and four that is sunday into monday. so something to keep in mind. not completely out of the woods here with this system. we'll definitely feel the big wave impacts from this as it slides just to the north. everybody wants to know where does it go it from here. and you can see the model, honing in on the next five days. but from there, very important to see where the trajectory takes it as it approaches the turks and caicos and eventually the bahamas and east coast of the u.s. whether or not it will impact us still yet to seen. here is the forecast satellite radar, this takes you through early next week. getting dangerously close to the turks sand caicos and bahamas.

tuesday saying that she has now testified. they plan on processing that testimony as quickly as possible and will provide us with any updates in due course. and really this now has ramifications in the footballing context as well. this is a man who had been suspended by world football's governing body fifa from his duties provisionally for 90 days. but up to this point has refused to resign despite calls from players, from other sporting bodies and organizations. the spanish sporting tribunal has issued proceedings last week. and they know had said that he had committed a serious offense rather than a very serious offense which is the bar at which they were able to remove him from his post. it will be interesting to see now whether this criminal

enter the $10,000 powered by protein max challenge. ♪ ♪ here are the top stories at the bottom of the hour. the georgia judge denied a motion to sever cases in the election case. the judge goutdoubts the plan ty all defendants together. prosecutors expect the case to last about four months. a federal judge has ordered texas to remove those floating barriers from the rio grande and they have blocked the state from putting new ones in the river. barriers are part of republican governor abbott's attempt to deter migrants from crossing the border. abbott's office says they are prepared to appeal all the way to the supreme court. justice department revealing that special counsel david weiss intends to indict the president's son hunter biden by the end of the month.

kara scannell has more. >> reporter: we learned in a court filing this afternoon that special counsel david weiss said that they will seek an indictment related to the gun case this month saying that because of the speedy trial act, that they would need to make a decision on this case by september 29. they are saying that they are going to do so before that date. remember this is part of this pretrial diversion deal that he had reached back in july. under that deal, he would have avoided prosecution on a gun possession charge, possessing a gun while he was under the influence of a controlled substance. he has been very public about his cocaine addiction. that is a felony that faces a maximum of ten years in prison. so that was going to be diverted if he met certain conditions including not using drugs and not possessing a gun for 24 months. that deal fell apart. what we don't know from this filing is exactly what they will try to seek an indictment on, if

it will be that same felony or -- which we know something that they were looking at -- falsifying the form in which he filled out to get that gun. so that remains an open question. but certainly this case is looking like it will move forward with a felony charge against the president's son. let's bring in margaret talov, from axios and director at syracuse university democracy, journalism and citizenship institute. margaret, good to see you. there is a lot to go through. we'll start with what sources are telling cnn and that is about house republicans making their first official ask to hunter biden's lawyers for documents related to what is now a defunct plea agreement. signaling really that it is not going anywhere. how do you think that this continued hunter biden legal drama is going to affect his dad's campaign?

>> i mean, it is sort of the obvious question, right? because this decision now to go forward sets up scenario where the president's son could very well be going to trial while the president is running for re-election. and that could make it easier for republicans to try to do this equivalency thing to try to suggest that donald trump's prosecutions and the prosecution of hunter biden are somehow comparable. on the other hand, i think that it does really blow up the kind of argument, the claim that president biden is unduly exerting political influence on the justice system because if he were, his son would not be going through this. i'm not sure either one of these issues will matter in terms of shaping voters' minds. you do think for the president for whom his son has been a concern for a long time, it will add a real degree of emotional stress and pressure as he is running for re-election and don't forget that hunter biden's

lawyer was jared kushner's lawyer. so things could get interesting. >> for sure. let me get your take on this, mike pence giving a speech in new hampshire on wednesday continuing his call against populism. here is part of it. >> we've come to a republican time for choosing. will we embrace the traditional conservative agenda that has led our party and our nation to victory and prosperity now for more than half a century, or will we choose to go down the path of populism and decline? >> so he is taking that approach, making this push, but now cnn polling shows just how strong of a grip the former president has on the field. so is there even an appetite among republicans for what the former vice president is trying to getting across? >> polling so far this this gop primary suggests that there is not really what he is doing -- this is the ronald reagan

argument right down to the words about the time for choosing. he is putting himself in this camp with nikki haley or some other -- like sort of standard bearers in the old republican party like a mitt romney type and these were always different camps inside the republican party, but now they are becoming the kind of institutionalist/return to conservative principles camp. and look, vice president pence is not only trying to distinguish himself as a candidate from the president he formerly served, but to kind of sever his relationship in terms of legacy from donald trump's to say i'm not like this. he is making this argument that this kind of populism is not only comparable to kind of the bernie sanders movement and the democratic party, but he is actually arguing that this kind of populism can lead to goempt oppression or over the long term authoritarianism. the problem is that populism has long attracted the working class, whether the working class

voters are republican voters or democratic voters. and mike pence is not offering himself as a populist option right now. that means that he will have a hard time attracting this really important portion of the gop base. so he is clearly separating himself long term from trump. but it is not clear that he can get much political traction out of that or whether if he did, whether it would kind of inure to him or whether it might help another gop rival like a nikki haley. >> we'll see if it resonates at all with gop voters. current vice president kamala harris is in indonesia attending the asean summit and she called for accountability of the events of january 6. take a listen to part of that interview. >> i think that people should be held accountable under the law and when they break the law, there should be account ability. and i support it when it happens. >> does that extend to the former president? >> well, everyone has their

right to their day in court. but absolutely people should be held accountable. but under our system of law, right? let the evidence and facts take it where it may. >> so her wording there is not all that harsh, but it is a departure still from the white house's seemingly no comment policy. so if biden remains quiet on trump's legal issue, do you think harris will start speaking up more on trump? >> it is a really interesting moment. it is going to be seen as a break from the white house's position and the president's position. although i'm not sure that it is. she is prettile positioned to try to test the waters on this argument. she was after all a former prosecutor and also not biden. biden's issue is that the republicans are trying to say that he is politicizing the justice department or putting his thumb on the scale. no one is saying that she is trying to do those things. and biden is eventually going to

have to distinguish himself from donald trump and make the case that donald trump's legal troubles and involvement in january 6 and all of these things make him unfit to be reelected. so the question for the last several months has been how is he going to do this and when is he going to start. and i think what you see the vice president doing here is beginning to test the waters for what arguments work and that may ultimately help inform the president's way of dealing with this issue as we move closer to the general election part of the 2024 campaign. >> thank you for helping us thread this all together. good to see you. at least 17 people are dead, dozens injured, this after a russian missile hit a crowded market in ukraine's eastern donetsk region. this is one of russia's deadliest strikes in months.

president zelenskyy condemning it as a deliberate attack on people who did nothing wrong. katie polglase is in london with more. ukraine in the midst of this counteroffensive right now. could this affect that counteroffensive? >> reporter: this is clearly a devastating attack on civilians and let's not forget these kinds of attacks on civilians by russia have been happening really since the beginning of the war and we've investigated them, they are often considered war crimes for targeting civilians, targeting civilian infrastructure. in terms of the counteroffensive, the morale is in quite a good place. while these attacks are horrendous, they are not damaging morale in the way russia may be intending. and that is if you look at the past couple of weeks, counteroffensive has been making progress, marginal land gains in the south and clearly now having strong backing from its western allies. blinken in town yesterday saying that there was real progress in

the counteroffensive and just this morning the head of nato jens stoltenberg saying that they are slowly gaining ground in the counteroffensive. clearly there is some confidence here from the western allies as well from the ukrainian leadership, this is the message that ukrainian leadership has wanted all its allies to be communicating really for the last couple of week. we are moving forward zelenskyy has been saying, we're making progress. and that morale clearly is very strong. the new defense minister appointment again is another sign of this, they are moving forward, this is a new phase of the counteroffensive and these devastating attacks on civilians is unfortunately part of something that ukraine is very used to in this war and does not seem to be having that morale dent that maybe russia is intending it to have. >> perhaps used to it but really still unsettling to see that striking video. katie, thanks. coming up on "cnn this morning," brand new cnn polling in the 2024 race for president. is it cause for concern for team biden? and next right here, surveillance video shows how a

escape. you have to watch this here. a crab walk between two walls in the exercise yard, that is apparently what no one saw and that is how he got out. we've got more now from brian todd. >> reporter: this is the moment convicted murderer danelo cavalcante escaped from chester county prison in pennsylvania. prompting an intense manhunt that is now in its seventh day. from the exercise area he crab walked up the wall and apparently dropped down the other side. >> he escapes having crab walked up a wall, pushes his way through a razor while, across a roof, scale another fence and push his way through more wire. >> reporter: a tower guard did not see the escape and has been out on administrative leave. it took an hour before the prison was locked down. and in may, another inmate briefly escaped in the same route. since then the only steps taken was additional razor wire were installed. >> and what we thought was

sufficient, they have proven otherwise. >> reporter: and another sighting reported tuesday night. unlike monday's sighting, this one in a creek bed by a resident was not caught on camera. any traces of him left anywhere? >> yes, there have been footprints and there have been other indicators to us that he has passed through a certain area. we've had a number of dog scent trails that we have followed for quite some time. >> reporter: hundreds of officers plus dogs and drones and helicopters continue to search. at road blocks and checkpoints, cnn observed police searching vehicles, opening trunks and checking back seats. >> he will make that mistake that we're pushing him hard so that he makes where there will be some piece of other type of evidence that points us to him. >> reporter: two school districts again closed on wednesday. reverse 911 calls warning residents in the area. >> if you see this individual, do not approach him. >> locking everything, locking the cars at night.

i've been checking out all the woods. >> reporter: the risk? >> he is a violent individual. if given the opportunity, i believe that he would use as much violence as he needed to or could to avoid capture. >> reporter: cavalcante escaped prison last thursday just over a week after he was sentenced to life without parole for the 2021 murder of his former girlfriend. authorities say she discovered that he was wanted on murder charges in brazil. her sister tells cnn he had become suspicious and jealous. >> translator: there were threats like if you ever cheat on me, i'll do the worst to you, these types of things. >> reporter: now that he escaped, she is scared. >> translator: i haven't slept for many days since then. i nap and i wake up afraid. >> reporter: while law enforcement says they are concerned that this manhunt could come to a violent end given cavalcante's violent history, the lieutenant colonel told me right now they don't

have any indication that he has a weapon on him. brian todd, cnn, westchester, pennsylvania. let's get to former fbi special agent and professor of criminal justice from the university of new haven ken gray. let's start with that video showing the escape. what do you make of it? >> this is quite remarkable, remarkable for two reasons. one is that they had had the previous escape using the exact same technique. and, two, this is just remarkable watching them go up the wall. it is really surprising that he was able to do this. there is another inmate that may be acting as a lookout at the time. and apparently in the may escape there was an altercation on the back court -- basketball court that allowed that inmate to briefly escape. >> human error playing a role, does this serve as any kind of wake-up call for prisons and

jails around the country? >> well, i wouldn't take this example here and try to use it too broadly. i think in this particular case there was a lack of coverage. they thought they had corrected it by physically adding more razor wire. but in this case one of the tower guards did not see it happen, so there was an internal investigation going on about this escape and they will -- they plan to add additional resources, other personnel, inside the exercise yard itself to make sure that this doesn't happen again. >> and i live in l.a. and that is something that you would expect out of a hollywood movie. the vitt i deo is incredible. can i ask you about the search? there is obviously coordination between law enforcement at the federal and the state level and local levels. how does that according nargs a nation and communication work?

>> whenever an incident like this happens, law enforcement comes together, you have a unified command with pennsylvania state police working with the u.s. marshals, working with the philadelphia fugitive task force and all the surrounding township police departments. so a lot of resources are being thrown against this. you also have k-9 officers working with their dogs and you have aerial asset, helicopters flying constantly in the area. cavalcante is likely staying put during the daytime and moving at nighttime. and so law enforcement are operating during the daytime and not moving around that much at nighttime. and so he has not traveled very far. he's been out ifor a week now ad he's still within five miles of the chester county prison. so this is a person who because he has not moved very much, they will catch him, just a matter of time. >> i know a lot of folks in that

beatdown. astros first team in major league baseball history to score at least 12 runs and hit 5 or more home runs in three straight games. finally the long wait is almost over. we're just hours away from kickoff of the nfl season with the chiefs hosting the lions. kansas city the preseason favorite to lift the lombardi trophy according to vegas. no team has won back to back titles since the patriots did it back in 2005. and patrick mahomes says it is not how you start, it is how you finish. >> just not being satisfied with getting wins or you are having early success. you have to keep building. i think that you can learn a lot in the nfl, you might have a great start to the season but as the season goes on, you have to keep building or other teams will catch you. you want to be the best team at the end of the season just as much as you want to be the best at the beginning. >> big question heading in to tonight's game for chiefs fans and fantasy football players, will travis kelce play tonight
