right now on early start, new revelations this morning this georgia's election subversion case. parts of a grand jury report that were redacted until today. plus president biden bound for the g-20 summit in india where the real story might be who is not attending. and hurricane lee getting

stronger and more powerful by the moment. as the category 5 storm now churns through the caribbean. to those of you joining us here in the united states and around the world, welcome to "early start." i'm david culver. in a few hours we expect the release of the full report from the fulton county grand jury that investigated the election subversion with the 2020 presidential election. ultimately it led to the indictment of former president trump and 18 co-defendants. it is important to note that this is different than the grand jury that actually returned the indictment last month. and this comes as trump tells a judge that he might try and move his case from state to federal court. so there is a lot of moving parts with this as this is obviously one of several cases the former president is facing. but here to help us break it all down and make sense of it is a

criminal defense attorney and former federal prosecutor. katie, thank you for being here nice and early. and there are so many elements to this and i know if we looked specifically at what was redacted earlier this year, perhaps some of that will come to clarity with what is coming out today, is that right? what kind of information do you think we can get here? >> the special grand jury report was essentially the first look of the january 6 case in fulton county. that report and that special grand jury did not have the authority to issue an indictment, so it will be interesting to see what types of recommendations, what types of defendants are listed in that report. as of right now we haven't been able to see that. so it is not that it has any practical impact on the case, but it is more so an interesting aspect of what types of charges were recommended by that grand jury versus what was actually indicted in georgia. >> and no redaction in what comes out today? expected to be fully transparent? >> that's right. because original redactions were

result of the fact that there were people named in the report that were not yet indicted so that is why the judge had not allowed that to become public. at this point everybody has been indicted had will be so no reason to further keep the report redacted. >> so a lot of information to dig through today. when it comes to the former president potentially moving his case from state to federal, this seems to be a trend that lot of folks among the 19 defendants are considering. what is going to need to be proven here in order to make that happen? >> in order for somebody to move a state prosecution to federal court, if they can show that they were a federal official at the time and that what they were engaged in was under the color of their official duties, then they have the right to file that removal notice in a federal district court even though the case is still technically state charges that will be adjudicated in this federal forum. so for donald trump's purposes, i think that he does have a very strong argument that the case has grounds to be moved there, but ultimately that federal

judge will have to make that final decision. >> and mark meadows, if he is able to make that move to federal court, will that set any sort of precedence here or is this really case by case and you have to be pretty specific on the defendant? >> i think with the meadows removal it will be a good indicate of how amenable the federal courts are to taking these january 6 cases. it is interesting though with donald trump because the question for the federal judge in removing the case is whether the official was acting under the color of their authority. and that is really what the ultimate question is in the january 6 prosecution in georgia in general. was president trump acting under his official capacity or was he outside the outer perimeter as they say of his presidential duties. so i think that is the big question, but for removal purposes, i think he has a strong argument that that is at least at play. so i would anticipate that he would make that request and i think he has a strong chance of getting it, but ultimately the judge will make that call. >> and peter navarro has been convicted of contempt of congress charges for not

complying with the january 6 subpoena. what is your reaction to this conviction here? >> it was an unfortunate defense to him. essentially peter in anavarro alleged that the reason he did not comply with the complain subpoenas is because he had been instructed by president trump to assert executive privilege. but according to what i've seen, the defense did not present any corroborating evidence to support the fact that he did in fact have that direction from president trump. certainly president trump did not bolster that claim. and so it was a pretty open and shut case it looked like. he did not comply with the subpoena and the ultimate fact finder did not see that he had a justifiable reason to avoid doing so, so he went down for that. >> i appreciate this, you brought a lot of perspective to what is a quickly evolving case and just one of many. so thanks for being with us in person this morning. >> absolutely. right now president biden in the air headed to the g-20 summit in new delhi. he is set to arrive in the next four hours or so and scheduled

to sit down with narendra modi for one-on-one talks later today. the summit among leaders of the world's biggest economies kicks off on saturday. but xi jinping deciding at the last minute here to pass on going. first time he has missed a g-20. vedika sud is in new delhi. has china reacted here as to why president xi is not attending? it seems like if they are not talking publicly, there is something bigger at play here and a message they are trying to send. >> reporter: no explanation whatsoever, david, at this point. all we know is that the second in command from china, the chinese premier will be attending the g-20 meeting instead of the chinese president. it is very important to note here that the chinese president has never missed a g-20 summit ever since he came to power back in 2012. this would be his first. now, why is this? there is a wide area of speculation after beijing's reticence really over why xi

jinping will not be in new delhi for the g-20 summit. could it be because of the border tensions that have escalated over the years with india? could it be because biden is going to be there? or is it because there is a disillusionment in terms of beijing with the current global governance system in the global order? here is what a foreign affairs expert had to say about this. >> i also would argue that perhaps president xi is trying to send a message to the u.s. and other western members of the g-20 that beijing is simply not inclined to participate with the western powers and western players at this moment and he would prefer to spend his time focused on global forums that are meant to provide -- or serve as alternatives to the west such as the brics and shanghai cooperation organization. >> reporter: so is the message that china would rather be apart and spend more time participating in anti-west bloc

summits. that could perhaps be one of the reasons. but like i said at the top, there is no inherent explanation that beijing has offered. in terms of india and their reaction to the absence of both putin and xi jinping from the g-20 summit, which we are hosting this year, they say this is not the first time that prime ministers and presidents have skipped the summit. so whatever they need to say, whatever the position is, it will be relayed through their representatives. but i doubt if any big ticket measures can really be announced by their deputies that the point. back to you. >> vedika sud, ahead of what will be a busy weekend there. we appreciate it. coming up, how rudy giuliani hopes to pay millions in unpaid legal bills. plus that 70s show actor danny masterson getting 30 years in prison. and a category 5 hurricane spinning in the atlantic. we'll look at where this is headed. that is next.

it only took hurricane lee about a day to explode into what is now a category 5 storm. let's go to meteorologist derek van dam in the weather center. we were talking 24 hours ago and it was hurricane level 1 and now we're talking a 5. and a lot of folks getting nervous. what are you seeing? >> yeah, this thing is in beast mode right now. this is what it looked like as the sunset last night. what we'll see this morning will be extraordinary. this is the strongest hurricane in the atlantic basin since 2019 with hurricane dorian. and get this, it mornl doubled its wind speed in 24 hours. this is the third fastest -- tied for the third fastest rapid intensification of any atlantic basin storm. so that is just really incredible. 85-mile-per-hour strength increase in those winds in a 24

hour period. again that is tying matthew from 2016. here is the latest information from the 5:00 a.m. update. nice what we call a pin hole eye right in the center of the storm giving an indication of the strength of this. 165 miles per hour, that also tells you the strength. that is a category 5. exactly what the national hurricane center was forecasting. but this is new this morning, they are explicitly calling for 180-mile-per-hour sustained storm. so the potential here to breach rarefied air, very rare type of storm to be able to have this type of strength in the atlantic basin this far south and this far east. now, the official track slows the storm down considerably across the southeast atlantic. and of course everybody wants to know when will it make this northerly turn that all of the computer models continue to show us? because if it happens later in the forecast period, of course that puts more of the eastern coast in jeopardy from impacts of this storm if it makes that

turn earlier of course it means it minimizes the risk to major of much of the major metro poll tans along the east coast. but one thing for sure, this will kick up large swell and wavespoll tans along the east coast. but one thing for sure, this will kick up large swell and waves starting sunday through next week. where it goes, we're still a little unsure, but this will be a considerable weaker storm as it moves through colder waters across the western atlantic. so that is something to consider as well. >> and your description of beast mode, that is obviously making folks uneasy and i know you'll be tracking it. >> very closely. >> good to see you. and let's get to quick hits across america at this hour. a federal appeals court says texas can keep those floating border barriers for now. a lower court judge had ordered them removed from the rio grande river by next week. an l.a. court has sentenced that 70s show actor danny masterson to 30 years to life behind bars. he was convicted earlier this year on two counts of rape. his attorney says they plan to

appeal. and rudy giuliani hoping he raised at least $1 million for his legal defense fund last night. donald trump hosted a fund raising dinner for his former lawyer and current co-defendant. a source tells cnn giuliani owes millions of dollars in unpaid legal bills. just ahead here for us, a black rainstorm paralyzing hong kong with floods that the city has not seen in 140 years. and what south dakota's governor plans to say about donald trump at tonight's rally. incremental gains in its southern counteroffensive. kyiv reporting that its air force destroyed 16 drones headed toward odesa this morning. but a russian missile attack on zaporizhzhia left at least one person hurt. meantime secretary of state antony blinken wrapping up his visit to kyiv after announcing $1 billion in new u.s. support. katie polglase is with us from london this morning. hey there, katie. so president zelenskyy is saying that ukraine is preparing more global pressure on russia. what exactly is this likely to look like? >> reporter: well he mention this had last night in his nightly address, something he does every night talking about the status of the conflict. and he said as you mentioned, global pressure on russia. this is clearly already happens. we've been seeing this week from blinken's visits to kyiv that there is quite a lot of public support for ukraine in this war. what we do know is that ukraine maybe will get more weapons. that is what zelenskyy hinted

out. but we don't know what kind of weapons, from whom or when. and this is already in a week of a lot of promises of military equipment, military training. that $1 billion promise you mentioned from the united states. and also quite a lot of successful diplomacy from other countries as well. just yesterday, he also had phone calls with the british prime minister rishi sunak, israeli prime minister benjamin netanyahu also talking about security, british again promising more security and more cooperation with ukraine going forward. all of this shows the gathering of allies, the western support around ukraine in this war. and that is not just verbal support but military equipment on the ground, desperately needed ammunition and weaponry and clearly there is more to come. >> and more later this morning as they continue the push for global support. good to see you this morning. microsoft warning that chinese operatives are using ai to spread disinformation ahead of the 2024 election here in the u.s.

the company says images like these that you are seeing are computer generated for click bait and reposted by real people on their own social media goal? to incite more division among american voters. steven jiang is joining us from china's capital. so disinformation efforts like this, you and i both know, they are not all that rare coming out of china, but the ai factor here, this is what really stands out. it is getting increasingly sophisticated, no? >> reporter: yeah, david, it certainly is. remember as recently as february of this year, we reported the discovery of china based bots planting fate newscasts on twitter and facebooking ai generated avatars questioning the in-telling gritd difference the u.s. elections and amplifying narratives of beijing's strategic goals. because experts say they didn't gain much traction. and fast forward to this latest finding, it seems that

technology and ai content has improved to the point that it is very difficult for average users to tell the difference between what is real and what is fake, hence all the engagements from real users. that of course something long warned by u.s. officials and he experts especially in this current polarized u.s. political environment. so americans are easy prey. but the chinese have pushed back on this latest allegation where the spokesman at their embassy in d.c. calling this report full of prejudice and another example of made llicious speculation agt china. but meta took down thousands of china based social accounts that were connected to chinese law enforcement targeting not just americans but also people in taiwan and elsewhere as part of a cross platform covert influence operation. so this is definitely not the last time that we'll be talking about cases like this and the concern, the of course, of course is that ai is deepening the threat posed by cyber attention and misinformation and

india prime minister later today before the g-20 summit officially kicks off on saturday. worth noting china's president xi jinping deciding at the last minute not to attend and no bid the g-20, but a new poll shows concerns at his 2024 campaign. let's bring in a politics reporter at axios. appreciate it, steph. this polling is really revealing. you've got questions regarding biden's age and perceived competence. and they really don't have anything to do with specific policies. but do you think this could be a wake-up call for biden's campaign that maybe it is time to rethink? str . >> it is never a good sign when two-thirds of voters from your own party aor leaning democrats are saying that they would rather see anyone else other than joe biden as the nominee

next year. and, you know, this age question keeps coming up over and over again. and maybe in the past it wasn't taken so seriously, but this is yet another poll, this is not the first time we've seen these findings, not the first time we've seen democrats uncertain that they want their nominee in 2024, and not the first time that age has been one of the if not the top concern for the voters. so certainly a sign that is this is a real vulnerability and the campaign will have to address these concerns and really make a show to democratic voters and voters across the can country that biden is the best answer going into 2024. >> manu raju spoke with elizabeth warren on thursday. listen to part of that conversation. >> voting for president biden is going to be about preserving our democracy and i think a lot of americans will show up to do that. >> drawing that contrast a little more starkly, more aggressively, more consistently? >> i think that every time donald trump opens his mouth, he

draws that contrast pretty starkly. >> so other democrats have also been vocal in their support for biden and his accomplishments. but does biden's campaign need to embrace this sort of big picture messaging more? >> i think we certainly will see them increasingly embrace this messaging. it is important to remember that while donald trump still looks to be the most likely gop nominee next year, that process is still ongoing. and i think one thing that is important to note when looking at some of the polls and seeing that democrats are not sure that they want biden to be the democratic nominee, when you dig into who they would want to replace him, there is not a clearance and there is an argument to be made that that is a sign that democrats maybe don't want biden to be the nominee, but when it comes down to it, when he is up against donald trump again in that anti-donald trump factor comes into play, democrats might get in line. but of course there does need to be a strategy to deal with this uncertainty among democrats

because as we've seen in election after election, democrats need voters to continue out. when people are not thrilled about the candidate, that is when voters decide to stay home. >> it doesn't seem likely that the biden campaign will stop pus pushing bidenomics. but according to the polls, this is not resonating. 58% thought biden's policies have made economic conditions worse. and katie porter was on with erin burnett last night and said this -- >> joe biden has a terrific story to tell on the economy. he is not getting a ton of help telling it. i think that is part of one of the things that i hear during my senate campaign is people want to hear about what he has done. they also want to hear about what he is still going to do. >> she says he is not getting enough help. so does need more help getting that message to land with voters? what do you think? >> clearly he needs something to work on the economic issue.

and the focus on bidenomics i think is a sign that the campaign -- signals that the campaign knows that this will be an important issue going into 2024. economy is always top of mind for voters no matter what year it is. so the focus on the bidenomics language, clear that the campaign is seeing that this is an issue that they need to nail, they need to prove that this is something that biden can handle. but as you point out, we haven't seen much movement in the polls so far. of course this is going to come down to what the economy looks like as people are heading to the polls. and we are still a long ways off and there is time for them to turn this around. and the other thing about economy, republicans and democrats will have their own points that they point to. >> steph, we appreciate it. convicted murderer who escaped a pennsylvania prison more than a week ago still on the run. officials zeroing in on a botanical garden where he might have been spotted for the second time.

brian todd reports. >> reporter: another reported sighting as the manhunt for convicted murderer danelo cavalcante enters its second week. >> we had a possible sighting by a person in the vicinity of longwood gardens. >> reporter: this sighting officials say was not far from where he was seen on a trail camera monday night. a law enforcement official tells cnn someone walked up to police and reported seeing cavalcante around noon thursday. police searched the area inside their perimeter of 8 to 10 square miles, asked why they couldn't squeeze in the area to grab him. >> it is not just a perfect open piece of land that you can march through. you've got businesses, residences, highways, hill, valleys, wooded areas. >> reporter: cavalcante has been on the run since august 31, the week after he was sentenced to life in prison for murdering his girlfriend. the victim's family in fear for their lives. >> they do have protection and they are terrified. they haven't left their home. they are barricaded inside and

very concerned about their safety. we do have police detail around them 24 hours a day. but i know that they are very, very worried. this is an outrage, this should never have happened. i was a prosecutor who was assigned to this case and i helped convict this man. and he was sentenced to life without parole. we're all upset. >> reporter: this stunning surveillance video shows the escape, the 34-year-old crab walking up the side of a wall in an outdoor exercise area of the prison. investigators say he pushed through razor wire, ran across a roof, scaled another fence and got through more razor wire. he has been seen several times and police found his footprints. >> saturday evening we heard very strange things in the woods. saw some things on our cameras. and we did alert police. >> reporter: nina and charlie live less than two miles from the prison on a 65 acre farm. they believe cavalcante may have been on their property which police have searched twice. >> we do have several nooks and crannies, we have three barn, hey lofts, horse trailers. there are three houses on the

property. so we're a little -- we're taking precautions. >> reporter: cavalcante has also been recorded at least twice on surveillance video. >> more days that go by without catching him, get more dangerous? >> he does because he gets more desperate. he is probably looking to obtain a weapon. he will need to get water and food and more clothes. and you know, he is looking for a vehicle. all of those things potentially put him in contact with the public, with citizens in their homes, cars, outside. and that is where the real danger comes in. >> reporter: police tell cnn that so far they have found no indication that danelo cavalcante has obtained a weapon. when we asked if he has left any traces of himself anywhere, like food, clothing or anything else, we were told so far they have found no physical traces of him. brian todd, cnn, kenneth square, pennsylvania. this morning we're hearing from the american trapped deep inside a turkish cave. mark dickey suffered

gastrointestinal bleeding during a research mission. he is now under observation at the base camp more than 3,000 feet down. he got some units of blood, is alert, talking and even smiling. but getting him back to the surface could take a nada bashir is covering this from london. what is dickey saying? >> reporter: is this a welcome update. he has expressed his gratitude to thosing part in the rescue operation. we know that around 150 rescuers from multiple nations are now surrounding the turkey's third deepest cave taking part in this challenge to rescue dickey from the cave. he is at base camp more than 3,000 feet below ground where he is receiving medical attention as rescuers continue to assess the upcoming operation. but as we heard in that message, he has acknowledged this could

certainly take days. take a listen. >> i look forward to working with everyone to safely get myself out with their assistance. as you can see, i'm up, i'm alert, i'm talking. but i'm not healed on the inside yet. so i'll need a lot of help to get out of here. >> reporter: turkey's caving federation said it would typically take an experienced caver around 54 hours to made it to the surface under ideal circumstances. so this will be a challenge. we know dickey has suffered from gastrointestinal bleeding so that is a concern. he is according to medical teams able to put pressure on his so many beistomach area. and that will pose a challenge. this is a deep cave and narrow wining winding passageways. but they share cautious optimism that he will reach the surface in the next couple of days.

case. sources telling cnn that south dakota government will endorse donald trump for president today. some republicans see her as a potential running mate if trump wins the nomination. and president biden set to arrive in india just a few hours from now, he will take part in the g-20 summit this weekend. and at the summit, the president will meet with world leaders to pitch the message that america's economy is strong after the pandemic and to discuss several other matters such as ukraine, climate change and developing countries. kevin liptak is in new delhi. good morning. so what do you think biden's main focus will be as he starts off the g-20? >> reporter: yeah, there is no doubt that this is a divided g-20. there are fractures in this summit and i don't think that president biden's objective is necessarily to paper over them, but he is hoping to highlight the united states as a reliable partner particularly for the developing world and particularly when compared to
