says she was warned about. after testifying before the house committee. so bad, she says, she could not go home. she had a leave of ten. plus the latest on ophelia, a huge tropical storm and heading to the east coast where hurricane watches are already in force. we begin tonight, with breaking news fill murphy new jersey's democratic governor are now causing i new jersey senior senator bob menendez to step down. it is the latest blow on the latest indictment on menendez who powers the foreign relations committee. latest indictment, yes i did say that senator menendez has been federally and died of a. for the last time around the failed to secure convictions. the allegations this time are remarkable, and came with pictures. they say the senator traded his influence for hundreds of thousands of dollars in cash, gold bars, and a mercedes convertible. his wife is accused of working, in the words of the indictment

to introduce egyptian intelligence -- for the purpose of establishing and solidifying a corrupt agreement with an american egyptian businessman. senator menendez notified chuck schumer that he is stepping down from his committee chairmanship. schumer for his part so menendez as quote, he has a right to due process and a fair trial. all of this comes of course, in the middle of republican efforts to show that the justice department is tilted towards republicans. a case that might be harder to make, now that the latest two biggest indictment on the biden doj are from a powerful senate committee chairmen, and the president's son hunter. we are going to take that up in a moment with former deputy director. first -- >> some of their cash was stuffed in the senators jacket pockets. >> indicted again, bob menendez facing corruption related charges for the second time in ten years.

prosecutors announcing a three count federal indictment against a federal senator, and his wife and no dealings with the new jersey businessman starting in at least 2018. >> the senator and his wife accepted hundreds of thousands of dollars in bribes. in exchange for senator menendez to use his power and influence to, protect and enrich those a businessman. the alleged >> bribes include more than $50,000 in cash, hidden in the senators home and safe deposit box. a mercedes benz convertible, and gold bars worth tens of thousands of dollars, among other things. the indictment also alleges that the foreign committee chair quote, provided sensitive u.s. government information and took other steps that secretly aided the government of egypt. >> behind the scenes, senator menendez was doing those things for certain people. the people who were bribing him and his wife. >> the senator issued a defiant statement in response.

>> i have been falsely accused before, because i refused to back down to the powers that be, and the part people of new jersey were able to see through the smoke and mirrors and, recognize that i was innocent. >> menendez has long maintained his innocence. telling cnn back in april -- >> this inquiry will end up in absolutely nothing. the >> senator faced similar corruption charges in 2015, he fought off conspiracy, bribery and other fried chargers relating to political favors. >> to those who are digging my political grave, so they could jump into my seat i know who you are, and i will not forget you. >> that case ended in a mistrial, a partial acquittal and all charges against the senator being dropped. in this latest case menendez remains defiant, saying he will not be quote, distracted by baseless accusations. >> we are joined from outside the federal courthouse in the war manhattan, the political reaction has been fast furious, and in copious i would say what

is the latest? >> yeah jon, that first move from menendez stepping down from the foreign relations committee, as you said something senator schumer said was the right thing to do for now. there is a growing chorus, in addition to have lawmakers in new jersey to call on him to resign. menendez digging in tonight, striking back saying it is not lost on me how quickly some are rushing to judge a latino, and push him out of his seat, i am not going anywhere. >> one after the other democratic colleague grossman calling on him to resign. what about the allegations involving the egyptian government? >> prosecutors say that he used his position of the chairman of the foreign relations committee to egypt. specifically they point to a few examples, that he allegedly goes through a letter to sanders several u.s. senators to lift a hold of $300 million

in aid to egypt. he also allegedly got information about staff in egypt, highly sensitive information and provided information to egyptian officials. if he is convicted he faces as much as 20 years in prison, and he and the other five defendants including his wife, are due in court on wednesday. the prosecutor say that this investigation is very much continuing. >> great work all day long, thank you. >> with us now someone who has seen a share of lawmakers on both sides of the aisle investigated, and sometimes prosecuted. former fbi deputy director mr. mccabe, and you've seen your share of indictments. here gold bars, as these convertible, hundreds of thousands of dollars in cash in a jacket, it almost seems like a hollywood script corruption indictment. >> it is incredible john, that

indictment is extraordinarily detailed. the inclusion of the photographs, it is a very impactful document, that makes serious, serious charges against the senator. they are allegations at this point, right? he has not been proven guilty of anything yet. it is true that conduct laid out in the indictment is damning, it is breathes in, and it really goes to show the incredibly high bar we have in public corruption cases that we have now. as a result of the case -- against governor years ago that went to the supreme court. it's a very high bar to be able to prove these cases. you have to show a very clear quid pro quo, that the politician accepted something of value in a term of committing unofficial acts. the items of value or laid out explicitly in this indictment, and it is an impressive

document, it will be one that he has a hard time defending against. >> according to the indictment senator menendez provided sensitive u.s. government information, and took other steps are secretly aided the government of egypt. how does that, maybe increase the gravity of this? >> well it certainly raises the specter, of in side dealing against the interests of our own country. he has not been charged with an espionage offense or anything like that, but that is what it feels like when you are reading it. they have included details that could have substantiated that, indicating in some paragraphs that these interactions that he was having a foreign officials to not include any members from his senate staff, or the staff of the committee that he chairs. so it is little details like that that go a long way to show that this activity was really

conducted kind of, under the radar, in a very personal way by the senator. not as part of his official duties as a government official. >> senator menendez essentially beat the rap with a hung jury last time, what does that say about his mindset this time around? >> the timing here is incredible. we know that the previous case, all the charges were dropped by the department of justice in january of 2018. the conduct alleged in this indictment begins in 2018. literally right off the heels of this pro previous experience, having defend himself to go to trial, being successful in that effort it shows him being right back into some corrupt activity, with a whole new group of people. again if true, it really raises questions about his judgment, and his inclination to engage in this sort of, corrupt

behavior, for his own enrichment as opposed to what he should be doing as a senator. >> and you've heard of the last several months, if not years, republicans attack the department of justice are somehow weaponizing the department to go after conservatives. yet in the month alone we've seen indictments against the democratic presidents signed, and now a powerful democratic committee chairmen. does that undercut some of the claims by republicans? >> well it should jean. to be clear, this indictment is not about defending the department politically. this department is done by the professionals in the department of justice, who do this tougher living, bringing this case because they have solid evidence and probable cause to believe a crime has been committed. in a broader sense american should look at this and really question those who are constantly harping on the falsehood of the weaponization of the department. the doj brings cases where they are, whether they are against democratic politicians or

republican winds. they follow the facts and they follow the law, and i personally think that this indictment is a very good example of that. i hope it convinces some folks at those claims of weaponization are absolutely baseless. >> all right mr. mccabe thank you, have a nice weekend. >> we do have more breaking news just days after accusing rudy giuliani of groping her on january six. cassidy hutchinson has more to say, it is striking. she now says just minutes before being sworn in before the house committee, and giving such damning testimony, she nearly backed out of the whole thing. she tufted out of course, famously, testifying only brought new concerns this is what she told cbs news. >> in the days after my testimony, you know, there was the immediate security protocols, and security concerns. so my life changed in the way in the fact the way that i was living my life. >> he could not go back to your apartment? >> i could not go back to my apartment.

>> i ended up moving down to atlanta for several months. >> they didn't even think it was safe for you to stay in d.c.. >> no? . >> a staffer spent more time and cast the hudson, he served as committee spokesperson he joins us now from washington. what more can you tell us about your experience with cassidy hutchinson and concerns for her safety? >> the select committee was concerned about the safety of all of our witnesses, when they came to testify. we had over 20 million people watching, 13 million on the day that hutchinson testified. i was with her that entire day. we weren't even more extreme, so we've got into it with the other witnesses. i don't know if you will remember, but we kind of announced this hearing as kind of a surprise, as we did not want there for any information to be leaked out for her to be in any more danger. the reason why is because of what she was saying.

we can remember the things we didn't know before she testified, that donald trump knew that there are weapons in the crowd, so when he said let's march over to the capitol he knew those people had weapons. that is what we learned because of cassidy hutchinson. we learned that trump lunged forward in the car to the secret service driver, because of cassidy hutchinson. that day when she was rehearsing, and getting ready for her debut as a witness, live in, one of our hearings, she was really nervous. i can understand why cassidy and i are of similar ages, which is why i was with her that day. i was so impressed with how she came across, during that hearing, she got across the fact that and she stood by her testimony. her testimony still stands today. we would not know a lot of the things that we know now is she decided not to go through with

that. >> in a cbs interview she talks about the moments just before she was about to testify this is what she said quote, i almost ran out there, is a little holder outside the committee room and i almost darted. i heard the door click open, and i turned around and looked at my attorney and said i cannot do this. i started to walk, and he gently pushed my shoulders, and he said you can do this. >> as you are saying you or wait for the entire day there, how nervous was she? and how much did she grasp that her life was about to change? >> cassidy is the smart young woman and i think she was so nervous because she knew, the man including donald trump, meadows, giuliani that she was going to publicly go out and testify about. when she was standing in front of those doors it was surreal. we went to the women's restroom at the same time, we were the only two women in that group. it was a moment where you are

kind of alone and i said to her, i don't know if it was the right thing to say, you are going to be iconic. it might have made her more nervous, it might have been the wrong thing to say. but it was true, what she was doing was of that nature, and she grasped that. i will say that the way she went out there, so poised was not surprising to me, but it was very impressive. i was sitting behind or during that testimony, and the number of cameras in her face and how she did not bat an eye, was just a testament to who she was as a person. i believe it was brought up in the hearing that there is a many man a lot older than her that pled the fifth to a lot of the questions from the select committee. cassidy hutchinson kept coming back, testifying in front of our hearing to america. i think it really brought to light a lot of the facts for donald trump and his plans to overturn the 2020 election. >> you also had a moment, during a break in the testimony,

can you tell us what you talked about? and how it impacted her? >> we had one break in the middle of the hearing, so we went back, and it was sort of, a breath of relief that the first part had happened. i think it was interesting to see how her testimony was coming across, as we were reflecting on that. we as frankly a young woman as well, you came across really really well, your story is being told. because of you, and the power of your words we are going to know a lot more. so she went out there for another hour to testify to more of the things that she had witnessed, being in those powerful rooms. and it was surreal. eight and then now we'll learn more about her experience, in her book on, looking forward to see what her experience was like. i do not envy her experience, especially afterward.

and presidential politics night, i knew look on where one candidate stands on policy. also where she now stands in the polls in new hampshire. we're type of former -- nikki haley she unveiled her economic plan today, it comes as she appears to be getting more traction at least in new hampshire. a recent cnn polling there shows are narrowly in third place. with former leading contender rhonda santa's in fifth, there is a four way tie for second more than a political panel. including a republican pollster. jeff zeleny in new hampshire first. >> when i pick a fight, the people always when. >> nikki haley is increasingly picking that fight in a presidential race, trying to break through a crowded field. >> we need a leader that will stand up to democrats and republicans. republicans talk a big game but they are nearly as reckless as

the democrats on spending. >> she's eyeing voters who are seeking anyone but trump, and hoping to add more to their ranks by confronting the former president directly on spending and more. and she unveiled her economic plan in new hampshire, she said trump was no better than democrats in the white house. >> joe biden, donald trump, and barack obama added more to our national debt than the previous 42 presidents combined. >> it is a tenuous tightrope for the former carolina governor, who is trying to distinguish yourself through conservative policy, rather than policing the conduct of the former president. in who's a ministration she served as the ambassador to the united nations. she is proposing to eliminate the federal gas tax, reform social security and medicare programs for future generations, and revoked 500 billion dollars in green energy subsidies from the inflation reduction app.

have somebody strong, which i think she is. i am very pleased with her. >> to prepare for the next debate, haley is taking questions from voters, sharpening her answers and distinguishing herself from rivals. including trump. >> why should we care about ukraine? we always have to have a president with moral clarity. someone who knows the difference between right and wrong. someone who knows the difference between good and evil. >> jeff -- joins us now, jeff how important does the haley team see next week's debate for her? >> john very important, they are trying to keep the momentum alive from that debate one month ago in milwaukee. attending her campaign events over the last month, which we have here in new hampshire and in iowa, there is an excitement and a curiosity about her candidacy. she is winning over some moderate republican voters and it is through talking about conservative policies. largely talking about spending,

the runaway spending during the trump years. the stakes are high for her, no question, but also many for her rivals as especially desantis and tim scott, each of their own imperative for that debate next wednesday at the reagan library. john, what this is really becoming is that trump is skipping these debates. right now this undercard is a race for second place. that is very important of course, she wants to be the one standing, face to face, one on line at some point, with donald trump. >> jeff delaney thank you so much. let's have more of what's playing out in new hampshire and whether anyone has a chance against donald trump there. senior reporter henry and kristen solstice anderson. desantis taking down, nikki haley taking up. what else do you see in the numbers in new hampshire?

>> yes i, i'm a fan of going on twitter sometimes, and there is a meme of a dumpster fire. to me that is the desantis campaign in the state of new hampshire. the fact is he started off with north of 40% of the vote and those independents, and he has ticked down considerably. now is in the mid twenties, now is at 10% of the vote. nikki haley going up, ron desantis going down. >> if you are nikki haley, chris christie, or desantis now very much in those four way tie. it promises army in there as well. how do you break out? i think the important way to break out is to continue to do well in these debates, in full defy yourself as the person to go head to head with trump. there are a lot of folks that said that it won't matter that much, trump will not be there. it's true it does not affect trump's standings, who has not been there, but it really did elevate haley to the top of the

pack. it proved to republicans who want to move beyond donald trump, hey you have a very good option here. the problem is going to be, for instance nikki haley is doing quite well in new hampshire. desantis is still doing reasonably well in that second place-ish spot in iowa. they'll be a split decision. you go to a place like south carolina, which is nikki haley's home state. if you do not when your own home state, that is kind of a challenge. there may be a different winner that leaves a really murky picture, and a murky picture benefits donald trump. >> all right harry let's talk a general election polling, president biden show new numbers with a show head to head lead over trump in new hampshire. what does that say about a relatively swinging state in new hampshire about how biden is doing in swing states in general? >> see if you can see a duplicate in other states. we know the national polling is

not exactly date for joe biden. he trailed, or within the margin of error from donald trump, but it is something that did not happen in the 2020 cycle. if you look at the swing state paul at new hampshire, where he is up double digits over former president trump. look at wisconsin, it had him ahead by nearly ten points. if you look at pennsylvania where he is up a point clearly in the margin every, or but he is not doing worse than he was in 2020. this plants a very different picture nationally where biden is doing worse than he was in 2020. the swing states where it ultimately matters biden is holding his own, or has a higher number than he did in 2020. kristen back to the republicans in the new hampshire primary, less than five months away at this point. if you are one of these republican candidates, not getting traction, maybe not in that second tier.

when do you have to start thinking about bowing out? i remember it was the democratic side but kamala harris was once seen as the powerful democratic candidate and she actually dropped out. >> that is right usually decision is driven by resources. running a campaign is not cheap. if you are able to continue to get support of donors, big and small, the people who write the big checks and the people who are kicking ten to $20 online. that is what you need to keep one of these machines going. if you are only polling and very low digits it can be hard to sustain that. especially if you do not show up on a third or fourth debate stage. we know what the criteria will be for the third debate, that barr keeps getting raised. if you are still down in the low single digits it makes sense to maybe stay in through iowa, cross your fingers but campaigns are expensive and you will see the field narrow when we get past new hampshire. >> all that seemed to make a

mark, maybe some fireworks in next week's debate. thank you guys so much,. >> and update on the story from last night coast guard captain turning president, allegations of sexual misconduct while he taught at the academy. less than 24 hours after cnn's report air, the academy announced that it had banned macy from its grounds. we have obtained a prosecution member of her 2016 that he had offered to give high grades, and showed favoritism in class in exchange for sexual banter. the coast guard's attorney recommended prosecutions back to, and its leader rejected that. since that report aired cnn has received documents of more allegations of this conduct. an attorney called it false, in attorney did not immediately respond to comment today. earlier this year cnn reported on the secret coast guard investigation that found dozens of sexual assaults and had been

what can realistically be done to address this influx of migrants there, how long would it take? >> first off, stop giving people benefits for breaking the law. we should not be shocked that when you allow people to have the ability to work, when they come into the country illegally, that it will entice other people to calm. we should also be prepared, as the summer months wayne, and it is not 110 degrees, you are going to start seeing an increase in activity. the simple solution that should happen today, does not require congressional notification, doesn't require congress to pass anything, we know congress can't pass anything. is to stop treating everyone as an asylum seeker. asylum israel, people struggled to apply for asylum. when he let other people abuse the asylum laws, it impacts the people that actually need it. him wanting to come to the united states to get a better paying job, is not a reason for

asylum. two we acted shriek start treating these human smugglers as terrorists, what i mean by that border patrol is collecting, what used to call in the business pocket litter. information where they pick up a bus, phone numbers of who they called in order to get to this location. we should be actioning that, and dismantling that, working with our partners in order to do that. those are two things that could be dying today, that border patrol is asking to be done, and it is not happening because of policy decisions in washington d.c.. when i was down on the border last week, for several days, one of the things that was most disappointing for me was morale is among border patrol is the lowest it has ever been. they are being forced to do something that is pretty terrible. the difficulty about all this, is for 20 years, we have had elected officials lying to us about the difficulty about how to deal with this path. democrats and republicans.

had a shutdown of the rail lines going back and forth from the united states and mexico. 30 states in the u.s., the number one trading partner is mexico. instantly like this continues, you are going to see an impact on the cost of food in our grocery stores, the cost of equipment to fix our car, it is going to have a lot of secondary and third affects. >> he talked about short term answers, you know real change has got to go through congress. you also know how little congress has been able to accomplish over the last 20 years house republicans were the ones that stood in the way of comprehensive immigration reform, sometime ago. how do you convince republicans, in congress, to reach across the aisle and work with democrats. and you know this may be part of the reason that republicans will shut down the government. >> i am not questioning your statement john, i agree with you or many republicans have been against this.

many republicans want to see a decrease in the number of legal visas that are brought in. unfortunately republicans and democrats would rather use this issue as a political bludgeon to hit each other over the head, during elections. there is a piece of legislation, and that is sitting on the table called the usa act it was negotiated between me and pete aguilar a democrat from california. it would have had over 250 votes in the house, and i think at the time we had 58 senators. when speaker pelosi came into power the second time, she refused to bring that up, even though she knew that she could get a bipartisan we need to do legal immigration as well how we approve agricultural workers in florida we need to be making sure that the best in the brightest around the world and the brain gain of the united states has benefited from the

comcast business, powering possibilities. more breaking news, the hurricane watches in effect right now for portions of the north carolina coast, as tropical storm ophelia takes aim at the state and areas north. including washington d.c., all the way up to southern new england. millions of people be in the path of the storm this weekend, and the advisory from the national hurricane center. chad myers joins us with the details, give us the latest on ophelia, the trajectory what to expect. >> 70 miles per hour right now, still moving to the north west toward the carolina coast, less than 100 miles away right now. there is not really an eye, getting this thing stronger, but the hurricane watches posted because now that it is in the gulf stream, in the warmest water. look at the rain all the way up

to virginia beach, that is a couple of hundred miles away from the center. virginia beach just got a gust of 56 miles per hour from a tropical storm hundreds of miles away. it is going to rain, it is going to flood, it is going to be a storm surge there is going to be wind that pushes all of this all the way up and down the east coast. by tuesday afternoon it is gone. by sunday afternoon we're only at 30 miles per hour. with 30 miles per hour in a saturated ground can clearly still cause some power outages, and all the way down the coast with the tropical storm warnings there could be many power outages. the only area of the hurricane watch, because the storm to still get stronger. >> obviously each storm is different, what are some of the biggest threats that you expect from a failure. >> the biggest threat that i think, people go to bed tonight thinking there is only a tropical storm i don't care about that. and they wake up tomorrow and it is a hurricane, and it is

flooding their property all up and down the east coast. maybe an water going over the outer banks, that is some overwatch. we are already seeing these surges at two and a half feet. the storm is still 100 miles away. the coastal innovations is pushed to 46 feet. i know that is not 15 to 20 like sometimes we see in a cat to three or four, but that is enough for a lot of people that live along the coast to loosen property. even if they park their cars and drive, way that car could be half underwater by morning. >> it's a lot of rain, we've had a whole lot already. chad myers thank you so much. just ahead new reports on advanced u.s. weapons system headed to the war in ukraine. most audacious the cat attacks today. fred plank in talks to the commander of the ukrainian counteroffensive about that, as well as the current pace the war. that is next.

despite a far right rebellion in the house over ukraine war funding and on the day president biden met with president zelenskyy there were multiple reports tonight that the u.s. has finally approved shipping advanced long-range missiles to ukraine. these have been long sought by the ukrainians in part because they can hit deep behind russian lines. the news comes the same day that ukraine launched one of its most audacious attacks yet, a direct strike on the headquarters of russia's black sea fleet in crimea. our fred pleitgen spoke with the commander leading ukraine's counteroffensive about that attack and the war ahead. >> reporter: moscow >> reporter: smoke billowing from russia's black fleet headquarters in sevastopol. i sat down with the commanding general oleksandr tarnavsky. and he tells me this is

invaluable for his troops. >> translator: a destroyed command means a destroyed command link and if there is no command hitting infrastructure like factories, warehouses. containing weapons is also a factor for victory. >> reporter: in the past weeks alone the ukrainians say they've hit a russian ship, a submarine, an air base and a surface-to-air missile system in occupied crimea still ukraine's president faces skepticism both from many republican lawmakers and the public about the u.s.'s continued support for ukraine. tarnavsky asking for patience. >> translator: we have one goal, liberation of our territories. however hard it is, we will keep on working. and i want to thank even the skeptics. their criticism also influences our tasks' success. >> reporter: it's been a slow grind for the ukrainians on the southern front. progress so far incremental. but the u.s. has cautioned time might be running out, as fall progresses, making the earth

here soggy and movement difficult. >> how much do you think that you can achieve before the winter sets in? how far do you think your forces can get realistically? >> translator: the weather can be a serious obstacle during an advance. but considering how we move forward, mostly without using vehicles, i don't think the weather will heavily influence the counteroffensive. >> reporter: general tarnavsky says he remains optimistic that ukraine's counteroffensive will be a success, especially if ukraine continues its campaign targeting russian forces in the rear like crimea. >> and fred pleitgen joins us now. so fred, when you spoke to this general, did he have any concerns about russia retaliating to an attack like the one we saw today? >> reporter: they certainly do have that concern. especially if you look at russia's track record, john. definitely some of the ukrainians are saying when it comes to attacks in and around crimea it's usually been russian counterattacks with missile strikes that have then followed right after that. in fact, it was just this week

that the russians after the ukrainians targeted that submarine and that landing boat that the russians came out and targeted ukrainian infrastructure really across the country here with cruise missiles. the ukrainians, however, now believe, john, that they have better surface-to-air missile systems to counter that threat and to try to shoot a lot of those russian cruise missiles down, john. >> are the russians saying anything about the attack on sevastopol? >> reporter: well, they're being fairly mute about the whole topic. in fact, one of the things i was hearing is that russian state television is reporting very little about what happened there today. it was quite interesting also from the russian authorities, we did hear that there was an attack on these headquarters in sevastopol. the russians claiming that five of the cruise missiles, as they put it, that were fired toward that headquarters had been shot down. but of course we see some of the video that came out later. it does appear as though at least two of those cruise missiles did hit that headquarters. so very little coming from the russians. but they do acknowledge that
