they were shown full of gigs and sons on stage and in front of the cameras as well. in a wild twist, a century later, one of the most famous lines is now being used in the fraud trial of a former president. >> i thought you left! >> i did not leave. >> i saw you with my own eyes. >> who are you going to believe, you are your own eyes? >> that was the quote. it was used by a judge in a ruling that donald trump is liable for fraud. pointing out that trump's fantasy world, when it comes to the values of his properties, and himself, and like the marks brothers, the scenes inside and outside new york city's courtroom became a routine, and a parade of insults. good evening, i'm abby philips, and trump the peering today in court for the first day of his trial which, threatens to decimate his entire real estate empire in new york. >> this is a continuation of a

single greatest witch hunt of all-time. we have a rogue judge, we have a racist attorney general. it's a scam, it's a sham. our country has gone to. it is all run by doj, which is corrupt. frankly, our country is corrupt. >> as you can see there, trump and his lawyers have now turned the courtroom into a campaign stop. at one point, the judge told lawyers to lower their voices, as they shouted trump side at the courtroom as if they were addressing a jury. the thing is, there is no jury. >> as you know, we're not entitled to a jury, which is pretty unusual in the united states of america. so, i think it's very unfair i don't have a jury. >> the judge had to explain today that neither side,

neither the prosecution, nor the french requested a jury trial in this case. he also added by law, a case like this, the judge decides the outcome anyways. remember, the new york attorney general is asking for the trump organization to pay a quarter billion dollars, and halt all of his business activities in the state of new york as punishment for lying about the property values of his properties, amongst other things. joining us now is michael cohen, to respond. he'll be here with us in just a moment. first, i want to take you through the facts today. we have daniel dale with us to walk us through what happens in the courtroom today. daniel, trump made quite a few claims as usual. some of them have already been rejected by the judge. but, here is the former president claiming that this lawsuit is part of a coordinated effort by the department of justice. is there any truth in the? >> [inaudible] fast-track, this trial could have been brought years ago, but they waited until i was right in the middle of my campaign. the same with other trials and

indictments, it is all run by doj, which is corrupt in washington. everything goes through them. >> the doj says, he's part of all of this, is there any truth to that? >> no, there's no truth to that. there is not a shred of evidence that doj is this hidden hand behind the scene. this is a state case brought by a attorney general who trump noted today, in previous occasions, made it part of her campaign platform that she was going to be tough on trump. the second significant inaccuracy in the comments was the part about timing it, and went into the middle of the campaign. attorney general james launched the lawsuit that led to the trial in september 2022. that's when she filed it. trump did not launch his campaign until november 2022. so, the law should alert to the trial was filed roughly two

months before he even announced a 24 candidacy. >> a good point there, daniel, trump also talked a point about what he calls a worthless clause, a disclaimer that he had put, or his aides had put in the financial statements that are now issue in this trial. let's listen. >> we have a clause in the contract. it's like a buyer beware clause. it says, when you take a look at the financial statements, don't believe anything you read. this is up front. some people thought a worthless clause, because it makes the statement, and anything you read is worthless. this is what is called a full disclaimer. we display the financial status. but, even with a full disclaimer, which immediately takes you out of any fraud situation and any litigation. >> what do we know about the, daniel? >> trump is making this clause sound way stronger than it actually is. you can read it. what it says, and i am paraphrasing, is that the acid evaluations and trump financial statements are estimates, that they use a variety of methodology's to come up with these estimates, including in some cases the judgments of trump and his associates. it says you may not be able to

sell these assets for the same price as listed here. so, it basically does, in so many words, encourage readers to be cautious about what they are seeing. but, it does not say that what is contained in these statements is useless or worthless. it does not say anything you read, and the judge himself noted this in his ruling last week, finding trump and his sons liable for fraud. the judge said they're reliant on the so-called worthless clause is itself worthless. they say, you cannot rely on such a vague disclaimer to miss represent facts and claim that is not the it's you against claims of fraud. so, trump's assertions about what this clause says and how it supposedly protects him against any and all liability it's just not borne out by the fact. >> that would be hard to believe, honestly, if it were true. so, daniel, also, before trump appeared in court today, his campaign released a statement about new york city's crime data, as if that is related to

all of this. was any of it accurately? >> it was not false. they used actual numbers, but they were cherry pick in the end point for the numbers. so, in talking about new york state, the and the data in 2021. talking about new york city, the end in 2022. so, they said new york city's shootings increased 71% from 2018 to 2022. murder is up 48%. 2018, to 2022. what they did not mention is we are in october 2023. the trend line is now sharply downwards. murder is down 11% this year. that's in addition to 10% decline last year. shooting incidents are down 27% this year and, that is after a 17% decline last year. so, in addition to the broader point that you cannot attribute any trends in crime up or down to any individual attorney general, this is complicated difficult stuff to pinpoint. those numbers do not and in 2022. they're not going up anymore, they're going sharply down. >> all right, daniel dale, thank you very much. joining me now to discuss,

trump's former fixer, michael cohen. he is now principle of crisis acts, and also the host of two podcast. mea culpa, political beat down. and to new york times bestselling author of revenge, how donald trump weaponize united states department of justice against his critics. michael, good to see you. trump, very very well. what did you take away from seeing him, his demeanor outside of that courtroom? even inside the courtroom we got a peek at it? >> the this is very typical donald. on the outside of the courtroom, he was all bluster, he was typical donald, he was in campaign mode, to the point that he was looking to figure out how to make this scenario into something profitable. inside the courtroom, he was behaving the way that you would expect somebody to behave when they are in a situation that they have no control over. that is something donald hates.

he hates not being in control. he sat there like a good child, he did not say word, he did not speak, he did not get out of control. >> he was angry. >> where he had to be reprimanded by the judge. of course he's angry, how can he not be? he's watching his company, his 50 plus your company is in a depth spiral. basically, what if james did, our unsinkable attorney general is gave him the corporate death penalty. judge arthur engoron is in agreement to tish james that the company should not be able to practice, neither should donald. allen weisselberg -- none of them to be able to operate any business in the state of new york. so, sure, it's understandable he would be angry. >> michael, you are at the center of today's hearing in some ways. i want to get your response to some comments made today in courts by cliff robert, one of the representatives for don jr. and air trumpy. said in part, quote, there are major lynch pin is michael

cohen. so, when you talk about credibility, they're going to have a guy who lies everybody, who's a convicted felon. he is a fixture of what their cases about. what is your response to that? >> i think cliff roberts is an idiot. first and foremost, i have provided testimony to seven different congressional committees, to the mueller team, to the district attorney of 23 occasions to, the attorney general. only cliff and donald trump, it's all part of the gop hands bank. all they are going to do is sit there and try to discredit me to disparage me, that's the name of the trump gain. look at what he said today. forgetting about michael cohen, what i brought to the table were documents and cooperating testimony. so, listen, i don't even think it would be 100% necessary for

the a. g. to use me in order to find trump guilty of the crimes that he's been charged with. look at what he did today, just with fish james and judge arthur engoron. judge arthur engoron called him all sorts of names, a rogue judge, tiff james of course is a racist, a line he has used many times with many people. he said the same thing about jack smith. he says the same thing about fani willis. this is a guy who does not understand. disparaging somebody is not the way to win a case. what you need to do is bring the evidence, bring the documents in order to clear your name, as opposed to thinking you're going to clear your name by disparaging somebody else. the fact that you have guys like cliff robert, the fact that you have alina habba or chris kise to make the statements, the fact that now

jimbo jordan is now outed as well. this is all part of the playbook. i have watched the playbook since 2015, as it's related to the campaign. this is so part and parcel for the playbook, it does not even affect me. do you think that trump cares, to the point that whether he actually loses this case? he seems to suggest that they are not as worried about the legal ramifications of all of this . >> yeah this is actually a big one for donald. because donald entire, id, ego, super ego have all been predicated around the notion that he is this incredibly rich, entrepreneur genius businessman and what this does the strips him of all of that. it demonstrates that he is neither rich, he is certainly not a genius businessman, and he is not a good entrepreneur. >> do you think he can -- survive.

>> everything that he has -- sorry? >> you think he can survive a penalty of a quarter billion dollars, or even potentially more, because it is up to the judge with that number ends up being. >> correct, that's also something that people make a terrible mistake with. what attorney general james stated that it is a baseline of 250 million. meaning that is the bottom. that does not mean that is the top. the way i calculate it, based on the information that i know it is going to be at least double, if not two and a half times that amount. with penalties and interests and so on. and i'll be now, he cannot survive this, he cannot recover from this. >> michael cohen thank you so much for that perspective. >> thank you for taking me away from my -- >> up next for us breaking news out of washington, republican congressman matt gaetz, filing a motion to oust kevin mccarthy. i will speak live to one of the lawmakers who may end up joining his cause. plus congresswoman sparks

never before in american history, has the speaker of the house been ousted through a rare move to a motion to vacate.

that is why a single lawmaker can propose a resolution to remove the speaker, with the majority of the house. the last time get a vote like this happened, william howard taft was president, in 1910. lawmakers and criticized joseph canada than speaker of having too much power. he was known as the czar of the house. the first person to graced the cover of time magazine. so the republican called the vote himself, daring lawmakers to go on the record. they backed down, and they failed. now the current speaker, kevin mccarthy will find himself at the center of the fire. calling the vote, is this the biggest thorn in his side from his party, that is congressman matt gaetz. he announced that move that will happen in the next 48 hours, and he is accusing mccarthy of not following through on the promises that he made. including drastic cuts to spending. but gaetz, has made it clear that he will need democrats to get on board with this. >> i have made no deal with democrats, because i believe the democrats should vote against kevin mccarthy for free. >> now mccarthy for his part

says, bring it on. and he has not ruled out working with democrats, to save his job. interestingly enough to after nearly a decade of breaking norms in the name of donald trump, kevin mccarthy he is now the one touting the institution as the reason to keep him in power. joining me now is a republican in the house, congresswoman victoria spartz of indiana. congresswoman i appreciate you joining us tonight. >> thank you for having me. >> i think the most important question tonight, is where do you stand on the motion to vacate. will you vote in favor of it? >> i am open minded, i have not decided yet, but i will tell you something it is very important that matt accountability and our leaders. it is very easy to criticize other party, to write books, until you fight in a transient very hard to challenge your own party. if one party does not, deliver a have full accountability. it is good to put pressure on your own speaker.

>> does it concern you that democrats will play a pivotal role in this, either way? either to save mccarthy's job, or to get him out of the job? >> partisan is good, i think it is so much good for them they probably want -- it is unfortunate that we cannot get together on a bipartisan basis and deliver to the american people, this issue of debt, and barters border security. it's very disappointing to me that we cannot get together even on national security. >> if speaker mccarthy is removed, do you have confidence that there is a another candidate that would have enough support to win the speakership? >> listen, people think too much of themselves for over 200 million people we can not fix -- we need to -- deliver you don't need to be a member of congress, we have a lot of great people, and unfortunately kevin -- was we have to decide can we

trust him to have another dry or not. and i am going to be thinking about that. >> so you have said, that you are really frustrated with what is been going on. especially the deal that was struck to keep the government open, he released a statement saying that if congress does not pass the debt commission this year. to move the needle on crushing national debt and inflation, at least at the next debt ceiling increase at the end of 2024, i will not continue sacrificing my children for the circus. with a complete absence of leadership vision and spine, i cannot save this republic alone. congresswoman i have to ask you how i would leaving congress help address any of the concerns you have about the national debt? >> listen, not all the issues resolve here -- let's be realistic nothing is going to be happening next year unless we force an issue to a vote, because everyone will be companion fundraising. it is unfortunate that this

great institution is not governed for the people. i am so afraid of special interest groups. i think this is our last chance, i think it is very reasonable legislation where we will have to sit at the table and decide how we can move the needle at the end of next year. this crushing debt and inflation will destroy many lives of americans, and we have to become serious. listen, it was not created by this congress it's been coming for many years, but we are in charge today and we have no excuses, we have to deal with that. >> republicans already have this very slim majority in the house, have you heard from your colleagues about what your resignation could mean about how much leverage they have to accomplish the agenda they have for congress? >> all of the agenda is not gonna be accomplished next year, this is how the institution works. there are very few times you are in appropriations, you are in debt ceiling increases, the rest people just to your presentation for messages. unfortunately nothing productive will be happening. i think that we have to make a final push to deliver, and i really hope that senator

been asked where they stand on this. only a couple have been vocal like aoc who said she absolutely would not support kevin mccarthy as speaker. i think this is about getting concessions, it's about showing that they are not going to give up something for nothing. kevin mccarthy has repeatedly shown that he cannot be trusted in the eyes of the democrats, and whether it is in launching an impeachment investigation against joe biden, or catering to marjorie taylor greene, he is somebody who in order to support him it is not about really believing in him, it's about doing what is best for the american people. >> i have to ask, if mccarthy is put in this position where he needs to come up with some kind of deal, with democrats, he has this removable no caucus

in his group. if it's maybe a blessing in describes with the way to move forward in the house that, it is not going to put him on the brink every single day. >> i think he will be on the brink every single day no matter what happens, that is kind of the nature of his leadership. unfortunately. the way i think about is, the old adage is if you see a boulder rolling down the hill do not get in his way. that is my knee jerk reaction to where democrats are right now. let's think about what happens, regardless of if mccarthy wins this battle, he will need democrats. that says a lot about where the

democratic party is, and the nature of the king jeffries leadership. when they are in the majority they get good policy, when they are not the majority still need a democrat to keep the government running. that is an incredible statement. >> who comes in after kevin mccarthy? there is no way that that person is more acceptable to democrats. >> no that's true, but it's also interesting to me, with respect to mccarthy, whoever comes in it really wasn't mccarthy's job to begin with. if you understand what i'm saying. because, at that point it is just chaos, after chaos, after chaotic moment what you see on the republican side. democrats will just look back and say hey we can govern, that's actually a great ad, why elect a republican if they're

going to ask a democrat anyway. >> -- this is a catch 22 kind of situation for kevin mccarthy, and matt gaetz we played the clip earlier he said, i am not going to offer democrats anything because it is in their best interest to get rid of mccarthy anyway. >> right but they have a moment to show again, that they are the adults in the room, and they know how to govern and they know how to come together for a moment of bipartisanship that benefits america. as americans are watching this right now, they may not know the ins and outs of how this vote works, but they do know the republican party is divided. that even if they technically

military amputees because it doesn't look good for me. miles taylor is the former chief of staff in the department of homeland security. and he was notably a senior adviser under than the age secretary john kelly. he's also the author of blowback, miles, you have noticed notably sounded the alarm on trump's misconduct. while he was in office. why is john kelly now in 2023 making these allegations? >> look, in defense of the chief, i think that he has been out there intermittently throughout this process and certainly before 2020 general kelly had signaled a member of things about donald trump. he felt like the american people needed to know. but i think like all of us, he's seen america on the brink of making perhaps the greatest suicidal civic mistake our country has ever made. i think that's why he's going out there delivering this warning, abby but if you go

back in time, i think kelly was very clear eyed about this from the beginning. i won't forget the first conversation i had with him about going into the trump administration. i decided not to go into the trump administration, it was several months. and he was -- he and his team had recruited me to come in and kelly said when you go swear that oath miles, when your swearing in to protect the country against foreign and domestic -- and i said yes, i know, he said i want to be clear. foreign and domestic. and he put the emphasis on the word domestic and it wasn't lost on what he meant. he was signaling his realization that the man he was serving under the president of the united states was one of the biggest threats to the united states. that's why he went and took the job to, stuff not because he thought was gonna be glorious because he was terrified of the man he witnessed in person serving in that position like the rest of us were and i hope that he continues to speak out this cycle. >> he really does hone in on a

reoccurring feature of trump's conduct in office which is his treatment of veterans particularly those who are captured or gravely injured. this all flies in the face of how he presents himself in public. he will literally hug the american flag. but he seems to have an issue with this group of people. do you have any understanding of why that is? >> look, i'm not a psychologist, abby, but i think it has to do with donald trump's lack of initiative in going into the united states military. at a really pivotal moment when when he was supposed to be signing up to go fight in vietnam, by all accounts, donald trump avoided that service. ever since have seemed to have had disdain for veterans. it bet, his complete disregard for john mccain, refusal to honor john mccain after the senator died, it is what caused me to come out against donald trump at the time the president wanted to raise the american flags back up. even though they were lowered at half staff for john mccain. look here, abby, there is a much bigger and disturbing

picture here. when your president of the united states, commander in chief of the armed forces, you are supposed to look at for american service members and for its veterans. donald trump, behind the scenes, was very, very different than that man you just noted hugging veterans and public. that's not just an attitude. it's not just disgusting comments he made behind scenes. i will tell you when speaking to the heads of veterans under donald trump, they have signaled that what he wanted to do was gunned the veterans health care safety net. they wanted to raise the veterans affairs to spend the money on political affairs. this is something they tell me he will do in a second term. again, these are donald trump's handpicked staff to run the department of veteran affairs saying in a spectrum term he will, quote, detonate them

because he wants to use those funds elsewhere. there are real policy implications for donald trump's disdain towards america's veterans and its fallen soldiers. >> how are we supposed to take the fact that all of these events that were reported, a lot of them at the time, they were denied by people who worked at the white house. even though they were all true. now, three years later, some folks are coming forward and saying, it's true. isn't that part of the problem that no one was willing to speak up in realtime? >> yeah it's a huge part of the problem. abby, we are living that lesson right now. if more people don't come out and say what they knew about

donald trump, this will happen again. make no mistake, it does have a difference. in 2020, when the largest group of administration officials in american history turned on a president who appointed them, donald trump, it did have an impact in getting independence, more uncertain how they were going to vote. concerned conservatives that did want to support donald trump, the air cover they needed to defect. we are going to have a close affection -- election 2024. if don trump is on the ballot, the american people want to avoid a second term and the autocrat, it is going to require people to step forward. i think the lesson here is that it is never too late to do the right thing. i would welcome anyone, even those who are standing by donald trump's side right now, to actually go speak their minds publicly and say the things they say to all of us privately. it's time for them to own up to the truth and come out and say what john kelly has that, what so many others know to be true, who have witnessed this man of close. >> miles taylor, thank you very much. let's listen in now to the new york governor on that missing girl that was just about. >> as a parent, i thought my own heart was breaking. i said to them, i promise you
