because [ bleep ], there are people buried in normandy who deserve us to stand up for what they thought for. that's what i'm going to do and all of you [ bleep ] who are saying what you're saying on social media, stick it. i will go on the floor and do my job. >> the anger is real, tempers are flaring, the job that chip roy is talking about, the job at hand is picking their next house later, after the historic ouster of kevin mccarthy as speaker. to republican lawmakers have jumped into the race so far. ohio's jim jordan is currently the chairman of the house judiciary committee, a powerful position in and of itself and in louisiana, , he is currently one of the top republicans in the house, to very powerful man already. lauren, where do things stand with this, what are we hearing now from these two top contenders? >> nerves are raw in the republican conference, and there are questions about whether or not jim jordan or

steve scalise could get 218 votes to unite the conference. i just spoke with jim jordan and he told me, right now, his goal is on trying to get everyone on the same team. here he was, just moments ago. >> who can bring the eight into part of the team, who can unite our team, i think i can do that. >> there's obviously a lot of members and allies of house speaker kevin mccarthy who want to extract revenge on the eight people who voted against the speaker of the house. many of them arguing that they should either be removed from conference in the case of matt gaetz, obviously that is highly unlikely, you also have some members who say they were threatened in not so veiled a threat like nancy macy said that before she decided to vote against kevin mccarthy on the

floor of the house she was told there may not be republican support to help her campaign for her reelection, she's obviously in a tough district. that money is obviously very important to members of the swing district. so you are seeing a lot of fall out in the wake of the historic ouster of kevin mccarthy. it was interesting when i talked to jim jordan a few minutes ago, he was pressed on how he could unite the conference around the issue of you pain funding. that something that's important to a lot of conservatives in the house conference, but it is also something that has divided members of the republican conference, and yesterday he

told our colleague that he didn't support more money for ukraine, today when he was pressed on how he will sell himself to people who do support that money, he said there are two fundamental questions that have to be asked, one, what is the ultimate goal, number 2, how is the money being accounted for but he was more vague in his answer about just saying that he was straight up opposed to more of that money. so obviously, he is trying to win people over right now, and that race is on for the speakership. >> when it comes to ukraine eight, there seems to be really two camps, there's not a lot of gray area within there. we will see how jim jordan and steve scalise or whoever, how they navigate these chopping waters. storming joining us now is the representative from georgia, rich mccormick, thank you for being here. just four days ago, you said it is not going to happen, mccarthy is not going to be ousted, it's just not realistic. now, here we are. you are a freshman congressman, what do you think of what happened? >> well, we are in uncharted territory right now, nobody's gone through what we've gone through, not one person in congress was alive the last time we brought this up. i'm sure there'll be other

things i predict incorrectly in the future. there's a bit of chaos, discord but this is nothing new to congress, this has been going on since the inception of our country, debates over wars, even the revolutionary war, a third of the country wanted to stay loyal to great britain. we've been through this before. >> look, we've all made bad predictions in our lifetime, so i get it. and i know you were surprised because you made those statements, you were just shocked that this actually did happen, something that's never happened before. two people have officially jumped into the race which is steve scalise and jim jordan. these right now are the potential alternatives, who can you support between the two of them? >> i think they're both great choices, they're both well- liked, well-respected, they have earned their stripes, they have a ton of experience. i think a lot of us are going to wait and see how the

presentation goes. i think there will be momentum. i don't think it'll be solved in one vote. i think we will have several votes, and hopefully we come close to a consensus, then when we come out, we actually vote together because i think that is important for the american people to see that we have some unity. >> you said both are great options for you. jim jordan has already said that he is against approving aid for ukraine. you have been very little vocal about helping ukraine. is failing to fund ukraine a deal breaker for you? >> this is a debate we will continue to have. i will put out a podcast on this. a lot of republicans don't want this but once again, going back through history, we've always had divisions on war. we've always had disagreements and that's healthy. i think we have to have debate on who we help and how much we help but in my opinion, we made a commitment, we are leaders in

nato, when we put our name on the line, we give someone our work, it's not something we take lightly and ultimately we will deal with a bigger russia who sells green to china or a bigger, stronger europe that actually helps us as allies. >> you talk about this, and there is news now the pentagon is basically warning you all, worn all of congress, it's running low on money to replace weapons that the u.s. has sent to ukraine and some republicans are saying we are getting blowback from our constituents on funding ukraine. they don't see that it's a priority. are you getting that same blowback and if you are, how are you explaining your position to your constituents? >> of course, i'm getting blowback, i'm sure everybody who has support for ukraine is getting blowback but i also

have support, some people understand the strategical importance of the breadbasket of europe, some people understand the giving their word, global leadership, there's a difference between globalism and global leadership. there on opposite side of the spectrum. if we don't have a presence in the world, that void will be filled by russia or china or another bad actor, so i think it's important to continue to be global leaders and we can extract our leadership when it comes to foreign policy, i think it's dangerous to think we are going to appease russia and they will continue to all of a sudden change their behavior, putin has been clear on lithuania, estonia, moldova, he has aggression stated in everything he says, he quotes peter the great, these are serious consequences if we don't go to bat for our friends. >> back to the united states, and just a yes or no answer, do you think matt gaetz and the other seven, who put this

forward and made this chaos happen should be removed from their committees and punished? >> no, i think that's a bad precedent, i think what they did was a bad precedent but i think also doing that doesn't solve the problem. >> congressman, thank you so much for going through all of that with me and for your short and decisive answer on that one. i appreciate you. this morning president biden is building the wall, at least part of it, this is something he said he would not do. the biden administration announced it would waive 26 federal laws to allow construction in south texas because of what they call an acute and immediate need. the plan is to construct up to 20 miles of border barriers in stark county. some 245,000 migrants have attempted to cross the border illegally in just that one sector since october of last year. on the entire border the number is close to 3 million.

hundreds of migrants rushed past order patrol agents yesterday. when he was running for president, biden made clear he would not expand the border wall if elected. >> trump campaigned on build that wall, are you willing to tear that wall down? >> there will not be another foot of wall constructed in my administration. >> the president said today that former presidents have said to him that they wish they had built a wall -- >> i don't know a single one. we need border security but that's not border security. >> and on the day he took office, president biden signed a proclamation saying that building a massive wall that expands the southern border is not a serious policy solution. today's action is not do that, it's a 20 mile section, nevertheless it's different than what biden campaigned on. so why this change, priscilla?

>> the reality the administration was facing was that they had funds from 2019 that were appropriate by congress for border areas. according to a source, they had to use those funds by the end of fiscal year 2023. so a decision had to be made, use or lose the funds, they decided to use them for border barriers which will include technology and access roads and do so in the rio grande valley sector, and this is a sector we often talk about because it is highly trafficked as you mentioned, this is an area that since last october to august, had nearly 300,000 encounters, and in this notice to the federal register, the homeland security secretary said that it is an area of high, illegal entries but to do so, to do this construction in an expedited manner, he had to waive certain laws, 26, that includes the clean air act, safe drinking water act and the

endangered species act. now u.s. customs and border protection have sought public input to do this wall and start the period projects, and in that, they announced that they would include for example, gaetz and cameras, so this is a more holistic barrier, a little more that we saw under the trump administration a big point is that this is not military, dod funds, this is congressionall y appropriated money that we chose to use. the white house is acutely aware of the situation on the u.s. and mexico border. it puts them in a precarious situation because there is an uptick in border crossings, republicans have seized on that increase and democrats have spoken out against border barriers, for example, the texas representative said this is a 14th century solution to a

21st-century problem, so all of this is unfolding, the white house is aware of it and also trying to talk to cities nationwide to make sure they have resources for the migrants they are receiving. so all of it unfolding but at least for now the news is that they are going to start construction in this area of the border, the rio grande valley sector. >> that explained it really well. thank you so much. and from the border, we know more and more migrants are being moved from the border to cities across the united states, and with that, mayors from some of those cities are heading to the border now themselves to get a first-hand look. chicago's mayor is one of the latest thing that he's going to go to the border to see if there's any better coordination that can be had with southern states. since august of last year, more than 17,000 migrants have been bused to chicago, this week alone more than 20 buses of migrants have arrived in the city and some 3000 migrants are sleeping in police stations. new york city's mayor, he's in mexico city right now to get a look at the causes of the migrant crisis. his city has also been a top

destination for migrants with 600 new arrivals each day. what do these numbers say, what do they tell you? >> so kate, consider this, just last week alone according to the city, there are about 3700 asylum-seekers who arrived in new york over about seven days. that was last week. we are a year and a half into the migrant crisis here in the city. that is certainly telling, that there's no signs of stopping in terms of these numbers, especially when you look at the situation on the southern border. those people are now part of the 63,000 that are still in the city's care, and the daily arrivals, the number you shared with our viewers, 600, that's up from 300 to 400 a day. that's why the city continues to see this increase in numbers. another factor in play, the republican governor greg abbott increasing the number of asylum- seekers that he is offering

transportation to. >> last week, texa s governor abbott centralized the dispatch, command and control functions of the deployment of buses to the texas division of emergency management and has ramped up the number of buses that are being sent, not just in new york city but other cities as well. while before, we may have received a few hours notice that buses were coming through back channels and different organizations, even including information on the manifest members of how many people would be on those buses, this change means that we no longer get even a scant heads-up. >> for new york city, there's a lot of hope hinging on a couple of things. for example, this week, the window open for some of the eligible venezuelan asylum- seekers to begin applying, putting them on track for

securing a work authorization but also the city has been implementing its confidential 60 day vacate notice, encouraging the asylum-seekers to leave the shelter system but here's the thing, those numbers coming into the system the increase, and that is going to be hard. mayor adams, traveling to latin america on what he is describing as a fact-finding trip, trying to tell migrants about the realities that await them once they arrive in new york. >> thank you very much. ahead, more indictments means more money, new numbers show just how much money donald trump is fundraising, off of his legal troubles. also, cnn has new video of a deadly car accident involving senator bob menendez his wife, it happened five years ago so what does it have to do with the indictment involving her and the senator?

one thing that has become clear this week is that donald trump is trying to make the civil trial, the civil fraud trial into a campaign booster for him. and there are members that may backup the strategy. they are reporting the republican front runner raked in more than $45.5 million in the third quarter that ended in september. his criminal charges mounting all throughout that time period, in comparison, his closest rival, desantis recorded about $15 million in the same time. what we are hearing from the trump campaign on this, what do these numbers mean? >> if you look at these numbers, powered a lot by the

small dollar donors. remember, president trump and his campaign can go back to those donors over a long period of time versus the big donors and when they max out with the checks, they've been tapped out. that's one thing to keep in mind but also, this is a very large number, and it represents an improvement over his last quarter of fundraising, and it sets him up to be in a very good position in terms of money, heading into the primary season and of course, as you just laid out, this is all coming as so many of these trials and developments, various jurisdictions, as these are all playing out and we know the trump campaign has made that part of their strategy. they tried to turn this in to a way to boost his campaign,

while being in the courtrooms, and having all of these legal troubles play out across the country in these various cases, and just to give everyone a snapshot of where this race remains, as we sit in october, before the primary has begun, starting with the iowa caucuses in january, trump and our poll of polls, so that's taking all the polling and averaging out, really continues to just lead with such force and really the runaway leader among all of these republican candidates running for president and then if you kind of distill that down into a state poll, look at south carolina, and the early states are important because obviously national polling is what it is but the early states are going to be were a lot place out and that's where candidates can get momentum but even there in south carolina where you have two natives running for president, tim scott and nikki haley, trump continues to lead the pack there. that's the snapshot we have right now. and you mentioned his closest rivals, ron desantis, coming in the $15 million. we are continuing to get money from the others as the deadline

passes. >> it's good to see you. $45.5 million. >> and ron desantis, $5 million that he can spend on the primaries right now, that gives you a sense of the gap between the two. and this morning we have an example of donald trump putting his legal struggles at the centerpiece of his campaign. he is now urging a judge in new york to dismiss the criminal hush money charge against him. he's got this argument that includes political interference. analysts say this is a longshot at best. but it really might be about politics here. also in new york for the first time since his business fraud trial started, trump will not be there today. he is at mar-a-lago spending his second full day under a gag order at the very property the judge said he tallied by hundreds of millions of dollars. the attorney general claimed the

trump show is over. what does the death of a pedestrian have to do with the indictment against senator bob menendez, the surveillance video that has just been released. why prosecutors say this is relevant to their case. also, the biden's german shepherd, commander, is no longer welcome on the white house grounds. the details on the biting incidents, that we actually didn't know about before. that's ahead.

new details this morning about an incident involving the wife of bob menendez. it's a deadly car crash that happened before they were married in 2018 where a pedestrian was killed.

the surveillance footage has been released. a little bit of this is disturbing so be careful here. immediately after the accident, she appears to sit inside her car for about a minute, she did not check on the victim. police first arrived about four minutes after the pedestrian was hit and we can see part of her exchange with an officer. >> i didn't do anything wrong. >> i understand. before you go i want to confirm that you do not want to give me your phone, correct, and that is your statement that you were driving this way and the guy came from this way and he ran into your the vehicle. >> the current indictment against menendez alleges this accident left his wife then girlfriend, without a car and two of the codefendants in the case later offered to buy her inexpensive this 80s convertible as part of the bride. she was never charged in connection with anything with this accident. john miller is here. i suppose the issues the questions surrounding those moments after the accident.

an officer shows up to say hey, i got a call from my buddy to come down here, what does that mean? >> he's a retired officer from hackensack police who comes on the scene and engages with the officer you saw on the screen and he says i'm retired from hackensack pd, but doesn't ask for any special treatment. he asks, is the prosecutor's office going to be involved because there's a fatality and the officer says yes, but as far as we can tell, she's going to be free to go. she wasn't tested for drugs or alcohol but in new jersey, unless there's an outward sign of alcohol on the breath, slurred words, unsteady gait, that's not procedure. the open questions are things we don't know, which is, the

issued a subpoena for her phone. >> on the video she did not turn over her phone, initially she gave them her phone but then took it back and that matters why? >> it matters because what police want to know in a modern car accident, what distracted you from the row that you weren't able to stop before hitting anybody. were you texting on her phone, looking at him out, where you dialing a call, in this case, we don't know if she was on the phone at all, but the subpoena for the phone records would say, what was the phone activity at the time of the accident, not part of the records that were turned over to us and that something we've been calling the bergen county prosecutor's office about, but the prosecutor has a unique phone system where it rings twice and hangs up. >> the reasons connected to the bribery cases because she was without a car and prosecutors allege that she got this car as part of an alleged bribery scheme but the open questions that remain about the accident itself which are separate, was there some kind of special

treatment given to her because of her relationship with senator melendez? >> that's right, and the family of the victim said, you know, they don't know the answer to some of these questions, either, but they are very concerned that there didn't seem to be any kind of aggressive desire to dig deeper into this case. now, the county prosecutor and the crime scene people came to the scene, they ran the accident investigation as part of this, john, all of the wheels that were supposed to turn that night turned, but there still answers the background about what they found that we need to get. >> thank you for explaining it so well. from the white house to the doghouse, commander, the biden's german shepherd has been removed from the d.c. grounds. the first canine has had more biting incidents than previously reported and sources say it's creating a dangerous work environment for white house staff, even the secret service warning agents to avoid certain areas to be out of the

way and not have an interaction with him. with all the things going on, this seems small but if people were afraid to do their jobs in the white house, it's a problem. >> certainly it significant, and we reported back this summer that ben 10 documented incidents of commander biting secret service personnel, and there was an 11th incident last week and in the course of my reporting, talking to sources at the white house, it became clear that there are dozens of incidents involving not to secret service agents but also members of the executive residence staff, other white house staffers, and the injuries have ranged really in severity, one person was treated at a hospital, other people have seen the white house medical unit here and some have not been treated or documented. a real number is impossible to come by. there has been those safety concerns from people who work here, and secret service had to start using different entrances and exits at the white house to

avoid the dog and it became a problem that the white house could no longer ignore. and as we were asking questions about safety concerns at the white house, we learned late last night that the biden's have made the difficult decision that commander, for the time being, is no longer here at the white house. the first lady's communications director told cnn, commander is not presently on the white house campus while the steps are evaluated. we have to remember that commander is a family member, this dog travels with the president when he is in delaware, or at camp david, and it'll be interesting to see what happens next year. >> it will be but when you see some of these pictures of commander, he's such a cute puppy, it's hard to imagine all this but if there's a safety concern, they've got to do what they've got to do. thank you so much, there's the picture that makes you think that he's as innocent as ever.

house republicans have proven they can fight, can they come back from this house speaker mess and proof they can lead? next week kicks off the next phase of this moment in history when the people who want to take over the job as house speaker will formally be making their pitch to house republicans. here's jim jordan just this morning, making some of his first appeals. >> somebody has to bring our team together. if we don't come together were not going to get done what the american people know needs to be done. somebody has to do it. i think i'm equipped to do it. seat is an american hero but i think i'm better equipped to unite the conference, bring the conservatives along that i'm close to with the moderates. >> key to his pitch, unity, at least amongst republicans and also getting done what he says the american people want done. and a divided congress, one of the most well-known groups on the hill trying to find bipartisan consensus is the

problem solvers caucus. joining us now is the cochair, congressman josh got i'm her of new jersey. you made clear you are not going to weigh in on which republicans should be speaker or not. but do you think this is going to get worked out next week, how uncertain is the future here? >> you know i'm not invited to the family dinner. it's the republican caucus, they decide who they want as their leader, that's the tradition. so, i think it's going to be tough but they will keep working to get it done. we have got 39 days until the government shuts down, if we don't work something out and to me, that's critically important as it was this past weekend when we worked out a bipartisan deal. a lot of priorities on the line for our country, and that's what we need to make sure we are focusing on as well. >> in your mind one of the most immediate concerns is government funding and avoiding another government shutdown.

jim jordan said the most impressing issue on americans minds is not ukraine eight, that is the border and crime on the streets, that's how he put it. if a goal is or maybe not a goal, but if a requirement in the reality is bipartisan consensus to get any forward motion on anything, is this an either or proposition? ukraine eight or border security, ukraine eight or keeping the government open? >> we live in the greatest country in the world. we need to make sure that we can do both. and in terms of supporting ukraine, it's key to america's national security and protecting us in our fight against our key adversaries. you can't just let putin have his way across ukraine, it will affect us globally, so we need to do both, and you know, i believe we can, as a country but the key is now sitting down

at the table in a bipartisan way and working together. we've got a divided government, republicans in control of the house and democrats in the senate and we are going to have to work together and find a way forward. as soon as we can do that, the better. >> this is a republican conference problem in terms of choosing the speaker but republicans are blaming democrats for not trying to help bring stability to the insanity, that's my way of describing it. i want to play for you what republican mark told me on the show, he was responding about pandering to the hard right. >> i mean, truly, democrats could have joined with reasonable republicans like myself do not undermine congress and to oust the speaker. remember, i think the senator

referred to republicans kicking out the speaker, eight members used a tool that should be used very carefully, they used it i think callously, and instead of being lectured to by the senator, it would've been helpful for democrats to respect the institution and not engage in an effort to undo the republican leadership. >> what do you say to that? >> first of all mark is a good man, he's in the problem solvers caucus, we are always trying to find a way forward, in this case, very difficult, because we didn't ask them to vote for nancy pelosi, we tried to work something out and kevin mccarthy made his choice, he said i think, quote, i'm not going to sell my soul to democrats, that's what he said. and that was his decision. we tried to work together, now the key of course is how do we find a way forward for the institution, and i think

there's a lot of opportunity to help change the rules in the house, to stop this one person being able to vacate the chair. it's something we had in prior conferences, to do that, we should go back to that, and i'm hoping we can work on a bipartisan deal to encourage more bipartisan governing and allowing for that, so allowing the democrats parties to come to the floor for a vote. those are the kind of changes we need to make, stop the extremist from being able to shut the institution down. i'm eager to do that and i know the problem solvers caucus will be a part of that solution. we are talking to a lot of my republican colleagues over the last few days and there are a lot of people who care about the institution and that's what we will continue to focus on. >> bipartisanship, can it be found once again under a speaker of jim jordan or steve scalise, we will find out.

police have revealeded a new video in connection with the shooting on the morgan state university campus. in the video there, you can see the four people walking into the video. the police say they want to help identify the people in the video, and they would like the public's help, but they are not saying exactly why. that shooting tuesday left five people hurt and prompted them to cancel the classes for the rest of the week. the homecoming activities are canceled or postponed while the police are looking for suspects in the shooting. this afternoon, a memorial

under way for the late senator dianne feinstein and the longest serving female senator. it is significant for feinstein, because she was the mayor of san francisco when she was at the murder of her colleague harvey milk which led to her lifelong battle to fight for gun control. she passed away last week at age of 90. and simone biles has done it again. she has helped the united states to help clinch a seventh consecutive u.s. world title. the team is led by biles at 20, and yeah, count them, 20 gold medals and quite an impressive return after a two-year hiatus, and she became the first woman to land the yurchenko
