breaking news this morning. the house ethics committee finds congressman george santos blatantly stole from his campaign and deceived his own candidacy for his own personal profit. now we are expecting a new motion to expel him from congress. >> new signs this morning that israel's operation in gaza may soon move into southern gaza. the idf's call for civilians to move into known shelters. >> and now, new video showing how alec baldwin handled guns on the "rust" set. john berman with kate bolduan and sara sidner, and this is cnn news central.

happened a little bit ago, we start with breaking news. the house ethics committee releasing the long-awaited report of congressman george santos. in it, they say that santos, quote, fraudulently sought to exploit every aspect of his candidacy for his own financial profit. the committee says they are referring substantial evidence that they found in their investigation to the doj. cnn's manu raju is joining us from capitol hill, and you are getting it hot off of the presses and the chairman is planning to move forward with expulsion, and what can you tell us? >> yeah, that is right. in fact, we have just have a response from congressman santos who just posted on social media, quote, if there is a single ounce of ethics in the ethics committee, they would not have released this biased report. the committee went to

extraordinary lengths to smear myself and my legal team about me not being forth coming and my legal bills suggest otherwise, and this is part of the first response that we are seeing from george santos in response to the report. the report also says that he did not cooperate fully with this investigation, and in fact, he did not sit down for a voluntary interview, and they made clear that the evidence they found goes beyond the 23 counts of indictments that he is facing in federal court over the lawful activity that is going around campaign finance fraud, fraud dealing with jobless benefits and the like, and including making false statements with the house all of which he has been pleading not guilty to, and now he has a threat to the career, and the house ethics chairman michael guest is moving to expel

him from the house. he is planning to offer a resolution as soon as tomorrow to start the process, force a vote which would require 2/3 of the house to make george santos, the sixth member in american history to be kicked out of the house seat. we will see if they can get the votes to do that. now santos for some time has been defiant about all of the lies that he has admitted to in his life as well as the charges in federal court, and denying them time and time again, and recently in the last several dayser i had a chance to sit down with santos, and talking to him about all of the issue, and he indicated that some mistakes were made even as he denied all of the charges. >> would you acknowledge though fabricating large portions of your life? i want to -- people want to know why? >> manu, manu, we have gone through this and i have gone through on piers morgan and -- >> it is still a question. >> how about we talk, and look,

we know -- >> the people are asking me, why, but why? >> it is insecurity, stupidity, i don't know. i'm human. we make mistake, and i have ap p apologized and i have profusely and with remors that i have messed up. >> and more importantly that he said in the social media post that he is not going to seek re-election for the house seat. that is significant, and remember that for some time he has been defiant saying that he would run all along, and in fact, in the same interview, i asked him if he would still run for a seat even if he were expelled from the house, and he said absolutely he would run, but george santos in the light of this damning evidence detailed by this bipartisan committee and facing the threat of expulsion making it clear here that he is not going to run for re-election which is a sign

of relief for republicans which is a biden district which democrats could pick up if he not a candidate, and if he changes his mind again, but important note there that he is not going to run again, and criticizing the report that it is a smear job with the allegations pulled up by this bipartisan committee. >> manu, any sense if that is making it more or less likely for the members to vote to expel him, because you could see the argument being made, oh, he is not going to be around here very long anyway, and why go through the trouble to boot him? >> yeah, that is a great point, john. and also the fact that the committee made an explicit determination not to have a course of action that the house should take whether he should be expelled or not, and even though the chairman of the committee believes he should be expelled,

and why, because the chairman said it would take up to next year if they come to the expulsion resolution to meet the bar, and make an explicit expulsion recommendation. the fact that it is not in there could give the members some cover to say that they have not made the recommendation to vote that way and the sheer politics of this, john, this would narrow the house republicans' already very, very tight majority if he were expelled from the house, and a special election to fill it, and the democrats almost could have a very good chance to picking up that seat, and tightening the already very, very tight majority, and already having difficulty passing the bills in that tight majority and could be a difficulty as they weigh george santos' fate. >> and joining us is john avalon, as we know has heritage in youngstown, ohio, who was the

hometown of the last member expelled jim traficant, and so, the argument here is for those who don't want to expel him is that there is not a criminal conviction yet. how do you see the situation changing now? >> look, i think that the people who are honestly making the argument about precedent have a point looking to conviction. expulsion from congress is a rare thing, and it should be as you mentioned jim traficant and my parents would be proud/disgusted that his name is still in discussion, but george santos is in infamy with his actions, so spare me the victim, so this is damning and brazen, and he didn't just lie about everything to his district, he allegedly stole money and spent

it on himself to a certain extent. so if this is not rising to that level, what does? at least a censure, but the republicans have been pushing for his expulsion, because he is such a blot and embarrassment, and it is a reminder that standards should be applied, you know. maybe they can't bring themselves to do it to donald trump, but george santos is an obvious case by comparison. >> all right. let me bring people up to speed, and remind people of everything that has happened in the last one hour and nine minutes. one, the ethics committee released report and it is devastating. two, the chair of the ethics committee says he is going to introduce a motion on the house floor to expel santos. and then santos himself said he is not going to run for re-election, and he condemning the ethics committee report, and he is not going to run for re-election, and would that weigh on the members who just want to punt it a few months

down the line. is that tempting to them? >> it shouldn't be. what is right is right, and principle should trump partisan interests. and the reason they would want to punt it is because the margins are so narrow, they would take themselves from four to three seats, and this is more tenable in governing, but that is the cynical partisan gesture that should not have an impact on this damning case. and when they realized that he had made up his story whole cloth, and this report is spelling it out clearly. so for rationalization, the road to hell is paved with rat rationa rationalization, right? >> but, santos still walks halls, and if you are a follow member, how do you handle that? >> well, you should do it by

further ostracizing him, and it makes everybody seem badly, and this is what senator patrick moynihan said, condemn and be damned. and there is no native criminal class except for members of congress 679 it is a slur on most members, but it should be a honorable profession, but when you have him parade around with everything that we know and has been divulged here, you are giving the credence to chose suspicion, and we should hold folks in congress for higher standards and not lower. so if you can be fired from a sporting goods store for infractions, you probably should be held to a higher one in congress. >> thank you, john avalon with this news, and manu raju is

the israeli military may be preparing to expand the ground offensive and cnn has been learning of the reports that idf has been dropping leaflets in a city of 250,000 people making it the largest in southern gaza, around warning people to head towards known shelters, and similar leaflets were dropped in the north sending tens of thousands of people fleeing to the south. this comes after israeli leaders saying that the north is under israeli control. this is coming after gaza's largest hospital al shifa is after the complex was being used as a hamas command base.

they released video of the hamas weapons. we are now going to tel aviv, and what are you learning about the leaflet, because they told them to go to southern gaza, and now telling them to go to safety. >> yes, it is suggesting that there are future military operations from the soldiers to be taking place there, and you mentioned khan yunis which is going to be halfway from gaza city and the rafah crossing where it is closer to the border of israel. and this going to make a situation with gaza much more serious. there are already 1.5 million people displaced by the military operations inside of gaza, and the u.n. is saying that there are about 800,000 people who are

using its shelters which is far exceeding capacity. and the defense minister here in israel says that ground operations will continue formons, and they will fight hamas in the north and the south and wherever it take, but as you know, as you pointed out, israel has been telling the residents of gaza to move south for weeks now. this also happens as we are well into day two of the raid on the al shifa hospital there in gaza city. israeli military officials have been releasing video images of the weaponry, and what they are describing the military office of an mri office, and as the operations continue, they will release more information and details of what they are describing concrete evidence that hamas has used this area as command and control area for years. that is why this is a pivotal moment in this ground operation as israel has come under

condemnation of many corners of the world for the way it is conducting the military operations inside of gaza. and sara, this a significant moment of what they find and publish to the world from inside of that hospital. >> ed lavin dare ra, this is new information that people need to know, and what they may not know that there are not that many places to take cover, because they don't have that infrastructure that israel does when they have come to be not hit from shrapnel, and it is families going from northern gaza to southern gaza. keep us up to date with the details. kate? and joining us is retired general james spider marks, to talk more about. this and what about the leaflets that israel has been dropping the leaflets to east of khan yunis in southern gaza, and so

what does that say about the israeli's strategy in continuing the operation to try to rout hamas out of the enclave? >> kate, what it really describes is that the idf has taken gaza and will go after hamas leadership in segments. they have got gaza city now in a position where they feel, the idf is feeling confident that they have protected themselves, and they can go after the infrastructure and leadership in a methodical and hopefully precise way. they are now going to continue to operations there, but they will expand the operations as they move to clear the rest of gaza. the idf is declaring their intentions, and this is where we are going next, and it is best if everybody can move to the safe hay vep and get out of the way, because we are about to move in this direction, and continue the operations with leadership of hamas.

and it is clearly saying, we are coming your way. >> i want to know something about the raid ongoing at the al shifa hospital, and the disclosure of finding weapons and they are under pressure to show more that there is a command center and tunnel structure underneath the hospital that they have pointed to. the idf says they will share more information in the coming days, and then what john kirby said about this just this morning. >> we are confident based on our own intelligence analysis that the basement areas of that hospital, underneath that hospital, and the hospital, it, has been use and is being used by hamas as a command and control mode. a place to control their fighters throughout north gaza, and as a storage facility for ammo, for weapons and guns and

that sort of thing. we believe they have used al shifa hospital for temporary housing for their soldiers. >> so you have patients, and doctors and patients, and young, you know, newborn premature babies that we have been talking about. where -- what is the responsibility of israel to show more evidence as they have been called to by neighboring nations and others, and what do you see in the raid? >> well, i think that the israelis will reveal what they have come across and what they are now in possession of. and bear in mind with your question about the tunnels. the labyrinth of tunnels are connected and israeli soldiers may be in the tunnels from other locations, and not directly vertically from the hospital where they are right now, but what the israelis have an opportunity to do now, they own that hospital, and they are

clearing the hospital. they will have an obligation and they will reveal what they have found, but they have an opportunity to open that hospital back up. the cry is for humanitarian support, and you do both. you can conduct the military operations and humanitarian at the same time, and so, clean it up, and bring in mercy ships ashore, and clean it up, and clear the hospital. they are not going to go into hospital, tear everything down and then leave. that hospital can remain, can regenerate the functionality, and it can get back to the business of taking care of palestinians, and the israelis have an opportunity to do that. >> it is interest, and we have to go, that you can do both, and it is a place that has suggested that it is an either/or. either an operation, and either this ground operation happens or you can pause to give humanitarian assistance n and what you are saying is that

this morning, democratic senator joe min anchin says he s not want to be a spoiler in the 2024 presidential race, but the jury is out if he wants to be a democrat. listen to exchange with kaitlan collins. >> are you going to leave the democratic party? >> well, you know, i'm -- i don't know if i have ever considered myself a washington democrat. i have been a very independent person. i don't really -- >> is that -- that sounds like you are leaving? >> well, you -- no, you have a d or r by your name, and it should not identify who you are. >> in a different exchange, he

would not rule out running for president as a third-party candidate, but he says he does not want to be a spoiler in the race. with me now is democratic senator tammy duckworth of illinois, and thank you so much, senator, for being with us, and how could senator manchin run as a third-party candidate without being a spoiler? >> he would be, and it would not be helpful to the nation. i don't think that we need to return donald trump to the white house where he is leading in the prim primaries, and we don't need a grifter back in the white house. senator manchin would be a spoiler no matter what he calls for it. >> he said he is not going to run for reelection, and he is considering leaving the democratic party.

do you understand why that is? >> well, he is becoming more and more endangered specie, because we have had many west virginia representatives switch, and so he is reflecting the pressures on him, but frankly, joe manchin, you know, he has made some great votes, and some great decisions. vi worke i have worked with him many times over the years on veteran issue, and i hope he stays a democrat. >> and you have had some arguments over night with tommy tuberville, and mike lee, over the blocking of military promotions over areproductive issues, and there is some anger, but no action. you were angry about this in july. so, where's the action?

>> there is an action that we have come up with a resolution to get around senator tuberville to vote on it soon to allow us to get the promotions to the floor and without senator tuberville to be able to exert his hold. the best way forward is for him to not object when we ask for unanimous consent to promote all of the votes, and that is the way it has been done for literally decades, but choosing to have a partisan agenda, and we have two ships off of the coast of israel, and we have no fleet commander, and troops in poland and romania, and we don't have a permanent three-star, because she can't take officially in charge because she has not been promoted, so we have to stop this which senator tuberville has done, and whether it is naming them one by one or this

resolution, and we will get it done. >> you are a military veteran, and put yourself in the seat of one of these military families waiting on the promotion, but it has not done because of tommy tuberville, and how would you feel? >> i would be furious. we have people in limb boeshgs and kids put out of school because they thought they were going to new schools, and spouses who were accepted to a new position at the base, but they can't start that job, and families are spending money they cannot afford in order to stay in the limbo status, and, you know, when i served it was all about the security and the wellbeing of this country, and tommy tuberville has put it in jeopardy. >> i said you are ra military veteran and veteran of the house of representatives and i don't know if you have been following the last hour with this house ethics committee with george santos. the house ethics committee chair

just moments ago, the u.n. agency operating in gaza says now a total communications blackout in gaza because of the lack of fuel. this morning, the agency's high commissioner for human rights is warning that massive outbreaks of infectious disease and hunger are now seeming inevitable. it is coming as we are learning that israel has dropped leaflets on parts of southern gaza as they could expand their offensive against hamas there. we are joined by the director of human rights watch. thank you for taking this time in this difficult moment. i know that you were in the west bank, and we will start with what is operating in gaza, but there is a total communications blackout due to fuel. at one point, israel said that we allowed the fuel in, and we wanted hospitals to be able to get it, but the hospital director of al shifa said that the staff is too afraid to go

get it, considering what is going on around the hospital, and what happens next? what can be done here? >> well, first of all to clarify, the israeli government has been blocking the entrance of fuel into gaza since october 7th. so the fuel that was allegedly delivered to shal shifa was a f meters of fuel that was outside of the hospital that they could not access it. but gaza needs millions of meters of fuel to operate bakeries, hospitals, vent ilatos and sewage, and the israeli military has blocked that even though they are expecting fuel shipments as well. yesterday for the first time it let in a few thousand of liters of fuel in, and it refused fuel

for other use including for the hospitals and the telecommunication system. >> what do you see happening here? what is the human rights watch which is going around the world to look at the conflicts in particular, and what is happening right now in this conflict? >> what i am most worried about is the way that all parties of the conflict have been flouting their obligations to civilians. so the latest escalation began with an attack of palestinian armed groups against israeli civilians which is a war crime, and it has continued with the israeli government against palestinian civilians. and so they have blocked drinking water, supplies saying it is fighting human animals, and they would not allow aid to enter with the territory, and that is collective punishment, and punishing 2.2 million people in gaza, and nearly half of them

are children, and that is punishing the whole for the despicable acts of a few. and the blockades are causing lives. the incue bays or the and ventilators and life support machines dropped out because of the last bits of fuel have dropped out. and now, there is increased outbreaks of diarrhea, because there is no way to purify the water. there is no allow of purifying pumping to operate for water. the amount of aid that is allowed in via egypt is a tiny trickle. to be clear, in all of the previous hostilities in fire, the israeli military found ways for the aid to enter, and it needs to do that now. open the crossings for the

hundreds of trucks needed to give the people in gaza a fighting chance and stop blocking fuel into gaza. >> one of the things that israeli says when they are letting fuel in or when they are asked to let the fuel in, it is confiscated by hamas as well as other things. when you are looking at the situation there with hamas, there is firing according to one of the reporters for the palestinian network, wafa around the hospital, and rockets fired and then some actions taken by israel around the hospital, and what are you seeing happening there, and how does the human rights watch look at this, and is hamas as much to blame as some of the action, and israel is to show some of the weapons and the munitions that it says it found inside of the al shifa hospital as well, and what is the human rights watch concern there? >> human rights watch is looking at the lenses of the humanitarian law. it is called it humanitarian law, because it is basic

principles ohf humanitarian law that needs to be uphold but we are finding that all parties are defiling those laws. so when israeli is firing the rocket, it is indiscriminately firing those rockets. but if hamas has been hiding weapons inside of the hospitals, and if that is true, then it is a grave violation of the humanitarian laws. and so the fact that one party is committing war crime, it does not mean that you can commit war crime. hospitals are not stripped of the special protection of humanitarian laws, because of presence of fighters. there are laws that must be followed, and they can only be attacked if they are violating the humanitarian law, and there

has to be warnings that have to be given. and either no warnings were given, and they told people to leave, and there was no safe place to go or no safe way to go, and some of the people there were patients in intensive care units. in terms of the fuel, the international law allows the fuel to be inspected to make sure there are no weapons and against diversion that. what has been done for decades in gaza. it has been monitored humanitarian aid coming in to protect against the diversion. it can and should do it now, but it cannot drain gaza of life-saving fuel. the telecommunications system has gone down a few hours ago, because there is no fuel to operate the generators. ambulance workers cannot communicate with the hospital, and they cannot get to the rubble to get someone to come to get people there, and that is

just into cnn. an arrest has been made in the death of a jewish protest in

southern california. a short time ago, police de detained a 50-year-old on suspicion of voluntary manslaughter in the death. authorities have said kessler fell and hit his head following an interaction with a proe palestinian demonstrator during dualing rallies earlier this month. the bail will be set at $1 million. police in las vegas are looking for any information about two teenagers in connection with a beating death of 17-year-old jonathan lewis. he was adulted outside his high school over a stolen vape pen. a eight teenagers are already charged with murder in this attack. some will be charged as adults. video obtained by nbc news showed alec baldwin handling a prop gun while filming the scenes for the movie "rust." it's from 2021. it was taken days before

baldwin's prop gunfired a real round on set killing the cinematographer and injuring the director on the project. a grand jury will soon decide whether to charge baldwin. josh campbell has been following this and continues to follow the twists and turns. walk us through what we see. >> some really interesting insight into the new video obtained by nbc news. prosecutors had originally accused alec baldwin of recklessness saying there was a culture of unsafe practices on that set. however, in this video, this is preproduction of that movie, you see alec baldwin talking to members of the set about safety. i want to play just a version of that here. listen to his direction to the members of the crew. >> step back to your original mark. so i'm getting up. then when he drops his arm, that

crew about safety on the set. so a the lot that this grand jury will have to grapple with when this case is presented to them. sara sidner mentioned this morning this is a prosecution that has been rocky to put it charitably. two prosecutors stepped down. the charges were dropped due to potential evidence issue. but now we'll wait and see whether authorities actually bring this back for state charges. >> absolutely. it's good to see you. thank you for the update. >> i want to note that josh just dropped my name. so i'm going to send him a gift. >> everyone's friend, sara sidner.
