4:03 am
here we are the end, the culmination of this trial closing arguments beginning when court begins at 9:30 this morning, as you just pointed out right there, the defense going to argue that michael cohen is the only one that the prosecution brought forward that can tie trump to these alleged crimes. and he is a liar. that is what they are expected to highlight in addition to that, the people, the prosecution didn't call who jurors sorted or heard about in some of the witness testimony. people like former trump, a cfo, allen weisselberg, who worked out the communications of those hush money or calculations rather of those hush money payments also, keith schiller, the former bodyguard, who allegedly according to the prosecution, had that crucial phone call with michael cohen connecting him to donald trump, to discuss those hush money payments. they also believed that those documents are not false. everything that the prosecution has laid out for those jurors it's not false because cohen was trump's attorney up until 2017. so that will be part of their arguments then, of
4:04 am
course, prosecution has it's turned and they say you don't need to fully just believed michael cohen because they have the documents to prove it. they have the witness testimony, they have phone calls, they have the 34 falsified documents according speaking to them, which includes the business vouchers, the invoices, and the check. so it's going to be an eventful de in court today. let me lay out exactly what we're expecting full day of closing arguments. they actually could bleed over into tomorrow and then of course, jury instructions that crucial oh, part of this of this case, where the judge will tell the jury how they are meant to interpret the law and apply it to all the evidence and the witnesses that they have heard from. those are expected to last an hour and then of course deliberations begin. the seven men and five women we'll go behind closed doors and determine the fate of the former president. guys really closing arguments set to begin in just about an hour or so. >> a brynn gingras outside court. thank you so much for being there. we'll check back in with the in a bit. it really kate, what we're going to see
4:05 am
today, we've seen bits and pieces, all the whole narrative, all scattershot effort. now, each sayyed is going tell a complete story in front of this year. that's entirely the focus, right? to sum it up today and it doesn't seem very clear already today, the donald trump seems raring to go posting on social media and wondering aloud, quote, whether or not he will become a common criminal. cnn, steve contorno is joining us now. he's got much more on this. steve, what else you're learning while trump is lashing out just before this final phase of his trial is set to begin. >> you look at truth, social yesterday, just one post after the other started the de with a message, a memorial day message aimed at quote the human scum that is trying to destroy our country. and from there he criticized the gag order in the case. he criticized rulings that have blocked certain witnesses. he also said there's no crime. and if there was a crime, it shouldn't have been brought seven years ago and then this post, which brought an interesting question to the mix why is the corrupt government allowed to make the final argument in the case
4:06 am
against me why can't the defense go last big advantage? very unfair i think the american justice system just tends to work that way for everybody it's not something that's being done specifically in trump's trial. but look, even though trump has been lashing out out on social media, and obviously is unhappy with where this case is headed. this is a consuming the campaign trail for him, for this week, there is nothing on his calendar other than a fundraiser on thursday. he has no planned events that we are aware of at this point. so the trial is the campaign for the foreseeable future. hey whereas we're learning is kind of the order of operation today with defense going first, prosecutors going second. >> it seems standard operating procedure in new york is what they're up against. it's good to see you see. thank you so much. so still had also for us. >> in addition to the big day of closing arguments in donald trump's case, today, today at americans, americans still detained in turks and caicos, one of them will learn his

charges or if he's going to go to trial. now, both of these appearances comment days after bryan hagerich was allowed not to return home. after a judge handed down a 52 weeks suspended sentence and a fine, the 40 year-old, he boarded a flight right back to pennsylvania on friday, just hours after a judge ruled that he found, quote exceptional circumstances in that case. now, heydrich told officials that he did not know that the hunting ammunition that he had in his luggage, he had no idea that it was in that bag when he visited the country earlier this week. here now is heydrich and his wife on the uncertainty that played out on friday remember, he was facing the possibility of spending 12 years in, prison he sent me a list of everything that he would have needed for prison and we write down the green suitcase and that was the they're not good suitcase.

>> doomsday. doomsday suitcase literally had two suitcases backed, one for home one black suitcase was home. the green suitcase was doomsday i think we lost. >> carlos suarez. >> all right. so hagerich's attorney is also representing watson at the american who will decide whether he's going to take that plea in the case now, over the weekend, his wife told cnn that they plan on essentially presenting the same argument here, right? which is that watson did not know that he had ammunition and his bag and that the judge should use discretion. john, a lot of the us officials that have been pretty critical of how officials and the turks and caicos islands have handled this situation were quick to applaud what happened on friday. and so the hope going into today is that this one american that will be sentenced today, we'll have a similar fate and that the the other

learning at this point, the us just waiting to see what more information israel has from its own investigation as that moves forward here in gathers more information on what happened. >> the challenge here is that the us doesn't have its own independent way of assessing the explanation that the israelis have provided in terms of what happened here, israel saying that they used a precision guided munition to strike a target, taking a two senior hamas militants and that ultimately ignited a fire that lead to at least 45 palestinian deaths and 200 more injured. the us simply doesn't have the ability or the granularity to know exactly if that explanation at this point holds water. so they're waiting to see what more information israel can provide at this point, the us has had to rely on israel for israel's assessments and not conducted its own investigations, largely because of the need to rely on israel for its ability to look at what happened and to investigate the question of course, does the biden

administration except that explanation and how does that affect the situation and the relationship moving forward here, president joe biden has said, in the previous month that a ground incursion into rafah would effectively cross a red line for the biden administration. the challenge here is that this isn't a ground incursion, but it has led to the exact sorts of civilian deaths and humanitarian catastrophe that the vitamin is duration has been urging the israelis to avoid all along and that is where the biden administration needs to figure out exactly where it stands here. again, israel said it used a precision guided munition to carry out the strike in rafah on sunday. and that the strike itself was not in the humanitarian zone. a zone that was supposed to be safe and where israel had told palestinians to go to to ensure that they weren't in harm's way. and that's clearly not what happened here, kate. so we'll have a chance to learn more and ask questions of us officials more throughout the day to see the reaction whether they find israel's explanation credible. much more much more

4:33 am
>> well, i'm glad to be with both deputies. it important day. it's a day really for the first time that the lawyers get to argue their position, they've been able to put on their evidence. they've been able to bring out documents. they've been able to make some objections. and so sort of gives some bluster in the courtroom, but to actually get to the tail these jurors out of your own mouth. what it is that this lattice is important. what matters, why this piece of testimony is irrelevant, why this is a lie, why this should not be used as a reason to convict the former president or why if you're the prosecutor, this ties it all together. so what do you talk about closing arguments? this is in fact the first time they're gonna get to argue this case. it's so there are risks to go into long if you're either side, you want to get get in there, get quick. this jury sat through. now weeks of testimony in trial. you don't want to lose them in a closing argument. sometimes you lawyers have a tendency to lose a good point because they drone on too long. >> but this is a day where they get to tie those loose ends together. >> and the defense will be saying the state didn't meet
4:34 am
its burden, didn't prove the defendant guilty. mr. trump get to be a reasonable doubt. here are those reasons to doubt the the prosecution will say, well, wait, now, don't be caught off by some red herring, fly it out there this doesn't mean anything that they won't need to get lost in chasing rabbits instead of actually looking at the meat of this case. and so those that'll be the competing narrative in some form that we hear today there are going to be a lot of animals brought into these closing arguments is what i'm gathering is what i'm learning just as randy michael getting at, is that the burden of proof is an important one to remind everyone. it's on the prosecution, right? they need to prove beyond reasonable doubt that he committed that donald trump broke the law and you think after listening to all this, you think they fell short, how they fell way short because let's start with reasonable doubt. what is reasonable doubt? and it's not simply a doubt based upon reason anytime a human being needs to make an important decision in life if you have
4:35 am
enough information. for example, doctor says you need open heart surgery. docx, go ahead and schedule. i don't have a reasonable doubt. conversely, if i say i appreciate it, but i need a second opinion, i need more information that is having a reasonable doubt. there is reasonable holdout all over this case where is keith schiller where is allen weisselberg? how did michael cohen get away with stealing $30,000? hold a pity party for him, made $4 million on this thought he'd be chief of staff. he's a fixer if the plumber comes to my house to fix my leak i could be home. that doesn't mean i know how he's doing it and what it's taking to be fixed stormy daniels, let's hold a pity party for her. >> why do we need to know whether or not the former president wore a condom or not. >> it's simply about did the former president know that? >> books his records for centuries for legal fees? >> michael cohen was his
4:36 am
lawyer, didn't intend to cover up the election. what to protect his family. it's africa everywhere. when randy gets to whisper tones, i start getting concerned. >> my goal, donald trump is upset that his defense team is giving closing arguments first, and the prosecution is going second. >> what he said in the social media post is why can't the defense go last big advantage, very unfair defense going first, prosecutors going second, if you will it's standard procedure in new york does that put his team at a disadvantage though even though there's nothing nefarious going on with it well it always is good to be the one that had the last word of the jury. i mean, you know that just an argument with friends and family, you booked everybody tries to get the last word so i can understand it. want to do that. >> but but the fact of the battery is at the prosecution bears the burden of proof. and so the law gives him the chance and circumstances hi, this to come in and be the one and have the chance at least to carry
4:37 am
that burden forward. i think randy was argued on the other side. they wouldn't have a good chance that it carried it because those are some great points that he brought out. here in the argument. but the complainant by tropp about how this saying lays out and what the procedure is. this is just sort of much ado about nothing. i mean, if every courtroom around the country, you know, the prosecution gets to conclude if there's been some evidence put on. certainly by the defense. i mean, that could be one factor that's considered, but they do bear the burden. so there's nothing that's being done to him. what his what he ought to be doing is slapping lawyers on the back, tell them they've done a good job to go there and fight for them. and let's make sure we point out a, b, and c because these are the holes in the state's case one thing that michael is also pointing out, randy is the timing of how long you spent. >> we are been told that prosecutors are expecting to spend several hours going through the evidence that even regardless of michael cohen's it's credibility, they'll say this is the evidence we have connecting donald trump to

together. my kids adored them. my kids adore their children, which they are alive. thank god. >> because tawam would've wanted her kids to be safe. >> linda would have wanted her grand kids to be safe children most arrived. sunday was the most active severe storm day of the year so far with at least 14 tornadoes reported right now, nearly 50 million people are at risk for more severe weather today, the storms could bring damaging winds up to 80 miles per hour. wind gusts, hail is large as golf balls continued threat of potential tornadoes seen as allison chinchar, she has much more on this. it is one thing after another. other. allison, what do you what do you watching most closely right now yeah. >> so totally different system than the weekend, but it's impacting a lot of the same areas that are dealing with cleanup from the storms this past weekend. here's a look at the focus. you can see right here, the southern plains. this is where we're really going to see most of the activity today
4:50 am
in terms of the strongest thunderstorms, we have an active severe thunderstorm watch as we speak just south of oklahoma city and that goes all the way through dallas. and you can see that strong line of thunderstorms really moving through the metroplex as we speak, a tremendous amount of lightning, very strong winds and very heavy rainfall. so all three components there, you've got several severe thunderstorm warnings. this one right here does include the city, especially the southern learn suburbs of dallas, as we speak again, power outages in this area have really started to tick up in just the last hour or so we're already over 120,000 people without power most of them and that northern region of texas, but that number is likely going to go up as that cluster of storms you just saw continues to slide down. you can see on the side of the screen there are just some video of the dallas general area, again, very dark skies. is that line moves through. now as we go through the rest of the aid at initial line will continue to slight east, but we're also going to start to see more development beginning. many of the same place as once we get to this afternoon. and then by the
4:51 am
evening that line really starts to take shape. so yes, another round potentially for dallas, much of northern texas. and then by the evening and overnight hours that's when we expect it to slide into areas around houston. so that means overnight tonight could be dealing with some more watches and warnings as we go through the evening hours and then by morning, we start to see the bulk of that, at least the strong stuff moving back out over shore. so here's a look at what we've got for today. the big concerns are going to be very large hail, yes. as you mentioned, it could be the size of golf balls, eggs, maybe even as much as baseballs in some areas damaging winds, but yes, also the potential for a tornado. so that does include dallas houston, austin, san antonio, up through amarillo, and also into oklahoma city. so you've got a pretty wide swath here of areas that we are keeping an eye out for for a lot of these storms just in the last few days, you look at starting before the weekend begin, we've had over 76 tornado reports, nearly 1,000 damaging wind reports, and over 300 hail reports and yes, as we could end up adding to those numbers by the end of the day today. >> there's one day after
4:52 am
another have been seeing this allison. thank you so much for bringing us up to speed on where things are now. >> john got to say this picture is behind you from dallas or menacing, we're going to keep an eye on what's going on there this morning. we'll bring you up to speed is that develops in the meantime, donald trump heads to court these are closing arguments set to begin very shortly in the course criminal case against him. what does this all mean for the presidential election? will this now cnn political commentator paul by gala and former trump administration official madam hours. paul, let me just start with you look. what does the verdict me how important is it for democrats? what happens in this trial? >> yeah. well, obviously the stakes for mr. trump are very high but democrats, there's a real risk for democrats darrell royal, the legendary coaches, my texas longhorns and 16th, they asked him why i didn't throw the ball more. he said, well, three things can happen in two of them are bad that's the case for democrats in this trial for mr. trump is acquitted. it's bad for the democrats if there's a hung jury, it's bad for the democrats. the other big risk,
4:53 am
which they have avoided, they've done a good job of this, is not obsessing on the trial. you don't see hakeem jeffries, the democratic leader of the house at the trial. you see speaker mike johnson. you don't see chuck schumer's his hometown? i have keys on down the democrats are not obsessing on this, which is good they need though, to make sure that they are messaging not about trump's alleged criminality and not about his character, but about people's lives. >> and they here's what the obvious thing i don't really care if trump was embed with a porn star. i care that he was embed with big oil executives and promised to close down all of our environmental protections for $1 billion in campaign contributions. because when donald trump gets embed with big oil, you're the one is going to get screwed that's the democrats should be saying, and they're pretty close to it do you think they'll be able to stay quiet about this if he is either a acquitted or be a hung jury pool so far they haven't? yes. and i like come on a lot at criticize my democrats all the time. they take their cues from joe biden, president biden has been really good that
4:54 am
staying focused on his mission and on the american people. the thing is trump's. maybe this is unfair. he seems somewhat self-absorbed to mate maybe i'm being unfair democrats should not also be so focused on mr. trump thing. it's a trap. they have to focus on the voters lives. if mr. trump is hauled and manacles, it will not help anybody fill their tank and their f1 50. but if trump is making corrupt deals allegedly with big oil, that could hurt you, mr. mizuhara get and that's where i think democrats need to keep the focus. >> all right. matt you've been waiting patiently and laughing from time to time. your take on this one wouldn't do what would a guilty verdict mean for donald trump here? >> i mean, that would have a bigger impact obviously on the logistics of running for president, having seek approval for travel and things like that, then it would on public opinion and public opinion polling shows embarrassed that out, that he's already been tried in the court of public opinion. most americans already have an opinion about whether they think he is guilty or not.
4:55 am
nearly every voter who's committed to a candidate says that the outcome of the trial has no impact over how they're actually going to vote. now look in presidential politics, obviously would rather be not guilty than guilty, right? like that is rule number one, rule number two is that if the vast majority of americans view that the trial is political, which most polling suggests that well, if you look back at ap poll about a month ago, it showed that only about 20% of american voters saw that donald trump would get a fair shake in a trial. that is just as much a part of this campaign can actually help him run for president compared to any sort of alternative. i think the key thing here and remember is that if it is even a hung jury this confirms a lot of suspicions of voted supporters or donald trump that this was political from the get-go, and that happens, i actually think you're going to see him gain and polling a little bit given that a number of americans going to think he got a raw deal. >> but convicted felon if that's the outcome, you do think that might have some negative. i look at certainly could have an impact. again, i
4:56 am
think more on the logistics, but most americans woke could hurt them a little bit with some of those soft republicans for and independents are coming around to them who still are now thinking very fondly of the days of the policies when he was president, it could actually highlight some of the negatives, obviously of the impact of him his personality. i still don't think it's going to change the dial right now. so as long as that the direction the country is going, the way it is, and that americans are responding to that way, which is largely driven by factors outside of the confines of the courtroom or even in the discussion, it's about what they're feeling every day within so paul, it's almost as if politico knows you're coming on into size to publish articles based on that, the headline in politico this morning, the playbook is quote dems in full blown freak out over biden you see it right there in 26 point font dams in full-blown freak out over biden and they have a quote here from pga and greco direct mail guy, famous democratic direct mail guy.
4:57 am
>> and he says there's still a path to win this, but they don't look like a campaign that's embarking on that path, right now, if the frame of this race is what was better than 3.5 years under biden or four years under trump, we lose that every day of the week and twice on sunday. so these are democrats spreading. paul yeah there's only two ways to run for office on a post and scared. >> and i think the biden people ought to be scared. i think he's done a great job, but this fixation on getting credit for his accomplishments. i think it goes about at the wrong way bill clinton didn't get credit for his economy until new game get shut down the government, barak obama didn't get credit for obamacare till the republicans tried to repeal it with the biden campaign that you do is go on the attack and the attack needs to be not, not match, right? not oh, trump's a crook. it should be trump is a threat we together biden should say, cut the price of insulin
4:58 am
from $300 a 35 bucks. trump is a threat to that hill repeal it. we expanded health care and cut your health premiums trump wants to repeal that. we produce more energy than ever without sacrificing our environmental laws. trump wants to sell out to a big oil. let them raise your prices and pollute our environment. in other words, go at trump as a threat to biden's accomplishments. that's how biden gets credit for his accomplishments. and i don't think they're quite there. i think there's simply saying give me a goldstar. i did such a good job really, i should carry 50 states. let's be honest, and the district i think that's a wrong way to do it. it should be all about trump as a threat to your middle-class life. >> not scared enough as you put it. all right. paul. matt, thank you both so much for this morning. great to see you. >> thanks two italian newspapers are accusing pope francis of using a homophobic slur during a closed-door meeting held last week. according to the papers, latest reporting, the pope said that gay men should not be allowed to train for priesthood cnn's christopher lamb has much more on this and there's a lot to learn here. christopher what more are you learning and what
4:59 am
is the vatican saying? >> well, kate, these reports have caused quite a stir at the vatican, have not yet responded to the claims that the pope used an anti gay slur in his meeting with italian bishops. a few days ago. now these meetings at the pope had were behind those doors. so the reports of the slur where leaked out. so we don't have any official confirmation of what was actually said. and as i said, the vatican is not commenting the context to this is that the pope was reportedly discussing with the italian bishops whether or not gay men could be admitted to train for the priesthood. the pope has consistently said, no, that cannot happen because of previous vatican rulings and his own feelings about the potential for a gay man to live double life within the seminary it should also be said that some are suggesting that the pope may not have been fully aware of the offense steve
5:00 am
nature of the slur that he used, of course, a italian is his second language but i'm clearly, if he did use intentionally homophobic words and homophobic slur, then that would undermine the popes great efforts to be more welcoming to gate catholics. he is, of course, the pope who said early on in his pontificate, who am i to judge when talking about gay priests, he's also offered the possibility of blessings of same-sex couples and called for the decriminalization of homosexuality so if the pope did intentionally use this slur, it would undermine that and threaten his attempts to really shift the church's position on this christopher lamb. >> thank you so much much more to learn here for sure. thank you. john oh, is next hour and say that new several says
