about the four corners of the indictment cnn chief legal affairs correspondent paula reid was at court today for the hearing. walk us through the takeaways paula oh, boris there are a few takeaways are first of all, as you can tell from that quote, judge chutkan has not lost a step since we last saw her in this case nearly a year ago. >> this was the first hearing since the supreme court she does opinion making it harder for prosecutors to bring some charges against former president trump, also making it perhaps more difficult to bring in certain pieces of key evidence. and today the goal was to decide all right, how are they going to proceed, how they're going to approach this case now, there were some contentious exchanges between the judge and the trump defense team judge chutkan outright rejecting a request from the trump legal team that she just dismissed the indictment against their client. she made it clear that is not going to happen. she also made it clear that she is not taking into consideration the upcoming presidential election and she has been consistent about this

throughout the entire case since he was indicted. she is repeated sibley told trump's lawyers that she does not take politics into consideration when she is handling this case. but the one area of agreement across all the parties was that the next step is to decide how the supreme court's immunity ruling applies in the case. so that will be up to the judge and she really has to get over that hurdle before the defense can try to litigate others she's they say they're going to try to challenge the legitimacy of the special counsel is something that judge signaled would likely not be successful in her court, but they will likely try. they're also going to raise questions about obstruction of justice related to january 6 in the wake of another supreme court case, they also have questions about discovery, so right now, we're watching and waiting before the judge to release her schedule to get a sense of how quickly this could all happen. but the judge made it clear today, it is far too early to set a trial date. there's a lot of work to be done and i'll reiterate if the former president is reelected, this case, along with the other federal case related to the classified documents at

mar-a-lago, will all be it's missed. >> paula reid. thank you so much for the update. let's discuss now with former federal judge john e. jones, the third and cnn senior political analyst, gloria borger, judge, first to you, how do you think judge chutkin handled today's hearing? it appeared that she gave both sides some of what they wanted i'll tell you what boar's i am a great fan of judge chutkan. >> i think she superb. she's everything you want in a federal trial, judge. and i can say that having served was 20 years in that capacity, and i don't like to cast dispersions, but if you contrast that with the way that unfortunately, judge cannon ran her courtroom in an hour and 15 minutes it's today. she made the party's hit the mark and had a chris good exchange on the path forward. so i think that i think she's doing great great work. >> and gloria, as we noted here, the judge says, the

election, that's not her concern about if she's concerned about the four corners of the indictment, that's not good news necessarily for trump because he wants to push this case past the election. she's also maybe though not trying to speed it up. if you take her at her word there, what do you think? well, the case, you know, we're not the case isn't going to go to trial until after the election. >> we know that. and of course, if donald trump is elected, it doesn't ever going to go to trial at all. but what we're talking about is seeing pretrial evidence and it could be some grand jury testimony, et cetera. and the trump folks are not happy about that. and i think you know, she's she's saying i don't i don't really care about this election that's not in my courtroom. and she kind of chastised trump's lawyers saying it strikes me what you're trying to do is affect the presentation of this case. so as not to impinge on an election. and she's not having any of it glory, i'm curious

as to how you think that democrats specifically vice president kamala harris, is handling trump's legal woes yesterday, we were watching her at this rally in new hampshire and we heard someone in the crowd yelling about donald trump, lock him up and she said let the courts handle that, essentially stepping away from it, we saw president biden do that repeatedly when he was the presumed nominee for the democrats. >> some of that may have had to do with his own son's legal issues and not wanting to appear as though he's tipping the scales of what the department of justice is doing but do you think it's smart for democrats at this point where the race is to essentially not make this a bigger issue, right? >> well, they made it an issue during the convention. they were talking about his felonies. but i think at a certain point, you can overdo it. and the people who they need to convince to vote for them, those few undecided voters left are very well aware of donald trump's legal issues and i believe that they feel

that they don't need to gild the lily anymore. they just need to let it let it be and let it hang out there. and we'll see what happens with this. and judge chutkan will see if there is if there are pretrial hearings, for example and i wonder, judge, if there are what we could see in those pretrial hearings on immunity ahead of the november election, what kind of evidence might come out that might really people paying a lot of attention well they're gonna, have to briana tie up some of the allegations that they have the unpledged allegations. >> if you we'll in the indictment and i think jack smith asking you to go forward first makes perfect sense to me and attaching to his brief certain excerpts from the grid grand jury testimony. now they may request to do that under seal so as not to prejudice the former president but i think you're going to see some of what the prosecution has at

least through that filing now, a judge chutkan at that point would have the opportunity to say, look, i need to see more in order to make these immunity calls. and she could on her own initiative asked for evidentiary hearings. i think it's one step at a time, but i kind of had a sense hey, that she was buying the prosecution's request to go first given what you sv trump, that is the immunity decision mandates that court do what she can't do. i don't think is decide this case on dry briefs without some context or some at least written evidence put in front of her judge, what we saw how that kind of argumentation from trump's team played out. as you mentioned, with judge cannon in south florida, we know that the trump legal team is going to try to make the same case it's again in this courtroom, essentially saying that the special counsel's appointment was unconstitutiona l or inappropriate. how do you

think that's going to land with judge chutkin? >> well, paula reid just mentioned it and chew is quite right, boris, that judge chutkan tipped her hand today. she said that she did not find judge cannon's opinion, particularly this way. so that means in judge speak, that's i don't think it holds water. all i think that was always sort of candy coated she also mentioned justice thomas's concurring opinion in u.s. versus thomas, where he brought this up and and she didn't think much of that either. and that's dictate anyway, it's not it's not binding, it's not precedent. so one thing we can say with durrance after the hearing today is they can preserve that for appeal if they want to, but i don't think judge chutkan is ever going to toss this thing based on the special counsel being unlawful. that's just not going to happen.

tomorrow. he's facing felony murder charges in the deaths of two teachers and two students that they already say he'll be charged as an adult let's go live now to cnn's nick valencia, who is outside of apalachee high school. nick, what more can you tell us about this investigation will zeroing in on that 2023 incident, brianna, that's ron drawing a lot of question marks here among the community as to whether or not if more could have been done to prevent what happened here yesterday. >> the fact that this 14-year-old, ben thursday teen at the time in 2023, was questioned by law enforcement officials because of a series of anonymous threats that indicated that he may have been posting threats online. he denied making those threats and police determined that there was no probable cause to take him into custody, but that event itself being drawn back under the microscope after the tragedy here yesterday, and i'm joined now by one of those survivors, somebody who was here in the school says, come on in here. you were here in the school yesterday and you decided to come here today to the vigil to pay your respects?

what are you feeling today? what is going on in your head after what you experienced? >> well, i'm feeling a little bit lost i woke up this morning with the feeling of i wish it was all a dream by after talking to one of my pastors, he came to my house. i feel better now. i feel like do you ask yourself if more could have been done? did you feel safe prior to what happened here yesterday, going to school at apalachee? >> well, you never would think it would be an apalachee, but i did feel you felt safe. it was just a normal school, before all it is and i think the police they did a great job, everyone that every job, the teachers, especially they did a great job and i just want to take this moment to say, we need the teachers or not to stick with us more than ever because they went through what we had to go yesterday they with us so you knew those teachers, you knew some of the victims talk to me about what they meant to you and what they mean to the school will they are part of our apache family.

>> i felt like we were just i think everybody is in shock. we never thought it would happen here. and for it to happen here is just crazy because you see it on the news, you see it on tv, so you don't movies, but you never would expect there would have been somewhere in a small town take me through that second period yesterday. it's 10:00. you go into your second period, class 10-15. the clock's ticking here what, what, at what moment did you realize something is wrong? this is something bad happening? >> well, they took me out of my class because i was finishing taking a test and when i heard some footsteps, you said in the hallway, you heard commotions? yes. >> when always like things started, the red light started showing and then they close the doors, they turn off the lights that made us hide behind the desk and they're not even a few minutes later, we can hear the police, which at that point we didn't know it was a police. we thought it was you'd never know who it was. there was just walking in, lambing. you could

hear sudden, you could hear screaming, you could hear doors being shut it's just a lot. you could you could hear everything that was going on, everything was so quiet yesterday at school that any single noise made one of your classmates cry, like bright. but my classmate right beside i mean, it was crying. i was trying to calm her down with i was shaking and it was just nothing that i would put anybody through talking to one of your classmates and she was talking to me about ms sarah me saying that she was the sweetest person talk to me about some of the teachers that you were telling me about when we were off camera and just tell me who they are will i knew mr. phoenix who is my david phoenix is right. one of the victims he was one of my teachers last year and geometry and he was just a really nice person. i wish i would have taught them how much i appreciated him the last time that i saw him before all this happened. >> we understand he may be recovering and joking around at this point when you're ducking

to school resource officers are being hailed for their immediate response that led to the gunman's surrender. >> the barrow county sheriff says one of them came face-to-face with the 14-year-old suspect. listen and the shooter quickly realized that if he did not give up that it would end with an ois or an officer involved shooting. >> he gave up, got on the ground and the deputy took him into custody joining us now is mo kennedy. he's the executive director of the national association of school resource officers, a former resource officer and a retired sro supervisor, mo thank you so much for being with us what was your reaction to news that? these two school resource officers on the scene, one of them confronting the shooter, who then surrendered, were instrumental in this process first of all i just have to say it's heartbreaking.

>> listen to that student described what he went through yesterday but i will say that there are no victories here. let me be clear about that. >> but the fact that those sorrows were there and did what they had been trained to do. >> it's very clear to me these were carefully selected specifically trained sros. there is no way for us to know how many lives are saved by those two officers responding and doing what they were trained to do thank god they were there. >> who knows how much worse this? could be today you i'm sure heard the news that law enforcement previously interviewed the shooter a year ago, he'd been flagged for online threats that he denied making schools in jackson county were alerted about him, but it's not clear that he was flagged to barrow county where the shooting actually took place, where his family had them go to school. >> would you like to see some kind of change a system to make

those kinds of warnings more expansive. >> you know i think that changes in progress as we talk and it was in progress before yesterday, it's been going on for awhile. part of that is behavioral throughout assessment. i just returned from washington, dc where i spent two days with a lot of the nations experts on the issue of behavioral threat assessment i think part of that is educating everyone that would possibly can creating more multidisciplinary school safety teams that include law enforcement. and then what that means is hopefully we have better communication flow, not just within a school, but between schools, in between school districts. that's critically important we also learned that teachers at apalachee have the special i.d. >> that can alert law enforcement to inactive situation, something that was actually put in place just a week ago would that make a

significant difference if that were installed at all schools? >> first of all, it's come to my attention that that is through some tjx, which is one of our wonderful sponsors of our national school safety conference. and i think that when we look at that technology and we pair it with other things that are going on in the school. it's a multi hazard relations are requires a multidisciplinary approach. and so this is a great u.s clearly of security technologies and having that panic button, i really actually liked the idea that the teachers being equipped with that, so that they have ready access to it sounds like it had a huge impact yesterday you mentioned this sort of holistic approach to these kinds of emergencies at schools and specifically with technology. i'm wondering this report that the school didn't have metal detectors. a

student telling my colleague, cnn's isa, little solace about it how effective would metal detectors be in preventing a situation like this? and what other technology could be used and implemented to save lives again i'm a big fan of security technologies we're talking about metal detectors. there are some fantastic weapons detection systems out there. but those are only as good as the human element. and what i mean by that is we have to make sure we're taking care of the rest of the basics around school safety perimeter security for instance, making sure our perimeter doors are secured and one aspect of this that many miss is relationships. we get a lot of intelligence from students, from parents, from other adults in the building. when we build good relationships ahead of that i'll see something, say something idea when you're in relationship with someone, there's a much better chance you're going to get that

information shared, which gives us a chance to stop the horrible act before it starts. >> and speaking of stopping the horrible act before it starts mo i have to ask what does it tell you about the united states that this keeps happening and it's kept happening and we're talking about mitigation at schools with metal detectors and these alert systems but it seems like we're mitigating the approach in a way that's responsive as opposed to preventative what does that tell you well, i think that there of course it's very concerning. >> there's no question about it that we're constantly having to i'm sick of responding to these. >> i was an sro in the columbine massacre happened. >> so it's it's sad it's extremely sad but you know, one of the things that we recognize is that are some prevention measures that are being put in

>> that's been a busy couple of days for the justice department. as you mentioned, prosecutors unsealing and indictment against dimitri signs, who you may remember all the way back from them. mole report, his name is mentioned several times in connection to his contact with members of trump's inner circle back in 2016, including people like jared kushner, who he was trying to push information about russia talking points about russia to back then. now he's once again in the news facing it's in criminal charges in connection to a different russian influence operation targeting the 2024 election, trying to sow that discord, that broader objective of the kremlin. now, prosecutors say that dmitry psalms wasn't direct contact with vladimir putin him itself and he was receiving $1 million to really cast his show on rt, which is the russian state-owned media arm of the kremlin, cast the narrative of a pro-russian anti-ukraine narrative with the objective of swaying public opinion in favor. and that is a theme of what we've heard from the justice department and other u.s. agencies over just the last two days, but also the last several months that

russia, vladimir putin, and the kremlin and overall are trying to wage this broad disinformation, brought influence campaign, both targeting the u.s. election in a pro trump sort of a way, but also trying to do so in a way that bolsters their own security they should lives and the primary one is trying to erode u.s. support for the war in ukraine. and that is something that we saw yesterday with the indictment of two russian nationals, a connection also with rt that russian state-owned media organization and the just department outlining a very sophisticated influence campaign that involved a tennessee-based you on u.s. soil, tennessee-based media company. that's it's linked to several right-wing social media stars with hundreds and millions of subscribers on both youtube and other social media platforms. these russian individuals were allegedly really trying to shape that coverage of that u.s. based media arm, trying to sow and the plant that narrative that pro-russian narrative in the minds of americans without them really knowing about it all right, zach, thank you so much for the latest on that. >> boris we're breaking news

into cnn on the hunter biden trial, his tax evasion trial. >> let's get straight to cnn's evan perez, who's outside of court for us, evan we understand that hunter biden's attorneys have now adjusted earlier. they were asking for this alford plea to strike a deal with prosecutors. now they've moved away from that. now they're saying that hunter biden is prepared to plead guilty to the nine tax offenses without striking a deal with prosecutors that's right boris look, we are getting a lot of twists and turns now in federal court, the court hearing is still ongoing, but at this 0.1, hunter biden the attorneys are offering is on his behalf is for him to plead guilty to all the counts he is facing. >> three felony counts for tax evasion six misdemeanor counts for failing to file and pay his taxes on time and under this scenario that they have now floated, he would accept to

plead guilty but it is not part of a deal with prosecutors. we expect that as part of this hearing, as it continues, that prosecutors are still still going to object to some parts of this, but this is the latest gambit that hunter biden is trying to pull to essentially try to avoid it. a lot trial, we expect that this trial would go about five weeks is very expensive thing. a hunter biden, of course, is already on trial in delaware earlier this year and he was found guilty on those gun charges. so what prosecutors what hunter biden's attorneys did first this morning was to offer that alford plea where he would proclaim his innocence, but accept whatever punishment would come for these charges, acknowledging essentially that the government has enough evidence to prove his guilt in this courthouse. so at this point, now, they've changed tactic and this new attempt is again, avoid a trial but in

this way, he would plead guilty, accept guilty plea on all of these counts. but it would be not part of a deal with prosecutors it's another twist in this very kind of bizarre day, frankly, that we, that we've had here. i should note there are still 120 jurors sitting there. there in the cafeteria having lunch just a few minutes ago, some of them waiting to hear whether they're not we're going to have more deal or they were going to have jury selection on this case, which was supposed to start earlier today. so right now, we don't know what the judge is going to do, whether he's going to accept this latest attempt earlier, the alford plea, the judge said he was not ready to accept that, and he would spend some time thinking about it. so it appears what hunter is trying to do is leave this building with some kind of deal, whether prosecutors accept that are not, we will find out. >> and evan, we know that on that alford plea prosecutors on david weiss's team, so that they would not under any

last year before the plea deal fell apart at that courthouse in wilmington last year. so it is clear that they're trying to make sure that they walk out of this court house trying to resolve this case without going to trial. >> and evan quickly, part of the reason that original plea deal fell apart last year is because there was an open question as to whether or not hunter biden could face more charges. do we know where the investigation into him stands? is that phil a possibility? could that come up again as he tries to strike a plea deal now yeah. >> that is a great question. i think prosecutors harris have tried to leave that open according to the sources we've talked to that case is not going anywhere. it's not likely that he will end up facing those charges on foreign lobbying charges, but it is something that prosecutors have held over his head, so to speak, to try to force him to admit to these charges. it is still an open question.

>> but now he actually had some proposals, so some toplines from here, i think we have it up on a screen and i can go into a little bit of detail. one was, as you said, tackling government regulations at one point, he said that he would get rid of ten regulations for every new regulation. he also said that elon musk had already agreed to lead a government efficiency commission, something that there's already been an enormous amount of pushback on. this would be a commission that looked at fraud and waste within government spending he said that they would draw unspent funds from the biden administration and he doubled down on this idea of sweeping tariffs on imports. he said, and this is something we've heard from economists that it wouldn't hurt inflation. it would actually help with the inflation economists to have disagreed with that. he also embraced cryptocurrency, something we've seen him do a lot of lately at one point, he said he wanted to make america the world capital for crypto and for bitcoin. he also doubled down on his tax cuts saying he wanted to make them permanent. of course, one of the things people are going to really hone in on is

something that you said which was those dirt cheap, gas prices, people are still paying quite a bit at the pump and that's something that really matters to him economists are weighing in on this plan, there is a lot of pushback, but also a lot of people saying that some of this is doable a little bit of both here, obviously as we look at these two plans, kristen holmes. thank you so much. let's get some analysis now with cnn economics and political commentator catherine rampell. catherine, thank you so much for being with does onset i should note lucky me. >> yeah. >> what what are your takeaways from trump's speech to the extent that he said things that were coherence and some of it was just sort of words randomly chosen out of a dictionary. i think to the extent that he said anything that was coherent, it was kind of what we would expect. it was a promise of more income tax cuts, higher tariffs, which by the way, tariff so taxes. and if you look at the distribution of what he has proposed, most people would see more increase

in taxes through tariffs and they would see he tax cuts through income tax cuts. so some of that yeah, it does. it more than gets wiped out so you heard tariffs, taxes, you heard this government efficiency commission, which i think at best will probably do nothing. we've had lots of blue ribbon panels before at worst might help donald trump identify more enemies whom he can weaponize state power against and then kind of more of the same direction collation which he tried to do in the first term. >> i'm curious about the distinctions between what he's laying out as an economic vision and that vice president kamala harris, you had goldman sachs come out today and in large part because of his as promised to jakob tariffs, essentially say that her plan would be better for stimulating the economy, getting the economy going, helping folks that need help then his, how do you see it? >> so to be clear, there are a lot of unknowns about both of their economic plans and what

would actually make it into law depending on who's in congress, who controls both chambers of congress? why i would say that there are some things in donald trump's plan that are obviously bad for the economy, obviously bad for inflation and gdp growth both one of them is tariffs. that's only one that would raise costs for consumers or raise taxes depending on how you look at it another thing would be deporting a large share of the workforce that would likely also lead to higher prices, particularly for the industries that are most dependent on a foreign-born workforce like agriculture and food services politicizing the fed also likely to lead to higher inflation and other things things that his advisers have talked about, like devaluing the dollar. all of those would be unequivocally bad the things like deregulation, it depends on what that actually means. and if you look at his record during his first term, he did some deregulation and actually increased regulation on certain things, including legal immigrants so i don't know that

might be a wash. kamala harris is plan again, a lot of question marks there and some of the things i've been very critical of the price gouging stuff. i you know, in fairness, it probably won't become law, so maybe don't worry about it so much. her other tax-related proposals. i think they're probably unlikely to have a major effect on the economy in the sense that her increase in the capital gains rate. i know that people who would be paying that capital gains rate are unhappy about it, but it's probably not going to have a major consequences for the economy. many of her probe proposals would help individual families even if there isn't a big macro effect like the baby bonus or her proposal to have a $6,000 tax credit for the parents of newborns? i don't think that's going to have a huge effect nationwide on the economy. but for some particular families would be very helpful i'm catherine rampell, great to have you here with us life. thanks so much. still plenty more news to come on. news central, stay tuned
