out today. >> this is cnn new central cnn breaking news all right and we are standing by for the first court appearance from the suspected georgia school shooter. >> we did learn moments ago that this will no longer be virtual. the 14-year-old will appear in person. we also just learned his father, who is also charged perished in this case, will appear in court in-person after his son let's get right to cnn's rafael romo outside the court. a lot of new information coming in. raphael what do we expect that's right, john, a lot of new information here and we're now less than 30 minutes away from the first hearing for the suspect, it will happen here at the barrow county courthouse at a 30 am local time, man and a new development. >> we have now confirmed that 14-year-old colt gray will make his first appearance in person and not virtually as previously

announced. then we have also just confirmed that the father 54-year-old, colin gray, will be arraigned at 9:30 a.m. eastern local time. meaning only an hour later here at the same courthouse in the same courtroom? colt gray has been charged with four counts of felony murder. he has been held at gainesville regional youth detention center and a significant significant development overnight, the georgia bureau of investigation is confirmed that colin gray, the father of the apalachee high school shooter, has been arrested and charged in connection with the crime the 54-year-old is now facing eight counts of cruelty to children in the second degree, two counts of involuntary manslaughter in the second-degree. >> in another four counts of involuntary manslaughter why did authorities decide to charge the suspect's father? >> this is what georgia bureau of investigation director chris hosey, have to say about it these charges stem from mr. gray knowingly allowing his

son, colt to possess a weapon that he is in custody at this time? >> the arrest was made when we had the probable cause to make the arrest and overnight, we have also learned that both father and son had been on law enforcement's radar for at least two years in july of 2022, john, the family was evicted from their home and as part of that eviction, sheriff's deputy he's called, like the three guns including an ar-15 rifle for safekeeping weapons that were later returned to the family in may of last year, deputies interviewed both holt and colin gray after the fbi flagged online threats at an unidentified location, but the sun denied any involvement. >> and last december, colin gray purchased the gun that was allegedly used in the mass shooting, u.s. a. holiday present for christmas, for his son, john sara, back to you? >> yeah, it's going to be a busy morning there, rafael, please keep us posted as you see things develop and

remarkable development there with us now is cnn senior law enforcement analyst and former fbi deputy director andrew mccabe, also with us cnn security cord correspondent josh campbell. josh, i'm going to start with you first because you have some new reporting. there were these writings by the suspect. what what did you find out about what was in those well, law enforcement sources tell us that after the shooting, authorities executed a search warrant at the home of the shooter and in his bedroom, they found various writings. >> they believe that he had authored that made reference to pass shootings, including the 2018 massacre in parkland. and we're talking to experts. this is so common when you look at past shooters, when any and i were fbi agents, we had a colleague named katherine schweit, who helped pioneer the fbi's active shooter response program. she was on yesterday with our colleague, brianna keilar, and she made the point that look, teenagers don't start out as five-year-olds who just want to become shooters. but what we see so often, particularly aggrieved children, perhaps so those who are experiencing some type of

mental health struggle, they look at past shooters, they conduct research as catherine had mentioned they emulate the clothing that they wear at the type of ammunition, the type of weapon that they use. there techniques. and so sad that we've seen this before. so it's not that surprising in this case that we see those past references to pass a shootings. cnn also reported yesterday that the shooter had a social media account that had made reference to the sandy hook shooter. so sadly, this is so common, of course, looking ahead, the question, well, what can parents do about it? there's this question about how much privacy should a child have, particularly in their own bedroom? so many times we see in these shootings, that agreement children have the warning signs they're only a concern parent would actually look those are really good points the parents do have some role in at least trying to see what their children are up to andrew. >> we do know that the fbi did contact his family just last year because of a tip about some of the child's writings concerning school shootings and the parents at the time they

were they were told that he didn't really have access two guns, so nothing came of it. and now here we are. can we extrapolate that the reason that the father is now charged and charged with something that no other parent in the country has been charged with. and one of these mass shootings, which is second degree murder, as well as involuntary manslaughter can we extrapolate that the reason these charges came? is because eventually he did allow his son to have a gun and knew because of the past visit from law enforcement that he was having these ideations sure sara. so there's a there's a few things that we know. absolutely. we know because of the statements made by the georgia bureau of investigations folks that he's been arrested because of his knowingly giving or enabling his son to have this weapon. so we know that it's based on that. it's a little bit harder to line out exactly what the charges are addressing factually, because we haven't

seen the indictment or the affidavit supporting the indictment yet. but i can tell you that the crime of it's a little odd because we know there's only two counts of second-degree murder, and we know we have for victims under georgia law defining second-degree murder is defined as when in the commission of cruelty to children in the second degree, a person causes the death of another human being irrespective of malice, cruelty to children in the second degree. sorry for the long lesson here is a crime that is committed when someone with criminal negligence causes a child under the age of 80 18, cruel or excessive physical or mental pain. those two second-degree murder charges are likely risk relative to the two student victims of the shooting. the two students who we know have are now deceased.

but again, we'll have a better understanding of exactly how all this it's works when we do finally get to see a copy of the affidavit are indictment i want to go back to you now, josh, in this particular case and we talked about the father so being charged with just talk about how unusual this is that you have a father and son. >> they're going to be in the same courtroom one after the other, one, an hour after the other, appearing before a judge. both of them charged in a mass shooting well, you know, this makes me wonder whether this perhaps as a new trend that we're going to see with prosecutors around the country. >> we know, for example, in the case of the oxford high school shooting in michigan, both of the shooter's parents were prosecuted in that case that pertain to access to the weapon all three of us sadly covered that 2022 mass shooting near chicago at a july 4 parade, where the shooter was eventually taken into custody, but they learned that police had visited the home of the

reporting this morning, two u.s. officials tell cnn the u.s. has detected increased russian military activity near undersea cables this raises concerns that they could be trying to sabotage infrastructure that is critical for global communications well this now cnn anchor and chief national security analyst jim sciutto. jim, this is your reporting. what have you learned here? >> this is something the u.s. john is watching with enormous concern and it's really two things that the u.s. has detected increased russian activity around these key cable choke points around the world, particularly in europe, but also that they believe that russia may now be more likely to carry out acts of sabotage but taj against these undersea cables, a u.s. official told me the following week, are concerned about heightened russian military activity worldwide. and russia's decision calculus for damaging u.s. and allied undersea critical infrastructure may be changing. that's the key

phrase, decision calculus. they believe that russia may be more likely to carry out operations now to damage these cables, they have an entire unit set up to do so, it is known as the general staff main directorate for deep research. it goes by the initials gui gui gi. this has been around for a long time, but what's notable here, john, is that they then adding additional resources to this group which operates as you see there surface ships, submarines, and naval drones. additional resources to this unit, even in the midst of the ukraine war, even as its devoting so much to the ongoing invasion of ukraine, it has maintained this unit highly secretive, one highly protected of one. as as a priority for the kremlin an attack or sabotage or something like these undersea cables, what will the impact of that be? i think folks aren't aware of just how much of our lives depend on these cables that the

vast majority of internet traffic around the world travels on cables laid on the bottom of the ocean, fiber optic cables. and that's not just for you and me sort of googling stuff, right? it's for communications, civilian communications, government and occasions, military communications, but also all the things and industries to depend on that kind of traffic. internet and communications traffic, including financial markets entire industry is the energy industry also in northern europe, you have undersea cables that carry energy between countries including among american allies. so and attack that would disable or damage those cables would have enormous effect beyond just things you and i tend to use on the internet, right? there is so much in the world today that depends on that and that is why the u.s. is making quite clear review any attack like this as a major you're escalation and they're watching very closely. i'll tell you, john, i was on a nato patrol in the baltic sea

them by the judge at that point, they can enter a plea. right now. it's unclear whether or not there's representation will see whether or not they had assigned counsel defense attorneys, who will be present. the next step would beach to talk about potential bail or release and then and that fourth schedule for the next appearances that will take place of going down the line. it's a very procedural hearing, but there are going to be some aspects to look for here, specifically relating to representation for each individual person and whether or not what plea they're going to enter. that will show how this is going to play out moving forward this is a really unusual case in some ways because usually the parents of the suspect that is this young 14-years-old. >> he's now being charged into adult are in the courtroom or they have at least some parental guidance. we now know his father has been arrested on

charges two second-degree murder and involuntary manslaughter just how does this work? i mean, he has no representation, obviously, his parent is now jailed so how will this work with the courts? >> so right now, sara, that was actually something that was pretty shocking that happens. so we've seen parents arrested for the acts of their children before we covered this all together with the crumbley case, but this case is a bit different. and also that arrest was so fast for the father to be arrested so quickly. usually you would see a more protracted investigation especially with these novel theories of law and so today you're seeing both being arraigned at the same time. so at this point there's going to be different issues with respect to each individual defendant first, we had a minor. now he's automatically being charged with an as an adult in this case because of

the severity of the actions and the allegations in this case but will they challenge that with respect to the father? is he going to request veil? >> we don't know exactly what's going to happen and as this plays out, but i will say it will be interesting to see the probable cause affidavit against the father because that arrest and the charges, four counts of involuntary manslaughter, a legal theory we've seen before ignoring a risk that was apparent pacifically in this case that there was a violent propensity of his son and then having a gun accessible, we know that he purchased the gun that was used in the shooting in december of 2023 and gifted it to his son. >> that's going to be the legal theory that there's another charge here second degree murder, that is a completely different legal theory than we've seen well, we, for so what, if anything, his defense attorney is going to raise at this arraignment. we'll see as

concluded, and you may escort this defendant out. >> wow just watching this 14-year-old coming into court listening to those charges, which he was told could be punished so old by death. the judge is still speaking a little bit about, let's listen to what the judges say. >> conduct that unless everyone's ready to proceed with that i think i think that i i told the media outlet that i would recess briefly to allow them to kind of reconfigure what they're doing. and so we'll be in recess for a short time until i'm informed that that everyone's ready. >> all right. so what you're hearing there is judge mingled dorf saying they're going to recess because the father is now going to come in all of the council said they're ready the so that's going to happen very shortly here. >> but that picture of the

14-year-old, it took your breath away to see how young he was, how small he was. and yet you have all these people in the audience it's 18 family members of the four killed, devastated because he's accused of taking their lives and they were lined up behind him watching this hearing as it took place in terms of what actually transpired, there was not a plea entered here. >> we did learn that he was represented by counsel, that counsel may change over the course of the day, but he had a lawyer, right there beside him and there was no request for bond at this moment. and then the defendant there and i'm not going to speak his name. the defendant there was told that the sentence for the crimes for which he's charges, the maximum sentence could be death, something for 14-year-old to hear. let's get to misty marris, who was also watching that's along with u.s. just your takeaway from what you heard from the judge. this is obviously a routine thing, but there is nothing routine about seeing a child in this position and knowing that

he's accused of taking other children and teachers lives at this young age and charged as an adult absolutely. >> and when you see this 14-year-old sitting there behind the defense table is truly stunning. >> but what we saw unfold in the courtroom we saw what is a procedural hearing. >> but as you stated, sara nothing mundane about this one so what did we learn? we learned that he had defense counsel, however, it sounds like for some reason maybe there's a conflict of interests, something of the like defense counsel is going to be replaced by the end of the day. the judge asked if there was going to be an application for bond that would be some form of released requesting released from the defendants. but defense attorneys said no, that means that he will be remaining in a juvenile detention center even though he's charged as an adult in georgia from the ages of 13 to 17, anytime served takes place in a juvenile

detention center because of his young age. so he's going to remain there. the next thing we heard was that he has the right to happy indicted by a grand jury or to have a preliminary hearing. we know this is a basic tenet of the criminal law that you have to be formally indicted in some ways, standard being probable cause, sometimes defendants waves that in a case like this week could see the defense actually wade it bears and say, let's just move on to trial and assess whether or not there's going to be a plea deal, not guilty or guilty that's the next step. >> a preliminary hearing is liking many trial. that's why we heard the judge set forth all of the rights that the defendant has. if this were to go to and every hearing, that there would be the opportunity to cross-examine witnesses and the opportunity for the defense to testify then we heard the judge asked a few questions at the beginning. one of the

reasons we're dealing with a minor here, sara john, this is what we were speaking about before we have someone 14-years-old, although he's represented he's technically under the law, not competent to make his own decisions. and i'm not talking about competent and the layman's term just the children are not able to enter into contracts. they can't make legal decisions for themselves in a situation like this. >> since his father is also facing charges, we don't know about the status of his mother, whether or not she's going to be involved in his trial. >> sometimes there's what's called a guardian ad litem who is appointed to oversee the case and help a minor make these determinations? >> we also did not hear and i would expect this to come at some point. >> a request for an independent mental health evaluation in cases where you have just the most horrific facts like this, a mass shooting a defense attorney is going to say this person should have a mental health evaluation, determine whether or not there's

new jobs numbers just in these could be the most important numbers of the year with us julia chatterley. >> what do they show and what do they mean? >> i've got good news and bad news. the good news is that it shows a slowing jobs market, not a collapsing jobs market. the bad news is it's not going to help address the question of what the fed does later this month. but you can push me if you want to. see what we got is the jobs added for last month, 142,000 jobs that's less than expected. we were hoping for around 160,000 the better news is that the unemployment rate actually fell. so a lot of people that were on temporary layoffs last month in that july number that was weaker actually came back into the workforce. so that's a good sign the danger in the slight warning sign in these numbers, the revisions to what we saw in july, july actually was the big fear factor, the recession warning that people were talking about. those numbers were revised lower. so would june's numbers. so there's a

little warning sign in the revisions again next month, this is a very important point until next month's data, we'll watch that to see whether we see revisions again. but if you look at the past three months once actually overall this does show a little bit of a pickup in the amount of jobs that were added, net over the month. but the revisions lower to june and july are warning where we were adding construction health care, where we lost a little bit in manufacturing. there will be some alerts. as i said, this doesn't address i think the question of what the fed does but the underlying data in this is still pretty good wages picked up a little bit. there's reasons to be optimistic, even in a slowing jobs market were just picked up a little more than expected. the revised down for june and july, maybe not the bratsummer the economy brat summer i'm looking for but pretty good. so let's talk about what this means for interest rates because the fed meets it's like a week from now. they make an announcement. the issue is and i'll try to explain it simply. you will actually say what it

means, whether or not they cut rates by a quarter point or a half-point, a half-point would be a lot. a quarter point would be about what's expected, but maybe not as much as some people want. >> i think it was perfectly explained. borrowers out there, they'd love that half a percentage point cut. this data, doesn't tell you what they're going to do. i hate to say to say it i'll go out in a limb and say, i think they do a quarter of a percentage point, i think based on this data, based on what we get in inflation data next week, i think if they came out in september and it's september the 18th is the date and said, look, we're going to cut half a percentage point it could create a bit of a fear factor. what did they know and see that we aren't seeing still in the data? >> it may be the news today was good enough, so they don't take more extreme measures of for some people, the good news made end up being bad news, but it's all sort of measured exactly alright, julia chatterley. thank you very much for that. we will try to see what the ripple effects will be on the market over the course of the morning. thank you.

in adult and all of the parents sitting behind who lost their family members and family members of the teachers watching all this happen, both j.d. vance and vice president kamala harris both had something to say about this. kamala harris says, i should never happen in our country. we have to do something about gun violence. and here's what j.d. vance had to say about it. >> clearly, strict gun laws is not the thing that is gonna solve this problem what is going to solve this problem? and i really do believe this is look, i don't like this. i don't like to admit this. i don't like that this is a fact of life but if you're, if you are a psycho and you want to make headlines, you realize that our schools are soft targets and we have got to bolster security at our schools what do you make of those comments? one of the things that struck some people is the fact of life thing and while it is true that that is something that we've had to deal with in this country over and over and over again do you think that was a good answer, miller, politically, you're looking at about 10 million unregistered

gun owners in this country. sarah, you look at some of the battleground states, pennsylvania, those around 500,000 of them unregistered, around 175,000 it's an unregistered in georgia. and so i think from the campaign's perspective, they're looking at this. do we potentially turn off those voters that we will absolutely need? and what will be a march? generally close race and i think in these types of tragedies, you certainly want to recognize the horror that occurred. you want to recognize the lives that were lost. but we are in a campaign season and i think j.d. vance recognizes that and he's recognizing the dynamics that you cannot risk turning off voters at you absolutely need. and donald trump already has scared this isn't from those voters because of the bump stock ban that he signed. that's a big issue. >> jim messina, what did you hear there? and though kamala harris has not given a he a robust plan on what she would do to stop this gun violence, especially gun violence in schools. she said it should never happen again. what do you think of how the two? candidates there handle this

look, this race is going to come down to these swing women voters in the suburbs that you're michael and i focus so much on and j.d. >> vance telling them that he wants to turn their schools into prisons to keep their kids safe, isn't going to work with these voters. they are sick of words ukraine about their kids and it continues in the fact that this is incident that happened in the swing state of georgia just magnifies the politics here. and i think you'll see the harris campaign be very strong and i think this will be a big issue in the debate next it's weak because these swing women voters that we're following are going to look at jd vance's answer and say, hey, that's not the route we want to go down i wouldn't do talk about money because it does play a role of course, in politics. >> it doesn't mean you win just because you have the bigger war but it does. he kamala harris has this huge haul, including 1.3 million from brand new donors should donald trump be worried about? >> so sarah, when you teed this up, you're talking about he

has almost tripled the amount that trump currently as well in 2016, that was the same dynamic for hillary clinton. we underestimated trump's performance with voters run to estimated his ability because he didn't have enough money. i'm not convinced and so at this point that that's going to matter in an interesting way, donald trump has been able to target and penetrate voters despite the cash deficit when compared to the other side. does it help kamala harris buy more ads, get to more places it certainly does. but in a unique way, donald trump has seemed to be able to penetrate that despite the cash default, jim are we in unchartered times? because as shermichael points out, the balances here haven't always helped the candidate that was running against donald trump well, we are i mean, sara one hand. i'm sad because i used to hold the record for most race and the presidential race and that the harris campaign is going to blow that petition is rahel and i think in general i agree with michael that money is less important in presidential elections. that

said, you need ads and you need the field operations in these voters that we're talking about. you need robust field operations and that's where the harris campaign has a math asif advantage over trump. she has like seven to one in the battleground states of offices open a paid staff on the ground. and that's the question. also, i want to point out that it's not 2016. trump has a huge negative. they didn't have their he's running for the third time he's kinda kept at these numbers and he's got to find some way to change this race. and having kamala harris and her money sitting on top of in these battleground states is not going to be helpful in the final 60 days sir, if i could just really quickly, i get jim's point and he's right. the money does help in terms of opening up field operation offices, you need them to be able to target voters in those states with, the trump campaign is doing this time around from my understanding, is depending on other outside groups that support the campaign to do that work on the ground, i would also push back a little bit and say this race is still close
