exchange for that, that being an official act the mayor has to really critical problems here one is the sheer number of gratuities that he's accused of taking, which doesn't look good at all. >> the second is that these are not legal campaign contributions that are alleged. these are illegal contributions. many times you have legal contributions that factor into it. so his defense, i suspect is going to be i would have taken the official actions anyway, but that's tough. in light of the factual allegations in the indictment. he's entitled to his due process, but it's a tough case well, but look at the flip side for a moment, judge. >> how difficult will it be though for prosecutors to win on these bribery charges? i mean, these are not easy charges to win in court, right? >> well, they're not and the ingredient has to be danny, that the jury finds that, but

for the gratuity or the campaign contribution the mayor would not have committed or accomplished the act or the axis in question. the problem, as i said i think the mayor has is the fact that these are not illegal campaign contributions frequently in these cases, they are that makes some really tough to prove and in addition to that, you know, if he took a flight on turkish airlines once or twice that's fine. but query this many trips, hotel rooms, et cetera is there something afoot but it's not a slam dunk case and i don't mean to say that it is, but the factual allegations if proven, are going to make a defense tough for him well, on that note, judge, i'm curious about that because the u.s. attorney, and they're office basically laid out nearly a decade of these inappropriate gifts, these travel as they say, quit cuoco's are building up to that, at least. what is your

reaction to these? instances reaching back so far, does that bolster the prosecution's case or somehow help adams argument that this may have been persecution >> you know, it could cut two ways, dana, you know, i personally having read the indictment, which is a kind of a speaking indictment as they're called, which is full of a narrative of what happened. i don't think it helps him that this goes back. apparently it is prior positions he had a number of turkish american constituents and ties to turkey i guess you could say it cuts the other way in his favor because he had relationship relationships with these folks. but truly you're right. the allegations go back way before he he ran for mayor, but again, some of the contentions in the indictment say that as he was ramping up for his run for mayor, he called upon these people and

apalachicola. derek, what are things looking like there? >> yeah. i think it's important to note that this now is a major hurricane. this will be the fifth major hurricane to shift florida. florida in the past since 2017. so this is a significant developments. the hurricane hunters here finding winds near the surface strong enough to make that call to a category three storm. now, we're in franklin county here in apalachicola. we're facing a multitude of threats, storm surge warning. we have a hurricane warning in effect, but we also have a flash flood warning and also a tornado watch very near us. we've had over seven inches of rain in the past 36 hours. and this isn't even directly associated with hurricane helene. its tropical moisture surging north but the heaviest rain is still yet to come. i think once we look back at history books with this storm we're going to see that the catastrophic flood

potential with it is going to be a big player. you can see on this map here the highlighted area and pink is known as a high risk from the weather prediction center. and it is so rare that they actually issued these is about 4% of the time, but 40 40% of the fatalities and 80% of the damage occurs within these very rare high risk events that stretches from where i'm located, the florida panhandle right through atlanta metro and into the southern appalachians, asheville, they're facing a one in 1,000 year flood event potential. now here in apalachicola locally, we've just been having to steady rain since last night this is not residents first hurricane obviously, they've done all typical preparations, boarding up the businesses, their homes, or windows, putting down the sandbags as well. they know what these storms could potentially bring and they're focusing so much on that exact track because they know that this is a game of miles, a shift west, a shift east determines who gets the worst impacts. but one thing's

for sure. this is going to be that significant surge into this very low line, big bend area of florida. it is such a low sea level region. we're only six feet above sea level here as the storm continues to not only grow in intensity, but balloon in size brianna, this story form has the potential to have one of the largest tropical storm wind field in modern record keeping across the gulf of mexico. and that means that impacts will be felt well away from the center. and it's fast forward speed is also crucial to this weather forecast because as it moves inland, it doesn't have the time to discipline paint and weaken, so it's going to bring tropical storm force and hurricane force winds well inland to central portions of georgia as well as into south carolina. i mean, as a meteorologist, i've never seen the entire state of florida, georgia, and south carolina under a tropical alerts, like what we have right now of the system is going to not only bring these destructive winds inland, but also again, that
