that pause. >> john berman this morning, it is the final count down in this election season and we now have the final new york times sienna college national poll before the election, kamala harris and donald trump deadlocked literally. can't i get tired of the map friends, the new numbers only further reinforcing how important the seven battleground states will be to the future direction of the country and so today, both harris and trump we're headed to texas. >> not about a ground state. >> trump will be focusing trump will be in austin, texas focusing on immigration and border security and sitting down with podcaster joe rogan harris will be in houston where she's going to focus on reproductive rights with beyonce at her side. it comes after a bunch of stars turned out last night for a rally with former president barak obama for kamala harris, cnn's eva mckend, starting us off this hour. eva, what is what are you hearing from the harris campaign on the strategy heading to texas today? >> well, kate, texas a
6:03 am
battleground. it is not, but they're traveling there because they described it as the epicenter of abortion bans. the event will feature a texas couple, let a lawsuit against the state's abortion bans after suffering life-threatenin g pregnancy complications. she net williams, she is the mother of amber nikola thurman, who died in 2022 from a treatable infection due to delays in receiving reproductive care from georgia's restrictive abortion law. she will also be in attendance and that's what we have been seeing from the harris campaign they are elevating women to tell their own stories to illustrate some of the tragedies abortion restrictions have led to this all comes as vice president harris is aiming to show contrast with former president donald trump. take a listen it's
6:04 am
that in the closing week, the enemies list. >> versus her to do list. now, as for today, in texas, the vice president going to be joined by beyonce for the first time on the campaign trail of texas, native, of course, as well as country music star willie nelson, kate eva mckend, great to see you. thank you. sara. >> all right. donald trump will be in texas to today and he is using the fear factor in his final pitch to voters. he will be in austin where he is expected to once again railed against illegal immigration. he will also make his first appearance on joe rogan's incredibly popular podcast, looking for an audience there, cnn's kristen holmes is joining us now tell us more about what the trump campaign hopes to accomplish with the sit down with rogen, which is, which is a huge, huge audience. >> yes, this is really a big
6:05 am
deal for the trump campaign. they've been trying to get this joe rogan sit down for a number of months and for them it's really the crowning jewel on what has been an overall strategy this election cycle, one of the things that they've really tried to do is reach these low propensity voters, particularly men and pr, low-propensity means people who don't generally vote so they believe that those voters lean, right? and if they can get them to the polls in november, they will vote for donald trump. so they've done. a series of these podcasts done a series of youtube, youtube streaming channels of various non legacy media to try and reach this group of people across the country. now joe rogan is an exception in the sense that he has more than 14 million followers on spotify. he is considered one of the most popular podcasts on that. that exists right now in the the u.s. and part of the way that they want donald trump to reach these people in the middle of the country is by not talking about politics. these, these non-voters girls are not general voters, are people who
6:06 am
don't generally engage with politics in the typical sense, but they do engage with potentially joe rogan or some of these other youtube streamers are some of these other podcasts. and that's why you've seen such an emphasis on donald trump trying to drive out these voters, trying to do this non-traditional media, particularly clearly now as we get closer and it will tell you one thing, one of the excitement factors around the rfk jr. endorsement, other than the fact that it would come with it potentially, all of these independent voters, or at least some of these independent voters which could decide the election given we believe the margin is going to, elections is going to be determined in the margins was the fact that rfk jr. had a relationship with joe rogan and they were hoping this would help with the sit-down interview that's an interesting little tidbit there. >> kristen holmes. appreciate you this morning. john, right here now cnn's senior political commentator, former senior adviser to president obama, david axelrod, and cnn senior political commentator and former trump campaign adviser, david urban. what i'm lucky enough to have the david's with me, both of them. i'm just going to try to get
6:07 am
out of the way here. let me just throw this out there as a starting point here in the new york times sienna college poll shows the race tied. it focused on the not fully decided voters, which a little different than undecided, but not fully decided. they say 15 percent are not fully decided. and i think we have that we can throw it up on the screen so people can see the actual number. and among that group right now, kamala harris is leading 42% to 32%. it was essentially tied a couple of weeks ago. so that not fully decided group david, you got like ten days left? >> yeah what can you give that will look, i think i actually think the other night when she was on the town hall and obviously she's amplifying it now, she said something that is meaningful to these voters. >> they're very much concerned about what's going on in their lives, particularly in the economy. and when she said he's going to come to the office with an enemies list. i'm going to come with a to-do list and your concerns are going to be he on that list of
6:08 am
issues to work on. i think that is a contrast that she needs to really, really hit hard and the final days of the campaign because yes, trump, his fundamentally anti democratic in certain ways. and i mean with about democracy and he's sort of signal what he's going to do. he's going to get rid of the special counsel. he's going to pardon the january 6 mob and so what does this have to do with people's lives? what, what what is his vengeance have to do with their day-to-day lives? and i think that contrast is really powerful and i would lean into it every single day. >> other david yeah, i like the analogy. i like to do less analogy. you know what? it's been number one, on kamala harris's to do list secure the border for the past four years, the number one item on her to-do list, secure the border failed. f gets an f grade, so let's make that contrast. she's been in office for over
6:09 am
1,400 days. there's lots of things on the to-do list that she still has to do so why should we give her another chance? why she she hasn't been able anderson asked a great question, what have you been doing for the past four years and why he started yesterday. when she's talking about securing the border, she said what we're going to do, all these things were to introduce this legislation would do this at anderson said, why didn't you do these things? why do you do the io? you could have done all these things and she didn't have an answer. she did have an answer acts as you said, it was a word salad answer to that. and look, i do agree with ax, the people who speak with excuse me, the candidates speaks to people's concerns, their economic concerns that makes him feel like they're being heard it's going to be rewarded with those swing voters here in the end days. >> yeah, let me let me say a couple of things. i did say one answer of hers was a word salad, but boy, if this is a competition of who is speaking in word salads i invite everybody to go and watch a trump rally. i mean, that isn't the word salad.
6:10 am
>> it's a, we've it's like sweet greens. david rohde are chopped but also, you know, on issues like the border. i mean, she did say what she had has been doing, what she would do. she's the vice president, of course, not the president but she's got a valid point. there was a very, very substantive bill on the floor and trump killed it because he wanted the issue. so that's a you know, i get the talking point. you guys want to look back? accords, but she's be smart to push forward and talk about the things she's going to do that are going to be positive in people's lives when she is present in the united states, dave, we don't talk about the pence years. okay. vice presidents don't make decisions president's make decisions. and the question is, what would she do as president? and that's what she needs to focus on here, but actually can't have it both ways. you can have joe biden there saying she was a partner with me. we did all these things together. you can't claim that she was last person in the room help, but make decisions and then no,
6:11 am
no, she had no input whatsoever what was going on? i think you got to pick i've been around those rooms and i saw joe biden was the last person in the room, often with barak obama, but barack obama made the decision i need say, thank you very much for your advice. >> i'll go in the direction i want to go only the president makes decisions. i think the way donald trump's behaving in the final stanzas of this campaign should give people some concern about how he's going to make decisions. >> so let me let me kit that point right there because abc news and ipsos have a different poll out today, which has a kind of a startling top line number. gary langer, the pollsters there, noted that 49%, about half of those polled see donald trump is a fascist, which is sort of a stunningly high number. so david axelrod, when you see this does this may be explained in this, by the way, this poll was taken before the john kelly comments came out with you know, you hear him on tape saying that donald trump said he he saw some good things they hitler did some
6:12 am
good things does this explain why the harris is the harris campaign is maybe trying to go down this path, ruining look, i think that there are republicans who may disagree with her on some issues who have real concerns about whether donald trump believes in the fundamental tenants of democracy, the so-called nikki haley republicans and i think they believe that there are enough of those to tip the balance in some of these states, like pennsylvania, where the suburban areas are going to play so big i think that there's valley how you in that, but i really do think you have to tie what trump's obsessions are with the concerns of everyday people and ask yourself, is he going to wake up every morning? and thinking about my problems are his own i really think that's fundamentally the distinction they want to make at the end. so it's, it's important to raise these issues and i care about deeply, but i've said many times here and elsewhere, if you're talking about democracy over the dinner table, it's probably because you don't have to worry about the cost of the food on your
6:13 am
dinner table. >> david urban yeah. look, i agree with axe, 100%. look at that cats and dogs sleeping together, shock the world i think, but not being labeling an aim have a little, a little impact at the end of the day when kitchen table issues are top of the list and every list, the economy inflation, immigration, those are things that are affecting people's lives every day that's what's going to move people in these last few days. the candidate who speaks best to that, who people feel that understands their concerns, their issues, their wants, their fears. >> those are the that's that's where the people are going to flock to that candidate. >> and these, in these closing days so it's an access point labeling is somewhat useful. negative campaigning we see does move numbers, but someone who has an answer for those economic issues is going to be the key i will say that's, that is the platform on which most fascist get elected. so that's
6:14 am
a famous fascist have run. so i'm going to make the economy work better and then all the other things come along with it that they don't talk about when they're running well on that jury note. i'll read it to him. and say, listen if we're gonna look at labels, i'll read, i'll read you the definition of a socialist. and then we can, we can just call kamala harris asy within i finished of a socialist. so we'll do, we'll do political theory one-on-one david urban, david axelrod, thanks to both you, sara. >> thanks, guys. >> donald trump now claims he's always tried to stop the lock her up chants about hillary clinton. it is hard to forget his role in that our daniel dale is going to do a fact check is the fbi closing in on who leaked documents outlining israel plans for a potential attack on iran and the menendez brothers could be close to walking free after their murder conviction without the possibility of parole those stories ahead

6:20 am
it easy, take it as if daniel dale is here with a fact check were other facts dana well, i went back and looked at the tape and i found what i thought i'd find because i was alive. like you were in 2016 when people chanted lock her up. donald trump did not say take it easy, take it easy. we're winning on many occasions. he paused his speeches for extended periods to let the chance continue. on other occasions, he said that lock her up himself, take a listen i'd lock her up. >> is right should lock her up. she's this it's disgraceful you should lock her up. i'll tell you what come up. >> you should lock them up lock up the lock up hillary

hillary clinton using other language. >> in fact, i think his crowds were chanting, lock her up because he kept calling for her to be sent to jail or prison. listen to some more eclipse i think she should be in jail for what she did with her emails. >> okay. >> she should be in jail hillary clinton is a thief and hillary clinton should be in jail for what she did to our national security it's just awfully good that someone with the temperament of donald trump is not in charge of the law in our country because you'd be in jail. secretary clinton attempted to rewrite history during this campaign, and i think this is a particularly egregious example let's do one more i want to play for everyone something that former president barak obama said while campaigning with calmly harris in georgia yesterday
6:22 am
some folks would be like, well, that'll trump, send me a check >> i know you are somebody you heard that you understand joe biden sent you a check during the pandemic just like i gave people relief during the great recession we didn't put our name on it because there wasn't about feeding our egos. it wasn't about advancing our politics. it was about i've been people around the pandemic relief checks? >> daniel well, i i'd say this claim about credit taking is at least a little bit misleading. >> it is true that joe biden did not put his name on covid relief checks? like donald trump did. however, what former president obama did not mention
6:23 am
was that biden, like trump had letters mailed to the people who received those checks? with his signature on taking personal credit saying this was a political promise, fulfilled. i have one of the letters in front of me said a key part of the american rescue plan is direct payments of $1,400 per person for most american households. continued this fulfills a promise i made to you, and we'll help get millions of americans through this crisis. it went on to that effect. and it was signed president joseph r. biden junior with his signature. so again, there's a narrow point. again, biden's name were not on not on the physical checks, but did he just decline to take any credit and just let this be about serving the american people know everyone sending checks and everyone's taking credit for it. that's my takeaway today. daniel thank you very much, john. >> you can all send me checks the first time you can take credit for it. just said right. for the first time of the campaign, one mega superstar is set to take the stage at a

6:29 am
i'm going to talk about is the state where donald trump was yesterday. that is arizona. this is a state that joe biden barely won four years ago by 10,000 votes. something really no democrat has done in a generation, arizona has been pretty solidly republican. donald trump wanted four years ago by four points before that republicans want it by a lot. you can see mitt romney, you want a big, of course, john mccain, it was his home state. he wanted pretty big. so what changed for joe biden in arizona from previous elections? will it all comes down to basically one place that's here. it's maricopa county that's where donald trump was yesterday. that's where every presidential candidate goes in arizona. it's the most populous county in arizona, about 60% of the population. it's the fastest-growing county in the country by some measurements, not just phoenix, but mesa tempe, scottsdale, all those suburbs, you've heard of them, you know, them. and joe biden was able to eke out a victory in maricopa county by about
6:30 am
45,000 votes, barely 2%. there doesn't seem like a lot. but if you go back for years, for years before that, donald trump won by about 40,000 votes. and if you just talk about the overall margin in arizona, you're talking about an 80,000 votes swing that more than accounts for the range of victory that joe biden had won the state by 10,000 votes. he increased the democratic vote, maricopa county by eight he thousand votes. that's explains how he won, as i'm slurring here, i do want to show you one visual thing here that's kinda cool. i'm going to circle maricopa county there. that was 2020, democrats won maricopa county in 2020. they won the election in arizona. look at 20:16, the only thing that's different is they lost maricopa county 2012, lost maricopa county, lost arizona 28, lost maricopa county lost arizona 24, 2020. i could just keep going back and back and you get the story there. it all comes down to maricopa county in arizona.
6:31 am
that's where the candidates are going. that's how to get victory there in arizona incidentally, 11 electoral votes what's right there? it's kind of electoral college insurance for wisconsin, which has ten if democrats have problems in the blue wall, they'll need something like arizona all right. >> thank you, john. with only 11 days to go. kamala harris is bringing up big star to her campaign rally today and texas, none other than beyond say she is there to hammer home her message about the loss of reproductive rights in a state that has a near abortion ban on her way to texas, kamala harris dropped a brand new ad where abortion front and center for 54 years, they were trying to get roe v. wade terminated, and i did it. >> he did it. >> it was pretty devastating. >> is brian racking about the rights that he stole from american women and trump is promising to do more alright, joining us now, democratic congressman vincent day gonzalez, representing south
6:32 am
texas. >> thank you so much for being here. this morning. i want to talk to you about the using texas as a place to talk about well, abortion rights and reproductive rights in polling done by the university of texas at austin abortion rights though have consistently been pretty far down the line. on the issues that voters think are the most important, the latest polling there finds its cif behind the economy, border security and immigration. so you think it's a good idea why focus on this message in your state of voters are telling you that it is not their top priority well, i think there are a lot of top priorities, but certainly for her women and young women. >> this is a very concerning issue. i and i could tell you just what we're dealing with. just weeks ago, i had a 24-year-old woman who literally was losing child inside of her and she couldn't get the care she needed from any doctor or hospital in south texas or anywhere across the state and she was forced to go across the border into mexico to get the
6:33 am
health care she needed to save her life and i think when texans hear stories like that, that is when people are called. i can tell you in south texas, most of us are catholic or certainly not promoting abortion. but we don't want a national abortion ban would zero exceptions that creates conditions like what this young lady just separate here in my district i think the polling does reflect that as well. trump says that he is getting angrier and angrier about immigration, and he said that america is and i'm quoting him here, a dumping ground a garbage can for the world, referring to migrants calling human beings, garbage. what do you think? polling shows? why do you think it says that polling shows he's gained with latino voters? >> well, i don't believe it's the anti-immigrant rhetoric and i don't quite understand how his game, but i could tell you on the border, i've been one of the most vocal members in the democratic party on issues on the border. and we've gotten serious about it. >> and numbers are way down on the border when you talk about border security and we had a
6:34 am
great border bill senate, that he decided to heal because he was hoping to campaign on it. >> right now, we don't have the surface that i've dealt with in my eight years in congress on our southern border, it's pretty unremarkable these days, but he was he was hoping for chaos around this period and it's not happening because that's what he wanted to campaign. they also want to stay on the equation it should down from nine and 21 to 2.4 last month and we continue to move in the right direction. so i think a lot of expectations that president trump had to campaign on a lot of the issues that he was hoping would be viable issues have fizzled out and there's a lot of excitement in texas and across the country. and a lot of excitement to have a woman and woman of color on the top of the ticket and i'm glad she's in texas and we welcome there's been a lot of discussion around immigration and you yourself said you are representing a border area that shares a border with mexico.
6:35 am
and kamala harris on more than one occasion denounce trump's border wall in this 2017 they're going to show you here. she called the border wall is stupid use of money and said that she would block any funding for it. but in 2023 agreed to that bipartisan bill that trump tanked. that left a chunk of money to continue building a border wall what are you hearing for voters about what they believe she will do? are they concerned in seeing sort of this flip-flop well, i think what voters want is common sense policies. >> i live on the border, a border wall hasn't really stop migration from coming. we need better policy. we need to change her if if we're serious about slowing surges, we need to change your asylum laws. we need to talk about policies that will be impactful. and other countries that will discourage people to when it come to our, to come to our southern border. we need to keep investing in places like central america to create conditions that create jobs for people to stay in their native country. it's policies like
6:36 am
that that stopped surges on our southern border, even places where i have border walls people, migrants are coming to that detection of the river and they go and look for a camera and they waved at the camera and tell border patrol we're here, come and get us. so they still get to come in and coming into the united states and have had a court hearing. who knows when. and it's all because of bad policies and until and until we get together in a bipartisan way, this is not going to be fixed let me tell you immigration and border security is not an american or democratic problem. it's an american problem that requires real bipartisan solutions and it requires both parties to get together regardless who's in charge in it. >> in the house, the center of the administration can come up with common sense policies what we hear now on the campaign trail is just campaign rhetoric, which is really discouraging for places like my district where the border is not a campaign topic, it's a place where we live and work in a place that we want secured and the place that we want to be a pleasurable place.
