it out of port-au-prince. u.s. warning americans not to travel to haiti among rising gang violence there. this is "cnn news central." breaking overnight, filling in some of the biggest cabinet positions with very prominent figures. multiple sources say, president-elect trump is expected to announce he will nominate florida senator marco rubio as his secretary of state. rubio is a starch, china hardliner , once dubbed little marco by trump in 2016, now a fierce trumpet suborder , and if confirmed, would lead trump's support in israel and iran. also breaking overnight, cna learned that trump will nominate north dakota governor christie known as homeland security secretary. noem made

headlines about bragging about shooting her dog, crickets, but disappointment is a huge deal when it comes to trump's mass deportation agenda. let's get to cnn's alayna treene, near mar-a-lago this morning for the pace of these announcements. good morning, elena . >> reporter: good morning, john. we are really seeing a lot of donald trump's top officials come together, particularly with national security as we look at the potential pick of marco rubio. it is unclear if donald trump has actually offered senator rubio this role, but it does make sense. keep in mind that rubio one , was on the shortlist for donald trump's vice presidential pick. he is also someone who sits on the foreign committee, also is on the foreign intelligence committee, and has deep ties to the barn immunity. he was on top of the list for this role, as well as though, with now donald trump's former ambassador to germany. we are told that as of yesterday morning, donald trump was actually leaning toward grenell

for secretary of state role. throughout the course of the day, a lot of allies of rubio's, and those who believe rubio should be the pick up secretary of state began calling trump . throughout the course of the day, that is what changed his mind. again, until donald trump offers him the role, and he accepts, it is not set in stone yet. i also think with rubio as pig, it shows how aggressive donald trump and his broader national security team will be toward china. we know that as well with florida republican mike walls taking the role of national security advisor. i also want to talk about the noem higher. what he will be doing with immigration will be one of the biggest, i think policy goals of his second term. noem, of course was also on the vice presidential short list as well. however, her relationship with donald trump soured and his idea of her as a potential vp pick soured after she detailed in that book that she had released how she had shot her 14 month old dog, cricket.

biden and first lady jill biden to the white house. this is keeping with her normal working with tradition here. >> doing her own thing. alayna treene for us , thank you very much. and just a few hours, president biden meets with israeli president isaac herzog at the white house, a critical meeting as u.s. aid to israel could be in jeopardy over a looming deadline for israel to improve the humanitarian situation in gaza. of course, this meeting comes one day before resident electron returns to d.c. for his sitdown with president biden. cnn's are like signs in life for us at the white house. what are you hearing for us this morning? >> reporter: sarah, president biden's advisors have said, foreign policy could very well be a part of the discussions between president biden and president-elect donald trump . they meet in the oval office tomorrow. the conflict in the middle east is among the foreign policy challenges that

trump will inherit when he comes into office. for president biden's part today, he will sit in the oval office with israel's president, isaac hurt . it comes at a time when the u.s. is still eager to reach some type of resolution to the conflict between israel and hamas in gaza, but also israel and hamas in lebanon. so far, it appears that the talks for a cease-fire and hostage deal or gaza and israel, which is a top priority for president biden, remain completely at a standstill. over the weekend, qatar, who had been leading the negotiations between israel and hamas, said, they would be taking a pause from their role in that. many questions about whether any type of agreement can be reached before president biden leaves office. this meeting between biden and herzog today also comes as a aid organizations has said that israel did not meet the standards that were set out by the u.s. to surge aid into gaza. you will remember just last month, secretary of state antony blinken and defense secretary lloyd austin sent a

letter to israel, outlining how they wanted to see additional humanitarian aid into the gaza strip, or potentially say, that if they did not, they could risk violating u.s. laws related to foreign military assistance, raising the question of whether the u.s. could potentially withhold military aid for israel. some of the standards they had set was allowing 350 trucks of humanitarian aid into gaza a day, as well as between 50 to 100 commercial trucks into gaza as well. these eight organizations that released a scorecard overnight, said that israel has failed to meet those standards and many more. now,

there will be a major question for the u.s. today as that deadline is now today. last week, the state department spokesperson matthew miller said that he would not get into speculation of what would and would not happen if israel did not meet these steps, but that would be something for the u.s. to determine going forward. at the same time, even as biden continues to grapple with this conflict in the middle east, you are also seeing president-elect donald trump engage in some diplomacy with israel, just over the weekend, israeli prime minister benjamin netanyahu said he had spoken three times with trump since the election. the former israeli ambassador to the u.s., ron dermer, was just at mar-a-lago yesterday. a meeting with trump. what you are seeing is a bit of a crossover between the biden administration, who is currently in office, and donald trump, as it relates to this conflict in the middle east to try and find some types of resolutions. >> it is hard to see any big resolutions before the new president is put in place to a lot of observers. coming up for us, the jury is still out on who will be the next attorney general. but justice department employees who worked on investigating donald trump are already preparing for potential retaliation. one thing that has been clear since the election, the markets thing to be happy

another record yesterday, and bitcoin is back, apparently, hitting an all-time high. ben egan is tracking all of this and what it really can mean . when it comes to the stock market, how long can all of this keep? >> kate, some of this will be up to the president-elect himself, when exactly he lays out his plans for terrace, how high they will go in mass deportation, some of the more negative parts. for now, the market is going straight up . the dow breaking about 44,000 for the first time ever. a massive move . more than 2000 points just since the election. a part of this is just relief that investors have clarity . there is no recounts, this will not end up in court. there is certainty. a part of this is trump specific. there is enthusiasm about his tax cuts and deregulation. we have seen big bank stocks like wells fargo go very sharply higher,

because investors are betting that trump regulators will go easy on banks. tesla is up 39% since the election, as investors are betting that elon musk will benefit from his close relationship with the president-elect. crypto is going to the moon, bitcoin skyrocketing almost $90,000. and coin base, the biggest crypto exchange is really cashing in. coin stocks like geo group are betting they are going to benefit from trump's immigration crackdown. for now, investors are very much focused on the positives. the negatives have not been factored in very much at all now. >> you talked about the bond market after the election, what is going on now? >> the bond market has a different take on this. the bond market started to sniff out this trend days, weeks before the election. bond prices went down, and yield with sharply higher. continual tragedy 10 year treasury yield up from almost 10 months ago .

there is a few factors at play, not all are trump related. this is because investors are getting more confident there will be a soft landing and the recession. they are also betting that growth will be even faster under trump, and there is been concerned about trump's plans to potentially borrow trillions of dollars more. the national debt already obviously very high. the committee for a responsible federal budget has projected the trump economic agenda will add another $8 trillion to the national debt, almost twice as much as what they are projecting under harris. >> and we knew this before the election. these balances were out before the election and we know that voters looked away from in voting for who they voted for. that does not negate the fact that we could still be blowing up the budget. >> investors are demanding a little higher compensation for u.s. debt because of all of this borrowing coming down. also, inflation. concerns that immigration crackdown and tariffs , you put all of this together, that is why we have seen great go up . the rates are not yet at a problem area,

but getting closer to an area that it could cause trouble for the stock market and it is costing all of us more to borrow. especially mortgages . we have seen mortgage rates go higher. we need to pay close attention to what the bond rate is saying and how it continues. >> fascinating. we will see what happens today. this morning, an investigation underway after two commercial flights were hit by gunfire in mid air . this morning, an 18-year-old is dead , and more than 25 million people under red flag warnings as wildfires rage here in the northeast.

new this morning, an investigation underway after two commercial flights were hit by gunfire over haiti's capital. they injured one crewmember, forcing a emergency landing in the dominican republic. a jetblue flight was also hit that managed to land safely. cnn's pete muntean is in with the latest. >> ready terrifying and significant . other airlines are shutting down their flights to haiti and the u.s. government is on high alert. the u.s. embassy in haiti just published a warning to travelers saying, it is aware of what they call gang led efforts to block travel to and from port-au-prince. the security situation it says is unpredictable and dangerous. the embassy says, travel within haiti is conducted at your own risk. remember, haiti has been in a state of unrest for months. a new prime minister was warning yesterday, historically, commercial flights have been hit by gunfire before, but it is likely unprecedented that flights have been hit back-to-back . this was the scene on spirit airlines flight

951. you can see the bullet holes there created as this flight was apparently about to land in port-au-prince. the crew aborted the landing me pulled up and averted the safety, ultimately landing at the santiago airport in the dominican republic. spirit says, one flight attendant received minor injuries, but thankfully, no passengers were hurt. we are also now hearing from jetblue that it discovered a bullet hole in one of its planes leaving haiti. jetblue says to me flight 935 from haiti landed at new york's jfk with no problems. after landing yesterday, a crew inspected the plane and found that it had been apparently struck by a bullet . jetblue says, we are actively investigating this incident in collaboration with the relevant authorities. it goes without saying that both jetblue and spirit have suspended their flights to haiti . american airlines also suspending flights there. u.s. airlines taking this into their

as president-elect donald trump considers who to choose as his attorney general, career justice department officials all reread the second trump term will bring chaos and potential political retribution, one official told cnn, there is a quote, general depression among lawyers who worked on trump's legal cases. another justice department says, some are considering whether they themselves are considering hiring their own lawyers. another factor adding to their worries? well, whether or not the supreme court's immunity ruling that expanded his presidential legal protections will play a role here. senior correspondent evan

perez, what are you hearing this morning from inside the justice department? >> it is a range of things, sarah . it is everything from the fact you see, four years of your work, and you see it probably going to be undone. so , you have justice department employees who are concerned, not only about that, but also about the fact that the former president and some of his allies have said, they want to go to the fbi . they say, they want to get rid of people who worked on cases that he cared about, including, of course, the two cases the justice department, jack smith, special counsel, brought against the former resident, the incoming president elect . those are some of the concerns you hear from inside the department, inside the fbi. some of it, you are getting a lot of attention from people who are up for -- in consideration for attorney general. there is mark paladino, a conservative attorney. smart guy .

yesterday, he posted on social media, said the following, this career, the oji employees won't implement president trump's programming in good faith, they should leave. those employees will engage in so-called resistance against the duly elected president agenda, would be subverting american democracy . he said, those people should essentially just resign. there is a lot of reason , a lot of concern i think for this fact . even if he picks someone like paladino, somebody like bill marr, somewhat like jeff sessions, we know the former president has a history of putting pressure on those people to try and carry out prosecutions, some of which would be necessary illegal. going after his political enemies when there is no evidence. previous attorneys general have run into problems as a result of that . he fired jeff sessions me and we know he essentially pushed out bill marr near the end of his term , because he would not support the claims of vote fraud. that

is the picture as trump is trying to pick what many would consider perhaps the worst job in washington . certainly the toughest cabinet position to fill in the next few days. sarah? >> he fired one of his top cops , and he pushed out the other. what about fbi director ray where does he stand in all of this? >> the former president, incoming president-elect has already said he wants to fire chris bray . serves in his seventh year of his 10 year term . donald trump could be the first president who essentially fires two fbi directors. that is an unusual thing . one of the things going on in the fbi is , officials are trying to figure out whether donald trump actually means that, what has he said more recently? it has been a

marriage between trump and a lot of appointees. look , the folks now in trump's orbit have been dating about 10 years so to speak. their relationship with them, marco rubio ran against him in 2016. to get the people of his stature other folks for terry of defense, jody earns possibly, because you have those relationships. also, two things . marco is one of the leaders want really being hawkish me taking on china directly, understanding the threat he poses, it is a bad day to be in beijing now if you are one of the ccp leaders. >> and incoming national security advisor, michael waltz hold similar views. it is worth noting the relationship rubio and trump have had over the years. they ran against each other in 2016, during that time, trump once tweeted, marco rubio is a total lightweight i would not hire to run one of my smaller companies. i think we have this to put on the screen. a highly overrated politician.

and listen to input. he has made up his mind for people around him not as duly elected, appointed cabinet members, like elon musk , probably will have a say of foreign policy . marco rubio, past, present. for everybody celebrating this is a norm that he is putting people in that are not necessarily maga. these are people who consistently bent the need to whatever donald trump wants and he will be running policy himself. from that perspective, i think this is a virtue signaling pick to the quote, unquote establishment, because the real establishment now is maga. anyone who does not get on board like marco rubio, will be out in five seconds, the same way his predecessors were. >> matt, do you want to respond to that? >> sure, he does on policy. last week at the ballot box, the american people enabled him to run the policy. he is implementing his campaign promises. again, the idea that he doesn't do that-- just like

the president of the united states, everyone will support his vision. the same with kamala harris. that is what you saw with joe biden and barack obama. that is nothing new here. the idea of this loyalist of, it is total misnomer's. that is okay. the president gets amount of deference to install his team, that is what you see here. >> i will say one thing, matt, the difference between donald trump and everyone else, i will go to republicans as well, reagan, bush, the second was, and so on, he does not sit around and take advice from his cabinet . it is not a collaborative process. joe biden, barack obama, would sit and listen to input from his advisors, because they were qualified. tony lincoln did not just show up, tony rubio did not just show up. these are people working in that space for a long time . i think we both know donald trump will not sit around and take advice from his cabinet and can enter, they both sides before making his decision. he has very tough decisions to make, but we know

party the post trump world . marco rubio, could be secretary of state shortly, j.d. vance, vice president, elon musk over here, ron desantis in florida. a lot of the florida people are getting pulled into this administration. then, there is don junior. will this be like a game of thrones jockeying met , you know the mantle of the next, the future of the party? i know it is early, but you can never be too early on cable television. >> i think we have a long way to go between now and then. certainly, as kamala harris will tell you, having a sitting vice president who once ran for president, gives you a leg up better than anybody. this will be unprecedented. certainly, somewhat like a ron desantis will run, marco rubio, others, we will see where it goes. j.d. vance right now is probably a little -- just because he is sitting vice president, and rightly so. >> i can tell he knows i am right. there's something going on. thank you both very much.

>> just say, john is right , and you will be able to wrap it up . that is the key to success. just kidding. more than 25 million people across the northeast are under red flag warnings this morning. the dry, windy conditions facing so many states is fueling wildfires that crews have been battling for days now. the jennings creek fire along the new jersey and new york border has burned 3500 acres so far, only 20% contained. the in and's lee waldman is in new jersey following all of this for us. what are you seeing there and what are you hearing from officials? >> reporter: good to be with you this morning. we are in one of the areas where some of the fire has actually been distinguished, but you can see some of the smoldering behind us and the trees burned out, smoke filled lingering behind. this got dangerously close to homes not only 200 feet from where we are just now. thankfully, this fire burning through the dried out ground

here , it is not looking like it is going to cross the road and impact the homes . like i said, not 200 feet from where we are now . officials are still working to try and contain this fire, but they are up against a historic drought in this area, gusty winds we have been feeling all morning long, and extremely, extremely dry air . we are hoping to hear more from officials in a few hours, expecting a 10:30 a.m. press conference from the new jersey forest fire service. we have been seeing some of them driving through the area today. we have been being trees spark all throughout this area. some roads have been closed off. not mandatory evacuations here, but with these homes so close to where these fires have spark, some officials are telling people that they need to have bags packed and ready to if the fire doesn't get too close to their homes . we spoke to the mayor of the greenwood lake village in this area. he said that the schools in this area were under a two hour delay,

that is because it was so dark this morning, they did not want the school bus drivers and people dropping their kids to school to be impacted by the fire . we saw a school bus driving in this area. a police officer offered to drive behind them to make sure those kids got to school safely. we know this is a dangerous situation and everyone is hard at work to try and contain this fire, kate. >> the situation as you are seeing and reporting, definitely not over yet . thank you very much for that report. donald trump's hush money conviction at a crossroads today. will this case be thrown out two weeks before he is scheduled to be sentenced? why some online pharmacies are seeing scales sales skyrocketing since donald trump won the election. those stories and more when we continue.

today, new york supreme court judge, juan marchant is expected to decide whether to clear president-elect's payments related to a hush money payment in the 2016 campaign. the self-imposed deadline coming after the supreme court decision granting trump immunity. if the judge ends up dismissing the conviction, the charges would be dismissed and would not be sentenced. joining us now, senior analyst and former assistant u.s. attorney in the southern district of new york, elie honig. you have been following all the cases for many years. can you give us some sense of what the argument are being made on both sides of this case?

>> sure, it is important to understand, the trial happened first, the conviction happened late may, and a month later, the supreme court came out with its immunity ruling and donald trump's lawyer said, we are entitled to the benefit of that ruling . trump's team is income under that ruling, the presidents communications with top advisers are automatically presumptively immune . trump is arguing in the hush money case, there was some evidence, not much, but a little bit of evidence of trump's conversations while in his early first-term, 2017, with except his first director, other white house staff. trump is arguing that should have been immune, that should have never been admitted against me, therefore, the verdict has to get thrown out. prosecutors have responded saying, that was not an official act. you were talking about your campaign, that is personal business, therefore, does not meet the definition. that is the dispute that judge merchan will have to decide today. >> what are the chances here that you see, because the sentencing would be this month

? >> the sentencing is scheduled for november 25th . the question of whether that will go ahead, as for what judge merchan will do today, it is always hard to get a judge to throw out a jury's verdict . you try to uphold the verdict and respect it, except for unusual circumstances. one wrinkle, the da is arguing, even if this evidence was immune, it should not been admitted into what we prosecutors love this phrase, harmless error. the evidence that should have come in did not really make a difference. the problem is the da stood in front of the jury and set this evidence is quote, utterly devastating to the case against him , and it is a quote, crucial piece of the puzzle. a little hard to say that evidence did not matter when the da said, it is a critical piece to the puzzle. trump has had a better chance than your average litigant. >> may i ask me what happens if the judge is, nope, this conviction stands then what? >> perceive the scheduling

november 26 ? watch for trump's lawyers very soon to make this argument, you cannot sentence the president-elect . it is pretty clear we have never obviously had a situation like this, but pretty clear a state prosecution cannot proceed against a sitting president. you can't imprison a sitting resident on a state charge. trump's team will try to make his case and others in rolling him back to try to include the president-elect. they will say, yes official duties now, in the process of transitioning , and he does not have the time and can't be sidetracked with sentencing. we don't know. anyone that tells you they know that for sure is making it up. we've never had a situation of someone taking office with criminal charges. that will be the argument they make and judge merchan will have to figure it out. >> was there any since before this case that there was potential jail time? >> maybe. my assessment before all of this happened was there was a 50-50 chance judge merchan with sentence donald

of an increase we are seeing in these types of sales . i spoke with a heads of two different telehealth companies. one company called wings health said, in the three days after the election results were announced , they saw an increase of 966% in sales of their morning after pill, compared with the three days before the results were announced. at another company called this wisp , they saw an increase of 1000% in sales of emergency contraception just one day after the election. the ceo of wisp , monica cpap, here's what she had to say about why these trends are happening. >> women are concerned , and are taking agency over their reproductive health , and preparing for whatever outcome the next few years brings. >> and kate, it is still not

clear what could happen under the next trump administration, but there is concern if additional restrictions are placed on abortion, for instance, that could have a rippling impact to other reproductive health educations like emergency contraception. >> absolutely. and what is seeing the biggest spike? >> plan b is a type of emergency contraception. it is a morning-after pill. we know plan b has been huge spikes in sales. this is the medication available now in all 50 states and over the counter. the concern, could we see additional restrictions impacting access? emergency contraception is different than abortion. emergency contraception is taken after having sex, but intended to prevent pregnancy , whereas, we know abortion medication is intended to end pregnancy. these are two different types of medications, but they all fall under the umbrella of reproductive health . that is
