10:02 pm
special report. we begin with the breaking news. trump preparing to oust three and four star generals. trump's transition team is considering a executive order that will give trump the power to oust three and four star journals. according to a draft of the order which was reviewed by the wsj, trump would appoint a so called warrior board and that board will have the power to fast track the removal of generals and admirals that are found to be lacking in requisite leadership qualities. decisions about generals are made by a military structure. as the commander in chief the president has the authority to fire any officer at well but the warrior board circumvents the pentagon system in place and this trump ousting at will
10:03 pm
three and four star generals is consistent with what trump has said. >> are you going to fire those generals ? >> yes i would get rid of them. now i know them. i would fire them. you cannot have woke military. >> thank you for saying you would fire those few woke generals that are a big problem. >> this news coming as one person in trump's orbit is a crucial force in making decisions about hiring and firing and that person is elon musk. for the past week he has set up shop inside of florida. he is one of only a couple of confidants attending trumps cabinet selection sessions. trump is reportedly embracing elon musk's quirky ideas. he is posting online he is happy to be first buddy. he is in a
10:04 pm
trump family photo also in this photo with trumps granddaughter who posted elon musk achieving uncle status. his net worth searched $1 billion in one week since trump took the presidency and much of his wealth is wrapped in shares of tesla. investors are so bullish that he will benefit, this will also be the tip of the iceberg. electric cars, renewable energy, space travel, social media, he could be handed billions more in federal contracts. take space x, it already received billions in contracts from the government and that can grow under trump. trump himself suggested awarding you unmasks satellite service have the contracts and then there is elon musk's boring company which is all about building underground tunnels. >> we are trying to dig a hole under la. this is to create the beginning of what will
10:05 pm
hopefully be a 3-d network of tunnels to alleviate congestion. >> of course he was paid more than 52 million to build a underground tunnel in las vegas. it could be tapped now for countless more infrastructure contracts. he is one of the most innovative humans on the planet and revolutionized industries but one man joined at the hip as trump is the president of the united states making decisions on who is in the cabinet, calling himself first buddy, does raise concerns. be honest about that. elon musk can feed trump's taste for conspiracy. his misleading election claims has been viewed more than 1 billion times on x. a slimmed-down government could have a positive impact for sure but his role had is beginning to have the potential to become
10:06 pm
the political oligarchy like we see in russia where they award their valuable oligarchs with valuable contracts. kristin, you have new reporting tonight about this room where elon musk and trump are this more room in florida where they are picking the new team. what have you learned? >> this is a room that caters to the president elect, a lot of tv sheen screens and information. these are long tables and rooms that have been quartered off inside of the building with curtains. i spoke with one person who made eye contact with the former president at one point so maybe not as private as they think. they are giving trumpet 360 view of every candidate and there is a reason. trump told people around him he was to be involved in the process and
10:07 pm
there was some embarrassing moments in 2016 where he would make a public backing for a candidate or a potential pick and then learned later that this person had said a number of negative things of out him behind his back so they are trying to avoid what one advisor said was any surprises. trump does not want anything that alarms him so what the room looks like it's essentially tv screens that have the pictures and bios of each candidate but they are also playing tightly edited clips of each of the candidates. one thing trump cares about is television presentation. can the person present in a way that is receptive or able to be received by outsiders. this is somebody that can communicate my message and that is something they are looking for. not all of these clips are positive, some of them have the negative things people have said about trump or more critical things but it is one indication of how seriously they are taking the process and
10:08 pm
how involved the president elect is this time around compared to what we saw in 2016. >> interesting in that context how fast and furiously disappointments are coming out even with all of that. thank you very much. general clark is out front now, a four-star general and former presidential candidate. i have a lot to ask you about this evening as a four-star general. you heard kristin's reporting on elon musk. the power he has been getting in trump's inner circle by trumps side weighing in on major decisions on that call with trump and the ukrainian president which they said was a short social call but it shows the influence and presence he has. does that concern you at this time at all? >> the presidents is in charge,
10:09 pm
the american people elected him and he is responsible to the american people for his performance in office, he has unparalleled power by virtue of the supreme court, the senate and probably the house of representatives and he will run the government the way he wants and that is democracy. >> it is not just the supreme court's competition but the immunity rolling although i note that is still being sorted out for sure. when it comes to this transition team , the wall street journal reporting, they are reportedly considering a executive order to create a warrior board. to be able to fire three and four star generals that trump does not like. of course he has the authority to fire generals. he can do that. you knew that but many respected people, the former secretary is voicing concerns. saying this board could turn out to be a vigilante hit team. you have
10:10 pm
worries like that? >> sure, i would like to see what the criteria are. if you do not like diversity training in the armed forces just say there is no diversity training. if people insist on it they either follow the order or they leave. if you think certain generals did not perform their duties in the afghanistan evacuation which is one of the items carried in the wall street journal article, do a investigation but remember when you are looking at the actual performance of generals and complex operations, you have to look above the generals. they are taking orders from the policy level so it is not always the generals decision that leads to the bad outcome. if you simply do not like the generals, what is the criteria? what is it based on? i think that is remaining to be defined. when trump says woke general or in response to a
10:11 pm
question, what is that exactly? there is a selection process and the arms forces, these people have been vetted at numerous times at each level of the promotion. someone has said they are competent so if there is going to be a review of their record, let it be a review, published the criteria and let's look at it. remember that diversity training was put into the armed forces for the end of it of the performance of the armed forces. i was part of the armed forces in vietnam where there was a lot of racial unrest and a lot of problems and we put in the equal opportunity human relations training in the 70s. some people let it lag and some of it has been put back in. it is about the effectiveness of the armed forces so that is what the ultimate criteria should be. >> to your point we do not know
10:12 pm
and maybe that is the point to a board like this, that there would be no transparency or accountability on that but it is that sort of checking the boxes and knowing what made the u.s. military great, the transparency that exists. it does come in the context that the pentagon is waiting for trump to call up troops possibly in the u.s. to use for mass deportations. he has talked about this so the pentagon is meant to talk about what that would mean, do you think they are right to prepare for such a scenario? >> if they are preparing for it is under the direction of the secretary of defense and chain of command. if it is a legal order, if the order is issued it will be checked for legality. if it is a legal order they are obligated to obey it. if they choose not to then either they resign from their positions where they could be court-martialed for refusing to obey a legal order.
10:13 pm
>> general i appreciate your time, ink you very much. >> thank you. president-elect trump choosing mike huckabee for ambassador to mexico. this is a decision that could have huge ramifications. there is a very different view of policy that mike huckabee has put forward. he said there is no such thing as a palestinian. nevermind a state. making extensive comments on this topic when he was running for president in 2008. in the context of the war and the fears that it could become a digger war, this reporting is crucial, what more do you know about what mike huckabee has said? >> this nomination is a hawkish pick by president-elect trump. he has a track record of highly polarizing comments on the
10:14 pm
israeli and palestinian conflict, the views go back years with him repeatedly questioning the legitimacy of a palestinian state on the border with israel. he said if a palestinian state should be created it should not be where it is now, it should be created with land from the neighboring countries, syrian, georgia and he even described a palestinian identity as a political tool to try to force land away from israel. i first obtained these comments when he ran for president in 2016. take a listen to them now. >> there is really no such thing , be careful of saying this -- palestinian -- persians -- there is such complexity. there is really no such thing. that has been a political tool to try to force land away from israel. >> obviously it is hugely
10:15 pm
significant. he is talking about taking land from neighboring countries. obviously seismic if true. in truth this is not the only time huckabee has talked about this issue. this is a issue he feels is deeply personal. >> he takes trips to israel. this goes back to 2008 where we played the original clip. this is a position he has consistently had, it is far from the only time he has said it. he has said consistently he opposes a two state solution. he said there is plenty of land outside of israel and the rest of the world for the palestinian state. take a listen to him going further on that in 2015. >> the two state solution, if we need to governments holding the same piece of real estate is irrational and unworkable.
10:16 pm
if there is a two state solution the palestinian state needs to be outside the boundaries of the nation of israel. there is plenty of land in the world, we can find a place and say let's create a palestinian state. >> we did reach out to huckabee. we reached out to the trump transition team and we asked if he stood by the comments and we did not hear back from either of them so it will be interesting to see how this all plays out especially with the conflict going on right now in gaza. >> it certainly raises questions if the voters who voted for joel stein in opposition may feel differently. you would have thought trump is consistent with the words they put out before. significant to hear that there. we have more breaking news. trump announcing he is tapping a fox news host to be the next defense secretary for the u.s. want to go back to kristin, what more are you learning about this
10:17 pm
one? to make this really goes to some of what we were just talking about witches trump really wanting people that can put forward his message on television and he likes the way pete performs. i want to note that pete has a long record in the military, he was a army combat veteran, he served in afghanistan and iraq and this is what we got for a statement from trump, he said pete spent his entire life as a warrior for the troops in the country, he is tough, smart and a true believer of america first. with pete at the helm america's enemies are on notice, our military will be great again and america will never back down. he goes a little bit into his biography. i talked to a number of advisors in the last few minutes as it was unfolding. they said pete has been a informal advisor to the former president for a number of years, he did it while he was in office and while he was out of office. i also learned
10:18 pm
he was considered for a position back in 2016 and got passed over but now obviously he will serve as secretary of defense which is a critical role for the former president and this administration. we know for example mike walls was also up for this job, he will now be the national security advisor, this rounds out or at least adds to this level of who will be serving at the pentagon, intelligence and foreign policy. >> thank you. in context of the reporting out there, this warrior board that trump is looking at potentially by executive order removing three and four star generals that he does not like, what andrew was reporting about the nominee for ambassador to israel saying there is no such thing as a palestinian puts the influence and crucial nature of the secretary of defense position in stark light and that of course will be pete from fox

moving very quickly to get this core group in place to deliver on some of his top immigration promises. >> thank you. 14 house races are still not called. here we are, it has been a full week but we do not know the balance of power in the house at this hour. republicans have 215, democrats have 206, you need to 18 for control. it is crucial because if republicans controlled the house, then they have the house, the senate the white house and of course in terms of conservatives versus liberals the supreme court. it comes as the nation's biggest and most liberal cities as part of the reason why we have seen this pushed to the right including san francisco. his progressive mayor london breed was voted out. first i want to go to

harry, it is historic but we are seeing. these maps of the u.s. with the red arrows, the shift, all over the place. you see them in the cities. the biggest most liberal cities. >> right, trump you remember back in 2017, the liberal cities were the resistance. what happened in 2024? you think of a major city in the u.s., trump put up the best republican performance for a republican nominee in at least 20 years if not the entire 21st century. we are talking about chicago, los angeles, new york city and san francisco. across the map trump put up historically strong numbers for a republican candidate in places that if you asked me eight years ago i never would have thought possible. >> it is really stunning so what exactly is driving it? >> immigration, one of the things you mentioned in the
10:29 pm
last segment is part of it but i think crime as well. if you ask democrats nationwide if you are satisfied or dissatisfied with their efforts to control and bring down the crime rate, you see that dissatisfaction number now versus a decade ago. unsatisfied from 35% to 58%. satisfied dropped by 20 points. i think that is part of the reason why you have seen the liberal das the ousted in places like san francisco and alameda county and los angeles. the crime rates moved a lot of the voters to the right. >> obviously we are sitting here in new york talking about this in manhattan where there was a swing but when you look at a map of new york city, the big swings right, it was in manhattan but also in other parts of the city and that gives you a real sense of who it was driving the shift.
10:30 pm
>> right it was in the bronx, queens, brooklyn, if you break it down by racial areas, if you look at the assembly district with the most asians in it, you see a massive shift. trump gaining 27 points versus four years ago. the highest hispanic percentage, a 25 point shift. what is going on is if 2017 or 2016 was the election of the white working fast-moving over the republican ranks, 2024 was trump doing historically well with minority voters. >> it is really incredible. those numbers are amazing. if that does not give you pause if you are a democrat looking at this world i do not know what will. thank you harry. daniel is the mayor elect of san francisco, it is a nonpartisan position although i know you are a registered democrats. when we look at what harry was presenting, republicans sing their best numbers in decades and those swings are unbelievable to think about it in the liberal
10:31 pm
strongholds of new york, chicago and of course san francisco so mayor elect, how big of a wake up call is this for the democratic party? >> thank you for having me. i am a lifelong democrat but we do not think of ourselves as progressives, moderates or conservatives in san francisco, we just want to get back to common sense. we have to deliver the basics, that is my plan, the mandate i was elected to fill. we have to make sure we have a fully staffed police department. we have to get our behavioral health and drug crisis under control and we need to make sure small businesses can thrive and are big businesses need to come back to san francisco. we need to be open for business again. i do not believe that is a right swing that is a common sense approach. >> it is interesting you put it that way but you did unseat
10:32 pm
london breed, she is one of the most prominent progressive democrats in the country and part of the reason she fell out of favor with voters is rising crime but also slashing the police budget. you need to be able to fully staff your police department but it only seems that way in the context of where you are. slashing the police budget. that is what we heard from you and your campaign. zeroing in on this issue time and time again. here you are. >> i want to be a candidate that prioritizes safety in san francisco. you cannot just be for public safety during the election year. we need more police focus on hospitality so our shoppers and tourists feel safe. >> i know you are calling it common sense but it would appear it is that way to most people but nonetheless you are the current mayor, your predecessor led differently. how much do you think your victory came down to this?
10:33 pm
seeing as something as simple as we need a fully staffed police department in san francisco? >> i think people want results and they were not seeing that. there is nothing progressive to have 806 people died of drug overdose in our city last year. property crime is rampant. small businesses are struggling each and every day. they want a mayor that is focused on delivering results. that is the mandate i was voting in with and that is what i will do. i do not believe that is -- those are progressive values. i understand i am talking to a national audience. this is not liberal, progressive or conservative, people want to feel safe walking down the street. we had so many instances of anti-asian hate on our streets. those are things we need to address. >> you talk about being a
10:34 pm
lifelong democrat but you're also somebody that has not served in a elected office before and you chose to do this now. you are not a politician, you found a tipping point which is a major nonprofit in california so you focused your time on anti- property initiatives and you also happen to be a heir to the levi strauss fortune so that helped you put your own money behind the campaign. i am mentioning that the, it is not usually in the context of where we would mention somebody's wealth but i mention in the context that the mayor elect said it has been one of the most sad and horrible things i have seen in politics that somebody would take their wealth and basically purchase this office. it is unfortunate and disgusting. she has conceded and she has said she will have a smooth transition but how do you respond to something like that? >> the election is over, the mayor has been gracious during
10:35 pm
the first few days of the transition. i thanked her for that, we will hit the ground running. i grew up around a iconic company, levi strauss, i understood from a early age that business can be a force for good. taking care of community is at the heart of everything i have led with my entire life. i was born and raised here. my two children were born on the same floor at the same hospital i was born at, i have a deep sense of pride in our city and i know you are sitting in the second best city in the world. san francisco when we are at our best is the greatest city in the world and i look forward to ringing our city back because i know we can do this. >> mayor elect i appreciate you taking the time. enqueue. >> thank you for having me. trump tapping fox news host pete to serve as the country's next secretary of defense. congressman dan on the homeland
10:36 pm
10:40 pm
10:41 pm
great. >> you can see exactly where he stands and he has been consistent in that. he is a army veteran that served in iraq and afghanistan. it comes as the trump transition team is considering a executive order that will establish a warrior board of retired senior military personnel with the power to remove three and four star officers that they want. outfront is congressman dan goldman of new york. he is on the committee for homeland security and we were going to talk about governor no, man her role but 10 minutes have passed so the world has changed and it has changed in a few ways. first it's pete been chosen for defense secretary, what do you think? >> i am shocked. this is exactly what we worried about and we warned about donald trump. he is going to appoint unqualified loyalists to shape this government into his own
10:42 pm
personal fiefdom and get revenge on generals and put really unqualified people, i appreciate his service in our armed forces but being a service man does not make you qualified to lead the department of defense and have access to our nuclear weapons. i am very disturbed by this and concerned about what it demonstrates about trump's priorities which now seem to be coming true as many of us warned. >> we just had this news for a few moments. obviously he is a fox news host who has said a lot of things over the years, let me play a little more about what he said about trump and this is from 2019. >> god has used imperfect people forever because we are all in perfect but what he has
10:43 pm
withstood is unlike what any other mortal could understand. >> that is pete talking about god using imperfect people referring to trump. he is a television host, there will be thousands more of those sorts of things but what the you hear when you hear that? >> that was 2019, before january 6. before trump tried to overturn a election, before trump hid classified information in his bathroom and refused to give it back while having phone conversations with russia. this guy is clearly a sycophant for trump and has been his biggest cheerleader on fox news, the august cheerleading network and that is not what makes one qualified to be a cabinet secretary or secretary of defense and the fact that trump thinks it is appropriate is dangerous for our national security. it is
10:44 pm
bad enough that you have kristi gnome who has surreal experience with the border or homeland security being a governor from south dakota heading up our department of homeland security, now you have a fox news host that has his finger on the nuclear weapons. it is very dangerous. >> when you think about the selection as secretary of defense in the context of the wall street journal reporting, what do you think? that reporting is that they are working on a potential draft of a executive order that will give a warrior board the power to remove senior three and four star officers. that is a draft but that is the context here and you have now the secretary of defense with a name on it, pete from fox news. what do you think will happen here with the defense department? >> i think pete is clearly going to do whatever trump wants him to do. trump has made it clear that he is going to
10:45 pm
politicize the entire executive branch. the entire federal government and i am just hearing about this news now, i will have to move in to the executive order more but if it is as you say and you have retired generals selected by pete who is essentially a arm of donald trump to target three and four star generals, who do you think is a first on that list? john kelly, mick raven, mark millie, these are people who have stood up as patriots for our country and confronted and opposed donald trump and this is what trump will do to get revenge and retribution against them and pete is clearly the pawn in trump's scheme to do that. >> as we were speaking there was another development let me share that with you, this is new to me as well. trump just announced that elon musk and the fake will lead the doak as
10:46 pm
elon musk has referred to it the department of government efficiency. it is unclear what that will entail but they will lead it. so i guess on this one take a step back because we do not know much about it other than that, we know he has been talking about it on social media. do you think such a concept being run by somebody from the business world could have the potential to be helpful? >> i think in the abstract, yes. i do think our government needs to be streamlined, we need to make it more effective and more responsive. i do agree with that. the conflicts of interest that elon musk brings to any government job are beyond the pale. how can we be sure that elon musk is not going to be making efficient everything in favor of his own companies? if he is not going to divest or separate himself and we know he will not because
10:47 pm
trump did not do that as president of the united states, how can we be sure that he is acting in the interest of the country and not in the interest of himself? so i think elon musk is a brilliant businessman, i do not think he belongs running our government and that appears to be what he is doing now. >> i appreciate your time and thank you very much as all of this news is coming out, for being with me. i will go straight to the former white house lawyer during trump's first term. obviously we have a conversation planned but i want to give you a chance to respond to this new development. pete name this trump's choice as defense secretary, does it surprise you? >> of course it surprised me. i do not know him well. i know he is a veteran with a distinguished service record and obviously he deserves our
10:48 pm
thanks for that but i think we are seeing, not across the board, you have some excellent and capable people like marco rubio who is qualified to be secretary of state and yes he is conservative and republican but elections have consequences, i think in some of these, it does not get much higher than secretary of defense i guess. in some subsequent nominations i think we are seeing a lot of ronnie james and not many step curries. >> homeland security kristi gnome of course , in the context here of what is at stake, you talk about elections having consequences, this is what the american people voted for to give trump the ability to do this and he is doing this. as you know he often chooses not to be but now he is, he specifically said he is urging trump not to pardon generally six rioters. some of whom threatened to hang mike
10:49 pm
pence. he told the dispatch, i do not think the president should pardon anyone who assaulted a police officer at the capitol on january 6. obviously as i said, the chance is some of the riders will hang mike pence, with you think? trump has said pardon most or all of the january 6 rioters, he called them hostages and he posted that on social media, what you think you will do? >> i do not think anybody in our history has more tarnished the rule of law then donald trump. i do not think it restrains him at all, the concept that he may do it again. i think it is highly possible that he will go forward with the pardons. i would join the choir with the former vice president, i respect him and i know him to be a man with great character. i think this would be a tragic
10:50 pm
event. further the meaning the rule of law to those of us in this country and it is not going to go unseen around the world. this is the type of conduct, that when viewed internationally, makes it impossible to distinguish the u.s. from a third world country or a south american dictatorship. this is lawlessness of the highest order and there is no principled basis for it. i think it would be a very sad event. >> let me ask you about the new york hush money case, i know there is a development there. the judge just announced he is delaying trump's sentencing and he has not decided if he will wipe the conviction away altogether. obviously he has the supreme court's immunity rolling but you say the new
10:51 pm
york governor, kathy a democrat obviously could make a big play here. what is it? >> she could pardon him. i think the judge postponing this and asking for guidance from the prosecution as to how best to reset proceed if at all, kicking the can down the road in a way that does not eliminate the ability of the trump team to appeal these convictions and try to create the perception that there was no legitimacy to the prosecution even though they do have a argument under the law. she could take that all away from the newly elected president by pardoning him. if she pardons him there will be no appeal , no court of appeals to overturn anything. the convictions will be there in history forever with a asterisk saying he was pardoned. >> can i ask one quick thing before we go? in the last
10:52 pm
election it was lock her up and he did not pursue it with hillary clinton. this time he said his critics should be arrested for treason. jim jordan is saying he will not do that but obviously he singled out biden, liz cheney, obama, adam schiff, the generally six committee has people who have engaged in treason. do you think trump will actually target them legally? >> i actually do not, on the other hand , this warrior board sounds like targeting. it sounds very menacing to me. it also seems totally irrelevant because trump already has the power to fire any general he wants. obama fired stanley mcchrystal, truman fired mcarthur. so this is a process
10:53 pm
