>> president biden is kicking off the g-20 summit in brazil, fresh off the announcement that his administration is giving ukraine the green light to strike russia with longer range u.s. weapons. new this morning, president-elect trump weighing in on how exactly he will address the issues at the border. could the military be used? >> and breaking overnight spirit airlines files for bankruptcy just in time for holiday travel. i'm john berman with sara sidner and kate bolduan. it is monday. can you feel the burning? this is cnn cnn news central to see president biden and rio de janeiro at the g20 summit, attending the final international summits of his presidency. >> as he's about to meet with world leaders here in brazil. but it is who's coming next that appears to be the real

focus. a diplomat from a western, from western europe telling politico this the real topic is trump's arrival, adding this about ukraine and beyond trump's impact is incredibly visible there are new ceasefire talks in lebanon. scholz is now calling putin. it's like something powerful just happened and we're starting to see accelerating shock waves across the globe. clearly, trump's promises on ukraine tariffs and the climate already are looming large. cnn's kayla tausche traveling with president biden. joining us now. caleb biden is heading into this summit right now, right after, as i mentioned announcing this, the new position and opening opening things up further for ukraine to strike further into russia. what are you hearing about that today? >> yeah, i figured i would go well, certainly it is a major shift in policy, a significant decision by the biden administration after months of deliberating on whether such a

change would even be effective to allow ukraine to strike targets up to 190 miles away, using those u.s. made long range missiles. and that decision could also greenlight new authorities from the u.k. and france to use their manufactured long range missiles as well into targets into russia. earlier today the principal deputy national security advisor, john finer bristled at the suggestion that the kremlin is saying that this is going to lead to more retaliation and potentially widening of the conflict to involve the united states or nato allies. finer saying earlier today, russia lit the fire and it was russia that upped the ante both with recent aerial attacks on ukraine as well as the recruitment of thousands of north korean troops that they see as an expansion of the war. on its own. now, of course, that is just one of the major conflicts that's going to be discussed here at the g20. russian president vladimir putin declined to attend, even though he's a member of the g20,

because just a few weeks ago, he said that his attendance could disrupt the gathering. there is also the threat that brazil could perhaps arrest him if he set foot on soil here. but of course, as you mentioned, the backdrop to all of this is the fact that in just about two months time, there will be an incoming administration that's going to upend the status quo for these u.s. alliances. and adversarial relationships that are, by their nature, the fabric of the g20. the u.s. has acknowledged that this is not a group of like minded nations that they disagree on quite a few areas. and so already there is jockeying to figure out where there might be more alignment with the trump administration what exactly the incoming president would do. but as we heard from president biden yesterday in the amazon, where he was talking about the progress made on climate, he said no one can undo his legacy. here's what he said in a statement it's no secret that i'm leaving office in january i will have my i will leave my successor and my country in a strong foundation

mass deportations he's promised throughout his campaign. overnight, trump reposted a comment about his plans to declare a national emergency over illegal immigration and use military assets. adding this true exclamation point and the president elect is refusing to back down over his cabinet picks, even as some of the most controversial ones may face an uphill confirmation battle in the senate now, just overnight, trump announced his pick to head the federal communications commission, brendan carr. carr is currently an fcc commissioner and authored a chapter on proposed changes to that agency in the project. 2025. cnn's steve contorno joining us now. what are you learning this morning about both the picks and the potential use of the military for these mass deportations >> donald trump is back in palm beach today where we expect him to continue to build out his cabinet over the weekend. his allies defended his picks and

made the case that donald trump deserves to have the cabinet of his choice. no matter the controversies that are looming over some of these picks, like matt gaetz for attorney general or pete hegseth, his pick for defense secretary. take a listen to what mike mike johnson had to say about the cabinet that trump is currently putting together these are disrupters. >> they are. i think that's by design. any president has the right to name their own cabinet to nominate persons that they think will fulfill their agenda. and the people that that are on this list will do that. they will go into the agencies that they're being asked to lead and they will reform them. these agencies need reform. and i think the vast majority of the american people understand that you can't have status quo appointments in a moment like this his cabinet at a much faster speed than eight years ago, when he was elected in 2016, although there are still some

key jobs that remain unfilled. >> let me walk through a few of them. the treasury secretary, for example commerce secretary labor, housing and urban development, transportation and education education. an interesting one because donald trump has vowed to shutter the department of education. so it will be interesting to see who he puts in that role. of course, he has already taken a number of steps to fill key roles related to immigration. and as you said, sarah donald trump has been threatening to use the military in order to execute some of his plans over the weekend, we learned that that includes potentially declaring a state of emergency that would allow him to use pentagon resources in order to fund his plan i want to ask you about some of the things that have come up, both investigations and accusations that have been metted out at pete hegseth and gaetz. >> where do those investigations and where do those accusations stand at this point >> over the weekend, we learned

that a lawyer for hegseth acknowledged that he paid a woman in a settlement related to a claim about sexual assault. he denies the claim. they also did not share the amounts, but they acknowledged that it was related to an october 2017 incident in which he was accused by this woman of sexual assault. he was never charged. he was not actually even named in the police report that we the police statement that we saw as a suspect however, he was involved in that incident in monterey california, in 2017. trump and his campaign so far is standing by. hegseth in fact, yesterday, karoline leavitt his incoming press secretary defended him in a tweet that she posted on social media and then gaetz, we are told donald trump nomination. even as the questions remain over the contents of an ethics investigation related to alleged sexual misconduct. sarah and there are calls to have that report come out. we

costello, and it was the deal with him that he had struck, saying that he did not sign a deal with the law firm. and costello no longer works there. so that is one of his arguments. the other, he's saying he never received the invoices to pay these bills, so he's going to try to convince a judge of that today. you know, as you say, though, it is one of many legal issues. giuliani is facing as numerous people are coming after him to try to collect millions of dollars. john. yeah. and what's the status of his watches and cars and luxury items and things like that, that he's had to turn over as part of this defamation ruling friday for giuliani to turn over some of his assets to the two georgia election workers. >> and according to his new attorney, in that case, because the ones representing him in that also sought to remove themselves, he said that giuliani had turned over this 1980 mercedes that was once owned by lauren bacall, as well as about two dozen watches. giuliani, though, is in the process of transferring his new

promise may collide now with another one of donald trump's biggest promises carrying out mass deportations of undocumented migrants and could actually force prices to go up rather than come down. so where does that leave us? seeing as meghan has been looking at, this is a question you were kind of diving into to to with a new analysis. what are you finding? >> well, kate, listen no secret americans are fed up with high grocery prices, but mass deportations could make them go even higher. the problem is that these industries are heavily reliant on undocumented workers. and it's simple right? fewer workers means less food and higher prices. let's just look at one example. crop farm workers. the usda found that 41% of the people who work as crop farm workers in the u.s. are unauthorized. i spoke to a farmer in michigan who told me that if there is mass deportations, like what the president elect has proposed, he said it would be devastating to the ag economy because there'd be nobody to pick the crops. but it's not just about farm workers across the entire

food chain you have this issue many sectors have tens of thousands or even hundreds of thousands of unauthorized production, food related wholesale, grocery restaurants, of course, all together, an estimated 1.7 million people who work in the food industry are undocumented take a listen to this warning from chuck conner. he's the ceo of the national council of farmer cooperatives workers, you're not going to have production. >> there's only one way prices are going to go they're going to go dramatically higher and when cows don't get milked, when apples don't get picked, when fruits and vegetables are not harvested, your supply is going to fall, probably fall dramatically. and that only drives prices up. >> now the problem of course, is that high grocery prices are a major frustration for americans. they sent trump back to the white house, but one of his key campaign promises could

make them go higher. >> how much progress has been made, though, in terms of just food prices at the grocery store? >> a surprising amount, actually. so the rate of food inflation, food at home at the supermarkets. look at this skyrocketed north of nightmare for everyone but look how sharply it's come down it's come down to about 1%. it's actually below the overall rate of inflation. now the level of prices, of course, are still very high from all of these price increases but it's certainly moving in the right direction. we could start to see this chart go move in the wrong direction though. if there's mass deportations, especially for food items that require manual labor. >> right. anything that has to be picked like tomatoes or berries or apples also anything involving meat and dairy here, these are jobs that americans do not want to fill these jobs. that's what we've often heard, that is really a very critical point. we heard that again and again is that americans don't want these jobs, that when they're open, they don't take these jobs. and again and again, i heard from industry officials who say they need

massive blowup, musk accused trump advisor and attorney boris epstein of leaking details of trump's transition including personnel picks to the media epstein responded by telling musk that he didn't know what he is talking about. so there's that plus the complicaons and workarounds that trump has for getting people confirmed. cnn's zachary wolffe, the author of cnn's what matters newsletter, is here. with that good morning, sir. >> good morning. you know, usually presidents end up getting their nominees or the ones that they want. every president has 1 or 2 that end up having to withdraw so they don't get those. but you have to go all the way back to the 80s to 1989, to john tower a former senator, to find somebody who was actually defeated on the senate floor so sometimes they will withdraw it's really rare for somebody to actually be defeated. and it was kind of an interesting story for him because he was you know, accused of drinking and, you know, they called it back then womanizing. we would call it sexual harassment

today. but he was undone because the senators who were to confirm him had been drinking with him. interesting story but, you know, especially when you think of matt gaetz today and some of the frustrations with him, you know, from people who are now in the senate. it's a process that really the senators are supposed to have input. so trump wants to get around that. he's talked about this idea of recess appointments. if you look for somebody who's done recess appointments there were three in the since 1900 for cabinet level positions. bill clinton did one for a short time george w. bush and lyndon johnson. other than that, nobody's ever done this. plus, if you start looking at the mechanics of this, the senate would have to take a full ten days off and so would the house in order for trump to get these recess appointments. so basically, all work in washington would have to stop in order for the senate to give up its constitutional right to to have advice and consent. all of this means it's kind of hard to see a recess appointment

system working out because senators, you know, republicans and democrats like to fight with each other senators don't like to give up power and they would have to do that in a very big way for recess appointments generally speaking, senators don't like to give up power. >> the question is, what are they willing to do for donald trump? and we'll find out soon. zach wolf, thank you very much, sarah. all right. joining me now, cnn political commentator karen finney. and cnn senior political commentator scott jennings to discuss some of this. scott, i want to talk about some of these nominations. you have ranked those who could possibly see some serious pushback from republicans in the senate from gaetz to hegseth to gabbard but in reality just how many times do you think republicans may not confirm a trump nomination >> gaetz is the one i put in a separate category. he seems to have the most opposition and you have to remember, some of these senators are simply not tenable. or as susceptible to trump's influence as the others. some of them are retiring, some of them, you

know, have an image of fighting with trump publicly that serves them well. back in their home states. and in the case of gates, some of them have had some long standing problems with him. that predates their time in the senate. so there's a group of senators here obviously, that would be more than the required number to defeat a nomination on the floor, but i think he's a separate category then my next one was rfk. he has some problems, and i do think some conservatives, particularly people who are pro-life, are going to have some issues with this nomination. gabbard and hegseth, i think, come next, she's going to have some worldview issues with some of the more national security hawks in the senate. and hegseth. i still think of that group has the biggest best chance to make it i think there is a lot of merit in his nomination, and i think a secretary of defense who is somewhat closer to the enlisted ranks than we've ever had, might be just what the pentagon needs but going from 4 to 1, that's how i rank them and i know it doesn't happen very often, but i think if if gates

and rfk get to the floor, it's going to be dicey on the votes. but again, i think a president deserves the chance to build the government he wants to build. and i also think the senate deserves a chance to vet those people. and perform their constitutional duties as well. >> karen, the american public have spoken. they've put trump in position. they've put republicans in position. what's your take >> so the president should absolutely nominate whoever he wants and congress should absolutely honor their duty of advise and consent. and they should make sure that the american people have an opportunity to learn as much as we can about all of these nominees. you know trump talked at one point about draining the swamp so where's the transparency? i think we know that part of the reason he's looking for these recess appointments is that there's a lot he doesn't want to have to adjudicate in the public eye. i mean, some of the things that, for example rfk jr.. has said

on a range of topics, and his belief on a range of topics could be quite dangerous. and for hegseth, a question about, you know, president trump during the campaign said he'd want to use american troops potentially against american citizens on american soil. >> would you honor that command should it come from the commander in chief? and so there's any number of questions that i think the administration or the incoming administration recognizes are dangerous. but from a strategic point. let me just say, i mean, i agree with scott that you know, some of these republican senators are going to put up as much concern as democrats. i think democrats should say what they need to say and then get out of the way and let the republicans fight this out, because part of this process, trump has set up so that congress can be the foil if one of these nominees doesn't make it through. i mean, it's a win win for him. either he gets his person or if he doesn't because they fail during a confirmation

waking up last night checking the score. i'm like it's still going on. wait. it's tied, it's tied. this is the source of many of your issues. you're not supposed to be waking up. >> i know, that's why i'm a little. a little bit looking at sports. yeah, it explains a lot. all right. >> multiple issues. >> so for the first time, president biden has authorized ukraine to use long range u.s. weapons inside russian territory. this comes as nearly 50,000 russian. and now north korean troops have been deployed to push ukraine out of russia's kursk region. let's get right to cnn's oren liebermann at the pentagon for this news about this new authorization. now, oren why? >> john, this is something ukraine has been asking for, for months now. part of the reason the biden administration finally made this decision is because they viewed the deployment of up to 10,000 or more north korean troops into russia as an escalation one that merited some sort of response. and this at least in part, is that response allowing ukraine to do what they have wanted to do for months now. ukrainian president volodymyr

zelenskyy, when he was here back in september, even presented president joe biden with a list of targets that he wanted to hit with a long range atacms missiles that have about a 200 or so mile range, allowing them to strike deeper inside russia. biden didn't dismiss it. he didn't reject the idea. but the the agreement was effectively to keep on talking about it. well now that decision has been made of course, the timing can't be ignored here the u.s. is preparing for the inauguration of president-elect donald trump, who has said he would end the war. and he's the only one who can bring the sides together. the u.s. here trying to make sure that if it comes to negotiations and when it comes to negotiations ukraine is in is in as strong a position as possible here. the understanding that these missiles would be used in the kursk region, that is where ukraine conducted a successful counteroffensive and has been holding on to some russian territory there. john. so what could these weapons change in the short period of time before trump's inauguration? >> so russia along with north korea, have deployed about

50,000 troops near that kursk region a fairly small area here. so at least in theory, ukraine can use these missiles and hit some of the important points here weapons depots, ammo depots used as part of this command and control headquarters to try to have an impact here and keep russia from seizing back its territory. the reason that's important is if this comes to negotiations and ukraine has held on to the kursk region it gives them much more leverage as part of those negotiations. now, the transition team for president elect donald trump didn't respond to this report only saying that he is the only one who can bring them together. meanwhile russia called it pouring oil on fire. >> oren liebermann, for us at the pentagon. oren, thank you very much. >> kate, let's talk more about this. joining us right now is cnn chief national security correspondent nick paton walsh and, nick, everyone knows you have spent extensive amount of time reporting from the front lines in ukraine. what do you think in terms of the immediate impact that these new weapons systems can have yeah, i mean, look ultimately this is something that ukraine has wanted for a long time, but now

they have that capacity. >> i don't think there are really enough of these atacms longer range missiles to suddenly, overnight change. ukraine's pretty dire fortunes on the front line at the moment. now they are more precise and they could potentially, as you was suggesting, hit north korean troops building up around kursk but remember, to, ukraine has had longer range drones that have hit deeper inside russia than the atacms can indeed go that are way cheaper and potentially more effective. what i think this announcement does do though, particularly after months of president joe biden delaying delaying, essentially, it's a no until you say yes delaying granting this particular permission despite saying it would be escalatory if he did it is show that this white house and its closing 2 to 3 months is essentially trying to raise the stakes here in what's been a proxy conflict with the kremlin they are less afraid, it seems, to allow this move, which vladimir putin has suggested if ukraine was firing u.s. supplied missiles, it would essentially be nato joining the

conflict in full. so we'll wait to see what the kremlin's full response here indeed is. but it shows, i think president joe biden wanting to give ukraine an upper hand on a battlefield as we see them losing in multiple directions across the eastern front here, potentially ahead of peace talks when trump gets into power, but also to to complicate the u.s .'s position here, to make them more of an aggravation towards the kremlin ahead of what we think is likely to be a softer approach from the incoming trump administration. kate, and let's talk about the impact of that incoming administration because you have a really interesting new analysis out this morning looking at the impact of the second trump presidency in term on the war in ukraine, potentially, and what ukraine's allies are preparing for now. what are you hearing from your sources? >> yeah, i mean it's kind of crazy, really. we've not had a full on trump administration policy announcement in any way shape or form since they won the election, yet it has caused stark shockwaves across the

western alliance that's backing ukraine, specifically the key move we've seen is the german chancellor, olaf scholz really in trouble? a lame duck himself facing elections next year and many analysts say trying to court a quite pro-russian eastern german part of his electorate, he reached out unsolicited to the kremlin head on friday and broke nearly two years worth in which putin hasn't heard from major western leaders directly to essentially sound out diplomacy. he emerged saying that putin's not a changed man. he still feels the same things, but also trying to justify that call as saying that europe needs to be in the room or in conversations with the kremlin. if trump is going to start talking to them more regularly as well. now that has caused french officials to raise eyebrows. certainly open conversation on twitter or x-com from the president of poland, donald tusk, essentially suggesting that the attacks we saw horrific on ukraine over the weekend show that really russia isn't interested in peace and phone calls can't kind of massage

this problem away. i paraphrase there, but signs i think within the western alliance of great anxiety about what trump may indeed bring. and also i think a difference in approach the germans, clearly they're trying to act as the peacemaker for their own domestic reasons that will irritate other parts of a nato alliance that has until now tried to very firmly say they are with ukraine until the end. the atacms, the longer range missiles from the us may be joined by their equivalent from the uk, the storm shadow and the scalp from the french and this, i think, is a western alliance now trying to give ukraine what it possibly can in these vital two months. the big downside, kate, about negotiations or the fact that they're looming is that everyone tries to get in a better place on the battlefield during a war ahead of them. that's what we've been seeing from russia over the past months. it's going to escalate, i think, in the weeks ahead and that's certainly what this new permission from the biden administration hopes to give ukraine, but be in no doubt it's a dire situation

yee haw john. >> all right. this morning, new testimony in the murder trial for daniel penny, accused of manslaughter for the choking death of jordan nealy on a new york city subway. the medical examiner who conducted nealy's autopsy testified she had no doubt nealy died from the compression of his neck. let's get right to cnn's gloria pazmino outside the courthouse. what's expected today? gloria yeah. >> john that piece of testimony from the medical examiner is critical because the defense in daniel penny has tried to argue that jordan nealy did not die of the chokehold, that he died from all these other set of factors that contributed to his death. so the medical examiner's testimony is critical for the prosecution to prove that it was, in fact, this choke hold. and the amount of pressure that daniel penny applied to jordan nealy's neck that killed him. now, the medical examiner remains on the stand this morning. she will be crossed by the defense team.

and then we are expecting the state to rest its case then it will be up to the witnesses. and we are expecting the defense team for daniel penny to begin calling character witnesses. these are going to be witnesses who are going to speak about daniel penny that what daniel penny was trying to do was protect people that were riding on the subway who were afraid of jordan nealy and who felt that their lives were in danger. some witnesses have testified to that effect. we're also expecting to hear from a psychiatric expert who will talk about whether or not jordan nealy's use of k2, which was found in his body following the autopsy, had anything to do with the way this incident unfolded. over the next few days, we expect to hear more expert t
