seeing the police report at the center of a sexual assault allegation against pete hegseth. >> he is the fox news host that donald trump has selected to be the next defense secretary of the united states. the 22 page report was released by the city attorney's office of monterey, california in response to a public records request. in it, there are new details and conflicting accounts of what happened in a hotel room seven years ago. a california woman, california woman telling police then she was sexually assaulted. pete hegseth was never charged with a crime and he denies the allegations. what is said in this report, though, is graphic and troubling and they are also now those details in the hands of all of the senators who are going to have to decide on whether or not pete hegseth should get this huge job that he's picked for. he's headed to the hill today for meetings with vp elect jd vance at his side. sara murray

has much more from this police report. as you were able to obtain this police report, sara, what does it say? yeah. >> kate, it really lays out these competing narratives of what went on this night in october of 2017, in california, surrounding a republican women's conference. >> so i want to get to the woman's account first. she's not named in this report. she's referred to as jane doe. you know she says in the report that hegseth was giving off a creeper vibe around the conference. you know, she says that she ended up in a hotel room that was unfamiliar to her and says hegseth allegedly took her phone from her hands. he went on to block the door with his body she alleges, and she went on to say she remembers saying no. a lot. now there are conflicting accounts about what led up to this moment she says that there were a lot of parts she couldn't remember, and someone may have slipped something into her drink but there are other witnesses that investigators talked to who said the woman did not seem to be inebriated. she seemed to be in control. there are also

conflicting accounts of how she encountered hegseth out in public at a bar at the hotel where other conference attendees were. one person said she showed up to be a crotch blocker because hegseth was hitting on another woman. another conference attendee said she and another woman appeared to be flirting with hegseth. at any rate incident in the hotel room, jane doe does go to the hospital. she has a rape kit exam and the nurse then reports this to authorities. now this is a very different version of events than what hegseth provides. when investigators contact him, he describes this as completely consensual incident of sexual intercourse. he says there was always conversation and always consensual conduct. he said that she showed up in his hotel room. he thought it was a little odd that she stayed there, but this sort of began this intimate interaction with them. now they had a conversation because jane doe is married and she apparently tells hegseth again, according to his account, that she's just

going to tell her husband that she had fallen asleep on a couch in someone else's room and he went on to tell investigators that she showed early signs of regret. although he didn't say what that was. now, as you pointed out, hegseth has not been charged with a crime in any of this. i talked to his attorney last night, timothy parlatore, who said this police report confirms what i've said all along that the incident was fully investigated and police found the allegations to be false, which is why no charges were filed. now, kate, we have to note that the police report does not say that they found all charges to be false. there were no charges filed in this case, and we don't have an answer for why the district attorney decided not to proceed with charges. there is additional evidence surrounding this case, including surveillance footage that has not been made publicly available, and authorities have cited state law saying they're not going to release it. and the same is true for a memo that the d.a. office wrote. that may give us a better indication of why charges were not brought. we should also note that cnn did encounter this woman. we contacted the

woman known here as jane doe last week but when our team, you know, showed up, she broke down in tears. kate. >> sara murray, thank you for your reporting as always, sara. we appreciate it. john thanks. >> all right. so our friend maggie haberman has been reporting over the last several days that the allegations about hegseth came as a surprise to the trump team. the settlement was confidential and did not appear as part of the vetting. still hegseth will be on capitol hill today, shepherded by vice president elect jd vance. they will be meeting with republican senators. alayna treene is with us for the latest on this. so what's the plan? >> well, what we've really seen happen behind the scenes, john, is they have tasked jd vance, the vp elect, with being, as you mentioned, this unofficial sherpa for some of donald trump's saw him do that yesterday while he kind of paraded matt gaetz through the senate to meet with

key people who are going to be involved in his confirmation process. and today, he'll do the same with pete hegseth. now, i do want to address as well that, um the what maggie haberman reported, we have reported as well. i mean, they were definitely caught off guard by some of these allegations. it did not come up in some of the vetting. and remember, he decided on hegseth, donald trump very quickly he called him up to mar-a-lago met with him. and then very soon after quickly announced that he was going to be his pick for the department of defense. and so we're kind of seeing all of that fallout play out now, and we're going to see it, i think, in fresh detail and with new eyes today, when he's confronted by different republican senators who have deep concerns and uneasiness about hegseth, like they did about matt gaetz. now, i do also, though, want to expand on what we're learning about jd vance, because one thing that's been very clear, and i've heard this from several people, several of my sources and other reporters, is where two weeks? we've seen a lot of

elon musk. we've seen a lot of rfk jr.. we've seen a lot of these kind of unlikely allies become this ensemble around donald trump in the public eye. jd vance really, we saw emerge as the first time on capitol hill in public. and really, we're starting to learn and we just have fresh reporting on this on what he has been tasked directly by donald trump to do. and that is to be his point person on capitol hill. donald trump has asked jd vance directly to really ensure that his policy priorities on capitol hill, his agenda is passed and that the senate, as well as the house, do not get in his way particularly given that republicans now have the majority in both in both chambers. now, of course, that also relates to these cabinet picks. and then behind the scenes as well, though i think it's interesting to note that he hasn't been totally absent either. he has been in essentially every single transition meeting, i'm told, along with donald trump jr., donald trump's eldest son, as well as elon musk, he has been weighing in on key decisions. he was a key voice in tom homan being the border czar, as well as tulsi gabbard being named

the intelligence director. so there's a lot going on behind the scenes, but it is notable that he hasn't really been out there on television like others now as for what he did yesterday with matt gaetz we heard matt gaetz himself address some of the concerns around him. i want you to take a listen to what he told reporters for the hearing folks have been very supportive. >> they've been saying, we're going to get a fair process for the ethics committee. >> they said they're not going to release the report after their meeting today, at least at this point. >> any response? >> i'll be honest with you. i've been focused on what we got to do to reform the department of justice now john, there's two key things, i think to keep in mind here one is how republican senators who are going to be confirming him really feel about this and whether they will get on board. >> and donald trump is successful in lobbying him. but the other thing to keep in mind is that donald trump is digging in on matt gaetz he has not moved away from this despite all of the controversy around him he believes matt gaetz is

interview with with cnn's christiane amanpour, told her broke the news that he was going to be searching for arrest warrants for yoav gallant for benjamin netanyahu and also for the three principal palestinian hamas figures. yahya sinwar mohammed deif, the military commander, as well. and ismail haniyeh, all those understand now to be dead. so it is interesting why the icc is is issuing an arrest warrant for mohammed deif. that is remarkably unclear at this time but what is very, very clear is is the language and the pushback that's been given by israeli officials now going back to may, what the icc said they were going to request arrest warrants for netanyahu and galant for crimes against humanity and war crimes and specifically there they were talking about knowingly and intentionally withholding water, food and medicines from

are warning parts of the state. cnn's derek van dam is joining us. he's tracking all of this for us. derek, what are you seeing? >> yeah, that's right. kate. so when these bomb cyclones form off the pacific northwest, they have the ability to draw in the moisture from the pacific ocean and transport it thousands of miles to the coastline. and this is what we're experiencing across north central california. check this out. santa rosa, california, dealing with flooded roadways. there have already been reports of over a dozen small terrain across this region. and guess what? it's going to continue before things improve into early parts of next week. you can track this tropical moisture all the way back towards the state of hawaii. we call that the pineapple express. and there it is. the moisture train that's going to send that torrent of rain continuing into northern and central california. in fact, we've got this rare high risk from the weather prediction center of excessive rain could lead to flash flooding. i bring this up because if we go back a

couple of months ago when hurricane helene was on its approach towards western north carolina, a rare high risk was in place. remember, 40% of all flood related deaths 80% of flood related, um uh, damage comes out of these rare, high risk situations. so here it is, very active radar, just rain continuing to slam the same locations. and then there's been concerns about the wind. remember how much damage we had in and around the puget sound yesterday from this bomb cyclone? well, there's still wind advisories, so not as powerful as what we experienced over the past 48 hours. but nonetheless, it will be gusty as another storm system approaches and starts to deepen and strengthen this won't be a bomb cyclone per se, but it will still bring more misery to the west coast that's already been hit hard with feet of snow in the higher elevations and over a foot of rain in the forecast for those areas that i just mentioned, eureka into north central california so a tough go for these locations. check out these snowfall

presidential candidate nikki haley becoming the latest voice slamming former congresswoman tulsi gabbard. >> president elect donald trump's pick for director of national intelligence >> department. department of national intelligence. this is not a place for a russian iranian syrian, chinese sympathizer. after russia invaded ukraine. tulsi gabbard literally blamed nato our western alliance is russia cnn's katie bow is joining me now. >> katie bow, you've got some new reporting for us on gabbard's history of really being at odds with the agencies that she could soon lead. what are you learning? >> yeah sarah, what's really fascinating about gabbard is that if confirmed, she will be perhaps the most markedly or most publicly anti-surveillance official to ever lead the part of the u.s. government that is tasked with doing surveillance on foreign entities in 2020.

back when she was still a democrat and she was in congress, she introduced a series of bills that would have been pretty profoundly antithetical to how the intelligence community thinks. two of them were aimed at persuading the government to drop its prosecution of edward snowden, the former national security agency contractor who revealed the collection of americans data back in 2013. as well as of julian assange, the founder of wikileaks. both of these men are seen really as as as almost enemies of the state within the intelligence community, even as they've attracted some support from kind of the the sort of libertarian wing of the republican party, as well as some progressives in the democratic party. gabbard also in 2020, introduced this piece of legislation that would have wholesale repealed one of the most powerful surveillance authorities that the u.s. government has to spy on foreigners overseas, something called section 702 of the foreign intelligence

legislation that has drawn some criticism from civil liberties advocates who say that it impinges on americans data privacy as well. but to wholesale repeal it without replacing it would be tantamount, according to some former u.s. intelligence blinding commander in chief. this is an authority under which, as much as half of what's known as the president's daily brief is drawn from every day. so whether or not gabbard as as dni would be able to actually kind of dismantle this program unilaterally, probably a really logistical task, really logistically difficult task that would face a lot of pushback. but it really speaks to this kind of profound distrust that she has in the intelligence community and the people that collect intelligence on foreign entities and in ways that the way the intelligence community gathers and spies. it gathers information and spies on american adversaries. sarah. >> all right. katie lillis, thank you for that reporting, john. >> all right. with us now christine quinn, executive committee chair of the new york state democratic committee and

president and ceo of win and shermichael singleton cnn political commentator and republican strategist. i want to go back to the news that broke overnight about pete hegseth the details inside this police report of this incident, this alleged sexual assault that happened, a few years ago. the details of which he denies. but i want to read a wall street journal editorial. this is from the editorial board of the wall street journal. the rupert murdoch owned wall street journal. this was yesterday, before the details of the police report came out. it said mr. hegseth denies wrongdoing, but the senators holding confirmation hearings next year also might inquire about what if anything, he told mr. trump's transition team regarding the woman's claim and the legal settlement. whoever leads the pentagon needs to have the president's trust. if mr. trump wasn't informed about this political liability before announcing the nomination he might reasonably wonder what else mr. hegseth hasn't told him. shermichael what about that well look, the wall street journal is owned by rupert

murdoch. >> i mean, this is certainly not a small editorial from the editorial board. and i would imagine the president elect is probably aware of it. >> i mean, it is important if you're advising the president elect, you're on the transition team, part of the process is to vet some of the individuals that he would like to consider. >> and it is important this early on to try to protect the principle as much as possible. he just had a great election, a great election victory. republicans won across the board and objectively speaking, john, you want to be able to hit the ground running hard with that significant amount of report and the mandate that many republicans would argue that the president elect has, particularly for the first 90 days, to try to move the needle on some consequential issues. so the question becomes, if you're an advisor, how much political capital would you like for the president elect to expend on some controversial picks? he's not the first person to nominate individuals that have had some controversy in their past. and so i think the question is, when you're doing that negotiation with

some of those republican senators, you have to give them the opportunity to question these individuals. and the individuals obviously have the right. i would argue, to defend themselves against some of the claims and allegations out there but again, this early on, is this what you want the focus to be? and ultimately the president elect is going to have to make that that decision. >> christine i mean, it shows a number of things one, that the vetting has been terrible because as i understand it, there are police reports out there that this wasn't deeply hidden information. >> two, it shows that the candidate is not being honest with the trump transition team. and if he's not being honest about something like this what else is he lying about? now we aren't just talking about controversy. here. we are potentially talking about a crime a crime that has a victim associated with it who allegedly has been deeply traumatized and, and, and hurt by this terrible criminal act. so how can you put someone like who may have done that in

kind of like the horrible hits that keep coming out of the transition team and the appointments. i mean the report should be fully released. what's going to happen now is we're going to get dribs and drabs leaked out. the republicans are going to focus on the fact that they were leaked versus the content of them. but what we see and what we know now one, the republicans are aiding in a cover up. and two, gaetz has clearly engaged himself in illegal activity and more and more it points to illegal activity with minors. >> again, he was not charged for any illegal activity. the justice department decided not to charge him for that. there is an ethics committee report that we may not see shermichael and is there an argument at this point that there is information that senators who will decide whether he should be attorney general information they shouldn't have look, i think republican senators are probably going to figure out a way to work with their

city of dnipro sparking claims that the kremlin used an intercontinental ballistic missile or what's known as an icbm. that type has significantly longer ranges than others. now, a western official says the weapon was a ballistic missile but not an icbm still, this is likely the first missile of its kind to be fired in this war that has so far lasted more than 1000 days. joining us now with more insight, cnn military analyst general mark hertling. there is obviously conflicting information here. ukraine saying it's an icbm. western nations saying they don't think that's what it is. if if russia did launch an icbm, what is the significance of using this particular weapon? is it that it is designed to deliver a nuclear warhead well icbms are designed to deliver all kinds of warheads sara. >> both nuclear chemical, high explosive and what the most important thing is is it has a

range most recent advances of providing ukraine with things like the storm shadow from the uk and the atacms from the united states hitting bases within russia, what russia has just said is we want a longer range. we want to stand off weaponry. but in seeing the films this morning, if it was an icbm, sarah, it also has the potential for what's called a mirved warhead mirv multiple independently released vehicles retargetable vehicles. excuse me, that means that one missile can launch a bunch of different missiles. and by my count, watching the film that you just showed, there were six launches at six different locations from that one film. so if that was an icbm, they were using a mirved warhead multiple explosive devices coming out of the warhead, which is what a nuclear weapon does. but over a much larger period. so both of

those things are concerning to me. the distance as well as the potential for multiple vehicles. and it just shows that every time the united states is helping ukraine to up the ante with with ability to strike inside of russia, russia is just moving their forces and their capabilities back further from the front line. >> what is the big worry here? because, you know, after president biden allowed the use of long range missiles from ukraine into russia russia then in turn changed its policy, which now lowers the bar for when nuclear weapons can be used. what do you think we are seeing here? is this the escalation that the biden administration feared it could be, but it also is the potential and i've said this all along, as you know there's always the fear of russia using tactical nuclear weapons and that was most recently pointed out in bob woodward's book when

ambassador where cia director burns stated openly that they had evidence and spies that were saying they were thinking about using them. >> it's been all along the capability of russia to use nuclear weapons. small yield, tactical nuclear but a tactical nuke is still a nuke and it still causes a spiral of development in nuclear warfare. and that's something the biden administration has been attempting and been very careful to mitigate the risk about. so yeah, those are all things that are part of this. but the other thing is the fact that russia keeps threatening new things in a war that's continuing on and, you know, you got to either call the bluff or make sure you do something about it. >> i do want to ask you about some announcements. we've been talking a lot about the different announcements for trump nominees. and one of those now is matthew whitaker who he has picked to be u.s. ambassador to nato. what do you make of this pick? and do you

feel like it's one of those ones that sort of flying under the radar? >> yeah, i was going to use under the cover, but but you're right, it is flying under the radar because matt whitaker, who's been on cnn multiple times, he's a lawyer. he served in the in congress. he was a former football player at at in a division one school. i think it was iowa. i'm not sure he's a somewhat normal guy, but the fact of the matter is he's being appointed to what, in my opinion, is probably the most important ambassadorship nato, because an ambassador in a normal country talks with the president of that country. does some, you know, messaging for the united states. but the ambassador to nato takes votes as part of the 32 member nato council. so this is an individual who would be basically sharing information with 32 other countries in europe. and with the turmoil in europe right now, not just in ukraine, but in other countries, that nato ambassador becomes very important and they have to know detailed military

the stock price nosedive 22%. cnn's vanessa yurkovich is with us now. like. >> oh, no no, no. >> people did not like this news from target. they reported really weak sales in the third quarter. and they said that they expect be flat. this is the holiday shopping season. this is usually when retailers are raking in the cash. and as you mentioned, investors absolutely really took a nosedive down 20% for most of the day and this is really because of two reasons. the first reason is target is saying that their consumer is being and you see that nosedive right there just right off the cliff. you see the consumer is essentially being more discretionary with their spending. so they're not buying things like furniture and candles and pillows. they're really focusing on everyday essentials groceries and they're looking for these items at lower cost. the second thing is that they target is seeing their consumer base shift. i want you to listen to an analyst i spoke to yesterday,

joseph feldman, who talked about this very strong bellwether for the consumer especially that middle to upper income consumer. >> and with the flattish type sales, that kind of fits in with the narrative that we're hearing now. the consumer has been resilient. the consumer is focused on newness and innovation. and when there's some differentiation with the product, they're spending. target saw all of that, right. >> so where are these shoppers going if not to target they're going to walmart. they're going to tj maxx. they're going to marshalls who all reported really strong. third quarters. and walmart in particular offers the lowest prices of any retailer, according to our friend joseph feldman there. and it's interesting that about 75% of the gains that walmart saw were from households making $100,000 or more. that is the target customer. so over the holiday season, target's going to be running a ton of promotions, sales trying to bring those customers back in.
