joins us now. >> a lot going on here. whitney, what are police saying about other possible charges here well, they're declining to give many more details beyond saying that there's a potential obstruction charge here. >> they were reluctant to go into any potential federal charges but they did say that there could be some restitution here, john. and when you think about how long it took them to do this search was seven weeks. they were using high end equipment. it was a lot of overtime. i mean, they are thinking this could be between 35 and $40,000 at least, and that doesn't even include the cost that a nonprofit incurred when it tried to help search for him in green lake, which, by the way, is the deepest lake in wisconsin which police say is why he chose that particular location. so, you know john, there are many more open questions here and what they keep saying is that it is very clear he's reluctant to come back to the u.s. and so they're continuing to push on his heartstrings. we'll see if that works to bring him home.

east coast, a live look at capitol hill on this friday morning. we made it to the end of another very busy week. good morning everyone. i'm kasie hunt, it's wonderful to have you with us. it has been just over two weeks since donald trump won the presidential election he's already on his second pick for attorney general. trump named pam bondi to replace matt gaetz after gaetz withdrew from consideration yesterday after growing bipartisan pressure to release a house ethics report into him investigating sexual misconduct and illicit drug use holy i didn't see that coming gaetz spent time on capitol hill earlier this week trying to lobby for his own confirmation. but on thursday morning trump called gaetz to tell him that he didn't have the votes in the senate to be confirmed. according to a source with direct knowledge of the call. by early afternoon, gaetz posted on social media, quote, it is clear that my confirmation was unfairly

becoming a distraction to the critical work of the trump-vance transition it was made clear that there's not a path and if there's not a path, you just you're going to spend a lot of political capital for a losing cause, and it wouldn't have been worth it. >> i know enough people that were hell no in the in the conference to know that the path would have been very very difficult if possible, even then, i doubt it was. >> just hours after gaetz's announcement, trump revealed his new pick for florida's former attorney general pam bondi. bondi is a supporter of the president elect, has close ties to trump's incoming chief of staff, susie wiles, and to his advisor boris epstein white house, you know what's going to happen. >> the department of justice, the prosecutors will be prosecuted. the bad ones, the investigators will be investigated because the deep state last term for president trump, they were hiding in the shadows, but now they have a spotlight on them and they can

all be investigated. >> joining us now to discuss washington correspondent for spectrum news in new york juan kevin fry. kevin. good morning. good morning. wonderful to see you. happy friday. yes on this friday we are already dealing with the the switch here from the trump team. the other piece of this of course, my colleague paula reid here was about to report that the ethics committee had looked at a second allegation of matt gaetz having potentially sexual misconduct with a minor, a 17 year old, but clearly system to bear. what does it tell you that they actually were willing to pull saying, you know, trump is all in no matter what? it shows that there are still some guardrails in washington, but the question is, are they are these is this such an extraordinary situation that this is one place where the guardrails, you know, flew up as opposed to some of the other

nominees? will they be as willing to perhaps buck this one? that's one of the extraordinary questions here because gaetz checks so many obscure boxes. one, obviously, the ongoing ethics probe, but also he's just not necessarily well liked by some of his colleagues. many of his colleagues on capitol hill because of his flame throwing nature, because he ousted kevin mccarthy, or at least was one of the leading proponents of that so there was a lot going against gaetz to begin with that maybe don't read too much into the guardrails that were put up. let's talk briefly about pam bondi trump's choice. i mean she is someone who had filed lawsuits, you know, worked on lawsuits on his behalf in the wake of the 2020 election. she is has been a trump loyalist. now, that said, unlike gaetz, who while gaetz was an attorney had really not practiced law, she was the attorney general of florida what is your initial sense of whether of what her confirmation prospects are? it seems that there is certainly much better just because she checks more of the boxes that that republicans would be comfortable looking for. i mean, you saw mitch mcconnell saying it was appropriate that

gaetz stepped aside. he was certainly one of those that clearly was not on board with this nomination. seems he would probably be more palatable to this one. senator lindsey graham coming out and basically calling her a rock star, and that this was an olympic gold medal sort of pick. i mean she does do one thing that gaetz doesn't, which is one she comes with experience, but she still has all the loyalty tests that she passed on behalf of trump, which is obviously a key part of his selection process. let's talk about pete hegseth, who is, of course the choice to be defense secretary yesterday, actually, around this time overnight, we received the police report into an incident involving allegations of sexual assault in monterey, california. right now, hegseth has claimed claims that he was cleared of wrongdoing. that's not what the police report says. there was a settlement. he did end up paying money saying, you know, the idea being he was concerned about his job at fox news. but senator kevin cramer, who has obviously been a voice on a lot of this, on the on the hill,

talked a little bit about hegseth you know, chances as hegseth himself was making the rounds on capitol hill. let's watch what cramer said. >> it's a pretty big problem given that we have you know, we have we have a sexual assault problem in our military that a number of us and certainly the champions being kirsten gillibrand and joni ernst. but i've been on board legislation to deal with it since the since the chain of command was not. i'm not going to prejudge them but yeah, it's a pretty concerning accusation. >> and of course trump world reportedly taken by surprise by this accusation. what is what happened with gaetz? what we're seeing with hegseth say about the chances for his nomination going forward. i mean, there's like two kind of thought processes here. one is that this shows that the senate, as we mentioned earlier, is willing to buck trump when the opportunity presents itself and stand up. those guardrails. at the same time, there's also the question of, okay, we've done it once. how frequently do we want to expend our own political capital crossing trump? um this early on in the

administration and thus go ahead with trying to block him. but as cramer was just pointing at senator joni ernst, probably going to be a problem for her we'll see exactly as this proceeds and as we get more information about this police report, and it's more deeply looked into. but obviously she, along with senator gillibrand and others, have been outspoken in pursuing and going after sexual assault in the military. so this is a prime issue for key members that could be decisive. right. and again, trying to count to four if, if if you're counting to four on the republican side, you got a major problem and if you've got susan collins, lisa murkowski potentially joni ernst, the question becomes who are the other ones? right. okay. kevin fry for us on this friday. kevin, thanks for starting us off today appreciate it. all right. straight ahead here on cnn this morning elon musk continuing to pal around with donald trump. now he's picking a fight with a fellow billionaire. plus trump's pick to lead the pentagon makes his case to gop senators amid those sexual assault allegations and the world's top war crimes court issues arrest warrants

it a decision of the court of justice but obviously the icc not accepted the same way by everyone. >> no. so many countries, over 100 countries have signed up to it, including the main ones in europe and the uk and the eu have both said they would respect this decision, which essentially means that they would feel a requirement to arrest netanyahu, for example, if he big moment but they are saying it's a separate legal matter. they would just living up to the court that they signed up to the u.s. and israel are not signed up to this court. so when mr. netanyahu talks about not recognizing this decision, it's not really in his place to be able to recognize it because he's not signed up to the court and he wouldn't be carrying out the arrests. but there's some, you know, some fury. i think, in parts of america and certainly in israel, that there's an equivalence here being given to

really distinctly different from what we have seen in the past. what does what happened with gaetz, what's happening with hegseth say about where this is all headed? >> well, i think the president elect has chosen to massively pressure test the system both to see whether republicans in the senate how far they're willing to go to align with him politically and to push back against him. >> and also, we're seeing him stress test the institutions, because in many of these cases, the people that he's nominated, um kind of directly confront the orthodoxy of the institutions. and i think, um you know, we're we're it's going to be very tempting. okay. matt gaetz is out of the picture now pam bondi is the nominee. pete hegseth future is unclear. it's going to be very tempting to follow the story about the individual nominees, but i think what connects the dots here is president elect

trump and the policies that he wants to pursue. and the idea that he's interested, um in political loyalists for, for a lot of these jobs and loyalists that have taken on the institutions, i think in this particular case, i'm also looking at female representation in the senate, because i think one of the big concerns in the u.s. military that has nothing to do directly with sort of readiness or force posture or, you know, all that, but just the culture of the military is that for women in the military, uh pre all of this, there have been long standing concerns about whether, um whether their safety in these sort of, um i don't know, like sexual safety situations. right. >> like, what is the internal mechanism? sexual assault out of the chain of command of the military, which, of course some changes were made. they were spearheaded by kirsten gillibrand and by joni ernst, who is a republican. i mean, and to your point, i mean, the question is, can they count to four, right? in terms of opposing one of these nominees? i am interested in kind of the

ago, and it does accuse linda mcmahon and her husband, vince mcmahon and the wwe and its parent company of essentially allowing a to exist within their professional wrestling organization in the 1980s and prey upon underage boys who were being used at that time as ring boys. so this dates back to the time when there was an announcer with the wwe, then the wwf called mel phillips, and that man he is now dead, but he is accused of abusing boys and having fetishes toward them, something that even federal investigators ultimately ended up looking into. the big question here is what did linda mcmahon know when she was the ceo of the wwe, and when did she know it? >> at some point in time in the late 80s, 1988? >> linda and vince mcmahon, they fired mel phillips and then they brought him back to the company about six months later. >> and so now, because the

state of maryland has changed its laws about when you can bring child abuse lawsuits, there are anonymous former ring boys who are suing mcmahon. the mcmahons, both of them, as well as the company claiming that there was negligence there that they knew and allowed this person, mel phillips, to continue to exist within the wwe. now there are a lot of things left to happen in this court case. >> it is something that was filed just in october, but we already have a statement from the attorney for linda mcmahon. this is laura brevetti, she said in a statement that the civil lawsuit is based upon 30 plus year old allegations and filled with scurrilous lies, exaggerations and misrepresentations regarding linda mcmahon and that she will vigorously defend against this baseless lawsuit and without doubt, ultimately succeed. vince mcmahon's lawyer has also put out a statement previously saying these

when she was a surrogate for mitt romney when he was running for the republican nomination. what can you tell us about her? about her evolution and most importantly, what it would mean for her to be at the top of the department of justice considering what president trump former president trump, has said he wants to do with the department? >> well yeah, first, it had several cases against her with miss bondi way back in the day when she was a lying prosecutor first and foremost, she's a prosecutor she's a good trial attorney formidable in a courtroom, quite honestly. >> now, as an attorney general, she's not going to show up in a criminal courtroom very often. but she does have that ability that style and that presence i think, is going to serve her very well as the attorney general. >> so, mark what how would you say her experience stacks up for the job that she has been nominated for? because there have been sort of two parallel

tracks here as we've been trying to cover trump's nominees for these positions. some of them have very problematic personal issues. matt gaetz is a good example. the one who, you know, who obviously just was pulled to make way for bondi, but the other is questions about, okay, what experience do you bring to the job? does it line up with the types of experience that others have brought to the job in the past? how does bondi's experience stack up for in terms of others who have also been attorneys general of the united states? >> well, if you compare it to the most recent nominee, matt gaetz, they are worlds apart. matt gaetz, i don't think, had any experience in a courtroom, no real trial experience. and although trial experience in and of itself isn't necessary for the job, the idea of being comfortable in a courtroom and presenting yourself it has become pretty apparent not only when she was a prosecutor over in hillsborough county, but since that she has a great presence. and after all, the attorney general job is sort of just that. so i think she compared it to gaetz also comparing to some of the other

nominees for the other positions she has the pedigree. she truly does because she's again been in a courtroom, presents very well. i think she's going to be an easy nominee approval by the congress because she doesn't have some of the downside. it seems that people like matt gaetz may have brought into it. so i think it's going to be a prettyshe's going to be an easy choice to be approved mark, one of the other things that bondi did in her court in the course of her time working on behalf of donald trump was lawsuits related to the said about who won that election, namely that joe biden didn't win the election, that donald trump did. >> let's play a little bit of a few of the things that she said in the course of that and i'll ask you about it on this side watch. >> we are still on the ground in pennsylvania. i'm here right

now and we are not going anywhere until they declare that we won pennsylvania. we know that ballots have been were found early on. we've heard that people were receiving ballots that that were dead. you know, the thing that's happening all over, were they legal ballots? it is about the integrity of this election. and every vote as mayor giuliani said, in every state must be counted fairly. we need to fix this. we need to remedy this now because we've won vote to be counted in a fair way so of course, we know that donald trump did not win pennsylvania in 2020. >> what does her role here have? what kind of implications does it have going forward? if general well, again, i've had problems and troubles with the election deniers just because of my view of it from a not a political but from a legal standpoint. >> everything we've looked at and seemed as though the election was properly done. and yes, it is somewhat problematic. generally speaking, that any

candidate, attorney general or any other cabinet member who still maintains this concern. but let's face it she is sort of also preaching to the choir of who is now going to be our next president. that was always the position of donald trump. it's never going to change from that. i find it concerning because the attorney general is the lead of the not only the department of justice, but when you hear about the justice system in america, you think about the attorney general has to be trusted. it has to be believed, has to be respected so that we know that we can place our trust. every one of us can place our trust in her and therefore place our trust in the criminal justice system so a little bit troubling, and i'm hopeful that she's going to move forward as an attorney general, not just as a continued election denier because it is problematic for the trust in the system. >> yeah, trust, trust in the system, of course, being the key one of one of these foundational things we've all just been grappling with as a country for the last, i guess, going on a decade now since
