you with us. we are hearing for the first time from the man whose search captivated the nation, 26 year old luigi mangione, the alleged killer fighting extradition back to new york, where he faces five charges, including second degree murder. these are new images from the moments before he was captured inside a mcdonald's. he was eating a hash brown mangione was in court in pennsylvania yesterday where he was denied bail on his way in, he shared this message. whoa, whoa, back up. >> and clearly out of touch and insult the intelligence of the american people and the experience. >> mangione is expected to insist on his innocence. according to his lawyer, he is pleading not guilty. >> i haven't seen any evidence that says that he's the shooter. so that's, you know, like i like i said earlier and i wasn't kidding around. a couple of things. if you're going to report something, report it accurately. and

remember and this is not just a small thing, the fundamental, uh, concept of american justice is a presumption of innocence. and until you're proven guilty beyond a reasonable doubt. and i've seen zero evidence at this point. >> so here is the evidence. the police say they do have. they have recovered several handwritten pages of a notebook that contains a to do list. in one passage about the unabomber, mangione writes that using a bomb against his intended victim, quote, could kill innocents in a shooting would be more targeted. mangione writing, what would be better than to quote, kill the ceo at his own? bean? counting? conference? end quote. friends say mangione suffered from debilitating back pain after recent surgery. the suspect posting his spine x rays on his social media. police are examining that procedure and its aftermath closely. >> he was posting an x ray on his social media, showing numerous screws being inserted

into his spine. some of the writings that he had, he was discussing the difficulty of sustaining that injury. so we're looking into whether or not the insurance industry either denied a claim from him or didn't help him out to the fullest extent. he knew that this conference was taking place at that time. >> the new york times reporting that mangione mother filed a missing persons report on her son in san francisco on november 18th. that was just weeks before the december 4th shooting. joining us now to discuss. cnn legal analyst, criminal defense attorney joey jackson. joey, good morning to you. let's start with that angry outburst from the suspect as he was being taken into that courthouse. what did you make of of what he said and the legal strategy that his team is taking at this point? >> yeah. >> casey, good morning to you. first, as to what he said, generally speaking, in prosecutions, the motivation as to why someone did something is

not anything the prosecution needs to prove. now, inquiring minds always want to know. but motive you don't have to show. you just have to show you did it. in this case, i think motivation is going to be significant. significant in terms of evidentiary value. what do i mean? you see his rant there. you obviously see that he has an ax to grind. speaking about an insult to the american people. et cetera. clearly, he had issues with the health care system in the country. a lot of people do. don't take it to this extent. but what i make of that is that all of his issues. right. his manifesto, his thought process, his grievances will come out in the event that this went to trial. in terms of the defense strategy. his attorney, casey, is saying he hasn't seen the evidence. i think it's a play on words. there certainly seems to be mounting evidence suggesting that it was him. right. in terms of the evidence found at the actual mcdonald's,

right on his person between the laptop, the gun, the fake id, the evidence certainly secured here, the backpack. et cetera. dna evidence. so the evidence looks like it's plentiful. it's just that his attorneys saying he hasn't yet seen it. and there, of course, is a discovery process wherein the attorney who represents a particular defendant will have access and be given all that information. let's see if his attorney changes his tune. once he sees and evaluates what we all are hearing and learning in public right now. >> joey, the other piece of this, of course, is that they are fighting extradition from pennsylvania, where he's currently being held, to new york, where he is being charged. what is the impact of that fight, and what do you read into the decision to fight extradition yeah. >> so, casey, extradition, of course, is the process where in a charging state that is new york, he's wanted for murder here. and of course, possession

of a firearm, et cetera. that charging state seeks to get the particular person who we're looking at there into their custody and jurisdiction. he's now in pennsylvania. you have a right. if you're a criminal defendant, to either waive extradition, meaning you're not going to fight, you're going to come back to the charging state or you're going to fight extradition. he has a right to do that. he's going to do that. but it's a very uphill battle. casey. here's why. number one, all you have to show if you're the charging state new york, is that the actual warrant is facially sufficient. what that means in english is that there are no defects. it's written and drafted properly. number two, in terms of what it says is probable cause to believe you wanted for specific crimes. and number three, that it is you. right? it's most probably you. and so as long as you meet those standards, you're going. and so you have a right, no doubt to fight extradition. he's doing that now. it could be because he doesn't want to be at rikers island. right.

right away. rikers island, of course, is the prison in new york city that is widely known. or it just could be that he just intends to fight this tooth and nail. in any event, in that process, the judge has given him two weeks, his attorney, to put together a petition. and it takes generally about 30 days for the charging state to come get you. after that's all said and done, so you can fight. but the realities are there are limited defenses, and he's coming to new york. the only question is when. >> all right, joey jackson starting us off this morning with the latest on this, which has of course captivated so many people. joey, thanks very much. i really appreciate it. of course. all right. straight ahead here on cnn this morning, new wrinkle in the rapidly changing middle east israel expands airstrikes in syria just days after the fall of the assad regime. plus, the latest on pete hegseth is momentum starting to swing his way as he, in his quest to lead the pentagon and how republicans plan to put trump's agenda

prevent, quote, strategic military capabilities left by the syrian military, end quote, from falling into the hands of extremists elena kagan we have no intention of interfering in syria's internal affairs. >> however, we do intend to do what is necessary for our society. we want to have relations with the new regime in syria. but if this regime allows iran to reestablish itself in syria or allows the transfer of iranian weapons or weapons of any kind to hezbollah or to attack us, we will respond forcefully and we will exact a heavy price. >> several arab states are accusing israel of taking advantage of the fluid situation in syria to take over more land. joining us now, cnn international anchor max foster. max, some pretty remarkable developments here. this, of course, along the border between these two states. what do you think the significance is of them not just seizing this demilitarized area, but putting troops on the

ground beyond it? >> yeah. so we'll have to see, you know, what the longer term plan is? if troops have gone beyond the demilitarized zone, that obviously raised concerns that they were heading towards damascus and israel denies that. we don't exactly know the strategy of what those ground forces are going to do, but you would expect them to try to, you know, really enforce the demilitarized zone. that buffer zone. but it's more a concern if they have wider plans for other parts of syria. you know, is it a land grab? not quite yet. they're basically taking out all the installations that could be used against them in their view. obviously, iran had a huge presence in syria, as did hezbollah. and, you know, some of these rebel groups are manned with extremists from the past, jihadis from the past. how are they going to use those assets? i just don't think israel is taking any chances here, but it is seen by many, as you know, a raid on that country's sovereignty, even though the politics is in chaos right now. >> right. well, i mean, we should note, you know, the the

americans have also expressed concern about the presence of chemical weapons, which obviously, the international community widely condemns the use and holding of and of those falling into the wrong hands. so definitely an element there as well. max, we also just have this this just crossed here from us because we're apparently hearing from the syrian rebel leader now, and he seems to be trying to assure the international community that they won't engage in the kind of conflict that actually, you heard benjamin netanyahu warn about. so this is what he said, quote, the fear. and this is mohammad al-julani, who is, of course, the leader of this group that's taken over the us does call them a terrorist group. there's no apparent intention to remove that designation. according according to john kirby, in the last 24 hours or so. but here's what jilani said the fear was from the presence of the regime. the regime is now gone. the country is moving toward development and reconstruction. it's going towards stability, he says. people are exhausted from the war. the country is not ready

for another one. it's not going to get into another one. and then he says this quote, the source of our fears was from the iranian militias, hezbollah and the regime which committed the massacres we are seeing today. so he seems to be sending a message. i mean, you heard netanyahu say there you start arming hezbollah and iran, then we're going to have a problem. he seems to be trying to say that he doesn't want to have a problem. >> yeah, but who is he speaking for? i mean, there's so many different rebel groups. he's obviously the leader of the main rebel group, and he's become very much the face of this insurgence, really, in the country that ousted the regime. so it's just not, you know, how much of what he says is actually going to turn into truth. i mean, there's a huge amount of hope behind him. there's so many people that genuinely feel liberated in the country. but at some point we expect there to be some sort of election. will he emerge as the leader of that country, or will someone else emerge as the leader of that country? it's very difficult to to see what's going to happen. i think we're only going to really know in a few months time at the very earliest, how this government will shake out

the winds have decreased somewhat from what they were yesterday at this time. they'll increase. this is very typical with santa ana wind events. they kind of peak right around daybreak. and then we anticipate some improving conditions later today and certainly into the day tomorrow. i'll tell you why. 0% containment with this. we have topped the 3000 acre mark. and this has threatened additional structures in and around the malibu region. we still have our red flag warnings in place for much of southern california, including los angeles county and ventura county. even stretching further south into the greater san diego region. the winds, though you'll notice, will change. you can see just some winds into the northern interior mountains, but really relaxing towards the coastline. and then there's this. even though it's very dry, we're talking bone dry conditions still this morning. that's why the fire threat remains. notice the green entering into this equation. this is an increase in the cloud cover. increase in the moisture in the atmosphere. we need that especially when we're talking about fighting this fire. so there is a cold

hegseth nomination for defense secretary appeared to be in jeopardy just a week ago, amid mounting allegations of sexual assault, alcohol abuse and financial mismanagement at veterans groups. but republican senators are signaling that there is growing support for his bid the accusations about mismanaging money and about non-consensual behavior. >> if they come forward, i will listen to those accusations, but they have to be credible and they have to be presented in a fashion that pete can rebut. so he's much better off this week than he was last week. >> today, hegseth will lobby for more support as he meets with three senators, including republican moderate republican susan collins of maine. that meeting will come just a day after hegseth chat with lisa murkowski, another moderate who had been viewed as a potential speed bump to his nomination after their meeting. murkowski wasn't a yes publicly, but she didn't oppose his nomination either.

>> i had a good exchange with mr. hegseth. >> are you ready to support him? >> i had a good exchange, and we'll see what the process bears. >> we'll see. joining us now to talk about all this and more, john bresnahan, the co-founder of punchbowl news, says, no one i'd rather talk to about what's been going down on the hill here. hegseth does seem to have basically saved his own skin here. how do you understand what's played out for the moment? >> i mean, he's not. >> he's not out of trouble. >> i mean, and he's not necessarily going to be confirmed. >> i think he will be. >> but, you know, he's going to have a public hearing, um, more could come out now, remember, hegseth, the the allegation of sexual assault, hague said, paid a settlement in this case in 2023 to resolve this case that could there could still be more information on this issue.

>> so i would say hegseth has definitely stopped the deterioration. i mean, last week it looked like he was done. i mean, we were chasing rumors that, you know, trump was going to pull him. there were reports that trump was maybe, possibly going to offer florida governor ron desantis the nomination. there were other names being floated this week. definitely after some intense pressure from, you know, trump allies on these senators. it looks like things have stabilized for hegseth. he's not going to be pulled. he's not going to be pulled now. but that doesn't mean his confirmation is a lock yet. >> yeah. breeze. marc caputo wrote this about joni ernst because she obviously was kind of the focus of a lot of this. he was meeting with her. she was doing interviews on fox, almost seeming to look for other allies who might oppose him. and they wrote this shortly. ernst after ernst offered a chilly reception to pete hegseth nomination to head the department of defense, she recognized she was in trouble politically with grassroots

republicans calling for her head. how do i make this go away? a flabbergasted ernst said to an intermediary, according to a top donald trump adviser who received the message. ernst, chuckling, underscored the choice facing 53 republican senators in the weeks ahead. board the trump train or get tied to the tracks. how do you read all that? >> yeah, ernst was an interesting situation because she did have an early meeting with hegseth. she made some comments that were negative about it, and then there was a huge pushback. i'm not sure i would go as far as like, you know, there were threats to her or anything. i mean, ernst has been very loyal to trump. she's been very she spent the final week of the campaign on the bus tour for trump. she's been at mar-a-lago. she was floated as a possible defense secretary. so. but her comments caught a lot of people by surprise. uh, in her after initial meeting. so she had a second meeting with hegseth,

and then she put out a statement that did not endorse him, but walked all the way up to the line. and that was a big moment because there is an issue of women senators, republican women senators, and how do they treat hegseth and the sexual assault allegations? and it's especially key for ernst because, one, she's a military veteran who served in war zones, served in iraq and kuwait, and she's a survivor of sexual assault herself. so ernst is a critical figure in this. and having these two meetings, having her comments, having the pressure that's put on her, this is everybody's watching this. everybody inside the senate republican conference is watching this and seeing how far trump was going to go. and the second part of this was, you know, trump pulled matt gaetz. was he going to pull pete hegseth? and it doesn't look like that's going to happen. >> yeah. let's also talk about the house, because obviously this incredibly razor thin majority that republicans have, it's going to get more narrow.

and there are big questions going forward. i was talking to one republican member who said that they've never seen the house so tied to one man in donald trump, basically like trying to peer read into every single thing he's doing, saying on truth social to try to figure out what he wants them to do. but there's a couple of potential flash points here, one of which is the ndaa, the must pass defense bill. it includes a massive raise for junior enlisted troops and a whole bunch of other things. but it also includes a pretty controversial piece about transgender children who are covered by military health insurance. and this is what you guys write this morning in punchbowl. the two parties and the two chambers have clashed over topline defense spending and culture war provisions, complicating the final talks. a last minute intervention by speaker mike johnson, barring gender affirming care for the children of military families, has upset democrats, as well as

some republicans. it's the 118th congress. you know, where everything is dumber and takes longer than expected as a more general point, what what do you make of this? is it going to go through yeah, that vote is this afternoon. >> it's going to go through this is this is the annual defense authorization bill. this has been passed every year by congress since the cold war, since 1961. so this is a big deal. congress is one of the few things that actually happens on a partisan basis. now, this is not the money side. this is the policy side of defense spending, which is a huge deal. and it authorizes an enormous sum of money. we're talking about $895 billion. it's just fantastic amount of money, um, far more than any other country spends on defense. this issue on the transgender, the gender affirming care for military dependents for children of military service, families, uh, it was johnson insisted that it be included in the ndaa and even the house armed services

committee chairman, the republican mike rogers, wasn't consulted on it. he wasn't told about it. we quote him in the story. he says, you know, i wasn't told. i wasn't asked, you know, rogers actually is supporting johnson's view. he doesn't like this policy at all. but he wanted trump to take care of this. when trump was sworn in. and on january 20th, arguing that the ndaa, like we try to keep it bipartisan, we try to to to swat away the things on the left and the right, try to, you know, play it straight that both sides can support it. and we get big bipartisan votes right for the yeah, it's too important to play around and then you know but this was an issue that, you know it's complicating it. it will pass. it's going to be a little tough for democrats to swallow. i don't know if a majority of house democrats will vote for it. it'll pass. it'll go to the senate next week and pass. but this left a bad taste in everybody's mouth that johnson would do this. and it's clearly about his own speaker vote in january. this is about him and his own policy and his

what you saw as as we watched that and what what it all means for syrians as they honestly wrestle with it's very unclear how the government is ultimately going to form here yeah. >> these are the joyous first days that we've seen before when dictators are toppled. as i was watching clarissa's report, i was thinking about the first images we got of marcos palace in the philippines, or what happened when saddam was ousted and you saw people take up residence inside his palaces as well. and, you know, these are the moments of greatest hope, right? and unfortunately, we have frequently seen these go awry later on as rebel groups that are terrific at toppling brutal governments. then go try

to struggle with the question of how do you govern? and that's the big issue that we're facing now, because the core rebel group here is a former al qaeda affiliate. they broke a number of years ago with al qaeda. they say all the right things about building institutions, being inclusive, making sure that minority rights are respected. but we're about to discover whether or not they mean any of that and whether or not you can install such a organized governmental system. not even a perfect democracy, but just a working government in a place that has been stifled by repression for 50 years. >> david, one of the things that i noticed in that piece, of course, and clarissa pointed it out, was the iranian flag to be stepped on as people were to walk in there. and you write this in your most recent piece, that the two urgent and related questions circulating through washington just six weeks before the inauguration is

first, will the rebels evict the iranians and the russians from syrian territory as some of their leaders have threatened or out of pragmatism? will they seek some kind of accommodation with the two powers that helped kill them in this civil war? and will the iranians, weakened by the loss of hamas, hezbollah? and now mr. al assad, conclude their best path is to open a new negotiation with mr. trump only months after sending hitmen to kill him? or, alternatively, will they race for a nuclear bomb, the weapon that some iranians view as their last line of defense in a new era of. vulnerability? how how does all of this tie together? >> well, we're about to go find out. so let's break these down into the pieces. the first is the russians. they have two big military bases in syria. one of them is their only real military port outside of russia, and gives them access to the mediterranean. and the other is an airbase that they

use to go mount attacks in defense of assad. when he was alive. so, you know, now the question, casey, is, do the russians get to stay? they've already made it clear they're going to try to build a relationship with these new rebels. they desperately need this. and the united states has a very strong interest in seeing them evicted. so when president elect trump turned out his tweet the other day saying, we have no dogs in this fight, you know, stay out. well, we do have one that has to do with with the russians. and then there's iran, which of course has been the biggest sponsor and used syria as a funnel through here. obviously, they are going to get evicted by this group. but the question is then how do they react? there's been some indication they may be interested in talking to the new administration, but that may be just to try to slow them down. there's also a lot of talk in iran that everything else has
