to cross into canada after allegedly cutting off her ankle monitor. i'm sarah simon. with john berman and kate baldwin. this is cnn news central a nation facing tragedy again. >> a community once again shattered. this morning we are learning new details on the investigation into what would drive a 15 year old girl to open fire, attack and kill at her own school yesterday morning. the madison, wisconsin police chief will be joining us, will be a guest in just a moment. and before that, we are also standing by to learn more about the victims here. two victims killed at this k through 12 school. so far, we know one was a teacher and one was a student. at least six other people were injured, two of them students who were in critical condition with life threatening injuries. as of the last update. we're standing by

for more of that this morning. also this morning, police say that the shooter's parents are cooperating and that they are, of course, still searching for a motive, a possible but unverified manifesto out there in surfacing. and we are hearing heartbreaking and heart wrenching stories from the children who survived this tragedy. some seen fleeing the scene just in christmas pajamas. police say it was a second grader who first called 911. oh, we heard them and then some people started crying. >> and then we just waited until the police came. and then they escorted us out. i was scared. >> why did they do that? >> that's what i was getting ready for lunch. so it was basically lunch time. and then i just heard sobbing and there was a teacher and she was screaming like, oh, my leg! >> help, help! >> can you imagine recounting that as she's just standing

there innocently holding a little spongebob ice cream? that's what she's dealing with today. yesterday's attack was the 83rd school shooting this year, the most in a single year since cnn began tracking in 2008. cnn's whitney wild is in madison for us. and you were there since the beginning. i heard you at that press conference. many of the press conferences, it's easy for people to become numb as it happens so often, but it is something we must refuse to do. it is horrific hearing the stories coming out of what these children lived through, and those who have passed. kate, it is an awful day. >> yesterday will continue to be awful days for the families affected by this. this community at the abundant life christian school. but moving forward, kate, the big the big questions that they're trying to answer, at least law enforcement is trying to answer is why this happened. that is a question they have not yet been able to answer. we do have more details about who did this. this is 15 year old natalie

rupnow. according to law enforcement, she went by samantha by the afternoon and early evening, we learned that police were able to execute a search warrant at her home and establish contact with her parents. here's what madison police chief shawn barnes said about her parents cooperation. >> we are certainly speaking and talking with the parents who are cooperating to determine if they were gun owners and if they had guns, but at this time, again, we're still talking with them. it's been a long conversation. we appreciate them cooperating with the investigation kate, this all started at 10:57 a.m. >> yesterday. police say that this happened in a study hall with a with a group of students from mixed grades. kate, i'll leave you with this. this was a gut wrenching detail. we learned that the person who called 911 from inside that building was just in second grade. kate whitney, thank you

so much for the update, john. >> all right. with us now is madison, wisconsin police chief shawn barnes. you saw him right there. chief, thank you so much for being with us. i know it's been a long and excruciating 24 hour period for you. we heard from you late last night. any updates on the investigation this morning no updates on the investigation this morning. >> we do have a briefing this morning around noon. our time central standard time. our officers, detectives and crime scene investigators have really been working late into the night. we gave them a break this early this morning. and so we'll come back early today. we'll start to process things and try to put together a timeline of samantha's last hours before she went to school. >> there were cameras inside the school. have you had a chance to look at the footage yet i have not had an opportunity to look at the footage. >> i spent most of my day

working with the media, making sure that our community understood what happened, trying to be transparent with our community, talking to the media. my briefings were basically virtual with some of our command staff, but a lot of questions still need to be answered, and we're committed to getting the answers to those questions for our community so we can move forward and heal. >> the handgun that was used in the shooting. what have you learned about who owned it and how it was obtained by the shooter? >> we have asked our partners with the atf to expedite what's called an atf trace form, to try to determine the origin of that weapon, who purchased it, and how it got from a manufacturer all the way into the hands of a 15 year old girl. these are questions that's going to take some time to answer, and we fully intend. we're fully committed to getting the answer to that. i do not believe that 15 year olds should have access to

weapons that they can bring to school, and potentially hurt someone. we really have to do a better job, not only in our communities, but in our country, with making sure that our young folks do not have access to weapons and firearms, and certainly making sure that we're paying attention to the mental health of our children. there's a lot of work that we need to do so that we cannot be having these conversations again and again and again on cnn and other news outlets. >> was the weapon owned or possessed by the parents i'm not certain at this time. still not certain at this time. at this time, you as of last night, you were still questioning the parents at this time, any reason to expect that they could be charged with any sort of crime here? >> well, we will certainly look at all facts and aspects of this case as they were voluntarily giving information.

that certainly helps to determine, you know, if they were involved or if they were. this was pre-planned. we don't have any evidence that it was. but we also want to look at if the parents may have been negligent. and that's a question that we'll have to answer with our district attorney's office. but at this time, it does not appear to be the case. we will get a briefing again today, but we want to make sure that that people know. that's a question that people have been asking me, but quite frankly, i don't want to speculate on that right now. >> i understand you say no evidence that it was pre-planned. we had reporting last night that after looking at social media posts and writings and whatnot, there was some thinking that this shooter had some kind of notion this was going to happen beforehand. what's the latest you can tell us about that? >> yeah, we have been made aware of a manifesto, if you want to call that or some type of letter that's been posted

by someone who alleged to be her friend. we haven't been able to locate that person yet, but that's something we're going to work on today. we'll also be looking through her effects. if she had a computer or cell phone to see if there are any transmissions between her and someone else, and that will give us an idea of what type of planning. when i spoke earlier, i was talking about pre-planning where her parents may have been involved, speaking to that question, but whether or not okay. >> yeah. okay. good. i understand that. thank you so much. absolutely. thank you so much for that clarification, chief. you have been and we were talking to other law enforcement officials last night. one of the things they kept on saying was how extraordinary your release of information was over the last 24 hour period, how helpful it's been to the public, the families, everyone involved here. you've been very forthcoming with information, any new information about those who were wounded or hurt in this attack. >> we know that. two that were that had non-life threatening injuries were released from the

hospital last night. that's a good thing. we know that two are still in very critical condition, and so we're praying that they will will pull through. and so we'll be keeping an eye on that. and if something changes we'll let you know. but you know, we do try to be as transparent as we as we can. we have an amazing public information officer, and she works very hard to make sure that we get information out early and often. i think we had four press conferences yesterday within the span of about ten hours, and we think that that's the way law enforcement should go. we should get information out because this is a tremendous process and hope. and hopefully today we can start the process of determining why this happened so we can heal and move forward. >> were there individuals specifically targeted in this attack? any information that the two deceased were singled out? >> we don't know. we know that one of the deceased was a substitute teacher, so we don't know if there would be a

security spokesman john kirby talked to our john berman last night and said that officials are following up on about 100 of those sightings, but they have combed through most of the 5000. >> after days and days now of forensics work, analysis, detection work and looking at the tips that came in. and our assessment is that these drones represent lawful legal commercial, hobbyist drones, even law enforcement drones. i can't rule out the fact that we might find some sort of illegal or criminal activity, some nefarious activity. all i can do is tell you that right now we see none of that joining us now is the mayor of montvale, new jersey. >> mayor mike ghassali, thank you so much for being here. you heard what john kirby said there. what did you think of that? and does it allay any of your fears at all good morning. >> unfortunately not. >> we had a briefing yesterday with the white house fbi, dhs,

faa, and they said the same thing. i don't want to speculate, but someone is making a really bad decision by not coming clean and saying that these are our drones. we're doing some sort of an operation. nothing to see here. they are safe. they're saying they're safe, but we see them on top of our reservoir. the schools, the grid and these are large drones. these are not small drones. these are probably car sized small dining room table size, flying at night with lights on. um, and our residents, my residents are saying, you know, why are they over the reservoir where it's all fenced in? we can't even go there. that's where we drink from. that's where our fear is. >> so i hear that the concerns and the fears of the residents. have you yourself witnessed some of these very large drones? because there are a lot of things flying in the sky. and you heard from kirby that of the 5000 tips that they have gotten, they have combed through all of them and determined that the vast

majority of them are are legal, are either law enforcement or are hobbyists who just happen to have drones up in the air so montville is on the path to teterboro airport, and we see small planes every single day. >> and i'd say 90 to 95% of what is reported are, you know, small planes going to teterboro. the ones i've seen the last time was about three days ago. there were two and then became three, and they were flying in sync in a pattern, as if they were being operated by a computer, not by a person. yesterday we had rain. we didn't see nothing the day before. they said they were seen with lights and then the lights were off. well, they go behind the cloud and and they disappear behind the clouds. so they think that they just disappeared. but i did see three, three days ago was the last time i saw in our town. >> you initially called for military intervention. has any of what you have learned changed your stance on your

call to to bring in the military to try and determine what is going on above the skies of new jersey? >> i think listening to them yesterday speak, someone knows something. these are not foreign. uh, drones. they're not coming from the sea. these are operated by. again, i don't want to speculate, but these are operated by us. uh, i don't think we need to shoot them down. you know, my fear is that they have a payload. we don't know what's in the payload. if they do have a payload. uh, but no, i think someone has to come clean and say, you know, folks, nothing to see here. these are our drones, and they're safe. let's let's move on. >> when you say our drones, are you saying that these you think are government drones or something else? >> you know, deep inside, i think these are our own drones. there's some sort of an operation being uh, you know, secret operation that we don't know and we don't want to know, but just let us know that

i want to be the greatest player that i could possibly become clarke reed hurry, hurry so this morning, the woman who kicked off a weeks long saga after she snuck past airport security and then stowed away on a delta flight from new york to paris. >> you remember all of this? this all happened last month. she is now back in custody after trying to essentially stow away again. this time trying to jump a bus to canada. and that is where cnn's mark morales picks up for us. what has happened, mark? >> well, the now she has to get back to new york, right? so she's in buffalo. she's going to be appearing before a judge. and now they have to bring her back. u.s. marshals will take her back, and she'll be appearing back in new york. and this is going to be a very clear escalation of what happened. because if you remember, when she appeared in court in brooklyn, they let her go. it was she was released without bail. but now she's

going to be charged with bail jumping, and she's looking at a maximum of five years in prison because she had there was with that no bail. >> there was a long list of conditions. i think everyone can understand one of the conditions would be don't cut off your ankle monitor. right? >> right. >> basically violated almost all of those conditions. she cut off the ankle monitor. they realized this once. her roommate, who she was staying with in philadelphia, found the ankle monitor on the floor without her, called authorities. and then they were looking for her. and that's when they realized she was on the bus before she got into the canadian border and on the bus with no ticket. well, i think she had a ticket. >> a ticket for this bus. >> right, right, right, right. but it was. but she had none of that documentation. she was also not allowed to leave the designated area where she was. and it's potentially a sad story because there's also some questions about mental health, because she was designated for some sort of treatment. so now it's what happens to her. what happens to this case now? >> and a lot of questions of of why and what happens next is

>> donald trump's transition team is blasting a judge's ruling that the president elect does not have presidential immunity in the new york hush money case. a jury found trump guilty of 34 felony counts back in may for falsifying business records to cover up payments to adult film star stormy daniels, but after his conviction, the supreme court ruled the presidents have broad immunity from prosecution for official acts which caused the court to postpone, for example, the sentencing indefinitely. now, new york judge juan merchan has decided the conviction stands because the evidence that led to trump's conviction was not related to his official conduct as president. cnn's kara scannell is joining us now. how did the judge come to this? this, um, decision. you know, you were there for the trial. you watched all of it. you watched as one person after the other took the stand. how did he get here? >> so he goes through this evidence, the evidence that trump's team is challenging

and saying that testimony from white house aides like hope hicks and madeleine westerhout and trump's tweets when he was in the oval office were all official evidence and should never come into the trial. >> based on the supreme court's ruling back in july. and the judge walks through all of this. and ultimately, he concludes that this case was about a private matter. it was about hush money paid to a porn star and the cover up that followed. and he said it is logical and reasonable to conclude that any communications about that were also personal and unofficial. so that's the bottom line here. he goes on to say, the court concludes that if error occurred regarding the introduction of the challenged evidence, such error was harmless in light of the overwhelming evidence of guilt. so he is saying that even if there were any mistakes, it doesn't matter because there was just so much evidence that the prosecution had proven their case. and so therefore he's saying this conviction stands and he's not dismissing it. >> what happens now? i mean, could there be a sentencing of donald trump before he goes

into office or even when he's in office? >> it's possible he could get sentenced before inauguration day. trump's team still has another motion to dismiss teed up that one is focused on that, saying that the da's office and the judge can't move forward because trump is president elect and any ongoing litigation would interfere in his decision making, you know, even like hanging over his head. and the da's office is saying that that is not the case. they're challenging this. the judge will have to decide that first. and trump's team is also teeing up a motion to dismiss based on some juror misconduct. we don't know what that is yet. we might learn the details today or tomorrow that is expected to be made public at some point. so there are two ongoing motions. but lawyers i've spoken to have said that there really is nothing to stop judge merchan from sentencing trump before election day. the da makes that argument, and in one of the da's filings, they even say that the judge, because trump is a first time offender based on the crime that he was convicted of, he doesn't have to be sent to jail. so for that reason, they're saying there's also that's just another reason why he could sentence him before

the inauguration. it would tie it up and a sentencing would be final judgment, which would mean that trump would be a convicted felon, even if he goes on to appeal it. >> kara scannell, interesting developments there. thank you so much. appreciate it. john. >> all right. breaking overnight, a bomb hidden in an electric scooter killed a russian general who was wanted by ukraine for using chemical weapons. lieutenant general igor kirillov was the chief of russia's nuclear, biological and chemical protection forces. the explosion was just four miles from the kremlin. we've got cnn's fred pleitgen live in moscow with the very latest. good morning, fred hi there. >> good morning john. >> we're actually live at the scene where all of this happened. and you're absolutely right. lieutenant general igor kirillov is certainly one of the highest ranking russian military members who was killed outside of the battlefields in and around ukraine. and you can see behind me that the investigative committees are still very much working. the scene in the area has been widely cordoned off. it has been so since the early morning

hours since we got here, and it was in the early morning hours that general kirillov and an aide left that entrance that you see over there, where you see those investigators there right now. and then apparently there was a bomb inside of an electric scooter that was planted there that went off as the two left that building, killing both of them instantly. the russians are saying it was about 300g of tnt that was inside that bomb. there was also a lot of shrapnel, which obviously caused severe injuries in effect leading to their death. you can see now that the investigative committee has parked two vans over there, seemingly trying to block the vision for us and obviously other people as well. those were not there before. and just to give you an idea about how powerful this blast actually was, 300g of tnt doesn't sound like very much. but if we pan over there, we can see that in the adjacent building on the other side of the street, even several floors up, there are windows that have been shattered by the power of this explosion. as you can imagine, john, the russians are absolutely furious about this. there's been russian politicians who have come out.

a position here this morning to give out a whole lot more information about it. >> totally understand that kirillov, this man, he's been sanctioned by the uk for the way it was described. abhorrent use of inhumane chemical weapons on the battlefield in ukraine. the biden administration sanctioned russia in may for chemical weapons use against ukrainian forces. what does it mean to have this man off the battlefield, so to speak, into this ongoing war well, again, i want to be careful not to speak to this particular event, but writ large. >> it is without question that the russian military has committed atrocities on the ukrainian people, that the russian military, with orders from on high, have have used chemical weapons and other agents to kill, to maim, to hurt the ukrainian people and ukrainian soldiers and all of that is being documented so that russia can be properly held to account. what we're going to be focused on here is making sure that we continue to provide ukraine with the weapons and the material they

need to succeed on the battlefield and to continue to push the russian forces back taking a big left turn here and something else under your purview right now, john, i want to i want to ask you more about this drone mystery that has continued. >> you say that currently these drones do not pose any sort of threat. the way i heard you say it is, you assess their their commercial, lawful drones, law enforcement drones, hobbyist drones, as is what people are seeing. nothing anomalous, no criminal activity detected. yet. the mayor of montville, new jersey was just on with us, and he essentially says he does not believe that. let me play this for you but someone is making a really bad decision by not coming clean and say that these are our drones. >> we're doing some sort of an operation. nothing to see here. they are safe and what the mayor is talking about is these are our drones. >> is he saying these are government drones? he is not happy with the response that

he's been essentially getting from you guys. what do you say well, i would repeat what we've said yesterday and last night in a multiple agency statement that we have taken a serious look at this. >> we have gone through 5000 some odd sightings. we have added detection capabilities to the region. we've even sent up visual observers and everything we're seeing to date. our assessment tells us that these are commercial drones, hobbyist drones or law enforcement drones all operating legally and lawfully. i mean, when people shoot video of that, kate, i mean, there you're seeing the lights on these things, the navigation lights, that's what's required. if you're going to be flying in u.s. airspace at night, our navigation lights. so clearly they're being operated in a lawful and legal way. and we've seen nothing from their behavior, nothing that tells us there's a public safety threat or a national security threat. i do want to add one point, though. we've still got about 100 leads that the fbi is following up on. and if we

learn something that contradicts that or something more, something additional, something more specific, my goodness, we're going to come public and we're going to talk about it. we have been trying to be as transparent with with the american people as we can, but i think it's also important to remember that there are a million drones registered with the faa and thousands upon thousands fly in u.s. airspace legally every single day, including in the northeast corridor. in fact, that's one of the busiest areas. >> it's very true. so, john, do you think this has been blown out of proportion i wouldn't say that, kate. >> no, i mean, look, people are right to see see these things and be concerned about it. i mean, i think what you're seeing honestly, is the huge ecosystem of drones now really coming to light. i mean, maybe people just didn't appreciate how many of these things are flying in u.s. airspace every single day, and it's only going to get more. there's the numbers are only going to increase as the utility of

these drones for commercial and law enforcement purposes, in particular, become apparent. and that's why we're calling for more authorities from congress. we need some legislative authorities to deal with the gaps and seams that exist between state officials and the federal government in how we manage this, manage this airspace, which is only going to get more crowded. >> yeah, we're actually going to have an expert on to talk about, which is a huge gap being exposed of how advanced technology is here and the laws with regarding all of it. yesterday, i want to circle back to ukraine. john, the yesterday the president elect criticized the biden administration authorizing ukraine striking further into russia that authorization to use u.s. weapons to strike further into russia. the way he put it is i don't think they should have allowed it, and certainly not just weeks before i take over. why would they do that without asking me what i thought? if that move was decided before the election, which i've heard you say, why didn't you announce it before the election? >> it was. it was decided

before the election. it was decided in response to the north korean soldiers, which we deemed and the ukrainians rightly deemed as an escalation by russia. and the reason we didn't come on out and announce it right away is because we wanted to give the ukrainians a little bit of the element of surprise for their ability to start using these weapons without the russians knowing they were coming. i mean, it doesn't make a whole lot of sense if you're going to allow them a new capability like that to then go out and announce it so the russians can be prepared for it and start moving their stuff around. so we didn't announce it right away for good operational security reasons. there was no effort to obfuscate or block anybody or keep anything out. and as soon as the president elect won and he named some people on his transition team in the national security space, well, my goodness, you know, we started having conversations with them and we kept them apprized of the decisions that we were making, what we had done, why we had done it. >> it's great to get that clarity. i will say, maintaining the element of surprise is something that we heard from the president elect over and over again in that press conference, that's for sure. john kirby, thank you so

tech giants, these leaders of these tech giants going down to florida to meet with donald trump. and it is something that donald trump is not only welcoming but touting. and we heard him do that yesterday during that news conference. i want you to take a listen to what he said. >> i had dinner with sort of almost all of them, and the rest are coming. and this is one of the big differences, i think, between we were talking about it before. one of the big differences between the first term and the first term, everybody was fighting me in this term. everybody wants to be my friend. i don't know my personality changed or something. >> now, kate, it's not just the way that these different leaders are treating donald trump, but we know from our reporting, following these meetings that donald trump is also treating them with a much more friendly, friendlier tone as well. i remind you that during his first term, and really in the years after he had left the white house, donald trump had a very hostile relationship with many of these leaders. take mark zuckerberg,

for example. i mean, they were at odds repeatedly throughout his first term. donald trump blaming mark zuckerberg, but also many of these other tech giants for what he believed were censorship of conservatives and also largely blamed a lot of these leaders for his election loss. so this is very much a departure from the relationships we know that he had with these different leaders. back during his first administration. but one thing i also just want to get into more of is that meeting with tiktok ceo chao chao chen yesterday afternoon at mar a lago, because it's very notable, given the timing of all of this. we know that tiktok, just hours before that meeting, had asked the supreme court to weigh in on the law that congress passed last year that would essentially force it to sell its parent company or divest from its parent company by january 19th. this is something donald trump has said that he is going to look into. he also said that he is warming to tiktok because he believes that young voters helped him with his election. so that is very much a meeting to keep an eye on as we report out what

exactly was discussed yesterday. >> kate alayna treene, thank you elena. really appreciate it. john. yeah. >> elena just scooped us right there. let's play what president elect trump said about tiktok we'll take a look at tiktok. >> you know, i have a warm spot in my heart for tiktok because i won youth by 34 points. and there are those that say that tiktok has something to do with that. >> so not for nothing. it turns out that if you look at the exit polls, kamala harris won, you know, 18 to 34 year olds by about 11 points. but that aside, let's talk about the issue with tiktok. with us now is democratic congressman from illinois, raja krishnamoorthi. congressman, thank you so much. you are the ranking member on the intelligence committee, which obviously, or you're part of this committee that that passed this bill here, which effectively bans tiktok after january 19th. so what about donald trump's warm spot? can he use that to stop

the tiktok ban no. >> but what he can do is he can help to get bytedance and tiktok to comply with the law. save tiktok by actually having bytedance still sell tiktok. that is what the law requires, and that's what they should do. now, all three branches of government have validated the law, including a very ideologically diverse set of jurists on the d.c. circuit court of appeals last week. and so it's time to move on. the clock is ticking. it's time for bytedance to sell tiktok again. >> that needs to happen by january 19th, or it's not allowed on platforms, is my understanding. the d.c. federal appeals court said that congress, you know, lawfully passed this. the supreme court has a chance to weigh in. what do you hope the supreme court does? >> i hope and expect the supreme court is going to uphold the d.c. circuit court of appeals. and remember, the d.c. circuit court of appeals again denied a stay of their

ruling. and so, again, i just think that we want tiktok u.s.a. to survive. i think that a lot of people enjoy the content on tiktok. but now it's time for bytedance, which is controlled by the ccp, the chinese communist party, to divest itself of tiktok and allow it to continue to thrive. >> so this is a little confusing when we talk about bytedance and we talk about tiktok and we talk about stays, and this is and that's what happens on january 19th, if nothing changes, if no court steps in to shift anything, if no one sells anything, what happens on january 19th? >> well, right now millions of people have tiktok on their phones. but apple and google, for instance, will no longer be able to distribute tiktok. for instance. they'll not be able to give updates if tiktok. all that being said, tiktok might

still be sold by bytedance even after january 19th, in which case they would then be able to be distributed again. but the main point is, as of january 19th, if they are in the process of selling, they can then ask for an extension and the president can grant an extension of time in which they can complete their sale as well. >> not to get too much into the minutia, but on january 19th, joe biden will be president. so it would be joe biden who would grant that extension. can they ask for that extension? in the afternoon of january 20th, or at that point, is it too late? >> i think it might be too late. i think they'd have to do it by january 19th. and i'm sure that they would. i think that there are a lot of bidders right now who want to buy tiktok, so i think they should pick up the phone and call some of these people. >> and again, that's what i'm getting to here. some of the confusion, if this goes into effect on january 19th and there are no extensions, donald trump is inaugurated on january 20th. is there anything that he

could do in your mind if this law is in effect, to get tiktok back on apple or google? >> yeah, he could do two things. one, he could get bytedance to sell tiktok and he can encourage that right now. and then secondly, he could encourage a repeal of the law. but again, 360 members of this house voted for that particular law. and the reason is very simple. as the d.c. circuit court of appeals repeatedly said, this is a national security threat under the control of the chinese communist party. they have hacked repeatedly numerous data sets, collected the data of hundreds of millions of americans. and as the d.c. circuit court of appeals said, there's no reason not to believe that that would happen with tiktok as well. >> it's going to be an interesting couple of weeks here to see what the supreme court does, what then happens by the 19th, and what happens
