on to ireport.com. we would love to share those. >> former d.c. mayor, marion berry could be facing a misdeamnor stalking charge. police arrested him at a d.c. park last night after a woman complained. he was later released. berry now a d.c. city councilman is known for his brushes with the law which includes a 1990 arrest for possession and use of cocaine. after that arrest he ended up losing his job as mayor of washington, d.c. only to be re-elected some years later. so he was able to make a come back pap number of arrests in his history, some strange circumstances surrounding this latest one. see him there. he's a council member at this point but expecting to get more details about exactly what happened last night. >> marion berry back in the headlines. that alleged incidence happened in a park, which is patrolled by federal or u.s. park police, and a spokesperson with the park
7:02 am
police joins us on the phone. sergeant, i know there's a lot to talk about. we talked about this arrest. i want to confirm with you, council member berry was arrested a arrested and charged for this misdeamnor stalking? >> that's correct. last night on the fourth of july, the united states park police officers were patrolling anacostia park which is a park in downtown d.c. on the east side of the anacostia river. the officer was flagged down by a d.c. resident, she was upset. this officer from the united states park police interviewed the woman that had flagged him down or requested assistance and the other vehicle that she was pointing to had also been stopped. after she was interviewed for a few moments the officer went to the other vehicle and
7:03 am
interviewed the occupant of that vehicle. based on the investigation that the officer did on the scene, there was probable cause developed arrest the occupant of the second vehicle. that was marion barry. >> do you know what relationship she had to marion barry? >> i don't have that information. >> it was around 8:45 last night? councilman barry was there at the park waiting for fireworks. >> don't know why he was there at this hour? this is an area known for it's fireworks. perfectly reasonable area for people for visitation for the holidays. >> specifically, talk about the stalking charge. according to d.c. criminal code, what does stalking mean? >> i haven't had an opportunity to really look into the elements of that offense. it's been a long night.
7:04 am
i haven't had a chance to do the research. the elements were pretty well met because after mr. barry was transferred to tuesday park police facility in washington, d.c., the detectives with the united states park police spoke with the united states attorney's office for the district of columbia and after discussion they felt this misdeamnor stalking charge was the correct charge. just for clarification the district of columbia, it's an unusual situation in the sense that the united states attorney's office pruts, all charges in the district of columbia, you can't infer the fact that it's the united states attorney's office this is a federal charge or extra big charge. it's simply a misdeamnor charge but in the district of columbia the united states attorney's office handles it. >> what kind of fines, penalties, sentence might he face here? >> i'm not sure what the exposure is in a charge like this.
7:05 am
as i said it is a misdeamnor charge but i haven't had an opportunity at this point to look into what the exposure is. >> where is he right now? >> well i don't know where he is specifically right now. he is not in park police custody. last night after processing him, he was transforward the district of columbia central cell block and then released from there. >> my last question, i think i've interviewed you during my time in d.c. marion barry has had his share of run ins with the law and in particular with the park police. what kind of a message is this sending seeing a leader of the community in situations like these over and over? >> i really can't speak for the commune. i can only speak important the united states park police. the simple issue is that the united states park police enforces the law regardless of who people are and it's very important to note that we
7:06 am
absolutely did not seek mr. barry out. we were flagged down by this person who was the complainant in this case. she was seeking assistance of a police officer. and that person happened to be in an area of the jurisdiction of the u.s. park police. >> sergeant, thank you for calling in. we appreciate it. i know it's been a long night for you. thanks. >> president obama leaving washington tonight heading for moscow, a crucial trip. there's some big issues on the negotiating table. our foreign affairs correspondent is on the line for us from moscow. i guess what is the biggest of the big items on the table? >> reporter: you have to say it's the agreement on the new arms treaty. it's a big deal. it's very, very complex and extremely important and
7:07 am
negotiators from both sides have been working on it very intensively. what we're expecting is they will report to the presidents and the presidents will assess where they are and tell them to keep going. the deadline on this treaty expiring december 5th. the other thing would be and it's almost in the bag s an agreement on afghanistan. russia is going to allow transit of u.s. military equipment across its territory and this is the first time that they are going to allow military equipment. they allowed what they call non-lethal equipment to go over by rail but this time could it be this military equipment could be going by air and that could be very, very helpful in the fighting that's going on in afghanistan. >> jill, categoryize for us, what kind of a start has the relationship gotten off to between president obama and president medvedev there in
7:08 am
russia? >> reporter: it's a lot better than what was going on before. in fact, president medvedev just this morning had an interview with the italian media and he said that, you know, relations were very bad under the bush administration. they had begun to revive as he put it and moderately optimistic about resetting this relationship. but, certainly, it will be very interesting to watch. president obama has a meeting the first day, several meeting, actually with president medvedev, but also more interesting thing in a sense is his meeting the next day with prime minister vladimir putin. putin used to be the president. there could be more testy relationship between those two men. so, if you're talking about president medvedev, it seems to be quite a good relationship, with putin who really is the man who many people say calls the shots politically, it's a little more testy. >> jill, thank you so much.
7:09 am
i want to get more details on the story, the breaking story out of orlando, happening down at disneyworld. to recap, there was a fatal monorail accident around 2:00 this hurricane warning. one of the operators of the two monorails that collided, one of the operators, one of the drivers died. here are pictures coming in. we have someone on the phone who took this picture. are you with he? >> yes, i am. >> tell me where you were, what you saw, what did it sound like? >> picture you're looking at is actually on the trains back to the loading dock. what we first saw, we were just getting off the ferry, one of the last groups because they close at 1:00 in the morning. we were trying to -- we were actually leaving the park and like i say we got off the ferry. going towards the exit which is
7:10 am
where you get the tickets. we were about to go under the roof and we heard a loud explosion. when we looked back we saw the two trains crashed and pieces of the monorail had fallen to the floor beneath it and a bunch of people were running from like under it. and then like about ten, 15 seconds later they moved the trains towards the loading dock. >> what we're looking at trying to understand this picture you caught, those are two separate trains that collided head on. >> yeah. the red one on the left side was parked at the loading dock. and apparently the blue one was coming from epcot. >> so, here they come together, one of the operators died. do you know, did you see anyone getting off the train? we heard there were five or six guests on one of the trains. i think up to eight were treated
7:11 am
for potential injuries. who did you see, adults, children? >> there was a complete family on train coming from epcot. the first car. >> were they getting off easily? did you see emergency crews on the scene? >> when we got upstairs we were there for about ten minutes before police and fire rescue got on the scene. we went upstairs. we got the doors opened and the family was able to come out. they were shaken up. they didn't know what was going on because you couldn't see forward. they came out. the kids were crying. it was a family of six. a mother, father and kids. and we literally tried to gain access where the driver would be. we were able to gain access into the rear part of the red one and that's the foremost part.
7:12 am
the blue one was so mangled up we couldn't get access into that to see that. we tried to open up the doors and there was no way we could get in there. one fire rescue and police showed up. >> what a frightening situation. disneyworld 2:00 a.m. people were out and about enjoying fireworks. thank you for sending us this picture. i want to read a statement. today we mourn the loss of our fellow cast members. our hearts go out to those who lost a friend and family and co-worker, they were referring to the monorail worker who died. the safety of our guests and cast members are our top priority. the monorail is out of service and we'll work closely with law enforcement to determine what happens and the appropriate next step. >> those picture let's keep these pictures up. they are a scary picture. you see a mangled mess pretty much there. looks like they certainly did hit at a pretty good rate of
7:13 am
spee speed. reynolds wolf has been helping us with this. you have some knowledge of the area. how fast do these things go? >> i would guess maybe 20, 30 miles per hour. not very fast movers. but these are key pieces of transportation that you have at the park. take a look at google earth. i want to show you something. you got a look at disneyworld, this is the disney area, many off shots, animal kingdom but this is disneyworld itself. towards the bottom you have the monorail station. you'll notice at the same time there seems to be like a little bit of a line that connects the park from one resort to another. say the contemporary resort over here. back over here the polynesian. the place that is suspect would be this area right here at the
7:14 am
train station, you got, some of these monorails makes its way up to the magic kingdom. this line that you see right here actually feeds in from epcot. i don't know if there was some kind of a mistake where some of the trains may have been leaving say the polynesian resort and going back towards the contemporary. that's where you had the collision. at this time it's murky to understand. at disney you don't have events that take place this late at night at 12:30. during the holiday season that's a big exception. we had a nighttime parade in downtown disney at 12:30. a lot of families moving around. maybe the sheer volume of people getting on. this mode of transportation, just, again, bad timing. >> reynolds, i want to ask you, you may or may not know, we can see these trains, these two monorails, one is red, one is
7:15 am
blue. >> to the best of my memory, say about five years or so ago, if i'm not mistaken red stripes indicate trains that stay in the magic kingdom. the other ones like the one that is blue would feed away towards epcot. i may be wrong but if memory serves that's the way it is. >> we're looking at this picture. one monorail member, a cast member as disney calls it, they call them cast members at disney world dead after this crash at disney world happened at 2:00 in the morning. we continue to pull in information and pictures. we appreciate our i-reporters helping us. we'll continue to bring those in as well. we're taking a quick break and be right back.
