if that weren't enough, we are learning details of one of the first two incidents, one of the two that ended in financial incidents that ended in confidentiality agreements. they came from a colleague who witnesses, he says, witnessed one of the incidents and spoke to gloria borrowier. >> at the time, she was a very lower level staffer. she was maybe two years out of college. this all occurred at a college and everyone was aware of it. it was only a matter of because so many people were aware of what took place. so many people were aware of her situation, the fact that she left after this. that it was -- it was a -- everybody knew with the campaign that it would come up. >> chris wilson, we should point out, is a rick perry supporter.

gloria borger will join us shortly. according to forbes dotcom, cain is blaming a campaign advisor who is now working for rick perry who is sparking this whole mess. but cain contradicts his only statements. we're going to lay all of that out. but the day began, a conservative front-runner not wanting to talk about any of this any more. >> let me say one thing, i'm here with these doctors and that's what i'm going to talk about. so don't even bother asking me all of these other questions that you all are curious about. okay? don't even bother. >> good question, though. >> but are you concerned about the fact that these women do want to -- want to come forward? >> what did i say? >> excuse me. excuse me. >> what part of "no" don't you

understand? >> well, there was some pushing and shoving and the questions that began on sunday when the politico story hit, detailing two incidents of alleged sexual harassment in the late '90s when cain ran the restaurant association. today, corroboration on the at least angle. a third employee spoke to the associated press. according to the a.p., she said the behavior included a private invitation to his apartment. the report goes on to say that cain made sexually suggestive remarks or gestures. here's the kairn response. mr. cane has said over the past two days at public events that we could see other allegations made against him. the statement goes on, he has never acted in the way alleged by inside the beltway media and his distinguished record of over 40 years spent climbing the corporate ladder speaks for itself and this third accuser

did not file a formal complaint. she says this happened at the same time those two other women filed complaints. they are the two featured in the politico report on sunday. then, his next day suddenly seemed to come back. >> if the restaurant association did a settlement, i am not -- i wasn't even aware of it and i hope it wasn't for much because nothing happened. i am unaware of any sort of settlement. >> i was aware that an agreement was reached. >> he attributed his earlier lack of recall to how long ago this happened and confusion over being asked over settlements when he understood them to be in his words, agreements. yet today, talking to a writer at forbes magazine, he himself blew a big chunk of his hazy memory to bits. he says in 2004 during the georgia senate campaign that a

sexual complaint was brought against him. quote, it was a typical campaign conversation. i told him there was only one case, one set of charges, one women while i was at the national restaurant association. that conversation happened in 2003 yet monday morning and afternoon he had no memory of the incident at all and then he did but was confused. so did he forget it between 2003 and monday something that back then he remembered and told his political advisor because he saw it as a potential liability. and evidence of a smear. confusing, i snow. joining us is chief analyst gloria borger and jeffrey toobin. gloria, you just got off the phone with the attorney for one of cain's accusers. >> right. >> what did he tell you? >> this evening he's not speaking with us. he's meeting with his client and she's the one that 12 years ago

alleged sexual harassment against kairn. he told me that it is likely that he will ask the restaurant association to allow his client to issue a statement under his name, without her name, to issue a statement saying that she vehemently denies cain's remarks and that she was sexually harassed and she believes he needs information from the restaurant association because he wants to get an agreement that this would not be construed as a violation of the confidentiality agreement. >> he's already said that. he said this on the program last night. are you saying that he would go farther in a statement? >> well, i think that she feels she needs to issue an explicit statement. i asked him how much detail would be in it. denot know. but this is what he did say to me. he said, she doesn't want to become another anita hill. that's not her interest or her expectation. she would like to put this behind her.

she put it behind her 12 years ago. she's not a publicity seeker. she's happily married and has a good job. so it's clear she wants to set the record straight but it seems like she doesn't want to go in in front of the cameras. >> you also spoke to a pollster for the restaurant oesh sags who says that he witnessed cain sexually harassing this woman. >> did he say that cain was inappropriate wa this woman? >> all he would say is what you played at the top of the show and in that interview it's very clear that he he believes that what he did was very inappropriate and he also said that everybody knew with the campaign that this would eventually come out. and one other point, anderson, i raised the question with him, obviously, of whether he was politically motivated and he would say this on the record to me because he does run a

political action committee independent from the campaign of rick perry but he supports rick perry. so it's an obvious question to ask and says, quote, i had nothing to do with leaking this in any way and i've never discussed or shared the story with any of my clients, period. >> it was interesting, though, chris wilson, what he said -- and i want to get the exact word -- >> uh-huh. >> -- he said that everyone was very aware of it. >> right. >> i'm not sure if that means that he thought it was inappropriate at the time, that means that they were aware of it, or just that word was out and the restaurant association heard. >> we really don't know. if everybody was aware of it, we can only surmise that people were talking about it at the next day at the office. >> right. >> that it became a topic of conversation. and then -- >> a third woman has accused cain of sexual harassment in an interview with the associated press. you said that there's a big

difference between this accusation and the other two that there was a settlement for. >> right. just because a woman says something to the associated press, that is not of great importance. i mean, what makes the two, that politico originally reported on and so significant is that the national restaurant association paid these women money. that suggests something went on, enough either to settle the case or it was perhaps just nuisance money to get rid of it. >> right. >> but paying money is very different from simply a blank accusation. >> but people settle and cases go away and settle with money all the time. >> they do. >> it's cheaper to make things go away than pay tens and thousands of dollars. >> that's certainly what may have happened here. but the fact that money exchanged hands following a sexual harassment is an order of magnitude and worthy of investigation than somebody saying that the associated press that this guy did something

wrong. >> gloesh yeah, it seems unless one of these women comes forward and puts a face on this, where does this go? if you have a press release from this woman's attorney -- >> right. >> it -- i mean, cain supporters will say, this is terribly unfair. how do you argue against a phantom? >> you know, i would argue that at some point you've covered a lot of these stories and at some point i think you kind of have to assume that the story will come out. the full story will come out and maybe her man cain will tell the story and maybe the restaurant association will release a report and maybe in the end the women will say, okay, release our names. it's very hard to predict. >> it's going to go. what is going to happen.

i think the fact that she wants to issue any kind of a statement means that she's clearly upset with what she has heard. >> yeah. >> it's certainly understandable that she doesn't want her name dragged through the mud. but a piece of paper issued by her lawyer, that's unfair to herman cain. how is he supposed to respond to that? that is not a fair airing of the issue. that's simply attacking him blindly and, you know, we shouldn't -- that's not something that should resolve this issue at all. >> right. jeff toobin, gloria borger. i've got to leave it there. i want to dig deeper with dana and jennifer rubin and james carville. dana, for the cain campaign, the most recent response of this, is it called -- basically, is it called -- it's for a call for the perry campaign and politico to apologize and do you think

that's going to work? >> this is something that they try to avoid now and they have all of these -- like you were saying earlier, it's very interesting that herman cain said on monday that he had no knowledge that these -- he had no knowledge at all of any kind of settlement and yet today the story came out that while he actually did talk to kurt anderson and they discussed it in detail, their words, not mine. so he opens the door to all of these questions and i think it's just going to end up being bad for him and i've seen the polls to how this translates to later on, how this is going to affect them. this is a bad move. this was sloppy. and the cain campaign is handling this in a very sloppy fashion. >> obviously the cain campaign has made a few missteps the last couple of days. the question is, are they doing anything right here?

>> not that i can say. first of all, they have attacked conservatives and it sort of steps on his excuse. remember, up until today he said that this was a liberal conspiracy to and how does this fit into that scheme. and what you didn't mention was that mark block tipped off another incidents, which concerns an iowa talk show host. which is that cain came in to his studio and made a comment oh to their employees. the cain campaign, they seem to be building and building and building and making this worse every single day. >> james carville, you've put out a share of fires in your time. what do you make -- how do you assess all of this? >> i'm glad i'm not in the middle of all of this. obviously cain was not telling

the truth. obviously this came from perry. who benefits in perry does. any detective would say -- he was the most likely suspect by fault. any democrat would believe this. >> what do you mean any democrat -- >> democrat doesn't want to get rid of cain right now. come on, get real. some of these charges, maybe some women felt like they were sexually harassed. maybe cain didn't feel like he sexually harassed them. one of these women was paid $35,000. as senator graham points out, after you take out attorney fees, that's not a heck of a lot of money. cain is not telling the truth. sure perry is behind this. if i was perry, i wouldn't blame him for being behind him. he gains from it. >> james, where you do you think this goes? is the lawyer thinking about having the woman release the statement and has that ended or -- i mean -- >> i don't know.

in the meantime, there is new polling out showing herman cain's strength going out to the scandal. cain is out front followed by mitt romney and newt gingrich in third. the numbers do not reflect the news this week. back now with our panel, jennifer rubin, james carville, and dana laesh. do you think these charges could actually help cain, the sense that he's being victimized by the media? >> i think to an extent. there's two quick points that i want to make concerning this. in the beginning, initially, there was an absolute racial aspect and in the new york times and referring to a menstrual and what is separate from what is

happening now with the way the cain campaign is handling this, i think rock block was wrong to go on and say without a shred of proof that -- >> the chief of staff? >> sorry. chief of staff. one man on the national association board was a perry donor. there's also donors on that board who donate to mitt romney as well. in fact, we could play the game that, well, maybe mitt romney is behind this. there's definitely a lot of speculation. i myself had a lot of questions about whether he's a stalking horse for mitt romney. to say that perry is behind this, it could very well be said that romney is behind this. kaimpb endorsed romney in 2008. he didn't attack him in any other debates. we could go on and on. to say that rick perry -- >> let me give you some facts. i spoke to the rick perry campaign prior to this and i said do you have mitt romney

being tied to this and they said other than the fact that he was on the board, no. and they said, is this the same as being the cain source? and i said, i've got no response. >> jennifer, what do you say about that race played a role in this early on? >> i don't think race played in any of the allegations. it was a legitimate story. cain brought it on himself. the talk show circuit would play the race card, saying that mr. cain is not responsible for this, there's some giant plot out there to get him because he's a conservative, there's no evidence of that. the central facts that politico reported, i think that -- >> jen -- >> what are the facts that politico has reported? >> a bunch of hearsay. >> no, cain has confirmed it. yes, he was accused.

interested. can you hear me. >> reporter: to myron's wife arleene who later said she would appear on camera, there's no doubt who is responsible for these attacks. who do you think is responsible for these attacks? >> sam mullet. >> she says that sam's family is unhappy because people left his group. >> if they ever arrest him and he's able to get out on bond, he's not going to go down easy. >> reporter: sam mullet has not been arrested but authorities say that they are making a case against him. >> i can't take any chances with him. >> reporter: meanwhile, a woman was attacked in a haircutting attack. they consider hair to be god's glory. the police report stating that the victim removed her bandana and reported several patches of hair mishs. the sheriff says that mullet is 450i7d that attack and now the federal government has decided to get involved in that attack. the fbi is involved in this situation. what is your feeling about that?
