the big story is greece, gamble with the global economy, and how could it cost the membership in the eu on this "american morning." good morning to you. it is thursday, november 3. welcome to "american morning." ali velshi is in stormy france. bad weather there. we will be talking to him in a few minutes about the g-20 minutes. >> stormy weather and stormy politics. up first, the scandal dogging herman cain's presidential campaign. growing larger this morning. associated press reporting that there is a third woman who accused cain of you wanted sexual advances when she worked for the national restaurant association. reports says she considered filing a complaint bunt didn't. cain for his part trying to stay on message. here he is facing reporters at an event in northern virginia. >> will he me say one thing. i'm here with the doctors and

that's what i'm going to talk about. don't even bother asking me all the other questions that you all are curious about. okay? don't even bother. >> are you concerned about the fact the women want to -- >> what did i say? >> are you concerned about -- >> excuse me. excuse me! what part of "no" don't these people understand? >> this morning his campaign maintains the charges are baseless and he the victim of a political smear campaign. even pointing the finger at texas governor rick perry. we begin our coverage this morning with cnn's joe johns. good morning, joe. >> good morning. that's what we know. cain campaign blamed the perry campaign of leaking the story. the perry campaign flatly denied it. and luke everything else on the story so far there isn't much proof. certainly nothing conclusive. what is interesting here, though, is that while some can

conservative supporters of cain originally suggesting the story was a product of a liberal plot, a clear signal from the voo point of the cain campaign the leading suspect for the leak of this story is the campaign of another contender for the republican presidential nomination. cain said at a town hall that they had been able to trace the story back to the perry camp and mark block, chief of staff, was more accuse toatory. the actions of the perry campaign are despicable and owe an apology. nobody at our campaign was involved in this story in any way and any claim contrary is pay tently false. the first we learned of it was when we read the story in politico. lot of back and forth. and as i said, nothing

conclusive. >> all right. nothing conclusive. we don't really even know many details of the allegations because of confidentiality agreements and because now a third seems to be missing according to the ap. what can you tell us about this one? >> well, i mean, what you reported there at the top is just about all you can say about this. and that is that a third woman came forward according to the associated press and said she considered filing a complaint. however, it is pretty clear she did not file a complaint. so you put that on top of what we heard about the other two and really there aren't think solid facts on the record and the fact of the matter is that this is not a situation where you are going to get some type offing a fact finding because it has been so long. so who knows at the end of the day. this could be just a lot of shooting back and forth. more troublesome perhaps for herman cain is that a pollster

and a former employee of the national restaurant association where all of this business is said to have occurred in the 1990s that said whatever cain was allegedly doing was a topic of conversation back in the day and was pretty much assumed that it would end up out in the open. can we just listen to that? >> i was actually around a couple of times when this happened. it was only a mat are of time because so many people were aware of what took place, the fact she left after this, that it was -- it was -- everybody knew at the campaigns, with every campaign, that this would eventually come up. >> there you go. chris wilson's take on the whole matter. and we are waiting because we love to hear more information. some indication that the attorney for one of the accusers is actually in a conversation with the national restaurant

association to try to release some type of statement but it is also clear that this accuser that attorney represents doesn't want to go out public at least now because she just doesn't want to become another sort of anita hill-type figure. a lot of -- if you will -- pieces to the story moving and nothing real clear this morning. >> all right. joe johns, thanks, joe. >> you heard joe say the cain campaign, rick perry's camp is behind the sexual harassment story and the cain cam subpoena demanding an apology from the texas governor. on "ac 360" cooper asked if they were tipped off by a rival campaign. >> was politico tipped off by one of cain's rivals? some including cain himself seem to be suggesting. >> jonathon was on message last night and i will try to stay on message. i will tell why you i think it is important. this is a sensitive story.

we haven't been reporting on innuendo or things we think we know. so in our public comment we try to stick closely to what is in our published story. that story was edited extensi extensively. i'm not trying not to go beyond that. i would say the question of motive is secondary to the question of facts. everybody or anybody rather who speaks to a reporter any time on any subject presumably has some motive for doing so. what's important is not the motive. but the -- but the facts. politico's two main facts in that initial tour, one that there have been complaints and two, those complaints have been settled or agreed -- agreements reached mr. cain's phrase. both have been validated by mr. cain himself as true and accurate. >> coming up at 8:15 eastern, we will talk live with kurt andersen, perry campaign adviser, who herman cain blames for leaking information about

the allegations. >> politico says it wasn't him. getting uglier and uglier. as it is in oakland, california. aingefer the streets, occupy wall street protesters clashing with police overnight. police in full riot gear shot tear gas into the crowd. thousands of protesters shut down the city's shipping port. vandalizing banks in a grocery store, several businesses, and had to close their doors. officers trying to get the crowd to disperse. they say some demonstrators are throwing rocks at them and setting off fireworks. the city is still reeling from last week's violent clash. what you are looking at now is cell phone video from downtown oakland. a couple of occupy wall street protesters hit by a car. keep your eyes on the mercedes in the back. see it there? you can see one of the people banging on the car's hood. then the car runs smack into

them. police say the man and woman were hurt but their injuries are not life threatening. the driver was questioned but was allowed to leave the scene. okay. in france, the g-20 summit is under way. greece has been noticed accept the euro zone bailout package or get out. the prime minister, lot of world leaders, he announced the bailout plan would be put to a vote by the greek people. that could happen within a missoumont missou missou missouri. sar yoez with y sarkozy is warning pass this plan or greece must exit. interest didn't take long for the sparks to fly. even this morning now we hear the greek minister is calling an emergency meeting with his cabinet. there's so much uncertainty around all this. every little development, every little development, its own attention. >> where am i? what is this? is this cannes, the south of

france? it was a dark and stormy night when the g-20 started. this is probably -- this is indicative of what is going on. this was supposed to be, you know, relatively meeting dashgs, you followed them to deal with the global crisis and global growth and things like that. 2 one-half hour meting between sarkozy and france and merkel of germany. basically they were telling him number one, if there is -- until the uncertainty is settled not a cent more will get to greece. they are supposed to receive much more money ask in a will not happen. while it is technically not a referendum on staying on the your euro zone if greece votes against this plan that the europeans came up with on october 27, it will essentially be a referendum on stating the euro zone. reinforcing that last night saying that it is very clear that this is a refer rent dumb and almost seems as if he was looking for sarkozy and merkel to be tough on the greeks and

prosecution, this audiotape of michael jackson -- that was actually recorded by dr. conrad murray, slurring his words. >> when people leave my show, i want them to say i've never seen nothing like this in my life. go. go. >> it took michael jackson 20 seconds to say one short sentence. it is difficult to understand how the defense can overcome that recording. can overcome the fact that dr. conrad murray went on and administering drugs to a man who was clearly having a problem. >> well, you know, i candace agree with you there. i think that when you look at the case, the defense has a real uphill battle to prove their case. they don't have to prove the case. it is the prosecutors'

responsibility. let me talk about how they will use that tape as part of the defense. the defense is going to come in and say michael jackson was addicted to drugs. he had a terrible, terrible problem. one man was trying to save his life. dr. conrad murray. because murray was trying to slowly wean him from the drug propofol and so he was administering it at the jackson home to try to get him off of the drugs. they are going to say had conrad murray walked away from this case, jackson probably would have killed himself. because some other uncaring doctor would have just prescribed drugs. so how can you convict a man who was trying to save michael jackson's life? that's how they will use the slurred speech and how they will use the train wreck of michael jackson's life to present the defense to the case. will the jury buy it? i don't know, carol. i mean, you have an iv set up in a man's bedroom administering propofol and operating room drug. this stuff is supposed to only

be used when you are having surgery. it is not tylenol pm. you are not -- you are not going to sleep with it the way you do with that drug. i don't know how they are going to convince a jur i don't this. you never know with jurors. >> i know. you do never know with juries. you said before you don't think it will take the jury a long time to make its decision. >> i don't. even though this case has gone on for 22 days, there have been lots of witnesses, you know, girlfriends, doctors, paramedics, in the end it comes down to one thing. can you administer propofol in a home setting to help somebody sleep? if that is a deviation from an extreme deviation from good and accepted medical practice, and it caused death, that's all that is required. a lot of people think that this is a murder case. well, this is not like somebody aiming a gun and pulling the trigger. all this is, this is involuntary manslaughter, an accidental death caused by extreme and gross negligence.

it is almost like a suit for money damages on steroids. it is one step higher. which is why the maximum penalty is only four years in prison instead of life in prison. >> if dr. conrad murray is found guilty, will this change things in the medical world as far as how cases are prosecuted? >> i don't think it will. i will tell you why. when doctors, nurses, people who know the medical profession look at this case, they are stunned by it. because they have never in their entire career seen a situation where a doctor administered propofol in a home setting. nobody else does it. so it is not going to change. other doctors don't do it, murray didn't have any influence on the profession in that respect. i think, of course, the defense will say well, this is going to put doctors in fear and if they treat patients and accidentally cause death they are going to be prosecuted for murder. that's not going to happen. this is an extreme case. frankly, even if it wasn't michael jackson, i think murray

would have been prosecuted for using the drug in this way. but will the jury convict? will the jury think well, michael jackson hired this guy, why should he be punished for doing what michael jackson himself wanted? you never know what will go through the jurors' minds in the jury room. >> thank you for coming in so early. we appreciate it. lindsay lohan is heading to jail. the troubled starlet may only serve a matter of minutes on a 30-day sentence. officials say lohan could be booked in and booked out on the very same day. a hearing yesterday, she admitted to violating her probation on a necklace theft conviction. so her sentence begins next week. lohan's judge warns if she messes up again she faces 270 days behind bars. no word on how many minutes that would be. it is 36 minutes after the hour. here is what's new this morning. five undocumented immigrants rescued from a tunnel while trying to cross into the u.s. local authorities say that

border agents saw them enter through a manhole near tijuana and they were sniffed out by the canine team. five people were found trapped underground. at then turned around and were able to dig them out. they were treated and brought to a nearby border patrol station. this is what could happen when you blindly trust the gps. the pizza delivery guy in michigan followed his gps right on to the train tracks straight into the path of an oncoming train. he missed the street by ten feet. he bailed but did grab the pizzas, too. now that's a hero. no one on the train was hurt either. >> like tend after movie chase scene. this is what happened when a car slammed into a fire hydrant in san diego. the water lifting the back of the car ten feet into the air. it stayed like this for more than an hour until crews were able to remove it. police say the driver ditched the car and ran away after the crash. >> i never get tired of looking at it. just ahead, shocking news

we asked to talk back on one of the big stories of the day. the question this morning -- do we understand what constitutes sexual harassment? this from laura. it is a complex issue and i don't think we fully understand what constitutes sexual harassment. part of that is because it is based on how others feel. a statement or joke that may be fine with person may be highly offensive to another. the advice given by most hr departments is err on the side of caution. no, we don't. in a world of political correctness the door is wide

herman cain this morning. they are wondering who leaked the information to politico and splashed the sexual harass many allegations over the airways everywhere. it is the story that will not die. right now the cain campaign is pointing the finger at rick perry's campaign accusing perry's people of leaking the story. he responded to these allegations of finger pointing and straight to the perry campaign. >> if it turns out a republican presidential candidate deliberately went out and created this kind of a story about a fellow candidate, they would pretty rapidly become pariah among the rest of us. that's the worst possible behavior. we republicans need to be unified to beat barack obama and that kind -- i don't know who did it. i'm not taking herman's word for it. fit turns out he is right, they

suicide. on this "american morning." all right. good morning, everyone. it is thursday, november 3, 2011. welcome to "american morning." ali velshi is in cannes, france, this morning. >> are you ready for this? there are more than several new developments this morning in the controversy swirling around republican presidential candidate herman cain. the republican front-runner facing new allegations of sexual harassment. the associated press is reporting a third woman says she considered filing a workplace complaint against cain for inappropriate behavior back in the '90s. in the meantime while cain tries to campaign he's clashing with the press. >> let me say one thing. out here with these doctors and that's what i'm going to talk about. don't even bother asking me all of these other questions that you all are curious about.

okay. don't even bother. >> are you concerned about the fact these women do want to -- >> what did i say? >> are you concerned about -- >> excuse me. excuse me! what part of "no" don't these people understand? >> cain is blaming rival rick perry for making the allegations public and he is now demanding an apology from governor perry. we begin our coverage this morning with cnn's joe johns. is cain likely to get this apology? >> this is a bunch of finger pointing and bunch of denials. the search for whoever leaked this story has been -- politically this is a question that matters especially since some conservatives think that there is a plot to discredit cain and the cain campaign has begun blaming, as you said, rick perry campaign of leaking the story publicly. cain happens pointed out there is a guy named anderson who worked on cain's unsuccessful

campaign for the senate in 2004. cain says he briefed anderson on the harassment allegations and now cukurt andersen is working r rick perry's campaign. this is the odd part. anderson says the first he learned of the story was in politico when politico reported it. he is basically saying he only had nice things to say about herman cain. he's an admirer of herman cain. there is another guy named chris wilson who is an oklahoma political consultant who is doing polling for a political action committee that supports perry's campaign. chris wilson says he personally witnessed cain engaging in inappropriate conduct towards a woman while cain was the head of the national restaurant association. wilson hasn't been real clear about what kind of conduct we are talking about here. listen. >> i was actually around a couple of times when this happened. it was only a matter of time because so many people were aware of what took place. so many people were aware of her situation the fact she left

after this, that it -- it was -- everybody knew at the campaigns -- with every campaign -- this would eventually come up. >> chris wilson denies leaking the story about cain. the perry camp also denies as a campaign having anything to do with it. no one at our campaign, they say, was involved in this story in any way, and claim is patently false. first they learned about it was in politico. so -- if you take all of this together, nobody knows nothing. back to you. >> nobody knows nothing. where do you suppose it will go from here? >> you know, they are there are going to be a lot of questions for rick perry and anderson is probably going to go under the microscope and people will continue to search for the source of that story. in a way it is just sort of the side show. it may put an end to this question of conspiracy by liberals to discredit cain as a

strong black conservative or what have you. but the main story is about the women accusers and what they said. we have heard cain's defense but the question is when or if some of these women are going to be get on the record and explain exactly what he is defending himself about. that, of course, is what a lot of people really want to know. running for president of the united states. >> yes. well, supposedly one of the women who are accusing cain will put up a statement through her attorney on thursday. we are awaiting that. thank you, joe johns. coming up at 8:15 eastern we will talk to kurt andersen the guy joe mentioned who herman cain blames for leaking the allegations. at 6:00 eastern p. catch john king's interview with governor rick perry. the first time we will hear from perry on charges he, his camp, is hind of the leak of the sexual harassment allegations.

"john king usa" right here on cnn. this morning it appears one of cain's accusers may be ready to go public as early as today. carol said here's cnn's brian todd. >> reporter: the other shoe may soon drop for herman cain. the attorney for a woman that cuesed cain of sexual harassment contacted the restaurant association which cain once headed. the attorney, joel bennett, says his client wants to speak out and set the record straight. bennett says he would like the association to release her from the confidentiality agreement she signed when she left that group. >> naturally she has been very upset about all of this since the story broke last sunday because mr. cain has been giving the impression that she's someone who came out and made false allegations. if and that's certainly not true. >> reporter: joel bennett said his unnamed client got a benefit from a sexual harassment complaint against cain and describes his client as married, highly intelligent, some one that doesn't go around making false claims. bennett says she is a career civil servant but asked whether

she is politically active -- >> i have no knowledge that she's active politically. she is a current employee of the federal government. >> reporter: by most indications, bennett's client is not the same woman who "the new york times" reports got $35,000, a year's salary, in severance pay after an alleged encounter with cain. that person could be the woman who cain described as someone that worked as a writer in the communications arm of the restaurant association in the 1990s. cain says all he did was make an observation about her height and on the claims of sexual harassment. >> it was ridiculous. i dismissed it out of mind. if she can make that statement, call that sexual harassment, fine. >> reporter: cain described the other woman as someone that worked in the restaurant association's governmental affairs department in the 1990s. i spoke with employment attorney deborah kelly about the request from the one accuser's lawyer, joel bennett, to lift the confidentiality agreement. >> what are the odds of the national restaurant association release thing?

>> i can't see a reason in the world why the national restaurant association would want to release because all of the stuff that they paid to settle and have go away and have not hit the reputational damages of the company would emerge. then it would get back to the very did it happen, didn't it happen? who saw it? who didn't see it? they paid to avoid. >> reporter: attorney joel bennett says he believes cain may have already baifed confide -- wayway waived confidentiality. bennett says there is a n provision. deborah kelly says if cain spoke negatively in public about an accuser's work performance he may have violated that part of the agreement. cain vehemently denies breaking the confidentiality deal. brian todd, cnn, washington. >> herman cain believes racism is behind the recent attacks as he rose to the top of the

political field. piers morgan asked former secretary of state condoleezza rice if she thought there was anything to that. >> i actually don't like playing the race card on either side. i don't like it. people say that the criticism of president obama is because he is black. the criticism is because he is the president. we tend to criticize our president. so i really don't like playing the race card on either side. obviously. i view myself as a black republican as someone that can stand up for myself and as i often said, i don't anyone to tell -- if you don't like my political views, that's too bad. >> he also asked secretary rice about the bizarre romantic crush moammar gadhafi had on her. there was a video montage of herself called "african flower in the white house." ride said his fixation was, quote, weird and a bit creepy. greece is the word at the

g-20 summit in france. president obama touching down overnight. face-to-face with french president sarkozy hashing out the greek debt crisis. the u.s. is already on the record. it doesn't plan to offer any handouts. the president's spokesman says there is still plenty the u.s. can do to help. >> we have a role here to play because of our experience and knowledge. and, of course, the fact that -- we are the largest economy in the world and can bring to bear insight and experience in a way that really no other nation can. >> ali velshi live in cannes. i don't know if they are asking for our help because they thought they had this thing nailed down. and then greece pulls a -- you know, a real u-turn here. greek prime minister calling an emergency cabinet meeting. what can you tell us about that? >> which we think sunday way. i don't know what jay carney was

talking about. they haven't asked for american help at all. the issue is money. money has been offered. the issue is there are ties to getting that money. greece has to do certain things in order to be bailed out and if greece gets bailed out it stabilize it is euro zone and everybody gets to move forward. all of a sudden after the thing is all nailed down october 27, earlier this week, the greek prime minister said that rather than just approve this in parliament they are going to put it to a vote to the greek people. this has become puzzling unexpected to your mean leaders and the two main ones, two benefactors -- you know, the two countries that are the strongest, france and germany, leaders of those two countries met with papandreou, the greek prime minister, last night here in cannes. and said what are you talking about? what are you doing? you can't let this go. he came out of that meeting. they agreed on one thing. if the greeks agree not to go for this deal, they are essentially saying that we don't belong in the euro zone. we are going to exit the euro zone, go back to what was there,

their currency, and it would be bad for everybody involved. there is an emergency cabinet meeting going on now in greece. we are getting sort of unconfirmed reports out of there there is a great deal of turmoil. this is far from settling of what will go on. tomorrow there is a confidence vote in the dpreek government. papandreou leads by two seats p that's problem number one. and if they go forward with the referendum it will be on december 4. at the moment, christine, we have a great deal of turmoil facing europe. all of the things that are going to be discussed at the g-20 are still going to be discussed but basically they just take the back seat now. it is a side show to what happens in greece. remember, christine, they were supposed to take this g-20 deal and present it. europe was going to present this to the rest of the world and see we have our house in order. come and invest tonight europe. >> if europe can't get its act together and falls into another recession it could be a steep and painful recession. euro zone is the biggest destination for u.s. goods. it is not good for the u.s.

versus 51% who had heard of it last month and 36% say they agree with it. that's up from 27% last month. 44% are unsure how they feel. 54% were unsure last month. >> on the subject of occupy wall street, oakland demonstrators started out peaceful but the protest turned violent overnight. thousands took to the streets. a couple of businesses were vandalized and shops had to close their doors. police tried to get the crowd to disperse. they fired tear gas into the crowd you, dozens of demonstrators were arrested. dan simon has more for you. >> reporter: it was an incredibly large crowd in oakland, california. thousands of people converging on city hall. why are they here? see at the top there, says foreclosure the 1%. then down here, we are the 99% from east oakland to the ports to the bay. we demand an end to profiteering off foreclosures and energy that fuels wars. we demand that banks be put in their place. that's what we have seen.

ron, you are sitting here shaking your head when watching that clip. why are you shaking your head? >> unbelievable. talking, excuse me, excuse me. he has no control of the message at all. he is allowing a sexual harass many scandal story to now go on four four days and will keep going and keep going until he handle this issue and until he speaks to it and until he addresses what's going on. he's completely missing the boat. >> part of the issue is we are not sure he's saying what he didn't do because we haven't directly heard from the women saying he may have done. it is a scandal that keeps boiling. >> there is no clarity at all. when luke at that first shot of him he is like a deer in headlights. i mean, this man had ten days to prepare for this story coming out. we still don't know what happened. he still hasn't addressed the issue. if you watch that clip, you see his security people pushing reporters out of the way. how long do you think that will go on? i think if he does not address these issues very soon, his campaign is a wrap. >> you did crisis management for a living. have you been inside campaigns. you know out there what could

bubble up and might not bubble up. how could this still be going on? >> this is in the a real campaign. first of all. they take great pride in not being a real campaign. they don't have a war room. they don't have a response team. i'm sure they did go opposition research on him. first person to do opposition research is your own side to find out what the other side can come at you with. this will always happen. to a certain extent to ron's point they had ten days, ten-day warning. ten days is a lifetime in politics. they should have been prepared for this. he should have sat down with the lawyers at the restaurant association and found out all of the details he agreed to or charged him with and he is fumbling around here. one of the things put into the forefront is his likability. he is pushing and shoving reports, that's anger. that's not a good trait in a man you are looking at to be president of the zbluns one of the things you can do when something like this is happening, you have to focus your fire. you have to come back and appear strong and you have to make your statement and appear strong.

i want to -- a witch-hunt. fox news, let's listen to this clip. >> do you think that race, being a strong black conservative, has anything to do with the fact you have been so charged? if so, do you have any evidence to support that? >> i believe the answer is yes. but we do not have any evidence to support it. >> then there is the blame of the pair grain and then sort of this -- this left wing media attack making -- who would -- you have to focus the fire here. >> whether it is left wing media basis or racism or whether it is rick perry's campaign chief, bottom line, who cares? did you do this? did you not do this? what happened here? i think all of this semantics is not relevant to what actually happened here. you know, many ways i think it is a republican nightmare reliving itself. when you look at the sarah palin selection of a few years ago,

and the pregnant teenager nobody seemed to know about, you know, this just -- same nightmare being repeated from a communications standpoint and he is still not getting. >> it how does he get over it? >> show has to respond. he has to have a press conference and open this thing up. once he knows all the facts and tell the truth. so far there has been no truth telling. it has been -- their fault and it is not his fault. false charges. two women two different times within the organization filed charges against the ceo. there something -- lit come out whether he wants it or not and paid him off at the end of the day. it is now a political issue and it is going to grow and grow and grow. >> restaurant association has to agree to waive confidentiality. what does it -- they don't get anything from it? >> the bottom line is he should sit down with them and has been the chairman of the organization and has been ceo and has friends on the board there. say i need some help here. i need to know what this is. i need to get the story out. if he doesn't the media will go look at it. that will destroy him.

his supporters are the supporters that work for trump, bachmann and perry and and came to him. they move all over the place. if there is any focus here basically shows sexual harassment or some bad behavior, some of them will move away from cain. >> you can -- this country loves redemption is the other thing. if he played this right, could he -- could he get over this? >> let's not forget bill clinton obviously had a sexual issue while in the white house and recovered and had great ratings. >> wasn't you wanted sexual advances. it was different. >> much different. i will give you two crisis communications nightmares which grew from relatively small issues. tiger woods which became bigger than the death of michael jackson and bigger than the princess di scandal over not anything illegal. and you look at tiger woods. tiger woods cheated with a bunch of women and became a three-month story. it became national stories over relatively what should have been a two, lee-day story became long

nightmares. herman cain is making the same mistake now. >> he is not going to be the no, ma'am know of our party. he will be front-runner for a period of time. no one thought he would win this thing. at the end of the day he didn't have the campaign and organization to do that which we are seeing now. he will basically diminish himself dramatically. >> you went to the bachmann campaign to restore discipline. did you succeed in getting discipline in that? do you think that herman cain's team lacks discipline? >> sure. part of it is they are not experienced very rans of running campaigns. the camp -- spent all last week worrying about the stupid commercial the campaign manager put out, dumb commercial. blowing cigarettes. instead of focusing on this issue. they said that i think he is a good machine. therefore, the public will. that's ridiculous. there is no credibility to this thing until the story is out there. >> do you think we should hear from his wife or should she stay out of this? >> i would keep her out. he has to address this issue. it is not going anywhere. >> nice to see you this morning.

dozens of arrests have been made. closing arguments are set to begin in the manslaughter trial of michael jackson's doctor this morning. dr. conrad murray is accused of giving jackson a lethal dose of propofol and faces four years in prison if he is convicted. militia members charged in a plot to attack the government are heading to court today. preliminary hearings start next week. the four georgia men have asked for a court appointed attorneys. prosecutor space the men planned to use explosives and bio toxins to attack federal officials. court documents said when it comes time to saving the constituti constitution, that means some people have to die. you are caught up on the day's headlines.

money is in savings accounts in banks. >> if you're talking about an average family and talking about $20 in fees per month. you're losing money. there you go. in "am house call" a popular drug hit with some alarming health warnings in a new report. >> the study finds that chantix is linked to depression and even suicide. dr. sanjay gu jjay gupta is her. tell us about this. >> a lot of people are focused in on this, but a long list of concerns almost since it was introduced, guys. this is the latest in that long line. talked about blackouts, people having blackouts, violent behavior, suicidal and thinking about suicide and suicide itself. so, this study looked specifically at that issue, but, again, there's been a history with this medication, the faa, for example, doesn't allow pilots to use this medication

because of this concern about potential blackouts. in this particular study they looked at 3,000 patients who had either thoughts of suicide, who had depression, who had committed suicide and found that if they also were taking some sort of smoking susation therapy, 90% of the time it was chantix and that's what thstudy was all about. making strong recommendations to the fda to say despite the fact although there is a black box warning, there needs to be more because they think it could have serious problems. >> feeling bad for people who try so hard to quick smoking and now it's confused again because contrary to a study out just last week by the fda, right? >> we follow that story along, as well. when the fda released that study, they specifically looked at patients who had been hospitalized taking smoking sensation therapies and had some sort of depression or something like that. they did not look at the vast

majority of patients who were not hospitalized. this study looked at more than 3,000 patients who had had some sort of episode of depression and then traced it back. so t was a much more comprehensive study and i think that's why there is the difference. they seem to agree more study needs to be done and the fda released the statement because we asked them why this difference between what you're saying and what the researchers from wake forest are saying and what they told us. specifically we continue to believe that when used as directed in the currently approved labeling, chantix is a safe and effective treatment to help patients stop smoking. pfizer, the company that makes chantix. we reached out to them, as well, in light of this new study to see what they had to say and they echo with what the fda says. post-marketing results do not establish a cause and effect relationship between a medicine and a reported adverse event. they don't dispute the study

findings and not saying there is a cause and effect here. >> dr. sanjay gupta, thanks for joining us this morning. >> you got it, guys. >> we asked you to talk back. the big question, do we understand what constitutes sexual harassment. this from jonathan. we probably all have a different interpretation, but if three different people accused you of sexual harassment, you're probably doing something wrong. just another easy way to cash in on the system. makes lawyers rich. people are way too sensitive and looking for a way to quit their jobs and make quick cash. those ladies will break their agreement physical the price is right. this from allison, sexual harassment does exist, however the plight of feminism has contributed to the ability of any women making claims for actions that most of the time could be dealt with by confronting the offender and telling them such. if every woman ran and cried to a lawyer for an inappropriate joke or slight made toward their sex, we could eliminate the job

now the cain campaign has begun blaming the rick perry campaign of leaking the story publicly, which i have to point out, rick perry himself now personally has responded to this in an interview with redstate.com. perry said his campaign had nothing to do with it. there was nobody in his campaign who knew anything about it, until they read it in politico. cain has pointed out there is a guy named anderson who worked for the senate in 2004. cain said he briefed this anderson on the harassment allegations and now curt anderson is working for rick perry's campaign. this is odd, he said he first learned of the story when it was reported in politico. basically he's saying he is an admirer of cain and only had nice things to say about him. then chris wilson who is actually doing polling for a political action committee follow this that supports perry's campaign.

chris wilson says he personally witnessed cain engaging in inappropriate conduct toward a woman while cain was the head of the restaurant association. not clear about what kind of conduct we're talking about here. take a listen. >> i was around a couple times when this happened. it was only a matter of time because so many people were aware of what took place and so many people were aware of her situation and the fact that she left after this. that it was, it was, everybody knew with the campaigns. this would eventually come up. >> chris wilson for the also for the record denies leaking the story about cain. even the perry campaign, the press spokesman has said they didn't have anything to do with it. no one in our campaign was involved in this story. anyone to the contrary. they say they first learned about it when it was in politico and that's where a lot of us learned about it.

really enjoy him. you don't enjoy everybody you work with, but i really enjoy the guy. >> are you the leaker? >> no, well, there's two problems with that. one is, i didn't know anything about this. it's hard to leak something you don't know anything about, of course. the second problem with it is this. if someone tells you something in confidence, a family member, a friend, a candidate and then you go out and blab it to other people, that's unethical. that's not the way i live my life. that's imaterial in this instance because i didn't know anything about this. >> you are saying that that conversation never took place? >> that's correct. i don't have any knowledge of any of this and, you know, it's just not true. >> so, are you saying herman cain is lying? >> well, i'm not here to add any more name calling to what is already -- >> my characterization, though, is he not telling the truth? >> i'm not going to attack him in any sort of personal way or

anything. i will say this, this has been, you know, he's in a tough spot and it's very rough and candidates when they get into a firestorm like this have sometimes come unraveled and, you know, it seems to me that they're kind of grasping at straws and fishing around trying to figure out how to get out of this. they're flaundering and maybe a diversionary tacting or something. i'm not here to discourage herman. this is all an unfortunate mess. >> you're saying maybe they're becoming unraveled. what does this tell you about mr. cain under stress as potentially a candidate or potentially as a president? >> i have great regard for the guy and i think both he and all the other republican candidates running would be a grit improvement over our republican president. i really do believe that.

i don't have an interest. here's the thing, the only reason i'm here this morning is this. you don't really have much in this world other than your own integrity and your character and other than that, you may have a house and some cars or something, but you can't take it with you. and i live my life, you know, as much as i can with simple set of rules, do the right thing, tell the truth. and, so, you know, after i saw this news yesterday, i figured well i have to go out there and tell the truth. i didn't know anything about this, didn't leak it. >> why do you think he fingered you then as the leaker? >> i don't know. it's a pretty good strategy to take them out of the limelight and said, oh, somebody else did it. i guess. i think it's kind of a weak strategy. the best thing to always do in any circumstance, people in politics get all confused and they get into tough situations and then what they need to do is kind of think back to what my dad used to tell me. well, when in doubt, tell the truth. come to think about it, tell the

truth all the time. >> let me ask you this then, you didn't leak anything, you're not a public official. have you thought about taking any legal action against mr. cain for some kind of defamation here? i mean, you say all you have your reputation. >> no, i don't have any interest in anything like that. i think herman, if he can get himself back to talking about the issues and the things that have put him in, i mean, this guy is the front running candidate for the nomination to be president of the united states. and if he can get himself back into gear, i mean, he can recover. but i have no interest in suing anyone or even attacking anybody. >> so, getting back to the question about why he figured you as the leaker, you, obviously, work for mr. perry right now. mr. perry would have a lot to gain, obviously, if mr. cain drops in the polls. so, is this politically motivated to kind of throw it back at the perry camp? >> well, i'm sure it's politically motivated. that's kind of the sorry thing

about the state of politics we're in. people don't do a lot in terms of just talking about what they really believe. everything has a political motive behind it and maybe this is convenient for them. let me say this, a lot of candidates and herman included talk about their faith in these issues and i endorse that. i think that's great. well, one of the important things there is that the old saying thou shall not bear false witness and you have a situation here where mr. cain is saying that people are falsely accusing him and, so, the last thing that he ought to do is falsely accuse somebody else. >> let me ask you this, if you never had this conversation with mr. cain you say you never had this conversation with mr. cain, have you heard these allegations kind of floating around in the campaigns and as part of sort of campaign opposition research? i mean, are these things you have sort of heard or just totally never heard anything? >> i have never heard this stuff

and i would say this, this, these allegations do not comport to the herman cain that i know. you know, i said in my statement yesterday, i have always known him as a gentleman and as a guy of strong character. so, no. >> so, now, the cain campaign says that you and the perry campaign, who has categorically denied this, your candidate denied this need to apologize to them. what's your response to that? >> well, that's silly, of course. and it's an attempt to take the limelight off of them. and, again, the best thing in all these circumstances is just stand up to the camera, tell the truth. and that's what everybody needs to do here and i think we'd be better off for it. here's another thing. this story that came out that, you know, about all this stuff in the beginning and everything, you know, the allegation that i had something to do with it, there is not a reporter, there is not a human being that will

ever say that that is true because it's not. >> so, the perry campaign has categorically denied everything. have you asked people in your campaign who work for you, who work around you, who work with you whether anybody had anything to do with this? have you sort of put out an apb question? >> no, absolutely not. >> the campaign is denying that anyone in the campaign -- >> i'm sure that they're right about that. i can only speak for myself. >> would you fire someone who had done it or is this just part of the way the campaigns work these days? so, if you found out someone in the campaign had done it, would they be gone? >> i think so, i think so. you know, the bottom line is, here we are in a terrible recession, here we have, you know, record unemployment and, of course, in my view, the republican view, the country going in the wrong direction and that's watt we need to talk about and this is just a silly, circular firing squad and it's a mess and, yeah, i think it would be worth being fired over if

somebody was out there leaking this kind of stuff. >> have you thought about talking to mr. cain and, i gather you have not, and if you could, what would you say to him right now? you could say it here. i'm sure he'll hear it. >> if i was going to talk to herman, i would do it personally, i wouldn't do it on cnn. >> are you hurt? >> you know, you get upset. i was upset for a little bit and then i thought, this is kind of pathetic. i don't have anything to hide. and, again, you have to look deep into your heart and say, where do you stand on this? i like the guy and i'm not going to let this or anything else i read in the paper change my opinion of that. now, i'm disappointed that he tried to use me as a pawn and to get him out of his mess that he's in, but i'm not going to let that cover everything i know about him. >> you say he's using you as a pawn but you also say you still like the guy. >> i know it sounds odd, but,

you know, it's true. he's a great candidate, by the way. and i knew it in that 2004 race. >> you think he's behaved well in this whole -- the way he handled all this? is that the way a great candidate would be? >> obiatesly not. but this guy has no financial support, you know, not big money for a presidential standpoint. when he first got in this race, no one is going to know that he's even running and right now he is the frontrunner for the nomination of president of the united states. that is tremendous. >> let me ask you one thing. if these sexual harassment charges are true, can herman cain survive as a presidential candidate? >> i'm not going to handicap that. i don't know. i don't know that they're true and i'll also say this. they just don't ring true to the guy i know. i don't know anything about it, i'm fought going to be judge and jury on that, but it just doesn't comport with the herman cain that i know. >> you don't believe the charges. >> i think you're innocent until proven guilty in this country. i think that's not a bad standard to go by. >> okay, curt anderson, thanks

so much for being with us today. it's important, i think, to hear your side of the story. we'll see what the cain campaign has to say later in the day. >> i'm sure that will be exciting. >> christine, back to you. >> gloria, we're not going to let you go quite yet. you're a great political analyst, you just talked to mr. anderson. i mean, what do you take away from that? >> i think he's personally hurt by what has occurred. you heard, you heard what he said. he said, he said situation in which mr. anderson is saying that this conversation never occurred. herman cain specifically remembers a conversation in which he told mr. anderson about sexual harassment charges. we have curt anderson wanting to come out and clear his name, but, obviously, we have these two stories that can't be reconciled. >> what does this do for herman cain?

i mean, this can't be good for herman cain. >> i mean, the entire story isn't good for herman cain. don't forget, two stories here. one is a political story about who leaked what. >> he said/he said about he said/she said. >> the other story which is a question of sexual harassment. we have not put faces on the women who have apparently made these charges. we've talked to one of the woman's attorneys and she doesn't want, as he told me last night, she doesn't want to become anita hill. so, she doesn't want to go out there. so, this thing is going to have to play itself out. it's been my experience, though, once you start pulling at the strings of one of these stories, the spool tend to come unraveled. but, we'll just have to see how this story plays out. >> even the nature of the allegations is still unclear because you have women who chose, in some cases, not to make an allegation or settled

instead of making an allegation and the ap saying there's another woman who thought about making allegations, but then didn't. so, until we know exactly what the nature of all this is -- >> what the specifics are. >> we don't know what the specifics are and we also don't know whether the restaurant association would release anybody from a confidentiality agreement. i mean, it's always been my contention that mr. cain could ask the restaurant association to release him from confidentiality agreement so he could then talk about the case more fully if he thought that the details would vindicate him. we'll have to see if he end up doing that. >> one thing for sure, this story is not over. gloria borger, thanks so much. another story you're all talking about this morning. a family court judge beating his daughter with a belt. he tells a cnn affiliate he doesn't believe he did anything wrong. did he? we'll discuss it with paul

president obama is in cannes, france, for the start of

the g-20 summit. the president already meeting with german chancellor angela merkel and the french president, nicolas sarkozy who is warning greece must accept a euro zone bailout package or face expulsion from the eu. anger on the streets of oakland. "occupy wall street" protesters clashing with police overnight. police in full riot gear shot tear gas into the crowd. thousands of protesters shut down the city's shipping port vandalizing banks and a grocery store and several businesses were forced to close and some demonstrators are throwing rocks and fireworks. the city is still reeling from last week's violent crash that put an iraq war vet in the hospital with a fractured skull. herman cain unable to move past stories about alleged sexual harassment. cain blames rick perry's campaign. the perry adviser in the center of this joined us and said, he

likes herman cain. he says he's not the leaker. we'll get perry's response when he's interviewed tonight on "john king usa" at 6:00 p.m. eastern. for the first time texas governor rick perry is talking about the jaw dropping speech he delivered. perry dismissing the notion that he seemed to be under the influence of alcohol calling the address, pretty typical for me. you decide. >> my plan is really pretty simple. it does deductions for the mortgage deduction for charitable. yup. you can keep that in there and your state and local taxes are in there, you put those on, 12,500 for the dependents that you have. pretty easy math. subtract it, send it in. why not? that little plan that i just shared with you doesn't force the granite state to expand your tax footprint. you know what i mean.

like 9% expansion. >> perry had spine surgery a few months ago, he denied suggestions that he was on pain killers before last week's speech and said he's back to his regular jogging routine. a family court judge in texas now facing a police investigation after a shocking video surfaced on youtube that shows him beating his then teenage daughter. we want to warn you that the video is pretty difficult to watch. if you want to look away, this is the video that hads been seen more than a million times. the judge william adams is whipping his daughter with a belt and the girl's mom also appears at one point in the video also striking her daughter. she was apparently being punished for downloading music and games. the full video lasts more than seven minutes. it was shot on a web cam seven years ago and posted last week by the daughter, hillary. >> in the description on youtube, the daughter, she said she posted it herself and she

suffers from cerebral palsy. >> in my mind, i haven't done anything wrong other than discipline my child after she was caught stealing and i lost my temper and i have since apologized. it looks worse than it is. >> you do acknowledge that is you in the video. >> absolutely, that's me. >> i don't know if i can call it happy, but i'm very relieved that these things were brought to light and not because i'm going to see my father burn or anything like that, that's a hideous way of thinking and i don't want to inflict that upon him. i cannot stress it enough that he needs help. >> hillary the daughter decided to post that video because of a barrage of harassment from her father. for now, judge adams has been temporarily relieved of his duties as a family court judge. a lot of legal questions surrounding this tape and around

what happeneds to the judge. we want to bring in cnn legal contributor paul callan. so, such a disturbing video to watch and then to find out that this judge is a family court judge. could he be dismissed for this? >> oh, it's shocking, shocking video. we only saw the first 24 seconds. it went on from for six minutes. he could be removed from the bench. when i looked at this initially, charge him with a crime and disbar him as an attorney and throw him off the bench. when i started researching it more carefully it will be hard to bring criminal charges because the statute of limitations may be gone. this happened back in 2004 and it's going to be hard to prove that she actually had physical injury. i don't know if he can be disbarred as an attorney, it's certainly something that can be looked at. but thrown off the bench, there's a texas judicial commission. they can investigate this. he's already under suspension. i mean, can you imagine, he's

the guy who's deciding whether people should have custody of their children in his courtroom and whether they handle the children properly. >> he says he's just a father disciplining his child after she was caught stealing. he says when the story comes out that behavior caught on tape, his behavior will be justified. any way to justify it? >> well, all 50 states, believe it or not, christine, allow what we call corporal punishment. >> a parent can punish their child with a belt. >> you can spank a child. the definition of corporal punishment varies from place to place. it is a matter of degree. that tape is so far over any civilized standard. she looks like she is being whipped in a public square. that's what i was thinking of when i saw it. he actually said to her, if you don't turn around, i'll spank you in the face. meaning he would slap her in the face with the belt. and then the mother shows up later on and gets involved. i understand the judge, i think

and his wife are now divorced. but getting back to this idea that can you imagine texas is allowing him to decide whether people should have their kids and whether they're raising them properly. get him off the bench, investigate this carefully. if you have a d.a. there who is looking at it, it's child endangerment, it's clearly an assault and there are a lot of things you can charge. the only real bug here is has the statute of limitation gone because it's about six years ago. she is 22 now and 16 at the time and hard to go back and show that she was physically injured or even psychologically damaged by this action. but, boy, i'll tell you, shocking, shocking video. >> just hard to watch. paul callan, thank you so much. she says herman cain, coming up, the rick perry and herman cain campaigns going back and forth about who leaked the story about the gop frontrunner. but what is the story really

ali velshi covering the g-20. joining us live from cannes this morning. the 32nd largest economy in the world and its internal politics might have more to do with whether we create jobs and get our economy on foot than the do nothing congress in the world's largest economy.

>> christine, it's really important that our viewers understand why what i'm about to tell you matters. now, here's what the news is. the news is that this emergency unscheduled meeting of the greek cabinet has just started. this is one thing we've been reporting all morning. it has been further delayed. we are trying to confirm that after that cabinet meeting the greek prime minister will go to the president's office. now, that is a euphemism in parliamentary democraciedemocra. the only time he goes to the office is when they're calling an election, dissolving parliament or the prime minister is resigning. we are expecting that one of those things is going to happen. a major shift in greece politics after he called for this referendum earlier in the week. now, this is a major crisis and a major problem for the euro zone because on october 27th they thought they had a deal which largely involved the bailout for greece. without greece that deal goes no where and that could plunge europe into further economic downturn. of course, christine, europe is

the biggest trading partner. euro europe as a block is the biggest u.s. trading partner. fewer people will buy goods and services that america produces. this is a major, major thing to look at. 32nd largest economy in the world, but right now, right now greece is the most influential country in the world and things are unraveling there very quickly. we are working on getting confirmations as to exactly what is happening but we do know the emergency cabinet meeting is under way right now and there are reports, unconfirmed as of yet, reports that the greek prime minister is heading to the president's office. afterwards the implication is that he is resigning or resigning government or there may be an election. we're not sure which of those things is happening. we're keeping a close eye on those things. what is going on here in cannes, the g-20 meeting.

>> whoever is leading greece because the people in greece have spoken. when they take to the streets and they say they don't like austerity. the european union has spoken and said, you are going to are have to really take more austerity to stay in the eu. this is a crisis for europe right now about who will be in the eu and what kind of pain you have to take to stay in it. >> the europeans. the other 16 countries in the eu said if you don't take that pain, greece, we'll throw you out of the euro zone. this is taken on a referendum on whether you want to stick around in the eu or not. the greeks have been saying we have been taking this pain and why should we take more pain so that french bankers and german bankers can see some return on their investment. you are absolutely right, this is a crisis, but one that this morning we heard from president obama and from his spokesman who said this is an internal greek problem. this is a greek political crisis. we're not involving ourselves in

and good morning, atlanta. partly cloudy right now. 43 degrees, but expecting rain later in the day, nice and warm. 69 degrees. welcome back to "american morning." herman cain is trying to stay on message, but he can't seem to get away from those sexual harassment allegations. cain is now accusing the perry campaign of leaking the story the perry adviser at the center of it all just denied he had anything to do with it at all. lost in all the talk is what actually happened. was it sexual harassment? joining us now sally cohn and in san diego, columnist and contributor to cnn.com. thanks to both of you for being here this morning. sally, i'll start with you because lost in this is what actually happened. like what are the exact allegations these women are making? >> yeah, we don't know.

the fact of the matter is, we don't know. democrats don't know, republicans don't know and the larger issue is, you know, sexual harassment is bad. regardless of your party affiliation, you can agree it's bad. what i find really troubling is the fact that we respond to allegations without even any facts based not on our concern for the truth and what really happened, but based on our partisan interest. if we like the guy and we're conservative and we're defending him and if we don't, we're a democrat and maybe already jumping to conclusions. let's just deal with the facts and take partisanship out of this and create a climate where this can't happen to other women, if, in fact, it happened. >> reuben, before you respond i would like for our audience to listen to what laura engram said the other day on the radio. listen. >> we have seen this movie before and we know how it ends. it always ends up being an employee who can't perform or underperforms and is looking for

a little green. >> so, reuben, this sort of goes to what sally is saying that people are just sort of dismissing these women's allegations and they're just allowing herman cain to come out there and say, no, this is absolutely not true. how do you feel about that? >> well, that's half the story it's exactly right. the point is exactly right about partisanship really trumping anything else. if you are a democrat and you're hoping for the demise of people like herman cain, you jump to conclusions and you believe everything that women are saying and you think he's guilty. likewise, if you're a defender of herman cain, you like his politics and suddenly doing another kind of twist to say, you think he's innocent when we don't know which is the case. i think what is also troubling about this the racial angle to this and the fact that we should be thinking long and hard about sexual harassment. we should also be thinking about going back to 20 years ago how it is every time we have a prominent african-american man and the line of attack is this idea of sort of sexual prowls and a very familiar and awful

ring to it and we ought to be careful with it. those liberals rejoicing at this should hit pause and really think twice about it. >> should we, though? we should look at, you know, we should look to see if there's a racial aspect to this. but in the end, does it really matter if it's a black and white issue if the sexual harassment did actually indeed happen? >> yes and no, right. of course, i wouldn't even speculate, of course there is a an issue to this. we will all judge, whether we mean to or not we'll judge a black candidate differently than a white candidate. the fact is if this brings down his campaign, why didn't it bring down bill clinton's campaign, for instance. that's appropriate. but that same time, we also need to look at the serious allegations. you know, folks like laura ingraham, if obama was accused of something like this, they'd be all over it.

let's stop attacking these women and blaming these women that we don't even know what happened. focus on creating a climate where this can't happen in the future and making sure we elect candidates and let's take sexual harassment seriously. >> reuben, les let's say it comes out and one of the women come forward and lay out all their allegations against herman cain and it's bad. let's just lay out that scenario for folks. what will that say about herman cain as a man who would be president of the united states? >> probably that he's not qualified to be president of the united states. that he lacks judgment, temperament isn't right and he doesn't know how to treat people, he's not a good manager and someone who doesn't pay attention. any of us who paid attention over the last 20 years, we don't have to take a course at work about sexual harassment. we know what's right and wrong. people of a younger generation know what it's like to work for female bosses and work in environments like this.

i have hope that this gets better as time goes on, but this will probably disqualify him from the presidency if it is, in fact, as bad as you speculate it could be because that's not typically the type of people you like to elect. >> bill clinton survived a similar allegation and he's seen as this great statesman right now. >> he'd already won once before or twice before the monica lewinsky scandal happened and i think there's a question about whether or not people want to get into that to begin with or in the case of bill clinton, we voted for him twice, they're in office and they make excuses. we shouldn't make excuses. double standard is very powerful here. even if you're how we don't judge newt gingrich on moral issues, twice divorced, three times divorced. we only seem to center in on herman cain and that doesn't seem fair and it doesn't seem like we're playing the game by
