syracuse university heard that tape, there really was no other choice. they had to fiere bernie fine, which they did late last night. the accuser, bobby davis, lived in the fine household for a period of time. he made the recording shortly after the alleged decade-long affair came to an end. and the tape suggests that not only did the coach's wife know about what was going on, but in fact she had a role in it. and we want to warn you that the tape is both graphic and also disturbing. >> i didn't know what to think. i know everything that went on with him. bernie has issues. maybe that he's not aware of, but he has issues. you trusted somebody you shouldn't have trusted. >> yeah. >> bernie is also in denial. i think that he did the things that he did, but somehow through

his own mental telepathy has erased it out of his mind. go to somewhere inside yourself where there's gay boys, find yourself a gay boy, you know, get your rocks off, and have it be over with. >> yeah, but -- >> you know, he needs a, that male companionship. i care about you, and i didn't want to see you treated that way. if it was another girl, it will be easy for me to step in because you know what you're up against. but if it's another guy, you can't compete with that. >> now, that tape was never given to police, nor was it made available to university officials when they investigated charges back in 2005. instead, bobby davis gave the tape to espn's sports channel as well as a local paper here. both of them held on to that tape because they were unable to get anyone to corroborate the events or the accounts in that tape. lori davis who has not spoken since this tape was released was quoted years ago saying, in

fact, she knew that the tape recorded conversations existed, and she says that in fact they may have been edited by bobby davis in order to make them seem more inflammatory. now, davis' account is corroborated by his stepbrother, michael lang. both of them were in the fine house for a period of years. both of them worked here as ball boys for the revered basketball program. you can imagine the syracuse community really trying to come to terms with these two sides of a coach that they have long respected. a third accuser did step forward, saying that he too was molested by the coach. but the accuser's father says that in fact he doesn't believe the story. police right now vetting the account. as for bernie fine, well, he says that he hopes the investigation is quick and credible. everyone waiting for the results of that investigation. both by the police and the district attorney. >> thanks so much.

all right. let's turn to politics now. he has climbed to the top of the crowd, and today newt gingrich takes his presidential campaign to south carolina after landing a big endorsement in new hampshire. our deputy political director paul steinhauser has the latest. >> this endorsement probably does matter. why? new hampshire. the second state to vote, the first to hold a primary, and we are talking about the new hampshire union leader doing the support. the most influential republican newspaper in the granite state. they said he is by no means the perfect candidate, but they say he is the best candidate who is actually running. listen, the union leader this is not a one-day deal with them. they probably will be touting gingrich over and over again in the next six weeks until the new hampshire primary. at the same time, probably criticizing mitt romney, who is the front-runner in the polls up there. how is the union leader's track record? look at this. this is an endorsement dating back to 1980.

they got it right just three years ago. john mccain won the primary and won the nomination. but you have to go all the way back to 1980 the last time they endorsed somebody, ronald reagan in 1980, who won the primary, the nomination, and then the presidency. this is late last week, the granite state poll. and there's romney at the top. if you saw that poll, he would be the front-runner by far, about 4-10 right there. likely voters endorsing or supporting romney. gingrich is starting to rise. you can see him right there at 15%. kyra? >> well, gingrich rising, and herman cane going the other way, going down. >> and he is blaming everybody i guess but himself. listen to what he told our candy crowley yesterday on "state of the union." >> what do you think has gone wrong in the past month or so? >> well, obviously, false accusations and confusion about some of my positions has contributed to it.

and, you know, that was to be expected. in terms of the campaign itself, nothing has gone wrong in terms of our strategy, of spending time in iowa, new hampshire, south carolina, and florida. so in terms of the mechanics of the campaign, nothing has gone wrong. but as you know, candy, some people are heavily influenced by perception more so than reality. >> cain's poll numbers nationally in the crucial early voting states is starting to waiver, but he is still doing ok in the poll numbers. and you want to hear more from herman cain? he'll be a guest with wolf blitzer today in the situation room. >> thanks, paul. and we just want to remind you as newt gingrich rises in the polls, getting an endorsement from new hampshire's largest newspaper. gingrich talking about what he needs to do to keep the moment up. watch that exclusive interview at 6:00 eastern on cnn. for all the latest political news, you can go to our website

and now there's a chance to vote. >> and for your father too. >> yes. and my sister. it's usually before to be voting. >> and does it feel like this is an important day for egypt right now? >> sure, very, very important today and as it's a day of freedom. and to be here, is to be a human. >> wow. so, kyra, there you go. >> and we apologize. we are having some technical issues there with ivan watson's connection in egypt. but we are monitoring the first parliamentary election there in egypt. our ivan watson at a polling station. we'll try and connect with him again a little later in the hour ahead. meanwhile, three american students are back home after their own harrowing ordeal in egypt. police there accusing them of throwing molotov cocktails at security forces. the men were on a study abroad program at american university in cairo.

we're following this out -- from ktla, one of our affiliates. in california, a dramatic rescue in the desert. just east of los angeles. about a dozen bystanders were lifted from this pickup truck that had rolled over, and pulled a woman passenger to safety. another passenger survived. the driver of that crash was killed. and prosecutors in seattle deciding not to file charges against a man who calls himself the masked crusader. phoenix jones is among a group of self-proclaimed super heroes who patrol seattle streets against crime. he was arrested for pepper spraying a man. he says he was chasing a stabbing suspect. well, today, millions of americans will avoid crowded stores and take their shopping list online. and while this cyber monday offers a lot of good deals out there, you've got to look out for the scams. pirated dvds, counterfeit clothing and potentially dangerous toys.

john morton is the director of immigration and customs enforcement. john, you told me already you have taken down about 150 of these sites. how exactly have you been able to track and know that they are not legit? >> well, what we do, kyra, is we look for websites that are pretending to be the real thing but actually selling counterfeit and pirated goods to the unwary, and it's a hard business. this is a criminal effort. a lot of these networks are overseas. and we take a lot of time to separate the real from the fake. >> what if i'm ochb online, though, and wanting to shop? is there anything you can tell me that i can look for, some red flags, to know if it's a fake site or not? >> absolutely. look for words like replica, cheap, any misspellings in the website. if the website doesn't have a particularly good background of who it's operated by and where

to go if something goes wrong. know your supplier. most legitimate retailers have authorized online outlets, and you can go online and figure those out. just be careful. >> i notice you brought a number of things in. i'm looking over at the table to your left. and just from first glance, everything looks legit to me. how do you know these are bogus items items? and tell me what we need to look out for, as in the most common things that are fakes. >> well, as you can see from the items to my left, it covers the water front all the way from nfl jerseys to dvds, to handbags. if the price is too good to be true, typically it is. again, know your supplier. make sure that you're not chasing that deal too far. go with legitimate online websites. and be careful. holiday lights, cords, batteries are counterfeit. and when you buy those things,

they can often be a very serious fire hazard and something that everybody needs to watch out for. and that's why on this cyber monday we're going after these websites. we've taken 150 seized today. and we're going to keep going after them so that when you go online, you can have some confidence that it's the real deal when you shop. >> john, if i'm looking -- ok. the boots, the jersey. i don't know. scottie, can we bring that table back? ok. the hat. how do i know that these are fake items? can you give me an example? for example, the boots. how do i know those timberlands aren't real? >> if you were to go and look at the soles on those, the stamp is very poor quality. often you have to look at the stitching. if it doesn't match up, for example, on the coach bag, it won't match up. it won't match up inside. a lot of times the holograms on the nfl jerseys are fake. but increasingly, we're seeing a sophisticated move by the counterfeiters to try to approximate the real deal as closely as you can.

and that's why you've got to be careful. last year, we seized a website called realtimberland.com. there was nothing real, nothing timberland about it. it was just counterfeits made in china, sent overseas to unwary buyers here in the united states. we seized it. and when we seize them, we put up our banner as you can see on the screen here, that lets you know this isn't and wasn't a real site. it was a fraud and the government has seized it. >> got it. john morton, thanks for your time this morning. appreciate it. >> thank you. still ahead, a royal rese. britain's prince william helps rescue two sailors tossing about the frigid waters of the irish sea. we'll have the details right after the break.

britain's prince william is not just second in line to the throne. he saves lives too. the prince co-piloted the helicopter that plucked two sailors from a life raft in the irish sea. dan rivers is live in london. where as you can imagine the story is getting a lot of attention this morning. hey, dan. >> hey there. absolutely. this is getting a lot of media attention here. it's part of the prince's routine job really. but everyone obviously is attaching the word hero to him. he was involved in this dramatic rescue of two crew members of a stricken cargo ship out in the irish sea. a full-scale gale blowing. he helped to pilot that helicopter out, plucked two to safety. five men from the crew are still missing. and this is an ongoing operation. and as i say, one body sadly has been recovered. but they are not giving up hope yet. helicopters are still in the air as i speak.

we're not clear whether prince william remains involved with this. he is due at some function tonight at buckingham palace. so it's probably unlikely. but certainly a very dicey situation for him to be way offshore in some very, very bad weather. >> dan, how often does the prince get a chance to go out on these types of rescue missions? >> well, he's been qualified for more than a year as a search and rescue pilot. and actually just a few days after his wedding back in may, he was involved in two different rescues. this time on mountains in wales, rescuing people who got into difficulties while out climbing or walking on the mountain. so it is something that he's been used to doing. this was particularly dramatic because of the weather conditions. the ship actually sank. and clearly if he hadn't been out there with his colleagues, these two men would possibly have not made it back. >> wow. dan rivers out of london for us.

earlier today, marshall cohen told me that about 44% of people who shopped this weekend shopped for themselves. it was pent-up demand. not necessarily holiday shopping. but really people who have been waiting for bargains to buy for themselves. the national retail federation, which is of course the big trade industry, trade group that critics say is actually a cheerleader for getting you to spend money that you don't have, they say it was a record 16% increase in holiday sales. we do know from shopper track tracking kinds of data that there were more people in the stores. the final numbers aren't in just yet. but let me segue to stocks today, because apple shares, kyra, right now in premarket trading look like they'll be up 3%. amazon looks like they'll be up 4%. why? holiday shopping, cyber monday. you're probably going to see those online retailers doing very, very well. apple had a great weekend. so did amazon. they shipped -- delivered something like four times as many kindles as they thought. and then european markets doing very, very well and asian markets overnight on this just belief that europe is going to

get its act together. so we're looking at stock futures right now. looks like the dow could be up 200 points when the bell opens a little over an hour. >> christine, thanks so much. well, newt gingrich is a pretty popular guy lately. he is surging in the polls, riding high on a buzz worthy debate performance, and just earned an endorsement from "the new hampshire union leader," right in mitt romney's backyard. even bill clinton is pouring in on the praise for gingrich's thoughtful approach to immigration. take a listen. >> he thinks about this stuff all the time. he's articulate, and he tries to think of a conservative version of an idea that will solve a legitimate problem. >> all right. joining us live, cnn contributor john avalon and l.z. granderson. so bill clinton says that newt gingrich gives independents something to think about. l.z.? >> well, you know, definitely

what he said would give independent voters something to think about. but the person who said it won't. i just think president clinton is being a very smart politician. and that he is setting people up to vote for gingrich because gingrich would be easily defeated in a general election. i think it's a smart move, and i think it's also a move that works on president obama's behalf. >> john, what do you think? >> yeah. i mean, democrats would love to run against newt gingrich. and the sort of sad fact is, it was a sincere compliment. newt gingrich circa 2007 when he was talking about building broad coalitions could have appealed to independent voters. but in this incarnation where he is throwing red meat, talking about secular socialists in the white house, that alienates independents from the get go. >> l.z., you mentioned obama. if gingrich earned the gop nomination, let's talk about how he would fare against the president. >> well, i don't see him doing much beyond his base. and even his base in my opinion

is a bit loaded, because people haven't forgotten newt gingrich of the 90s, and i mean the religious conservatives. it still leaves a bad taste in their mouths. i don't see gingrich having the ability to reach beyond what you see right now, which is just a little buzz about anyone besides romney. and that's really what it is. even the newspaper that everyone's talking about, they have only picked one person who has actually won the presidency, and that was reagan back in 1980. that's not really as big a deal as we are saying right now. >> john's smiling. >> well, first of all, give newt his due. he will surge in the polls in new hampshire and elsewhere in part because of this endorsement. the romney camp can't be happy because of it. and there is a glass ceiling that romney has. but when you pivot to the general, that's when things get fun. and you start gaming that out and ask yourself questions like, could president obama win 40 states with a 40% approval rating? that beings about

becomes a new bar and it's sort of fun to play it ahead. >> herman cain thinks he a shoo-in with black voters in iowa. he says, as a descendant of slaves, i can lead the republican party to victory by garnering a large share of the black vote. l.z.? >> you know, why is this man still talking? i just really -- i don't get it. you know, i've gone through a lot of emotions when it comes to herman cain. i have been frustrated, upset, curious. and now i just feel really bad and sad for him. it's obvious he's not going to win. it's obvious he's in over his head. why doesn't he take his life and spend it at home with his wife, his grandchildren, and enjoy this part instead of making himself look like an idiot for the next few months? he just isn't ready. and the idea that he's going to, quote, get black people to vote for him based on what he said in the summer, he's dreaming. >> lz, pretty powerful words there. john, is he an idiot?

>> no. herman kacain is not an idiot. he is a great communicator, and he had his surge and he'll be a player in the republican party on some level probably for some time to come. but i want to give him the benefit of the doubt and say this mailer was about the general election, not iowa. it is a great state, educated state, but not a particularly diverse state. so that mailer gets a little off base. but i think you're going to see cain keep a core base of support. he'll be a player in the party because he is a great communitior. >> i'm putting my money on some sort of radio show, talk show. lz, todd, thanks, guys. you got things going for monday. appreciate it. well, newt gingrich has the spotlight. we definitely have been talking about that. now the question is, how should he use it? it might be time to show voters the new newt, according to our david gurgen. we'll talk about that in just a moment. also "playboy" sued for alleged sex discrimination.

"showbiz tonight" has reached out to miley. no answer yet. i think people need to cut her a bit of a break. however, when you're miley cyrus, you need to know when it's going to be on video, even if you're joking about it, people are going to see it, and they are going to probably call you out on it, and that's exactly what's happening here it seems. >> all right. well, apparently this guy is calling out "playboy" saying it discriminates against men. >> yes. he's really standing up for men everywhere who ever wandered into a bar and had to pay a tab while the women walked in for free. here's the story. he is a california man named steve fry who is suing "playboy" over a leather meets lace party. they charge men $1,000 to attend, and women got to go in for free. kind of what you might expect. but he alleges this is discriminatory towards men and

have been here a quarter of a century, and i'm prepared to take the heat for saying let's be humane in enforcing the law. >> well, senior political analyst david gergen wrote the article, is there a new newt in town? he is joining us live from cambridge, massachusetts. so, david, you actually write that he has seized the spotlight by being more interesting, and more of a gambler. yet analysts say he may pay a price for his stance on immigration. >> well, he may. you know, going soft on immigration as it's called is very dangerous within republican ranks, as you well know. we saw that with rick perry and how he tumbled in iowa after he had come out for a variety of things that seemed to be soft. and now here's newt gingrich today. but my own sense right now is that while he will pay a short-term price, especially in iowa, he clearly has got the momentum, as you suggested. this endorsement from "union leader" in new hampshire was a

terrific boost for his campaign. just when he needed it. because he is getting all this attention now. but what the question was, how do you sustain momentum with no debate this week? and here he gets "the union leader", in a state that looked like a laydown for mitt romney. this by no means -- "the union leader" has endorsed conservatives in the past who have not won. so it doesn't guarantee anything. but it does give newt more credibility and more stature, and that's what he's seeking right now. kyra, he has -- he knows -- i have talked to him about this. he knows the next two to three weeks are crucial to his campaign. if he is still standing as a viable alternative after christmas, he will become probably the serious alternative to romney in the campaign, and it could be a real close campaign. >> well, let's talk about new hampshire for a second. mitt romney has consistently led in the polls there. but "the union leader's" editor

says romney plays is too safe. >> i don't think we're in the kind of situation right now as a country that that's necessarily the right kind of president at the moment. perhaps in the late 19th century, perfect. >> ok. so what's the deal, david? are people drawn to gingrich, the man, or is he just the alternative to mitt romney? >> well, i think it's a different style. he himself would tell you that voters are looking for more of a brawler this year. they want somebody who will take the fight to president obama. somebody who will be tough, someone who really does want to change washington, and will come with ideas and forcefulness to do that. and that romney so far has looked like more of a manager, someone that, yes, is extraordinarily competent. >> we apologize. we lost our connection there to david gergen in massachusetts. if you want to check out his entire article, you can do that. all right. we're just getting word that congressman barn any frank will not seek re-election. cnn has learned that he's going to be holding a news conference later today 1:00 p.m. later today. when you talk about an eye opener, a new study is suggesting a link between drinking coffee and lowering the risk of cancer. cnn medical correspondent elizabeth cohen joining me now. what kind of cancer are we talking about and how much coffee? >> in this case endometrial cancer and the women who drink four cups or more had a significantly lower risk of getting endometrial cancer. other studies have shown that people who drink other coffee have a lower risk of diabetes.

>> how much can i drink, does it matter what we put in our coffee? >> it does with these. they have shown we're talking two, three, four cups. that seems to be what gets the effect, but there is a but here, which is the minute you put in this milk. this is about two ounces of milk. you put that in there. you put in a couple of sugars. you've put in 100 calories into that coffee. you do that four times a day, let's say. that's 400 calories. it can add up. you want to be careful what you're putting in your coffee. >> what is it that's made this link? is it the caffeine that's actually lowering our risk? >> they don't think so, which is good news. you can get decaf hopefully and get these benefits. coffee, it comes from the ground, right? it's produce in a way, right? so what that means is that it has antioxidants.

they think that's what's doing it. kier ra, i want to say this. i don't want people to say i heard them talking about coffee. i'm not a coffee drinker and i'm going to drink four cups of coffee a day. it's perfectly fine to drink coffee and may be helpful for you. it's not so great you shouldn't start drinking it if you don't already. >> there's other effects that aren't good for you. drinking too much. >> exactly. caffeinated coffee. doing things like exercising, eating right are off the charts so much better for you than drinking coffee. the bottom line is if you're drinking coffee, feel good about it. you're okay. if you get jitery, drink decaf. >> it's a talker. thanks. checking stories making news later today, 11:00 eastern a family of an a&m drum major announces the decision to file a lawsuit against the school. at 1:40 eastern president obama along with officials of the european union are going to make remarks at the white house.

thanks for joining us this morning. we begin with the firing of syracuse basketball coach, bernie fine. a third man comes forward and accuses fine of molesting him nine years ago. the wife knew about the sexual abuse and allowed it to go on. deb faye rick live in syracuse. we're going to hear the tapes. deb? >> reporter: keer raryra, this s the game changer. up until that point there were a lot of allegations by a single accuser and his stepbrother. once that tape was made public the chancellor had no other choice but to fire him. >> not a single one gave us the slightest bit of an impression that these were true allegations. this is coming from former players, coaches and people he worked close with. it seemed like the syracuse basketball community was in

defense of coach fine. >> reporter: and that was the sports editor of the local paper here on campus. there was really a strong reversal by the top coach here, jim bay hiem who said last night he was sorry if he was insensitive to any of the vimps because he had come out very strongly supporting his friend and fellow coach and somebody who lives across the street from him. yesterday he did apologize and really a lot of people on this campus thought that bernie fine was innocent. they could not reconcile the two descriptions of this man, somebody who was reveered here as a coach, who has been one of the key people recruiting and developing people in the country. the allegations that surfaced. the accuser, one of two, came forward saying that this molestation had gone on for more than a decade. a third man over the weekend stepped forward saying he, too, had an encounter with bernie

fine. it was shorter. it was not ten years long, however, he says it did occur. one caveat on that, the guy's father thinks the guy is lying. so there are lots of bits and pieces of information coming out now. police have launched a very active and aggressive investigation. federal authorities seized some documents and computer files as well as paper files from bernie fine's home on friday so they're really looking into this. one thing you have to keep in mind, kyra, that is that police never investigated the initial charges back in 2002 simply because the accuser, bobby davis, placed a phone call. never came in to speak to them in person so when police told him statute of limitations ran out, he took a different tact which was recording the conversation with the wife and making that conversation available to espn sports channel. >> the recordings are

disturbing. in ten minutes you will hear that taped conversation between fine, accuser bobby davis, and fine's wife, laurie. we'll talk with npr sports correspondent mike peska about any fallout. now the biggest bailout in u.s. history. it was your taxpayer money, but you never even knew about it. the federal reserve and big banks managed to keep it secret until the bloomberg news agency managed to pry loose thousands of documents. christine romans has been pouring through those and has analysis for us. christine, we're talking trillions of dollars, right? >> we've known the largest bailout in american history is not the $7 hundred hundred billion t.a.r.p. bailout. the fed was giving secret loans during the height of the financial crisis. what we didn't know is to whom, how much, what days are the biggest loans. now because of a freedom of

information request, bloomberg has done more analysis and found that these biggest banks got $13 billion in interest from these loans even though these loans were all paid back to the government in the end. this was really a big boon to the biggest banks who then turned around and lobbied against having more stringent regulations to prevent another financial crisis. this is what it looks like. it looks like $7.7 trillion in loans. t.a.r.p. was $700 billion. jpmorgan, bank of america, wells fargo, morgan stanley, all of the big names you've known. there were recipients from foreign banks as well. in all 190 different banks. defenders of the fed will say this. they'll say that the reason the fed wanted to keep all of this secret is because at the height of the crisis, kyra, in 2008, if investors had known which banks were going and getting very super low interest loans, secret

emergency loans from the fed, that the market would have taken those down. there would have been a run on those banks. they had to go borrow money to keep the economy going. the fed did its job. in hindsight many are saying the banks enjoyed largess from the fed and the american taxpayer and congress and then turned around and lobbied very, very strongly not to have more oversight and restrictions against it. it's pretty disturbing to think that this rescue may leave the nation's financial system even more at risk for a collapse. >> because those banks got bigger and bigger, actually, because of the largess of the fed who was able to keep them going with these very low interest loans that they actually were able to profit over. they did get bigger, you're right. >> christine romans. thank you very much. 35 minutes into the new trading day stocks are soirg on

wall street. they're showing new optimism with the debt crisis in europe. record breaking retail sales in the u.s. over the holiday weekend. korean in a, what are you seeing? still good news. we're up 300 points. >> exactly, we are off to a roaring start this morning. you were talking about the financials. it is the bank stocks that are doing well today. they're up by 4 and 6%. we're seeing online retailers, amazon and ebay popping. that's ahead of cyber monday. experts believe sales will top $1 billion today. good news for them. why are the markets taking off today after tanking just last week? a couple of reasons. first we have the record breaking retail sales we saw over the weekend. this is interesting, more than half of all americans hit the stores and went shopping online this weekend. they were spending more money this year per person than last year. another reason today that we're seeing some nice gains is because of europe. that has been the market driver

of late. this is on news that france and germany are trying to step in with a new plan to stop the debt crisis from spreading. that is certainly helping matters today. it's helping ease the pressure on spanish and italian bonds giving a nice lift to euro penal markets. the markets in france and germany are up by 3.5%. here in the u.s. the indices are trading by 3%. thanks. this morning we have big news from capitol hill. massachusetts congressman barney frank will not seek re-election next year. the iconic democrat has held the office for 16 terms. that's 32 years but not without controversy. senior political editor mark preston is in washington with more details on his legacy. mark, you spent a lot of time covering barney frank. >> i certainly did, kyra. i have to tell you, i was just on the phone with several people up in massachusetts and shock waves right now, the fact that barney frank has decided to retire after serving 16 terms in

the house. he will not seek re-election. for democrats, this is massachusetts after all. very likely they will keep hold of his seat. the fact of the matter is he has been a titan when it comes to financial services on capitol hill. he still has been a very strong voice for democratic ideals and what have you on capitol hill. he did have controversy as well. he was considered to be one of the best debaters in congress who did not want to get on the floor and get into an argument with him. i have to till, as a reporter i was working for some massachusetts newspapers at the time of president clinton's impeachment. i remember asking congressman frank a question which he didn't like and he tore me apart. afterwards i sulked away. it took a few other reporters to come up to me and say, look, you have arrived. this is when i was a young reporter. if you get torn apart by barney frank, you have arrived. he was a tough person to deal with on capitol hill whether you

were a republican, reporter or democrat that he disagreed with. >> i think he respected you more when you were tough. you as a young reporter also asked tough questions, mark. you have to hold politicians accountable. >> yeah, you do. i have to tell you, barney frank was one of these people who was always the smartest person in the room. that was one of the strengths on capitol hill. he could go toe to toe with republicans. he was abrasive. what's interesting about barney frank is that back in 1987 he came out and acknowledged that he was gay which was a big deal at the time. he went on to wear this as a badge of honor on his sleeve and probably helped many other folks who were in the closet and didn't want to talk about their sexuality to come out. he has done a lot to promote democratic ideals, but he also did a lot, actually, for the gay community. >> point well made. mark, thanks so much. tape recordings suggesting bernie fine's wife knew about her husband's alleged sexual abuse.

deciding not to file charges against a man who calls himself the mass crusaders. this is a super hero who patrols streets against crime. he was arrested for pepper spraying a man who he says was a stabbing suspect. now to the sex scandal at syracuse university. bernie fine has been fired. a third adult has come forward alleging that fine molested him years ago, and one of fine's other accusers, bobby davis, has given espn a recording of a phone conversation that he taped with fine's wife, laurie, in 2002. you're going to hear some of that now. we warn you, the subject matter is pretty graphic and disturbing. the tape aired on espn's "outside the lines." >> reporter: bobby davis says he could validate one person who was being sexually abused by fine. that person was laurie fine.

>> hello. >> hi. >> hi, how are you? >> reporter: davis says that in october of 2002 he recorded a phone conversation with laurie fine without her knowledge. a legal act based on the location of both parties. during the call fine, seen here in hidden camera video from 2003, discussed the alleged sexual molestation of davis by her husband, syracuse associate head basketball coach, bernie fine. >> you have to be honest with me. did he want you to grab him? >> he tried to make me grab him. at first he grabbed me. >> but you never had any oral sex with him? >> no. >> no. >> i think he would have. >> oh, of course he would. >> reporter: after bringing his

allegations against bernie fine to a syracuse police detective in 2002 and getting nowhere, davis says he was determined to confirm his story. he says he hoped laurie fine would disclose on tape the details of her own knowledge of the abuse he says started when he was 12 and continued for more than a decade. >> so what were you hoping to accomplish by recording it? >> laurie was a person i talked to about the situation. as i got older she was there a lot of the times and seen a lot of things that were going on when bernie would come down in the basement in his house at night when i was laying down there. she had to see him every night do that. laurie was the only one else that knew about what was going on and saw things that were happening with her own eyes and that we talked about it. >> i know everything that went on with him. bernie has issues. maybe that he's not aware of, but he has issues.

you trusted somebody you shouldn't have trusted. >> yeah. >> bernie is in denial. i think he did the things he did, but somehow through his own mental tell lep think has placed them out of his mind. >> reporter: davis who stayed here at the fine's former home beginning in the seventh grade and at one point had his own room in their basement says laurie fine told him she was aware that her husband was sexually abusing him. >> no. i think there was something about you. >> that's what i'm wondering. i was wondering why i was the worst one. >> i don't know. >> one time she's talking about innocence where she saw him through the basement window and she left the blinds open a little bit one night. she was acting like she was staying away from it. >> what did she see? >> bernie grabbing me and touching me. she said the next day, bobby,

you've got to do something. this is when i was a little bit older, junior in high school. you've got to step up to him. say something. be a man. >> reporter: during the phone call davis explained to laurie fine that when he was about 27 years old in the late '90s he asked bernie fine for $5,000 to pay off some student loans. >> when he gave you the money what did he want for it? >> he mentioned me touching him a couple times. grabbing my hand. then he put me in your bed. i would try to go away. he put an arm on my chest. stay here. >> right. right. he wanted to get what he wanted. >> it's about the -- >> reporter: during the call laurie fine suggested to davis what her husband should do with

his need for male companionship. >> go to a gay boy sierkts find yourself a gay boy. get your rocks off, have it be over with. he needs male companionship that i can't give it to him. nor is he interested in me and vice versa. >> reporter: at one point laurie fine seems to say that her husband was not the only adult in the fine household who betrayed davis's trust. part two of mark schwartz's espn special coming up after the break. hey, i'm really glad we took this last minute trip!

coach sexually abused him. again, we warn you that the conversation is gracphic and disturbi disturbing. >> reporter: at one point laurie fine seems to say that her husband was not the only adult in the fine household who betrayed davis's trust. >> when he was at kansas, he had no business doing what he did with you. you know what, he's going to deny it because -- >> reporter: davis says he and laurie fine had a sexual relationship that she initiated when he says he was 18 and a senior in high school. >> were you ever with her sexually. >> yes. >> slept with her. >> yes. >> had intercourse with her. >> yes. >> does bernie fine know about that. >> i did tell bernie, yeah. this is as i got older. not when i was a kid. i thought he was going to kill me. i had to tell him. i felt like i told him about what was going on with me and laurie. it didn't phase him one bit.

>> reporter: later in the call laurie fine tells davis she wanted to come to his defense but she just wasn't capable of it. >> because i care about you and i didn't want to see you being treated that way. and if it was another girl it would be easy for me to step in. you know what you're up against. when it's a guy, you can't compete with that. it's just wrong and you were a kid. you're a man now, but you were a kid then. >> this is about a kid who was abused and adults who didn't help, who didn't step in, who in fact sort of allowed it, created a space for it to go on. >> reporter: danielle roach who has been friends with davis since the second grade says as a teenager she served as the fine's baby-sitter for about three years. recently roach listened to the conversation again.

davis first played the call for her after recording it in 2002. >> this tape tells me that laurie knew and watched it go on, knowingly that it was going on in her home for a long time. >> reporter: roach, who is now a mother herself, says she cannot imagine how any mother could know sexual abuse was happening in her home and not act. >> it's amaze that go she can say some of the things she said to bobby but couldn't pick up the phone and say this isn't the place for your kid, maybe he shouldn't be here. >> reporter: at the time davis says he questioned whether anyone would ever believe his story, yet laurie fine tells him she's already warned her husband one day his alleged molestation of davis might become public. >> i said to him, bobby and i talked. i know something about you that

are going to be let out. >> definitely. >> he says, let him go ahead. sure, let him go ahead. >> he doesn't think he'll be caught. >> he thinks he's above the law. >> npr's mike peska has been reporting on this story what do you know about the fine's marriage and the fact that she knew it was going on and didn't do anything? >> what espn has reported is they have been way out in front of the story. in fact, a lot of the journalism, unlike jerry sandusky at penn state which was investigated by state police and state officials, this has been a media-fuelled investigation. that's not to say the police haven't been involved and they've become involved with the latest allegations, but since 2002 this has been i guess you could say shopped around to police and the media. back then almost a decade ago it was seen as not credible enough

or not having enough corroboration to go forward. that all changed when espn got a second source. >> mike wharks do you think about penn state, syracuse? are more coaches going to be exposed and what kind of impact on male sports? >> i think now we have a data set of two. there are more. there's definitely a lot of sexual allegations and abuse stories in the world of coaching, in the world of sports. it's usually just because adults have access to kids and have a power relationship. i think that's the threw line. i don't think it's as much to do with sports as it has to do with power and unquestioning authority figures. i see this of a piece with the church abuse scandals, mayor of bridgeport, connecticut being involved in pedophilia. people who have power, sometimes aren't questioned and can get away with

gingrich riding pretty high in the polls. we've been talking about that this morning. he's earned an endorsement now from new hampshire union leader. how much does that endorsement, all this momentum really matter right now. sherry? >> i think matters. he's earned this endorsement. it's coming at just the right time for him to be able to take full advantage of it. i imagine it's going to help his fundraising a great deal. this is in mitt romney's backyard. this is important and he has every reason to be very enthusiastic about it. >> i think it all depends on what gingrich does moving forward and how hard he goes after mitt romney in terms of his lack of conservative credentials. four years ago the paper pummelled romney. if they do the same and it looks very much like they will because this is a paper that just does not like romney one bit, then it might very well hurt romney going into new hampshire which

could hurt him going into the rest of the nomination process. >> pete? >> well, keer rarks let's give knew the credit. i was one of those talking heads who wrote him off months ago. i still have my bet with you that if he's there in august, i'll give you your charity $500. let's give him credit. he's bounced back solely how well he's done in the debates. the latest granite state poll says he's 27 points behind mitt romney. he was practically the governor of new hampshire when he was in massachusetts. i think mitt romney is going to take it in new hampshire. this newspaper is not known for endorsing people that can win as opposed to who should win. i like that. >> herman cain's poll numbers are slipping. here's what he told us. >> what do you think has gone wrong in the past month or so? >> well, obviously false accusations and confusion about

some oppositions has contributed to it. that was to be expected. >> all right, guys. can cain stage a comeback. maria? >> it's going to be really difficult for him to come back from this, kyra. he has two things going against him. very serious sexual allegations that he has done an atrocious job of responding to credibly and effectively. his flubs on public policy positions. republican positions as well. for example, he didn't know that china had been a nuclear power for 40 years. joke about the electrified fence. the fact that he said he would negotiate with al qaeda and retracting it. his position on abortion which makes him sound like a democrat. he has put around him an aura of unelectability. >> a put trid aura. sherry, what's your take? >> i think that he just didn't handle the allegations well whether they're true or false, the sexual harassment

allegations. people need to have confidence that a president is going to be able to turn on a dime and handle a crisis situation. however, overall the republican primary process so far is allowing the candidates to reach their own high water mark. it's not a case where other candidates can tear them down and affect them. they are pretty much on their own. herman cain reached his high water mark. he's responsible for the decline in his numbers. he's responsible if there is confusion about his positions. >> pete, time for you to define the aura. >> i can't do that. that's maria's job. i think she laid out not only the democratic case but the republican case against herman cain. he said these false accusations and confusion surrounding his positions. he's confused about his own positions. we saw the excellent debate on cnn that cnn produced. when talking about iran talked about how many mountains they have. he's not looking things up. he doesn't seem to care about knowing what he's talking about. the american people, they sense

the bodies of three men turned up in shallow graves in ohio. police say they may be the victims of a new craigslist killer or killers. here's susan. >>. >> reporter: timothy kern is the most recently identified victim. he was shot multiple times in the head. the divorced father of three was found in a shallow grave in a wooded area behind a vacant

akron shopping mall. his son says kern was enticed by an ad on craigslist, as were three other victims. fired from his previous job as a street cleaner, kern accepted a $300 a week job to manage cattle on a 600 acre farm including a place to live and a truck to drive. before disappearing he wrote this now eerie in hindsight on his facebook page. just got one of the strangest job offers. a good offer, but strange. life can be such a -- sometimes. when kern's son wrote of his father's murder he wrote on his blog, the years ahead of me will be so hard. i love you, dad. rest in peace. the possible craigslist connection surfaced three weeks ago when a man told police he was driven into the woods by two men who advertised a job on a farm. he narrowly escaped after being shot in the arm. nine days later police found a fatally shot man in a shallow grave in the same area. authorities say a fourth man

from west virginia also reported missing answered a similar craigslist ad. on friday police found a shallow grave of an unidentified man found in eastern ohio in the same area the first two victims were discovered. police have two suspects in custody. the father of 16 year old brogan rafferty says his son is one of them. he's chargewide attempted murder. a second suspect is being held on unrelated charges. his mother identifies him as richard beasley. this man answered the ad and was interviewed. it doesn't sound right. >> wait a minute. he owns 688 acre farm, he doesn't know the exit. >> police say a possible motive is robbery though it's unclear what killers could have gained from unemployed victims. also not known, whether there are more victims of the online

well, we got word this morning that 16-term congressman barney frank will not run for re-election. mark preston remembers covering the barney frank himself as a very young reporter, even got chewed out by him. that definitely made him a

tougher journalist. hi, mark. >> the right of passage here in washington to have barney frank make you feel this big. that's a good thing for me. yes, first ee lengted in 1980, barney frank will announce in a few hours he will not seek another term. barney frank has been a stallworth for democratic ideals. he's been one of the best debaters in congress. one of the biggest fighters against republicans. he was one of the first openly gay members of congress, something that probably helped open the doors for other folks who were in the closet. they saw somebody in congress come out and talk about their sexuality. he also had controversy. back in 1990 he was reprimanded by the house over allegations of his association with a male prostitute. just in the past couple of years barney frank might have made the comeback, some would say, to push all those bad things aside when he was the co-author of the dodd frank federal regulation bill. w
